Parts of Apple-HTC Settlement Made Public Thanks to Samsung Case (But Not the Juicy Parts)

Portions of Apple’s deal with HTC were made public Wednesday night after Samsung filed them with a federal judge overseeing its own case with the iPhone maker.

However, the 140-page settlement document was redacted and excluded key pieces, such as the royalty rates that HTC must pay to Apple. It does include some interesting details, including the patents covered, an anti-cloning provision and confidentiality provisions.

Samsung is likely to use the Apple-HTC deal as evidence that Apple doesn’t need an injunction against Samsung’s products in order to be compensated for any patent infringement. A jury has already ordered Samsung to pay more than $1 billion in the case, though both Samsung and Apple are expected to argue in a court hearing on Thursday that the amount should be changed.

Samsung is also seeking a new trial, alleging, among other things, that a juror’s failure to disclose a past lawsuit amounted to misconduct.
