Samsung: Hey, Everyone! We Might Sue Over the iPhone 5!

Samsung hasn’t yet had a chance to examine the iPhone 5, which goes on sale tomorrow. But after it does, the company is pretty sure that it will add it to the list of Apple devices it believes infringe upon its intellectual property.

In a new court filing, Samsung said Apple’s latest iPhone — which has been racking up record presales — is likely guilty of the same patent infringements of which its predecessors stand accused.

“Based on information currently available, Samsung expects that the iPhone 5 will infringe the asserted Samsung patents-in-suit in the same way as the other accused iPhone models,” the company said in the filing. “Samsung plans to file a motion to amend its infringement contentions to address the iPhone 5 as soon as it has had a reasonable opportunity to analyze the device.”

Samsung’s announcement comes just weeks after a San Jose, Calif., jury found it liable of infringing Apple intellectual property, and awarded the iPhone maker more than $1 billion in damages. The two companies will go to the mat again in another trial over different patents scheduled for 2014.

Apple declined comment.
