			<content:encoded><![CDATA[<p><img src="http://newenterprise.allthingsd.com/files/2011/04/joshjames-200x300.jpg" alt="" title="joshjames" width="200" height="300" class="alignright size-medium wp-image-5487" />It&#8217;s not unusual for founding CEOs to hang around only for a little while after their companies have been acquired. Even so, Josh James, the founder of the Web analytics powerhouse Omniture, seemed eager to hit the road faster than most. After <a href="http://mediamemo.allthingsd.com/20090915/measure-this-adobe-buys-web-traffic-counter-omniture-for-1-8-billion/">Adobe Systems acquired Omniture</a> for $1.8 billion in September of 2009, James resigned the following July.</p>
<p>What&#8217;s he been doing since then? Gearing up for another venture, I&#8217;m told. Some time last year, James, flush with the $80 million and change he made from Adobe as one of Omniture&#8217;s biggest shareholders, hit the eject button on his gig as an Adobe exec and acquired/bought out <a href="http://www.corda.com">Corda Technologies</a>, a business data dashboard start-up based in Lindon, Utah. Corda forms the basis of James&#8217; new venture, but its vision is substantially bigger, I&#8217;m told.</p>
<p>Until recently, James has been bankrolling the venture out of his own pocket. But in recent weeks he&#8217;s been raising money for a seed round. And as seed rounds go, it&#8217;s unusually large. I don&#8217;t know a precise amount, but it&#8217;s somewhere north of $5 million and less than $8 million.</p>
<p>I&#8217;ve confirmed that Andreessen Horowitz, the venture capital fund run by Netscape creator Marc Andreessen and his partner Ben Horowitz, the former CEO of Opsware&#8211;the software company they sold to Hewlett-Packard&#8211;have ponied up about $1 million, betting that James can strike gold once again.</p>
<p>Corda specializes in pouring all types of company performance data into a dashboard for executives. It will have a new name, still undecided. In fact, the Corda Web site doesn&#8217;t even mention the fact that James has acquired it. Still, James has started assembling a team in Utah.</p>
<p>His acquisition of Corda and his an offer to hire a former Adobe employee caused a legal spat between James and Adobe, as reported by <a href="http://www.sltrib.com/sltrib/home/50864867-76/adobe-james-corda-lawsuit.html.csp">The Salt Lake Tribune</a>.  Adobe claimed that James violated non-compete agreements he signed when he left the company in buying Corda and <del datetime="2011-04-27T14:57:18+00:00">hiring</del> trying to hire away a former Adobe employee. The Utah case is over, ordered stayed by a judge, while a case that James and Corda brought in a Santa Clara County court in California against Adobe alleging unfair competition is still pending.</p>
<p><strong>Update:</strong> Since I first published this story we&#8217;re learning more about who&#8217;s investing in this <em>still-unnamed</em> Josh James-helmed venture. A source familiar with the matter says that aside from the $5 million-plus seed-round, which should be announced officially within the next few weeks, James is already pretty far along in the process of raising a Series A round that will be announced later in the year. A source familiar with the situation says that Benchmark Capital&#8211;which has backed companies like Mint, the personal finance site acquired by Intuit last year, and others as varied as eBay, Instagram and Jamba Juice&#8211;has committed up to $30 million to the new company.</p>
<p><strong>A Second Update:</strong>I&#8217;ve just confirmed that Ron Conway&#8217;s SV Angel is investing in the seed round.</p>

<p>Although caught in an <a href="http://kara.allthingsd.com/20100411/exclusive-video-adobe-cto-lynch-smacks-back-at-apples-protectionist-strategy-calling-it-bad-for-consumers-but-hell-swing-chickens-if-forced/">ever-noisier squabble with Apple</a> over the banning of its popular Flash technology from the iPhone, iPod and iPad and over other issues, Adobe Systems is pressing forward with the release of one of its most important products&#8211;an upgrade of its popular and highly profitable Creative Suite software.</p>
<p>It is the most significant update in several years, and the success of the latest version of this collection of graphic design, video-editing and Web development applications, CS5, is critical, as it is responsible for close to 60 percent of the San Francisco software maker&#8217;s revenue, or $1.7 billion last year.</p>
<p>This is due to the popularity of the well-known Adobe (ADBE) products in it, such as photo-editing program Photoshop and its Flash video technology.</p>
<p>New features for both are in CS5, including greater ability to manipulate images and add interactive elements more easily, as you can see in the video below. The cost of upgrading ranges from just above $1,000 to upward of $2,500, depending on the version.</p>
<p>But some of the improvements in CS5 are at the heart of Adobe&#8217;s problems with Apple (AAPL), including tools that let developers write an application once and deploy it on a lot of devices.</p>
<p>That has been a workaround due to Apple&#8217;s current ban on Flash on the iPhone and, now, the iPad. Apple moved again last week, adding rules that apps cannot use a middle layer of software to run on its operating systems.</p>
<p>Let&#8217;s just say it is not in Apple&#8217;s interest to have apps easily available on other mobile platforms, such as, say, the Google (GOOG) Android operating system.</p>
<p>Of course, Adobe could not let the release go by without an Apple slap, noting in its <a href="http://blogs.adobe.com/conversations/2010/04/unveiling_the_all_new_creative.html">blog post on the CS5 release</a> last night: &#8220;You know for a supposedly slothful company, Adobe sure launches a lot of products.&#8221;</p>
<p>Apple CEO Steve Jobs had reportedly called Adobe engineers &#8220;lazy&#8221; at an employee meeting.</p>
<p>So, until the trash talking stops, here&#8217;s a video of Adobe CTO Kevin Lynch giving me a tour of some cooler aspects of CS5, which will get to customers in the next month:</p>

<p>Yesterday, BoomTown helmed the <strong>ATD</strong> motorboat through the torrential rain to Adobe Systems&#8217; San Francisco HQ for yet another sit-down with CTO Kevin Lynch about the latest drive-by software attack by Apple.</p>
<p>This time, rather than taking a more conciliatory tone as in the <a href="http://kara.allthingsd.com/20100217/adobes-cto-kevin-lynch-talks-about-apple-insults-flashs-future-and-more/">last video interview we did</a>, the mild-mannered Lynch was more pointed, calling Apple&#8217;s actions to block use of its flagship Flash video technology by developers a &#8220;protectionist strategy&#8221; that was &#8220;bad for consumers.&#8221;</p>
<p>Lynch joked about Apple&#8217;s increasingly hostile moves against the software maker, saying the computer powerhouse will soon require developers to &#8220;build applications by typing with one hand and swinging a chicken above your head.&#8221;</p>
<p>Lynch then promised to package chickens with Adobe&#8217;s Creative Suite 5&#8211;the latest update of the collection of graphic design, video editing and Web development applications, to be launched tomorrow&#8211;if need be.</p>
<p>For those paying attention, Apple has definitely been pecking away at Adobe (ADBE) and Flash, which is the most popular video technology on the Web.</p>
<p>But it won&#8217;t remain so if Apple (AAPL) has its way.</p>
<p><a href="http://kara.allthingsd.com/20100409/lets-go-to-the-videotape-before-adobe-and-apple-went-all-gosselin-on-us">To recap</a>:</p>
<p>Right after the news that the iPad was coming from Apple earlier this year, CEO Steve Jobs, in much-leaked remarks at an employee meeting, called Flash a buggy software nightmare.</p>
<p>While Adobe has long tried soft-pedal the tech tussle, Apple escalated the battle last week by adding new rules for developers that pretty much freeze out Adobe, preventing them from using a tool that will port applications created in Flash to Apple&#8217;s iPhone and iPad operating systems.</p>
<p>With its anti-Flash workaround declared illegal by Apple, and even though Lynch <a href="http://mediamemo.allthingsd.com/20100409/adobe-well-be-fine-without-apple/">penned a don&#8217;t-worry blog post</a>, Adobe was also forced to acknowledge the potential damage in a regulatory filing last week.</p>
<p>What&#8217;s next is anyone&#8217;s guess in this Silicon Valley smackdown, but it looks like Apple and Adobe are going to the chicken-feather-filled mattresses.</p>

<p>BoomTown&#8211;fresh from <a href="http://kara.allthingsd.com/20091102/and-you-thought-ask-com-had-an-annoying-jingle-try-bing-goes-the-internet/">slapping around six graders caught in a Bing stupor</a> and commenting on the use of <a href="http://kara.allthingsd.com/20091028/beware-google-bing-is-going-to-suck-your-blood-um-market-share-the-new-commercial/">restaurant-seeking vampires</a> by Microsoft (MSFT)&#8211;is also not quite sure what to think of another new advertising campaign from an Internet giant.</p>
<p>This time, it is coming from eBay (EBAY).</p>
<p>With the tagline, &#8220;Come to Think of It, eBay,&#8221; the ads start today, according to a <a href="http://online.wsj.com/article/SB10001424052748704746304574505543900212118.html?mod=WSJ_hps_sections_tech">report in The Wall Street Journal</a>, to &#8220;boost its standing as a holiday shopping destination.&#8221;</p>
<p>Interestingly, the new marketing campaign in print, television and online&#8211;the first for the Web commerce giant in 18 months&#8211;has been crafted by San Francisco-based Goodby, Silverstein &#038; Partners, which has also <a href="http://kara.allthingsd.com/20091019/yahoo-hires-goodby-as-top-creative-agency-for-its-ongoing-brand-revitalization/">just nabbed the lead role</a> in the $100 million advertising campaign by Yahoo (YHOO).</p>
<p>Goodby, owned by the Omnicom Group (OMC), is known for its innovative ideas and has done such memorable campaigns as the Slowsky turtles for Comcast (CMCSA), the weird folk of Emerald Nuts, owned by Diamond Foods (DMND)&#8211;as well as campaigns for tech companies such as Hewlett-Packard (HPQ), Adobe Systems (ADBE) and Netflix (NFLX).</p>
<p>Still, Goodby might be getting a little too cute here, because &#8220;Come to Think of It&#8221; could remind consumers exactly how much they <em>have</em> forgotten about eBay.</p>
<p>At best, &#8220;come to think of it&#8221; is a double-edged sword.</p>
<p>In a good scenario: &#8220;<em>Come to think of it</em>, I really haven&#8217;t listened to my &#8216;Frampton Comes Alive&#8217; album in forever and I really want to hear it again.&#8221;</p>
<p>In a bad scenario: &#8220;An old girlfriend of mine is trying to friend me on Facebook&#8211;but, <em>come to think of it</em>, she was pretty freaky and I am very scared she found me again.&#8221;</p>
<p>You get the idea! Come to think of it: Play at home!</p>
<p>Actually, according to the Journal story, Lorrie Norrington, president of eBay&#8217;s marketplace operations, is pushing a different meaning of the phrase: &#8220;to shift the buyer perception of what eBay is today.&#8221;</p>
<p>The San Jose, Calif.-based company has to shift perceptions since it has seen its core marketplace business suffer, even as it has advertised less.</p>
<p>Here&#8217;s a video of one of the new ads, as well as some past ones&#8211;all of which include an unusual amount of Broadway-style singing, dancing and egregiously fabulous frolicking for a company led by then-CEO Meg Whitman.</p>
<p>But, come to think of it, Meg: <em>Not that there&#8217;s anything wrong with that!</em></p>
<p>And, I could not resist adding at the end Weird Al Yankovic&#8217;s funny parody song about eBay, with video clips synched.</p>

<p>Until now, the top job of goosing Yahoo&#8217;s tarnished brand, as part of a <a href="http://mediamemo.allthingsd.com/20090922/live-from-new-york-yahoo-introduces-you">recently launched $100 million marketing push</a>, has been <a href="http://kara.allthingsd.com/20090624/exclusive-yahoo-working-on-major-brand-overhaul-please-no-more-yodeling/">helmed by Ogilvy &#038; Mather</a>, a unit of the WPP Group (WPPGY).</p>
<p>While Goodby will lead on creative initiatives worldwide, Ogilvy will remain in the mix, <a href="http://kara.allthingsd.com/20090701/yahoos-extreme-makeover-confirmed-with-the-hiring-of-a-new-global-marketing-exec">Integrated Marketing and Brand Management SVP Penny Baldwin</a> told BoomTown in an interview this afternoon, focusing on international marketing efforts, including all upcoming brand launches in France, Taiwan, Hong Kong, Korea, Brazil and Indonesia.</p>
<p>And, via it Neo and Mindshare units, Yahoo said, Ogilvy will also run all media buying for the Internet giant globally.</p>
<p>Yahoo (YHOO) is also keeping strategic branding firm Landor &#038; Associates.</p>
<p>Goodby, Ogilvy and Landor will apparently form a Brand Advisory Board at Yahoo, run by Baldwin.</p>
<p>Baldwin stressed that the move was a broadening of its outside marketing advisers and was not a replacement of Ogilvy, or any indication that the current <a href="http://kara.allthingsd.com/20090913/exclusive-yahoo-set-to-unveil-massive-new-marketing-campaign-at-advertising-week-declaring-size-does-matter">new marketing campaign</a> needed to change.</p>
<p>She said internal reports on the effectiveness of the overall big theme, &#8220;It&#8217;s Y!ou,&#8221; launched last month, have been strong.</p>
<p>Nonetheless, Baldwin added that the new agency is sure to bring more ideas to the mix in the massive effort, which has included television, print, outdoor and online ads.</p>
<p> And, she noted, the location of Goodby&#8217;s HQ in San Francisco, not far from Yahoo&#8217;s Sunnyvale digs, was also a plus.</p>
<p>&#8220;Goodby has the caliber to serve worldwide needs,&#8221; said Baldwin. &#8220;And with the way the Web moves so fast, we thought it was also important to have deep resources locally.&#8221;</p>
<p>Up next, she added: to &#8220;root our brand strategy with more hard-hitting&#8221; messages about Yahoo.</p>
<p>&#8220;This is far more than just an advertising effort,&#8221; said Baldwin of Yahoo&#8217;s efforts to revitalize itself in the eyes of consumers&#8211;and, while she did not say so, to the digerati of Silicon Valley. &#8220;This is a business transformation.&#8221;</p>

<p>For starters, the deal came together in a hurry. On July 20, Adobe told Omniture it was interested in pursuing a transaction, and that it wanted to announce the deal on September 15, the day it was scheduled to report earnings. And that is actually how it played out.</p>

<p>While challenges remain, including technical issues and the reluctance of parts of the entertainment industry, companies are building chips and Web browsers for TVs, and others such as Yahoo Inc. (YHOO) and Adobe Systems Inc. (ADBE) are developing Web applications that can be accessed on a new generation of TV sets.</p>

			<content:encoded><![CDATA[<p>Microsoft Corp. (MSFT) has closed the technological gap with Adobe Systems Inc. (ADBE) in a battle over software for adding video and animation to Web sites. But Microsoft&#8217;s efforts to win customers in the market are moving much slower.</p>
<p>Over the past two years, Microsoft has poured resources into its technology for online video and animation&#8211;dubbed Silverlight&#8211;and has boosted its ability to deliver high-definition video with the technology. Silverlight is positioned as a rival to Adobe&#8217;s technology, which is known as Flash.</p>
<p>While Microsoft has nabbed some marquee Web customers for Silverlight, including the National Football League, most popular video sites like YouTube and Hulu continue to use Flash. That&#8217;s because the Adobe software is much more broadly installed on computers than Microsoft&#8217;s technology.</p>

<p>More musical chairs at Yahoo, which <a href="http://kara.allthingsd.com/20090415/stop-me-if-youve-heard-this-one-yahoo-management-and-staff-set-on-shuffle-again/">BoomTown predicted recently</a>, as top execs at the company move in and out of jobs, and new ones from the outside move in.</p>
<p>Perhaps the most important change to occur is the replacement this week of SVP Scott Dietzen&#8211;who has been in charge of all communications and communities products at Yahoo (YHOO)&#8211;by former Adobe Systems (ADBE) exec Bryan Lamkin, several sources said.</p>
<p>Lamkin will become SVP of Applications Products.</p>

<p>According to his <a href="http://www.linkedin.com/pub/dir/bryan/lamkin">profile on LinkedIn</a>, Lamkin (pictured here) was most recently SVP of Creative Solutions, Adobe’s largest business unit, where the software exec &#8220;led product strategy, marketing and product development for Adobe’s flagship software applications, including Photoshop, the Creative Suite, Dreamweaver, Flash and Illustrator.&#8221;</p>
<p>Lamkin, who was at Adobe for 14 years, has more recently been an executive-in-residence at two venture firms, New Enterprise Associates and Sutter Hill Ventures.</p>
<p>He will take over for Dietzen, who came to <a href="http://kara.allthingsd.com/20070917/yahoo-zimbra/">Yahoo in 2007 after its $350 million Zimbra open-source email acquisition</a></p>
<p>Dietzen&#8211;whom sources said is more entrepreneurial than managerial and did not want to lead such a big organization at the Internet giant&#8211;will become VP of strategy in the move. Many said they expect he will eventually leave Yahoo to try his hand at another start-up.</p>
<p>His colleague, Zimbra founder and CEO <a href="http://kara.allthingsd.com/20090121/zimbra-founder-satish-dharmaraj-to-depart-yahoo">Satish Dharmaraj, left Yahoo earlier this year</a> to join <a href="http://kara.allthingsd.com/20090323/zimbra-founder-and-ex-yahoo-exec-dharmaraj-to-redpoint-ventures">Redpoint Ventures as a VC</a>.</p>
<p>In his job since, Dietzen has been <a href="http://kara.allthingsd.com/20081007/yahoos-scott-dietzen-speaks-about-its-new-online-calendar-which-is-about-a-decade-late">busy fixing Yahoo&#8217;s mail and calendar offerings</a>. (See my video interview with him below from last fall.)</p>
<p>But that&#8217;s not all.</p>
<p>Also afoot is a restructuring of Yahoo&#8217;s North American sales unit, with the unexpected promotion of Mitch Spolan, who was a regional sales exec and will now be in charge of all North American field sales.</p>
<p>The <a href="http://www.paidcontent.org/entry/419-yahoo-centralizes-sales/">paidContent Web site reported the sales changes</a> first, which have been rumored around Yahoo recently.</p>
<p>Spolan jumped over two more senior execs, sources said, who run sales operations for the East and West coasts. One of those execs, Beth Lawrence, will now run Yahoo&#8217;s relations with agencies. Both report to U.S. sales SVP Joanne Bradford.</p>
<p>Over the last 18 months, Yahoo has seen a bleeding of its advertising staff to a wide range of Silicon Valley Web companies, including, most recently, Yahoo’s VP of Sales Operations Dan Foehner to social-networking site Facebook.</p>
<p>Lastly, one of Yahoo&#8217;s most senior communications execs, Brad Williams, was let go as <a href="http://kara.allthingsd.com/20090421/yahoo-first-quarter-results-are-as-meh-as-expected-will-cut-five-percent-of-staff-plus-the-full-press-release/">part of its recent round of layoffs</a>. He had been running PR&#8211;admirably and with good cheer, I might add, despite all the bad news&#8211;since its <a href="http://kara.allthingsd.com/20090202/yahoo-pr-head-jill-nash-to-depart-the-company">head, Jill Nash, departed earlier this year</a>.</p>
<p>Williams&#8217;s departure was <a href="http://online.wsj.com/article/SB124061817277555167.html">first reported by The Wall Street Journal</a> tonight. He came to Yahoo in early 2008 from eBay (EBAY).</p>
<p>New marketing head Elisa Steele, who was hired by CEO Carol Bartz, had recently hired a headhunting firm to find a new PR chief, sources said, and Williams was not considered as a candidate for the job.</p>
<p><em><strong>UPDATE</strong>: Yahoo confirmed my report above.</em></p>
<p> A spokesman sent me the following info about Lamkin&#8217;s appointment:</p>

<p>Today, a panoply of prominent tech and Internet leaders is taking a very public stand against a controversial initiative before California voters, which would eliminate the current legal right of same-sex couples to marry.</p>
<p>Forming a group and taking out a full-page ad in the San Jose Mercury News tomorrow, the execs hope to convince voters to reject Proposition 8, which is titled &#8220;Eliminates Right of Same-Sex Couples to Marry.&#8221;</p>
<p>Silicon Valley has had a long history of supporting gay rights. And recently, Google (GOOG) Co-Founder Sergey Brin has made a strong statement opposing Proposition 8, while Apple (AAPL) gave $100,000 to help defeat it.</p>
<p>The honorary co-chairs of &#8220;Silicon Valley Leaders Say NO on Proposition 8&#8243; include: Brin; Bill Campbell, Chairman, Intuit; David Filo, Founder, Yahoo; Chuck Geschke, Founder and Chairman, Adobe Systems; John Morgridge, Former CEO and Chairman, Cisco Systems; Pierre Omidyar, Founder and Chairman, eBay; Sheryl Sandberg, COO, Facebook; Eric Schmidt, CEO, Google; and Jerry Yang, Founder, Yahoo.</p>
<p>In a statement in a press release set to go out this morning, Yang said: &#8220;Silicon Valley has always been an example for the rest of the country of how diversity and openness help to drive innovation and value creation. This divisive measure is the antithesis of those values that make Silicon Valley so unique.&#8221;</p>
<p>An ad the group&#8211;which also includes star venture capitalist Mike Moritz of Sequoia Capital, as well as Palm Founders Donna Dubinsky and Jeff Hawkins, and many others&#8211;is putting out tomorrow in the Mercury News reads:</p>
<blockquote><p>Silicon Valley Leaders Urge You to Stand for Equality.<br />
Vote No on Proposition 8.</p>
<p>As Silicon Valley leaders, we are committed to equality and fairness. We are opposed to Proposition 8 because it would change our state constitution to take away rights from one group of people. It would set our state, and our country, back in the fight for fundamental fairness and equal rights.</p>
<p>Please join us by reaching out to friends and neighbors and asking them to stand for fairness: Vote No on Proposition 8 on November 4th.&#8221;</p></blockquote>

<p>If passed by a majority of voters, the California Constitution would be amended to include a new section stating &#8220;only marriage between a man and a woman is valid or recognized in California.&#8221;</p>
<p>Earlier this year, the California Supreme Court held that same-sex couples have a constitutional right to marry under the state&#8217;s constitution.</p>
<p>Former California State Controller and former exec at eBay Steve Westly noted that his own interracial marriage was once illegal, which is one of the reasons he was opposing Propostition 8.</p>
<p>&#8220;It really is the civil rights issue of the day &#8230; people stood up and fought for people like me and now it is time to stand up for others,&#8221; said Westly, who was an early supporter of gay marriage and is said to be eyeing a run for governor of the state. &#8220;While this is a polarizing issue, it is mind-boggling to me not to support the right of any two adults who love each other to marry.&#8221;</p>
<p>One thing is certain&#8211;the issue is indeed polarizing. Currently, the vote on Proposition 8 is very close, and a huge amount of money&#8211;more than $60 million&#8211;has been spent by both sides in the battle, which is considered one of the most contentious and high-profile in the nation.</p>

<p>Recently, while I was at a conference in Los Angeles, I caught up with <a href="http://www.veoh.com">Veoh</a> Founder Dmitry Shapiro.</p>
<p>BoomTown will be focusing a lot on online video this year and Veoh is one of the several online video-sharing sites&#8211;a group of smaller players that includes sites like Joost, Hulu, Dailymotion, Vimeo and others that I like to call <em>not-YouTube</em>.</p>
<p>But there are pluses to not being the Google-owned (GOOG) video behemoth, in that major entertainment companies who want to figure out how to put their content online aren&#8217;t wondering all day long whether to hug or sue you (or both if you are Sumner Redstone).</p>
<p>Today, for example, the Los Angeles-based Veoh announced that the ABC (DIS) television network would put full episodes of its hot prime-time shows&#8211;such as &#8220;Ugly Betty&#8221; (love it) and &#8220;Desperate Housewives&#8221; (not so much)&#8211;up on the site on a non-exclusive basis.</p>
<p>While Veoh has a lot of short, user-generated material, it has also made a push to get more professional material from big media companies like CBS (CBS)&#8211;which wins kudos for being the most promiscuous of networks&#8211;on its service.</p>
<p>Interestingly in this deal, media connections seem at play here: Disney-owned ABC is giving over content to Veoh, which has former Disney poobah Michael Eisner as one of its principal investors.</p>
<p>The traffic-type deal is typical&#8211;Veoh gets paid to send audience to ABC&#8217;s site or gets it to use ABC&#8217;s really nice player, and ABC tries to monetize it. Veoh currently says it has 28 million unique monthly visitors.</p>
<p>Of course, Veoh is also trying to figure out that nettlesome monetization issue that all online video sites face, which centers on building audience with the attractive big media content and then getting them to watch other ad-supported fare on its site.</p>
<p>But, as with all video sites, it is still in the early stages and, thus, Veoh got another tidy pile of new funding just two weeks ago to help it muddle through.</p>
<p>That would be $30 million more to add to the kitty of about $40 million previously raised.</p>
<p>Along with existing investors&#8211;Shelter Capital Partners, Spark Capital, Goldman Sachs (GS), Eisner&#8217;s Tornante Company, Tom Freston&#8217;s Firefly3, Time Warner (TWX) Investments and Jonathan Dolgen&#8211;Veoh&#8217;s latest round included Intel Capital, Adobe Systems (ADBE) and also media and tech investor Gordon Crawford.</p>
<p>I talked to Shapiro, who now serves as Veoh&#8217;s chief innovation officer, about the money and more here:</p>

			<content:encoded><![CDATA[<p>You would have to have been under a rock not to have heard about the controversial piece in Vanity Fair magazine this month about the escapades of former President Bill Clinton since he left office.</p>
<p>Called <a href="http://www.vanityfair.com/politics/features/2008/07/clinton200807">&#8220;The Comeback Id&#8221;</a> (oh, how <em>pun-ny</em>!), the article has gotten a lot of attention for pointing out the rampant speculation that Clinton&#8217;s well-known penchant for marital infidelity had returned.</p>

<p>And the reason for that disturbing development, besides Clinton himself? The piece actually placed a good bit of the blame on Clinton&#8217;s close friend, grocery magnate and billionaire Ron Burkle (pictured here), who also has been one of the key directors at Yahoo (YHOO) in its takeover fight with Microsoft (MSFT).</p>
<p>It&#8217;s a wonder Burkle can focus on the turmoil at Yahoo, given how busy he appears to be in the article corrupting Clinton both personally and&#8211;worse&#8211;professionally, via some questionable investments the pair had made through Burkle&#8217;s Yucaipa Companies.</p>
<p>Writer Todd Purdum paints a decidedly unattractive picture of Burkle, noting even the tasteless nickname of Burkle&#8217;s plane these days, in a portrayal so rough that Yahoo CEO Jerry Yang&#8217;s tough treatment by the press recently looks like a walk in the park.</p>

<p>Well, almost.</p>
<p>In what amounts to a rant by Carl Icahn (pictured here), <a href="http://online.wsj.com/article/SB121251736489942015.html?mod=hps_us_whats_news">The Wall Street Journal gives the billionaire investor lots of room to kvetch</a> about what he thinks of Yang, including asserting that he will oust the Yahoo founder if he wins his proxy fight against the company.</p>
<p>&#8220;I am amazed at the lengths that Jerry Yang and the board went to entrench themselves in this situation,&#8221; said Icahn.</p>
<p>Apparently, Icahn was the only one who didn&#8217;t get the memo that Yahoo has been consistently obstreperous about Microsoft&#8217;s many overtures, since&#8211;well, let&#8217;s do the exact calculations&#8211;<em>forever</em>. And a day.</p>
<p>Still, Icahn perseveres and hangs this old entrenched management chestnut on a lawsuit that was recently filed by shareholders that points to the <a href="http://kara.allthingsd.com/20080219/retaining-yahoo-talent-enhanced-severance/">massive and costly severance plan</a> Yahoo sneakily put into place as a ploy to fend off Microsoft.</p>
<p>&#8220;It&#8217;s no longer a mystery to me why Microsoft&#8217;s offer isn&#8217;t around,&#8221; Icahn said. &#8220;How can Yahoo keep saying they&#8217;re willing to negotiate and sell the company on the one hand, while at the same time they&#8217;re completely sabotaging the process without telling anyone.&#8221;</p>
<p>How? By Yang opening his mouth, that&#8217;s how, and then doing nothing much.</p>
<p>As a student of this lugubrious style of Olympic dithering, I would point Icahn to Yang&#8217;s <a href="http://kara.allthingsd.com/20071025/day-100/">100-day Sacred Cow VisionQuest</a>, well before this soap opera got started.</p>
<p>You need to catch up pronto, Carl!</p>

<p>And speaking of people irked by Yang of late, investor Gordon Crawford (pictured here) also made some news yesterday with his investment in Veoh Networks, part of a $30 million round that included Intel Capital and Adobe Systems (ADBE).</p>
<p>Existing investors in the not-YouTube video service&#8211;Shelter Capital, Spark Capital, Goldman Sachs (GS), Michael Eisner’s Tornante Company, Time Warner Investments (TWX) and Jonathan Dolgen&#8211;also ponied up more money.</p>
<p>Crawford, the SVP of Capital Research Global Investors, manages a massive portfolio, and it is one of Yahoo&#8217;s biggest shareholders.</p>
<p>And, unlike Veoh, Yahoo is an investment <a href="http://kara.allthingsd.com/20080506/a-history-lesson-for-jerry-yang-it-sticks-in-my-crawford/">Crawford has not been happy with recently</a>.</p>
<p>&#8220;I am extremely angry at Jerry Yang and at the so-called independent board,&#8221; he said in an interview a month ago. &#8220;I&#8217;m hoping that there is such an outpouring of outrage that the board is embarrassed into revisiting this thing, but I&#8217;m not optimistic about that.&#8221;</p>
<p>And by independent board, by the way, he meant directors like&#8211;you guessed it&#8211;Ron Burkle!</p>
<p>At least Burkle&#8217;s not to blame for the so-so, lots-and-lots-missing&#8211;<em>Google? What Google? (GOOG)</em>&#8211;piece in the same Vanity Fair issue, an oral history of the Internet.</p>
<p>Called <a href="http://www.vanityfair.com/culture/features/2008/07/internet200807">&#8220;How the Web Was Won,&#8221;</a> it makes the founding of the world&#8217;s most important medium seem awfully dull.</p>

<p>I&#8217;d recommend instead&#8211;as any sentient being would&#8211;the <a href="http://www.vanityfair.com/culture/features/2008/07/jolie200807">cover story on Angelina Jolie</a>, with this sharp quote from her: &#8220;In my father&#8217;s generation, the product was 80% of what you were putting into the world, and your personal life was 20%. It now seems that 80% of the product I put out is silly, made-up stories and what I&#8217;m wearing.&#8221;</p>
<p>Or not wearing, in the case of the pictures of Jolie in this article.</p>
