			<content:encoded><![CDATA[<p>Director Chris Milk’s new music video, released yesterday, introduces a young woman roaming a postapocalyptic landscape, and features a song from the coming album “Rome” by Danger Mouse and Daniele Luppi. But for some viewers the video’s main attraction will be the technology used to create it.</p>
<p>In “3 Dreams of Black,” which Milk prefers to call an interactive film, the viewer takes control in certain sequences, using the computer mouse to steer a stampede of morphing wildlife, or build structures in a vast desert. Five months in the making, the video shows off a burgeoning technology called WebGL, which allows an Internet browser to render 3-D graphics in real time.</p>

No? Well, it&#8217;s resolved: The rich man&#8217;s Radiohead is staying with EMI Music Group for another five years.</p>
<p>Phew! EMI says that as part of the <a href="http://www.emimusic.com/news/2011/pink-floyd-and-emi-sign-new-global-agreement/">agreement</a>, &#8220;all legal disputes between the band and the company have been settled.&#8221; Which means that if you were worried about <a href="http://digitaldaily.allthingsd.com/20100818/comfortably-dumb/">the band&#8217;s music disappearing from Apple&#8217;s iTunes</a>, you can breathe easy.</p>
<p>Of course, it was unlikely that Pink Floyd&#8217;s music really was going to leave the world&#8217;s biggest music store, even though part of the dispute between the band and the label had to do with online sales: Supposedly, the band was upset that <a href="http://mediamemo.allthingsd.com/20100311/pink-floyd-wins-court-case-will-money-leave-itunes/">its music was being sold as individual tracks on iTunes</a>, instead of in album-only form.</p>
<p>But that argument never really rang true to me: Sure, it&#8217;s great fun to space out to all of &#8220;Dark Side of the Moon&#8221; in one sitting, but it&#8217;s an awful lot to insist that people have to listen to or buy the whole thing. Especially since no one else does that anymore. Not even Radiohead!</p>
<p>In any case, a check seems to have resolved the band&#8217;s misgivings, and you can still buy &#8220;<a href="http://itunes.apple.com/us/album/money/id14336410?i=14336370">Money</a>&#8221; as a standalone track at iTunes.</p>

<p>And Apple has an ad campaign cued up, of course.</p>
<p>If you&#8217;re the kind of person who keeps track of this stuff, you should note that the ads feature five songs:</p>
<ul>
<li>&#8220;I Want to Hold Your Hand&#8221;</li>
<li>&#8220;All You Need Is Love&#8221;</li>
<li>&#8220;Let It Be&#8221;</li>
<li>&#8220;Yesterday&#8221;</li>
<li>&#8220;Here Comes the Sun&#8221;</li>
</ul>
<p>And if you&#8217;re really keeping count, you&#8217;ll note that there are two &#8220;Paul songs,&#8221; one &#8220;John song,&#8221; one &#8220;George song&#8221; and one &#8220;Lennon-McCartney song.&#8221; Alas, no Ringo.</p>
<p>Everything else is pretty straightforward, and designed to please both completists and samplers: <a href="http://itunes.apple.com/us/album/the-beatles-box-set/id402060584">$149 gets you the entire Beatles box set</a> that the band put out a year ago on CD, or you can pick and choose.</p>
<p>If you really want to gripe, here&#8217;s something: Apple (and/or the band) doesn&#8217;t know how to handle the mini-songs on the second half of &#8220;Abbey Road&#8221; and has made the silly decision to sell them as individual tracks.</p>
<p>So if you really want to hear all 23 seconds of &#8220;Her Majesty,&#8221; but you don&#8217;t want to buy the whole album, <a href="http://itunes.apple.com/us/album/her-majesty/id401186200?i=401187194">you&#8217;ve got to shell out $1.29</a>. But whatever. Buy the whole album.</p>

			<content:encoded><![CDATA[<p>Tonight, Yahoo is introducing a new set of search upgrades, moving to focus on boosting its experience for consumers as it ports responsibility for underlying search technology over to Microsoft under its new partnership.</p>
<p>The new features include an innovative, if odd, vertical &#8220;accordion&#8221; tab.</p>
<p>&#8220;We have been actively working on the algorithmic transition of search, which was  completed in August, and we are already releasing new features to the search experience,&#8221; said Shashi Seth, SVP of Yahoo Search and Marketplaces, in an interview with BoomTown today. &#8220;Since we are not actively spending a lot of energy on back-end stuff, we can focus our efforts on new things.&#8221;</p>
<p>Among the new enhancements to Yahoo (YHOO) search: A vertical &#8220;accordion&#8221; paradigm with shortcuts on search results that allow for new kinds of information presentation; &#8220;quick apps,&#8221; beginning with one for Netflix (NFLX) that lets its members add movies to their queue directly from the search results page; slideshows within search from the &#8220;Trending Now&#8221; lists on Yahoo; more immersive and theater-style photo and video search, as well as &#8220;the ability for people to view personally meaningful public Facebook albums from friends,&#8221; when they sign in to Facebook; and a new mobile search experience for Apple (AAPL) iPhone and Google Android smartphones, as well as feature phones, that uses HTML5 technology.</p>
<p>&#8220;We wanted users to see that things had changed dramatically,&#8221; said Seth. &#8220;Consumer needs for search engines have changed.&#8221;</p>
<p>He said that in testing so far, engagement&#8211;an increasingly important measure for advertisers&#8211;had spiked with the new features, especially in &#8220;taking search from an information need to action at an end.&#8221;</p>
<p>Seth promised a &#8220;huge pipeline of stuff&#8221; to come in search, where the Silicon Valley Internet giant holds the No. 2 position in market share, well behind Google (GOOG) and ahead of the Microsoft (MSFT) Bing service.</p>
<p>Both Google and Microsoft have been adding a series of search upgrades over the last year, such as Google Instant, while Yahoo has not.</p>

Sony Music is thinking about you: The label has opened up <a href="http://www.ariama.com/">Ariama</a>, its all-classical online store.</p>
<p>This is the <a href="http://mediamemo.allthingsd.com/20100715/exclusive-sony-is-set-to-open-a-classical-itunes/">iTunes-meets-classical project I told you about in July</a>. Sony owns the shop, but sells music from most of the big labels.</p>
<p>Who needs an all-classical iTunes? Both labels and music fans, apparently: Conventional online stores don&#8217;t feature much classical music, for obvious reasons. And while the crummy sound quality of most online music doesn&#8217;t seem to bother most people, it&#8217;s a real problem for classical connoisseurs.</p>
<p>So Sony gives classical a room of its own, and promises that it will sound good, too, because its downloads come in two different formats.</p>
<p>There&#8217;s a 320-kilobits-per-second version that Sony promises will produce &#8220;near–CD quality audio&#8221; (the more kilobits, the better the sound; <a href="http://www.apple.com/pr/library/2009/01/06itunes.html">Apple upgraded its catalog to 256 kbps in 2009)</a>.</p>
<p>And there&#8217;s also a &#8220;lossless&#8221; version (FLAC, for those who care about this stuff) that&#8217;s supposed to be even denser and better. In my brief self-guided tour through the store on Monday, I found that the lossless stuff generally sold at a premium of about $2 per album.</p>
<p>Hate digital music players, period? That&#8217;s okay. Sony will sell you CDs, too. In fact, that&#8217;s the only way you&#8217;ll get music from Universal Music, the world&#8217;s biggest label&#8211;for whatever reason, it has licensed only discs, not downloads, to Ariama. (You can get Universal&#8217;s stuff in download form from rival classical store <a href="http://www.passionato.com/">Passionato.com</a>.)</p>
<p>Tough for me to assess the quality and selection here, given that I know next to nothing about classical. <p>Yesterday, BoomTown made a brief stop at what felt like an underground bunker in a hotel in San Francisco to see the Doobie Brothers.</p>
<p>Yes, the legendary band of indelible hit songs such as &#8220;Black Water&#8221; and &#8220;China Grove&#8221; and misspent youth way, way back in the day.</p>
<p>Except the group, which was founded in San Jose, Calif., in 1970, was performing at a Cisco (CSCO) television studio down south in Silicon Valley to launch its first album in a decade, called &#8220;World Gone Crazy.&#8221;</p>
<p>Cisco&#8211;founded in San Jose too, but in 1984&#8211;put on a 90-minute concert by the Doobie Brothers that was broadcast to 11 U.S. cities, helped by AT&#038;T (T) and Marriott (MAR).</p>
<p>It was an odd event, because we were watching a concert on a big screen in what felt like a place more suited for a corporate retreat.</p>
<p>Still, in its ongoing attempt to push its telepresence technology into the consumer space, such a thing has become more typical for Cisco.</p>
<p>That&#8217;s why it will be interesting to see what the tech giant will announce at an event it is having on October 6.</p>
<p>The invite reads: &#8220;Come see a new Cisco consumer experience at an exclusive media event, hosted by Chairman and CEO John Chambers.&#8221;</p>
<p>What could the new consumer product be?</p>
<p>Perhaps Cisco has built its own version of Apple (AAPL) TV. Or perhaps a consumer-aimed home version of telepresence?</p>
<p>Until we all find out, here is a short video I did at the event yesterday:</p>

<p>It&#8217;s nice to hear enthusiasm on the part of <a href="http://www.linkinpark.com/main/">Linkin Park</a> band member Mike Shinoda about an innovative-for-the-music-industry effort to give fans a chance to be part of the iconic Grammy-winning rock band.</p>
<p>That&#8217;s because most artists or content creators&#8211;while making all the right sounds about the Internet&#8217;s impact on their business&#8211;often privately cringe at the ongoing flood of user-generated material that has drastically changed the industry.</p>
<p>Not Shinoda, who is certain he will find some real talent via a new online contest, called &#8220;Linkin Park, Featuring You,&#8221; that gives anyone an opportunity to collaborate with the band to produce an original song based on some of the tracks from the forthcoming single “The Catalyst.&#8221;</p>
<p>The song is on Linkin Park&#8217;s next album, &#8220;A Thousand Suns,&#8221; to be released September 14.</p>
<p>&#8220;We looked at it as both risky and fun to save a spot on the record that could be just anything,&#8221; he said in an interview with BoomTown earlier this week. &#8220;It&#8217;s creative, lets the fans be heard and, of course, is a great way to promote the album.&#8221;</p>
<p>Of course it is, but Shinoda said he is not expecting to have to put any bad-quality music on the record just to sell more music.</p>
<p>&#8220;The album could not be any more sacred to us and this is certainly an X-factor, which is kind of a move against the grain for us,&#8221; he said. &#8220;But the Internet has actually given a lot more people a chance to be heard and, as it has turned out, amateurs are so much better than we ever expected.&#8221;</p>
<p>So far, Shinoda said, he has just sampled a few dozen of the thousands of submissions so far, either selecting randomly or via a popularity ranking system the contest uses. He said he&#8217;s also using a range of people who are part of the Linkin Park team to filter material.</p>

<p>But, ultimately, Shinoda and his bandmates (pictured here) will pick the winning submission, with either the song to be included on the band&#8217;s new album or the winner to be invited to perform with the band on a song on the upcoming record. Either way, a pretty good prize for an aspiring musician.</p>
<p>Shinoda said he is hoping to hear a lot of different sounds from electronic music to keyboards to guitars and even horns (&#8220;No one has submitted a horn version so far,&#8221; he laughed. &#8220;But I hope someone does.&#8221;)</p>
<p>Linkin Park is using a group of Internet companies to carry out the massive user-generated effort, including: MySpace Music (platform, promotion and direct fan messaging); Indaba Music (hosting the MySpace application that allows musicians to auto-syndicate their remixes on MySpace); Top Spin Media (using their email for a song widget to deliver audio stems to all participants); and Ning (the back end to Linkin Park’s Web site, where they are also distributing the audio stems to push back to the contest)</p>
<p>There have been remix contests online done before, such as Snoop Dogg&#8217;s “That Tree” Remix Contest, which had 8,000 entries and generated a lot of fan interest.</p>
<p>But this effort is clearly more ambitious, perhaps because Shinoda is clearly a techie, with an ongoing interest in filling the Linkin Park Web site with puzzles, games and other interactive features.</p>
<p>In fact, Linkin Park had already conducted a smaller contest for fans to submit designs for characters used in a game the band released in April, called &#8220;8-Bit Rebellion,&#8221; for the Apple (AAPL) iPod touch, iPhone and iPad. And, after the game was completed by a player, it unlocked a new song, &#8220;Blackbirds.&#8221;</p>
<p>Shinoda said the band hopes to do even more digitally, trying to involve and engage fans in ways that they never would have tried before.</p>
<p>&#8220;There is a huge unknown factor and this is not something we would have done five years ago,&#8217; he said of the latest collaboration contest. &#8220;But I am not afraid of my fans being good at music, even if it turns out they are better than me.&#8221;</p>

Would you think about it if CDs were cheaper?</p>
<p>That&#8217;s what Universal Music Group is hoping. The world&#8217;s biggest music label is pushing a plan to sell all its CDs at a retail price of $10 or less, <a href="http://www.billboard.biz/bbbiz/content_display/industry/e3i56ed42b9a46f8554e2671afccecca01b">Billboard</a> reports. Given that all the big labels are currently selling discs at wholesale prices of $10 to $12, that&#8217;s a big price chop.</p>
<p>(An update from UMG, which says it hasn&#8217;t committed to the new pricing: &#8220;This test comes after extensive consumer research and conversations with our retail partners, and we will be looking at such variables as greater selection at sharper pricing on front-line releases. We expect to begin the test in Q2.&#8221;)</p>
<p>And it has been a long time coming, since on the Web, the price of an album ranges from nothing (via legal streaming sites and pirate services) to $9.99 or so on Apple&#8217;s (AAPL) iTunes.</p>
<p>You could argue that people still buying physical discs are unlikely to be comparing prices with digital alternatives. But there is indeed evidence that consumers respond to cheaper discs. Billboard relays the example of Trans World Entertainment (TWMC), which runs the <a href="http://www.twec.com/corpsite/stores/">F.Y.E. and Coconuts</a> chains:</p>
<blockquote class="memo"><p>In the last few months, Trans World Entertainment began testing the $9.99 price point in over 100 stores, while Wal-Mart has been telling the majors to release shorter albums at lower prices more frequently.</p>
<p>The Trans World test&#8211;in which most independents and every major except for the Warner Music Group participated&#8211;produced units sales increase of more than 100%, according to label executives who participated in the tests. The Trans World test helped sell the new pricing model to the Universal labels, sources say.</p>
<p>On the reluctance by other majors to so far address the $10 retail price point issue, one source says, &#8220;The definition of idiocy is doing the same thing over and over and expecting a different result. Things are not going to get better for CD sales unless the price point is addressed. One thing that the Trans World test shows for sure, $10 will drive sales and traffic.&#8221;</p></blockquote>

<p>So here&#8217;s one that just started running: A campaign for AMC&#8217;s &#8220;Breaking Bad&#8221; series that&#8217;s running on iPhone apps for CNN and NPR.</p>
<p>The video below should give you some clue about how the ad, produced by mobile marketing start-up Medialets, works. But in case you can&#8217;t tell, the idea is that you click on a small banner ad, which turns into a mini-app that lets you &#8220;mix your own chemicals&#8221; and eventually lets you watch a trailer for the series (about a chemistry teacher turned meth dealer) or buy an episode via Apple&#8217;s (AAPL) iTunes.</p>

<p>If you follow mobile marketing, this might seem familiar. Last year, Medialets rolled out a <a href="http://moconews.net/article/419-shake-this-ad-dockers-dances-to-market-pants-on-the-iphone/">campaign for Dockers</a> that asked users to shake the ads. And earlier this year, the firm rolled out a <a href="http://www.businessinsider.com/cool-new-iphone-ad-check-out-vampire-weekends-interactive-music-video-2010-1">campaign for Vampire Weekend&#8217;s new album</a> that asked users to shake the ads. At some point, the novelty factor for this stuff will wear off.</p>
<p>Meantime, it&#8217;s still going to be new for most users. If you&#8217;re really into this stuff and you live in New York, stop by Apple&#8217;s Soho store Friday, where the show&#8217;s creator will be promoting the show and the app ads.</p>

<p>A ruling in the band&#8217;s <a href="http://mediamemo.allthingsd.com/20100309/dark-side-of-the-download-pink-floyd-sues-emi-over-online-sales/">lawsuit against EMI Music Group</a> may mean that the band&#8217;s songs will only be available online in album form. <a href="http://news.bbc.co.uk/2/hi/entertainment/8561963.stm">BBC</a>:</p>
<blockquote class="memo"><p>The rock legends, signed to EMI since 1967, said their contract meant their albums could not be split up without their permission.</p>
<p>A judge agreed, saying the contract contained a clause to &#8220;preserve the artistic integrity of the albums&#8221;.</p>
<p>EMI has been ordered to pay £40,000 ($60,000) in costs, with a further fine to be decided.</p>
<p>&#8230;In court, Chancellor Sir Andrew Morritt declared that the contract means EMI is not entitled to exploit recordings by online distribution or by any other means other than the complete original album without Pink Floyd&#8217;s consent.</p></blockquote>
<p>As of this morning, you could still buy much of the band&#8217;s output on a track-by-track basis at the online music stores that Apple (AAPL) and Amazon (AMZN) run.</p>
<p>And just because the band has won the ruling doesn&#8217;t mean that&#8217;s going to stop&#8211;its entirely possible, for instance, that a check of a certain size could allay the band&#8217;s concerns. Other album-only holdouts like Metallica and Radiohead eventually held their noses and allowed their stuff to be sold by the song on iTunes, too.</p>
<p>But if you really want to buy &#8220;Pigs on the Wing Pt. 1,&#8221; but not all of <a href="http://itunes.apple.com/us/album/animals/id188506401">&#8220;Animals&#8221;</a> (apologies to fans of the album <a href="http://mediamemo.allthingsd.com/20100309/dark-side-of-the-download-pink-floyd-sues-emi-over-online-sales/#comments">I offended</a> earlier in the week), you might want to buy now, just to be safe.</p>
<p>UPDATE: EMI says it hasn&#8217;t been ordered to stop selling individual tracks, adding that this will be hashed out in the courts for a while. Here&#8217;s the full text:</p>
<blockquote class="memo"><p>Today&#8217;s judgment does not require EMI to cease making Pink Floyd&#8217;s catalogue available as single track downloads, and EMI continues to sell Pink Floyd&#8217;s music digitally and in other formats.</p>
<p>This litigation has been running for well over a year and most of its points have already been settled.</p>
<p>This week&#8217;s court hearing was around the interpretation of two contractual points, both linked to the digital sale of Pink Floyd&#8217;s music. But there are further arguments to be heard on this and the case will go on for some time.</p></blockquote>

			<content:encoded><![CDATA[<p>Installing a multiroom stereo system can involve drilling holes in walls, running wires throughout the house and spending a lot of money. And after all that, the stereo still won&#8217;t have access to as much music as your computer. This week, I tested an alternative to the traditional stereo system that lets you control digitally delivered music in multiple rooms without spending a lot of money.</p>

<p>I tested Sonos Inc.&#8217;s $399 ZonePlayer S5 (<a href="http://Sonos.com/S5">Sonos.com/S5</a>), an all-in-one system that plays music off of your Windows PC or Mac, including music files on the computer, content from Internet radio sites Pandora and Last.fm, local radio stations, Sirius Internet radio, Napster and Rhapsody. The S5 plugs directly into your router and a wall outlet, and a simple software program installs on your computer, working as a desktop remote control. It can work in concert with other S5s or other Sonos products to create a multiroom system around your house. And a free iPhone or iPod Touch app facilitates full remote control of multiple systems.</p>
<p>Since 2005, Sonos has offered high-end audio systems that permit people to listen to their digital music in multiple rooms on stereo systems with straightforward setups and simple remote controls. But its past products were relatively costly and required users to provide an existing stereo setup, powered speakers or a device (like a Bose Wave Radio) that allowed adding components via an auxiliary line-in. </p>
<h5 class="subhed">Streamlined Setup</h5>
<p>The ZonePlayer S5 is Sonos&#8217;s first product that works right out of the box and doesn&#8217;t require additional pieces. It took me very little time to set up and, once set up, sounded great. Music fans will want to know that it has five speakers powered by five dedicated digital amplifiers, two tweeters, two midrange drivers and a subwoofer. Discreet buttons on the top of the S5 can be pressed to mute, raise or lower volume.</p>

<p>Sonos&#8217;s $99 ZoneBridge accessory frees the ZonePlayer S5 from being wired to a router. Most people will need to buy one of these because they don&#8217;t have their routers set up in the same rooms where they want to keep their ZonePlayer S5s. The ZoneBridge is what it sounds like: It can bridge a connection between your home network and one or multiple ZonePlayer S5s—or other Sonos products. There&#8217;s no limit to the number of Sonos products that can work with one ZoneBridge.</p>
<p>Last year, Sonos created a free app for Apple&#8217;s (AAPL) iPhone and iPod Touch that, as of a recent release last month, works just like the standalone $349 Sonos Controller 200, a touch-screen remote control. Using either the free app or the Sonos Controller, people can control music on multiple ZonePlayers and on other Sonos devices. For example, from my iPod Touch, I can mute one ZonePlayer and crank up the volume on another; I can skim through and play a list of Billboard Chart hits from Napster or listen to one of my personalized stations on Pandora.</p>
<p>If you&#8217;re like me, you don&#8217;t like bothering with plugs as you move electronics around your house. Even though the ZonePlayer S5 has a built-in handle and can easily be moved around (it weighs only about nine pounds), it will need its AC adapter cord wherever it goes. And the ZonePlayer S5 doesn&#8217;t have a dedicated iPod dock. Sure, you could buy a cord to plug an iPod into the auxiliary port on the back of the ZonePlayer, but that&#8217;s not the same as a dock. </p>
<h5 class="subhed">Competition Report</h5>
<p>Competitors, such as Bose Corp.&#8217;s $270 SoundDock Series II, work as speakers and iPod docks. The Bose can&#8217;t sync with other SoundDocks, as Sonos products are made to do, nor can it wirelessly play music from the hard drive of a nearby Windows PC or Mac. But as long as an iPod Touch or iPhone is loaded with free apps from Pandora or Last.fm, it can be placed in the SoundDock to play Internet radio through this system. And Bose&#8217;s $360 SoundDock Portable works plugged in or for over three hours on rechargeable batteries, making it easier to move around the house. </p>
<p>It took me less than 10 minutes to set up two ZonePlayer S5s, one ZoneBridge and a Sonos Controller 200 remote control in three different rooms. The ZoneBridge is just 1½ inches tall and its surface measures about the area of a piece of toast. It plugs directly into a router so the S5s can work anywhere within the Wi-Fi network, though they still must each be plugged into a power outlet.</p>
<p>I installed Sonos&#8217;s setup software, which came on a disc with the ZonePlayer S5, on a Dell (DELL) XPS One running Windows 7. When prompted, I followed on-screen instructions that explained how to press a button on each ZonePlayer S5, the ZoneBridge and the remote to wirelessly link them to my system. An indicator light on the S5 and ZoneBridge changed from blinking to solid to signify the connection.</p>
<h5 class="subhed">Listen Up</h5>
<p>Free 30-day trials of Sirius Internet Radio, Napster and Rhapsody come with the ZonePlayer S5, and the software is smart enough to set everything up in one step so users can start listening without first filling out any forms (like email address, name etc.). If users don&#8217;t have accounts with Internet radio sites Pandora and Last.fm, they must go to those sites to create accounts online. </p>
<p>I entered my Pandora Internet radio user name and password on the computer, and my saved radio stations appeared on the computer screen. These personalized stations also showed up on the Sonos Controller&#8217;s colorful touch screen, as well as in the Sonos Controller app on the iPhone. And Pandora&#8217;s thumbs-up and thumbs-down buttons also work on these portable remotes, so my musical preferences were saved in my account as I selected each to indicate whether or not I liked a song.</p>
<p>I played all sorts of content from the Web directly on my ZonePlayer S5s: hip-hop from Jay-Z, Ella Fitzgerald jazz, classical Christmas songs sung by the York Minster Choir, my local NPR station and tracks from Shakira&#8217;s new &#8220;She Wolf&#8221; album. I also listened to music from my computer&#8217;s hard drive.</p>
<p>The Sonos ZonePlayer S5 lets you build a stereo system that can be wirelessly spread around with help from the company&#8217;s $99 ZoneBridge. And, as is the case with all Sonos products, the setup process is fantastically simple.  Now that the iPhone and iPod Touch can use a free remote-control app that works just as well as the Sonos Controller 200, these players are even more accessible.</p>

			<content:encoded><![CDATA[<p><a href="http://mediamemo.allthingsd.com/files/2009/12/ManWearingBarrel.jpg"><img class="alignright size-medium wp-image-13415" title="ManWearingBarrel" src="http://mediamemo.allthingsd.com/files/2009/12/ManWearingBarrel-225x300.jpg" alt="ManWearingBarrel" width="225" height="300" /></a>Required reading for anyone interested in the economics of digital music and the pitfalls of digital media in general: <a href="http://www.toomuchjoy.com/?p=1397">This post from Tim Quirk</a>, who is currently an executive at RealNetworks&#8217;s (RNWK) Rhapsody but who used to sing in a band called Too Much Joy.</p>
<p>Quirk&#8217;s tale revolves around his quest to find out how much his band earned from three albums&#8217; worth of digital music over a five-year stretch. Warner Music Group (WMG) initially tells him that his band, which enjoyed very modest success through the 80s and 90s, has earned a grand total of&#8230;$62.47.</p>
<p>After some prodding, Quirk eventually gets Warner to concede that the band generated more than that paltry sum. But it&#8217;s still not likely to be that much.</p>
<p>Again, you&#8217;ll want to read it yourself, but there are two points here:</p>
<ul>
<li>It is much more difficult than it ought to be for digital content creators and owners to figure out how much money they&#8217;ve made online. Quirk, who works for a digital music distributor himself, lays much of the blame on the labels. But in their defense, I&#8217;ve heard many label types complain that they&#8217;re at the mercy of the likes of Rhapsody and Apple (AAPL). Remember that iTunes has been selling music since 2003. If digital music is still this knotty to navigate, think of how difficult, say, figuring out an actor&#8217;s residual for a video download is going to be.</li>
<li>At least under conventional contracts, digital really isn&#8217;t going to amount to much for most performers. Maybe <a href="http://www.hypebot.com/hypebot/2009/11/spotify-fights-back-we-paid-more-than-that.html">Lady Gaga really did make more than $167 after generating more than one million plays on Spotify</a>, but she&#8217;s not going to make a ton, because streaming music royalties are really, really tiny. And given that streaming music start-ups are struggling to pay even that much, this is not going to change for quite some time.</li>
</ul>

But there&#8217;s a catch: You&#8217;re going to have to buy some of the late singer&#8217;s other songs, too.</p>
<p>That&#8217;s the pact that Apple (AAPL) and Sony (SNE) have reached this week over the upcoming release of the Jackson&#8217;s newest stuff: Anyone who wants to buy a copy of &#8220;This Is It,&#8221; the song, via iTunes will also have to buy some extended-play version of &#8220;This Is It,&#8221; the album</p>
<p>Here&#8217;s the official word from Apple, following a couple days&#8217; worth of erroneous and confusing reports (one of which I <a href="http://mediamemo.allthingsd.com/20091014/sony-michael-jacksons-estate-tells-apple-to-beat-it-skips-itunes-with-new-album/">wrote</a>):</p>
<blockquote class="memo"><p>We look forward to offering the new Michael Jackson album, as well as a digital-only EP with six previously unreleased tracks, providing fans a great way to get all of the new songs. The iTunes Store will offer the album-only single &#8220;This Is It&#8221; on both the album and EP starting October 26.</p></blockquote>
<p>To spell that out: Apple will <em>not</em> be selling the single by itself.</p>
<p>That&#8217;s an unusual arrangement for Apple, which generally insists that labels sell their music on a track-by-track basis. If the labels had their way, they would consistently force customers to buy an entire album for $10 or more. No word on pricing yet, but it&#8217;s a fair bet to assume that even the six-song EP will sell for more than $1.29, Apple&#8217;s highest price for an individual song.</p>
<p>Apple does make an occasional exception here and there. For instance, many of the songs on iTunes soundtracks are only available as part of an album. But while &#8220;This Is It&#8221; does accompany a movie by the same name, it&#8217;s not technically a soundtrack, so that&#8217;s not what&#8217;s going on here.</p>
<p>Sony has sold a staggering amount of Jackson&#8217;s stuff since his death last summer, so it&#8217;s possible that Apple is simply trying to take advantage of what appears to be insatiable demand. But that doesn&#8217;t sound right to me: Even a huge hit on iTunes does very little for Apple&#8217;s books.</p>
<p>My guess: Apple maintains a vise-grip on the digital sales, but every now and then likes to throw the labels a bone. For instance, it used to insist that all of the labels sell all of their songs for 99 cents, but earlier this year, Apple changed its policy and now offers <a href="http://mediamemo.allthingsd.com/20090106/confirmed-itunes-going-drm-free-unclear-does-anyone-care/">three different price points</a>.</p>

<p>EARLIER: After <a href="http://mediamemo.allthingsd.com/tag/michael-jackson/">Michael Jackson</a> died, fans <a href="http://www.rollingstone.com/rockdaily/index.php/2009/06/26/michael-jackson-catalog-sales-soar-on-itunes-amazon/">flooded iTunes</a> to snap up his music. But when <a href="http://www.michaeljackson.com/us/node/326415">&#8220;This Is It,&#8221;</a> the singer&#8217;s final work, comes out this month, they&#8217;ll have to look somewhere else: Apple&#8217;s digital store won&#8217;t be selling the album.</p>
<p>So says <a href="http://www.digitalmusicnews.com/stories/101309mj">Digital Music News</a>, citing &#8220;confidential information.&#8221; The problem, supposedly, is that Sony (SNE) and Jackson&#8217;s estate want to sell the entire double album as a set, while Apple insists that all of the music it sells needs to be available as singles.</p>
<p>I&#8217;m checking with Sony and Apple to confirm, but the story is a familiar one, because it&#8217;s a longstanding dispute between Apple (AAPL) and the music business. The industry, for both financial and artistic reasons, has tried to keep music bundled together, while Apple insists on selling it a la carte.</p>
<p>Apple usually wins these disputes: Even the stubborn iconoclasts in Radiohead eventually bowed to Steve Jobs&#8217;s will and turned their precious albums into individual songs.</p>
<p>If there is a clamor for the new Jackson music online, it will reportedly benefit Amazon (AMZN), whose MP3 store does offer album-only releases.</p>
<p>But I&#8217;m not sure how loud the clamor will be: As best I can tell, the &#8220;new&#8221; release contains only a smattering of Michael Jackson you haven&#8217;t heard before: Two versions of the title song, plus &#8220;a recently discovered spoken word poem.&#8221;</p>
<p>The rest? Greatest hits you can already buy, song-by-song, on iTunes.</p>

<blockquote class="memo"><p>Guns N&#8217; Roses and Universal Music Group&#8217;s Interscope-Geffen A&amp;M label were sued by British label Independiente and the U.S. arm of Domino Recording Company, who own the licensing rights to songs by German electronic musician Ulrich Schnauss.</p>
<p>Singer Axl Rose and Guns N&#8217; Roses band members and album producers copied portions of two of Schnauss songs&#8211;&#8221;Wherever You Are&#8221; and &#8220;A Strangely Isolated Place&#8221;&#8211;for a song used on the band&#8217;s last album called &#8220;Riad N&#8217; the Bedouins,&#8221; according to the lawsuit.</p>
<p>The lawsuit, filed on Friday but made available on Monday, seeks $1 million in damages. A spokesperson for Interscope-Geffen A&amp;M, owned by Vivendi&#8217;s Universal Music Group, was not available for comment.</p></blockquote>
<p>You might have thought the labels suing the band and Universal Music would have done so last fall, when there was a <a href="http://mediamemo.allthingsd.com/20081121/omg-new-gnr-on-myspace-ohnevermind/">biggish to-do about the album</a> and when the band and Universal Music were <a href="http://mediamemo.allthingsd.com/20081216/blogger-to-guns-n-roses-sorry-i-shared-your-album-best-buy-to-guns-n-roses-sorry-we-bought-your-album-axl-rose-to-internet-look-at-me/">siccing the federal government on bloggers</a> who posted links to unauthorized MP3s from the album.</p>
<p>Anyway, it&#8217;s another good opportunity to remind the young people of today why the young people of 20 years ago were really into Guns N&#8217; Roses: They used to be great! </p>

			<content:encoded><![CDATA[<p><a href="http://mediamemo.allthingsd.com/files/2009/08/beatlesforsale.jpg"><img class="alignright size-medium wp-image-10490" title="beatlesforsale" src="http://mediamemo.allthingsd.com/files/2009/08/beatlesforsale-250x242.jpg" alt="beatlesforsale" width="250" height="242" /></a>I don&#8217;t normally bother providing you with updates on the music industry&#8217;s revenue because the update has been the same for most of the last decade: <a href="http://mediamemo.allthingsd.com/20081231/the-music-business-bids-good-riddance-to-2008-gets-ready-to-say-the-same-thing-to-2009/">Each quarter, the industry&#8217;s collective sales decline yet again</a>.</p>
<p>But here&#8217;s a very slight twist: The sales decline slowed in the most recent quarter. U.S. sales dropped 11.1 percent in Q3, compared to a 14.5 percent drop in Q2, according to Nielsen Soundscan.</p>
<p>That&#8217;s the good news. The bad news is that Michael Jackson isn&#8217;t going to pass away again&#8211;and that unless they <a href="http://mediamemo.allthingsd.com/20090908/let-it-be-beatles-still-not-coming-to-itunes-tomorrow/">finally do come to Apple&#8217;s (AAPL) iTunes</a>, there probably isn&#8217;t another way to repackage the Beatles again. <a href="http://news.yahoo.com/s/nm/20091005/media_nm/us_sales">Billboard</a>:</p>
<blockquote class="memo"><p>Renewed interest in the Beatles and Michael Jackson slowed the decline of U.S. album sales in the third quarter, although the industry is still on track to fall for the eighth time in nine years&#8230;.</p>
<p>Music retailers are hoping that the continued performance of Jackson and Beatles albums and a strong fourth-quarter release schedule will continue to make up lost ground.</p>
<p>During the quarter, Jackson&#8217;s June 25 death fueled sales of about 5 million units, and the September 9 re-release of the Beatles catalog has sold 1.3 million units so far.</p>
<p>So far this year 11 albums have topped the 1 million-unit mark, the same number as in 2008. In 2008, the top seller was Lil Wayne&#8217;s &#8220;Tha Carter III,&#8221; at 2.5 million units; this year&#8217;s top seller is Jackson&#8217;s &#8220;Number Ones,&#8221; at 1.8 million units.</p></blockquote>

			<content:encoded><![CDATA[<p>At long last, Microsoft has made a portable media player that you can be proud to carry around: the Zune HD.</p>
<p>This fourth-generation Zune (<a href="http://Zune.net">Zune.net</a>) is ultra thin and has a stunningly vivid 3.3-inch touch screen that covers most of its surface, doing away with the old device&#8217;s touchpad. It comes in one small size rather than the older large and small versions, and has capacities of 16 and 32 gigabytes for $220 and $290, respectively. </p>

<p>The Zune HD does a nice job of integrating and artistically displaying content about an artist, song or album whenever possible. It has an acceptable built-in browser that surfs the Web using a Wi-Fi connection, and a customizable Quickplay menu on the home screen that displays your content using tiny, stylish tiles. The corresponding Zune Marketplace finally offers movies—about 500 for renting or buying, half of which have HD resolution. And a $90 docking station works with the device to display its HD content on your HDTV.</p>
<p>Given all the improvements of this new Zune, it&#8217;s a shame that this makeover stopped short of revamping its commerce system, which is still too confusing. Rather than inviting newcomers to the Zune and its online store by allowing them to use real money to buy content, it is still tied to the points system made popular by Microsoft&#8217;s (MSFT) Xbox gaming console. In this gamer-friendly system, the cost of one song is 79 points, roughly the equivalent of a dollar, and users must buy points in buckets ranging from 400 for $5 to 5,000 for $62.50. People who are trying to watch their budgets don&#8217;t need the hassle of calculating points per purchase. And Amazon&#8217;s (AMZN) Kindle e-reader and Apple&#8217;s (AAPL) iTunes Store have proved that using dollars and an uncomplicated one-click system is a successful strategy.</p>
<p>The way I prefer to get the most out of the Zune system is by using the Zune Pass for $15 monthly. This charge allows free continuous streaming of music from any computer&#8217;s browser as long as you log in, and includes 10 free MP3 downloads a month that are yours to keep even if you bail on using the Zune software. The Zune Pass lets you listen to Smart DJ playlists that can be built in one of three ways: using your own library; using a mix of Marketplace content and music from your library; or using only songs from the Marketplace. These also can be set to last for a certain amount of time—say for a 30-minute jog or a two-hour party.</p>
<p>I created several Smart DJ playlists including one using Dierks Bentley as the seed artist from which other suggestions were generated. This country singer was a good test for the Zune software because Mr. Bentley&#8217;s music blends new and old country sounds. I set the Smart DJ to produce a mix using only content from Marketplace and it returned a great list that included songs from newer group, Little Big Town, as well as older stuff like Joe Diffie&#8217;s &#8220;John Deere Green.&#8221; Any Smart DJ list can be dragged onto the Zune HD.             </p>
<p>Apple&#8217;s iPod Touch is the Zune HD&#8217;s biggest rival and its iTunes Store has much more content in all categories compared with Zune Marketplace. But let&#8217;s put music, movies, TV shows, podcasts and music videos aside and say we&#8217;re satisfied with the amount of content offered by Zune Marketplace. </p>
<p>One of the iPod Touch&#8217;s best features is its ability to access Apple&#8217;s App Store, a catalog of 75,000 applications. The Zune HD only dips its pinky toe into a pool where Apple is already swimming laps: Only nine apps can be downloaded from the Zune Marketplace (all are free). They&#8217;re colorful and simple to use, but nine apps won&#8217;t be enough to compete head on with the iPod Touch.</p>

<p>It would be a real boon to Zune if it somehow inherited the gaming genes of Microsoft&#8217;s already-established Xbox, especially considering how Apple has heavily marketed the iPod Touch as a portable gaming system. Microsoft will only say that later this year Zune will offer apps for Twitter and Facebook as well as 3-D games like &#8220;Project Gotham Racing: Ferrari Edition.&#8221; </p>
<p>The only same-capacity model in the Zune HD and iPod Touch is the 32-gigabyte, which costs $290 and $299, respectively. The Zune HD is smaller than the iPod Touch so its organic light-emitting-diode touch screen is 3.3 inches compared with the Touch&#8217;s 3.5-inch screen. The Zune fits easily in any pocket and is just 0.35-inch thick. A thin horizontal button on the face of the device takes you to the home screen, and a hidden button on the left side pulls up an on-screen menu for volume and playback controls—or just tap the screen when content is playing. It doesn&#8217;t have a speaker like the iPod Touch, so you&#8217;ll always need earbuds to hear anything that&#8217;s playing.</p>
<p>Quickplay is one of my favorite features on the Zune HD. It uses tiny tiles to visually represent your content in four categories: currently playing; anything pinned (or labeled with a shortcut tile) to Quickplay; a history of recently opened content; and anything that&#8217;s new to the player. This includes all of your photos, videos, music, Web pages and apps. I easily pinned <a href="http://AllThingsD.com">AllThingsD.com</a>, a &#8220;Saturday Night Live&#8221; video and a favorite photo to the Quickplay menu. Clever animation sends this menu to the background of the home screen or swiftly pulls it into the foreground when needed.</p>
<p>I rented and downloaded the movie &#8220;Girl with a Pearl Earring&#8221; and opted to pay 360 points for the HD version rather than paying 240 points for the standard-definition version. A helpful on-screen explanation described the advantages of each according to where it would be played. Movie rentals last for 14 days or 24 hours after you first press play. </p>
<p>Listening to music on the Zune HD is a lot of fun—and even educational. Whenever the screen goes idle while playing a song, large images of the artist and album cover fill the entire screen while text—album name, artist name, song name—scrolls across these images. With one touch, I saw a list of other albums and songs by that artist, an artist biography, related artists, and pictures of the artist. This is a lot more interesting than staring at one image on the screen, and I learned a lot of new information about musicians I&#8217;ve been listening to for years. </p>
<p>The newly added Web browser on the Zune HD gets the job done, but has downsides. Its on-screen keyboard for entering names of Web pages has very small keys and doesn&#8217;t use predictive typing to fix your mistakes. Some Web pages rendered normally on the browser, but a couple—like <a href="http://Georgetown.edu">Georgetown.edu</a>—looked normal only when I turned the Zune HD horizontally. </p>
<p>As with other Zunes, this Zune HD has a radio receiver and now uses HD radio for finding more stations with clearer signals. If you like a song, an on-screen button tags it for buying and downloading immediately or later.</p>
<p>The Zune HD is a great-looking little player, and users will especially appreciate its Quickplay menu, rich collection of artist information and mesmerizing screen. If its points system was scrapped and its Zune Marketplace was filled with more content, I&#8217;d like it better.</p>

<p>Also included in this update: Home Sharing, which allows songs, movies and TV shows to be shared  and <em>copied</em> to up to five home computers. Another very slick feature that allows users to simply drag and drop songs between computers to copy them.</p>
<p>iTunes 9 also features a new store with redesigned music, movie, TV pages and a handy new navigation bar. Beyond this, there&#8217;s also support for Twitter and Facebook.</p>

<p>&#8220;You know, some of us here are old enough that we actually bought LPs,&#8221; says Jobs. &#8220;You used to get liner notes, essays and photos, but that stuff left us when we moved to digital music.&#8221;</p>
<p>With that, Jobs announces iTunes LP&#8211;the official name of the company&#8217;s rumored &#8220;Cocktail&#8221; album bundle. As expected, these iTunes LP bundles will feature additional art, photos and whatnot. Apple is working directly with artists and labels to develop them.</p>
<p>A Doors &#8220;LP&#8221; is offered up as an example and it includes some videos exclusively recorded for iTunes&#8211;Ray Manzarek talking about how Jim Morrison named the Doors (&#8220;Not a door-door, man. Like the door in your MIND.&#8221;). Surprisingly nice little video, actually. Certainly, it&#8217;s likely to appeal to die-hard fans.</p>
<p>Apple (AAPL) is doing something similar with movies&#8211;iTunes extras. Movies bundled with additional photos, etc.</p>
