<p>As I <a href="http://allthingsd.com/20120103/exclusive-yahoo-poised-to-name-ceo-with-ebays-paypal-head-as-top-choice/">reported late last night</a>, Yahoo said it had named PayPal President Scott Thompson as its new CEO. The exec is currently in charge of the large eBay online payments unit.</p>
<p>He&#8217;ll start next week, but there are staff conference calls today and also an all-hands meeting on Yahoo&#8217;s main Silicon Valley campus (meet at URLs, troops!) tomorrow.</p>
<p>Yahoo shares are down almost three percent on the news so far, as Wall Street has been hoping for a big sale of some sort and not another turnaround.</p>
<p>Yahoo will be holding a 7 am PT press conference about the move and presumably to swan around Thompson.</p>
<p>(Welcome, Scott! I hope you were informed &#8212; please do not listen to what co-founder Jerry Yang says on this important issue &#8212; that you are supposed to send all internal memos to <em>me</em>! Also, as one of my Twitter followers, Mike Dudas of Google <a href="https://twitter.com/#!/mdudas/status/154552407374835712">just tweeted</a>: &#8220;If Thompson leads companies as well as he grows a moustache, Yahoo made a great CEO choice!!&#8221; I concur.)</p>
<p>A Yahoo PR person confirmed the hire very cordially in a phone call early this morning and the Internet giant also put out a press release.</p>
<p>So did I, of a sort, last night. Given I am too tired to rewrite myself, <a href="http://allthingsd.com/20120103/exclusive-yahoo-poised-to-name-ceo-with-ebays-paypal-head-as-top-choice/">here is what I had reported</a>:</p>
<blockquote class="memo"><p>The company <a href="http://allthingsd.com/20110906/exclusive-carol-bartz-out-at-yahoo-cfo-interim-ceo/">fired its last CEO, Carol Bartz</a>, in September, and Yahoo has been run by the board and also by interim CEO Tim Morse, who had previously been its CFO.</p>
<p>After Bartz&#8217;s ouster, Yahoo said it was looking at a range of strategic options, including the possible sale of all or part of the company. </p>
<p>That was the focus at first, although Yahoo had simultaneously <a href="http://allthingsd.com/20111013/exlcusive-yahoo-hires-heidrick-struggles-for-ceo-search/">hired Heidrick &#038; Struggles</a> to look for a new CEO. </p>
<p>The company attracted <a href="http://allthingsd.com/20111130/yahoo-bidders-come-in-at-16-50-to-17-50-with-plan-to-keep-jerry-yang-staying-on-board/">two partial investment bids from private equity firms</a>, Silver Lake and TPG Capital, but shareholders were unhappy with the low prices of these so-called PIPE &#8212; Private Investment in Public Equity &#8212; arrangements.</p>
<p>Yahoo then moved to try to strike a tax-advantaged deal with its long disgruntled Asian partners, China&#8217;s Alibaba Group and Japan&#8217;s SoftBank, to sell back parts of the large stakes it has long owned in Alibaba and Yahoo! Japan. </p>
<p>Those <a href="http://allthingsd.com/20111223/yahoo-okays-proceeding-with-term-sheet-to-sell-stakes-back-to-asian-partners-while-also-hoping-to-keep-pe-firms-in-fray/">complex negotiations are still ongoing and look promising</a>, which could yield Yahoo billions of dollars in capital to be given to investors, for stock buybacks or to invest in new initiatives.</p>
<p>Since then, the board &#8212; long considered one of the more cloddish in tech &#8212; has turned its attention to hiring a new CEO, in the hopes of trying once again to revive its flagging fortunes.</p>
<p>Thus, it began looking to hire someone with deep tech experience at a large public consumer Internet company in Silicon Valley. </p>
<p>That narrowed the field, with Yahoo looking at a range of choices with expertise in advertising, technology platforms and more. </p>
<p>There is a lot of that on the deep bench that eBay CEO John Donahoe has assembled at the online commerce giant, including Thompson.</p>
<p>Plus, he is a genuine Internet geek.</p>
<p>According to his eBay bio, Thompson became president of PayPal in early 2008, after serving as its CTO in charge of information technology, product development and architecture.</p>
<p>Before eBay, he worked at Inovant, a subsidiary of Visa formed to oversee global technology for the organization. He was also CIO of Barclays Global Investors and has worked at Coopers and Lybrand on information technology. </p>
<p>And here&#8217;s a tasty new wrinkle: Thompson recently <a href="http://www.facebook.com/profile.php?id=609937772&#038;sk=wall">&#8220;liked&#8221; Yahoo on his Facebook page</a>, along with the decidedly more interesting Kickstarter and Splunk.</p></blockquote>
<p>Again, Scott, thanks for the Facebook tip &#8212; I knew the social networking site could come in handy!</p>

<p><img class="alignright size-thumbnail wp-image-2023" title="osamapaypal" src="http://emoney.allthingsd.com/files/2011/01/osamapaypal-150x145.jpg" alt="" width="150" height="145" />In a blog post, Scott Guilfoyle, PayPal&#8217;s CTO, made the announcement and introduced the new head of the platform team, Matthew Mengerink.</p>
<p>But the departure of Bedier to Google is a big blow to PayPal, considering that both companies are racing to build next-generation payment platforms with a strong mobile component.</p>
<p>Bedier held the title of VP of platform and oversaw PayPal&#8217;s global payments platform, including mobile.</p>
<p>Mengerink is an internal replacement for the position, having worked at PayPal for 10 years. He previously led the PayPal architecture, infrastructure, payments development, core technologies, international development, customer quality and engineering services teams.</p>
<p>I will update when I hear more on what Bedier will be doing at Google.</p>

			<content:encoded><![CDATA[<p><img src="http://newenterprise.allthingsd.com/files/2011/01/intel-logo-275x181.jpg" alt="" title="intel-logo" width="275" height="181" class="alignright size-medium wp-image-1754" />Chipmaker Intel just reported quarterly earnings of 59 cents a share, beating the expectations of analysts who had expected earnings of 53 cents. Revenues were $11.5 billion, ahead of the forecast of $11.37 billion. Sales were up 8 percent versus the year-ago quarter, while profits surged 48 percent.  Gross margins, a key measure of profitability, was 67.5 percent, slightly above the company&#8217;s prior guidance. Intel shares are trading up by 1.7 percent after hours.</p>
<p>Intel said in its statement that PC Client Group revenue was flat. Other groups were stronger: Data Center Group revenue was up 35 percent, and Intel&#8217;s architecture group saw sales surge by 27 percent. Intel Atom microprocessor group, its low-power chip aimed at tablets and smartphones, saw revenue grow 8 percent. This despite word from Microsoft last week at the Consumer Electronics Show that it will <a href=" http://mobilized.allthingsd.com/20110105/live-microsoft-talks-arm-at-ces/">develop a version of Windows for ARM-based chips</a> from Texas Instruments, Qualcomm and Nvidia aimed at tablets and smartphones. Microsoft&#8217;s move calls into question Intel&#8217;s hopes to land design wins for the Atom low-power chip that it hopes to sell to manufacturers of smartphones and tablets, but which has yet to show any significant results.</p>
<p>This report of flat revenues for PCs comes a day after Gartner and IDC both said they saw <a href="http://newenterprise.allthingsd.com/20110112/pc-sales-weakened-in-q4-everyone-blame-the-ipad/">weaker-than-expected sales of PCs</a> in the fourth quarter of 2010.</p>
<p>For its 2011 first-quarter outlook, Intel said it expects revenue of $11.5 billion, plus or minus $400 million, and a gross margin of 64 percent, plus or minus a couple of points. For the full year, it expects gross margins to be 65 percent, plus or minus a few points. More after I go through the numbers and attend the conference call, which starts in about an hour.</p>

And he did come prepared with an answer: Tablets are just another growth opportunity for Intel, one that the company plans to take good advantage of. And while they might present something of a challenge to PC sales in the short term, in the long term, they&#8217;re just another revenue stream.</p>
<p>&#8220;We believe that like netbooks, tablets will expand the term for computing overall with a new form factor and new uses that bring computing to even more aspects of our lives,&#8221; <a href="http://seekingalpha.com/article/229697-intel-ceo-discusses-q3-2010-results-earnings-call-transcript?">Otellini said during the call</a>.  &#8220;Will they impact PC sales? Sure. At the margin, they probably will. Consumers will have a limited amount of discretionary income and some will choose to purchase a tablet instead of upgrading an existing PC or purchasing a netbook in any given period. We saw the same thing happen when netbooks were introduced, but three years later, both the PC and the netbook market segments have grown substantially and we believe that will happen again with tablets.&#8221;</p>
<p>Given that, what does Intel (INTC) plan to do to gain a little more presence in the category?</p>
<p>&#8220;We are deeply engaged with a number of partners to bring to market innovative tablet solutions,&#8221; he explained. &#8220;Our design win momentum is very strong, and in the coming months and quarters, you will see Intel solutions that run on Windows, Android and MeeGo operating systems across a variety of form factors and price points. We fully expect to participate broadly and profitably in this category, and that in the end, the tablet category will be additive to our bottom line and not take away from it.&#8221;</p>
<p>&#8220;We are the only architecture that runs all of the major&#8211;all but one of the major tablet operating systems, we don&#8217;t yet run on Apple,&#8221; he added. &#8220;So I think we&#8217;re in a pretty good space.&#8221;</p>

			<content:encoded><![CDATA[<p>In yet another major departure from Yahoo in recent days, Yahoo VP for Social Platforms Neal Sample has left the company for eBay (EBAY), where he will be the chief of the e-commerce giant&#8217;s architecture.</p>
<p>After being contacted by me after I&#8217;d heard about his departure from several Yahoo (YHOO) staffers, Sample confirmed the move but did not provide other details. His email to staff is below.</p>
<p>A Yahoo spokesperson also confirmed Sample&#8217;s leaving.</p>
<p>It was less than a week ago that Yahoo Communications Products Head <a href="http://kara.allthingsd.com/20100823/exclusive-yahoos-communications-head-jason-titus-departs/">Jason Titus also left the company</a>.</p>
<p>Sample&#8217;s move is another blow to Yahoo&#8217;s management team, led by CEO Carol Bartz, given his job as the leader of the Internet giant&#8217;s open, social and publishing platforms.</p>
<p>That purview stretched from comments to Answers to status updates and, of course, to Yahoo&#8217;s recent move to integrate social networks such as <a href="http://kara.allthingsd.com/20091202/yahoos-project-rushmore-begins-with-massive-facebook-connect-deployment-across-internet-giant">Facebook</a> and <a href="http://kara.allthingsd.com/20100223/yahoo-expands-twitter-relationship-in-next-stage-of-project-rushmore-complete-with-cutesey-bird-puns">Twitter</a> deeply into the service.</p>
<p>Sample and his colleagues were behind the Silicon Valley Internet giant&#8217;s late-to-the-social-party strategy of employing an all-inclusive hug of every social networking service globally and providing users with a kind of social dashboard that is understandable amid all the noise.</p>

<p>Team&#8211;</p>
<p>It is with mixed emotions that I tell you that I am moving on to become VP of Architecture at eBay. I&#8217;ll be taking on a larger role and taking on new challenges and opportunities. I&#8217;ll be leaving early next month and am working hard to ensure a smooth transition.  Jay and team are already searching for a new permanent leader.</p>
<p>Needless to say, my time at Yahoo! has been full of adventure, technical achievements and a lot fun with great, smart people. My decision to leave was not an easy one. We&#8217;ve made significant progress over the last six years, particularly related to the advancements of our Social and Open platforms and I know many good things will continue to come out of this team.</p>
<p>As many of you know, I went to college in Wyoming where I learned one thing that&#8217;s been more important than anything else: how to shake hands. There&#8217;s a lot of handshaking that goes on there, so you get good at it! I’ve explained to a few folks that you even wave to other people in cars in Wyoming (perhaps because there&#8217;s a good chance one of you will pull the other out of a snow bank one day!).</p>
<p>In the 90s, I started a PhD at Stanford and experienced an immediate cultural disconnect.  Seemingly no one in California shook hands or even said &#8220;hello&#8221; as they passed on the sidewalk. It was strange.</p>
<p>A little over six years ago, I was looking for a new work home. I knew that I needed a workplace loaded with good people and Yahoo! fit that bill. On my first interview, I was recruited by a friend from elementary school (Mark!), bumped into someone I&#8217;d bought a foosball table from a couple years before (Vikram!), and met a future boss, a long-time Yahoo! with outstanding character and a great handshake (JV!). It was a great fit: good folks, good work, and plenty of new hands to shake.</p>
<p>I leave present and future Yahoos with this: shake more hands! Get out there and press the flesh. Learn the names of your fellow Yahoos, all of them. Invite them to coffee and introduce them to your favorite baristas. It helps to know who is on the other end of that email, who to go to in getting things done, and who&#8217;s available for a session of mid-afternoon stress-relief (aka, foosball).</p>
<p>I’ve got some new hands to shake, but I won&#8217;t ever forget yours.</p>

<p>Here&#8217;s Walt Mossberg&#8217;s interview with HTC CEO Peter Chou, who heads the Taiwan-based smartphone maker.</p>
<p>As <a href="http://d8.allthingsd.com/20100603/peter-chou-session/">Digital Daily&#8217;s John Paczkowski wrote</a> in June:</p>
<p>&#8220;Over the past few years, Chou has transformed HTC from a contract handset manufacturer into a smartphone powerhouse, a company that ranks behind only Nokia (NOK), Research in Motion (RIMM) and Apple (AAPL) in global smartphone shipments. That&#8217;s quite an achievement and one attributable to the very early, savvy bet Chou made on Google&#8217;s (GOOG) Android mobile operating system.</p>
<p>But that same bet has gotten HTC into trouble as well, most notably a high-profile lawsuit from Apple alleging that a number of HTC’s Android devices infringe patents related to the iPhone&#8217;s graphical user interface, underlying architecture and hardware.&#8221;</p>

Over the past few years, Chou has transformed HTC from a contract handset manufacturer into a smartphone powerhouse, a company that ranks behind only Nokia (NOK), Research in Motion (RIMM) and Apple (AAPL) in global smartphone shipments. That&#8217;s quite an achievement and one attributable to the very early, savvy bet Chou made on Google&#8217;s (GOOG) Android mobile operating system.</p>
<p>But that same bet has gotten HTC into trouble as well, most notably a <a href="http://digitaldaily.allthingsd.com/20100302/apple-sues-htc/">high-profile lawsuit from Apple</a> alleging that a number of HTC&#8217;s Android devices infringe patents related to the iPhone’s graphical user interface, underlying architecture and hardware.</p>

<h4 class="subhed">Liveblog</h4>
<p><strong>11:55 am:</strong> How many of you have an Android phone, asks Walt, directing his question to the audience. If you do, it&#8217;s likely to have been made by HTC. And with that, Walt welcomes Chou to the stage.</p>
<p><strong>11:56 am:</strong> Walt notes that when he first encountered HTC it was an OEM. How did you get from there, he asks Chou, to where you are now, where your brand is actually on the phone?</p>
<p>Chou: It was a great journey for us. We started with a vision of mobile convergence and how smartphones would change people&#8217;s lives. That vision excited us, so we focused on innovations in technology and tried to deliver on that vision. Over the years, we began partnering with companies like Microsoft, Google. Then we shipped the world&#8217;s first Windows phone, the world&#8217;s first Android phone, and this week, we introduced the world&#8217;s first 4G phone, the Sprint (S) EVO. So we&#8217;ve been in this industry for a while. But we needed a brand identity. Without that, it was difficult to communicate our vision to the market.</p>
<p><strong>11:59 am:</strong> Walt&#8211;Other than 4G, what&#8217;s innovative about the EVO?</p>
<p>Chou: It has a breakthrough display, it&#8217;s much bigger, it&#8217;s clearer. It has an eight-megapixel camera and a front-facing camera as well. It&#8217;s the first device in the U.S. that people can use to make a video call. It&#8217;s also a hotspot; you can use it to create a Wi-Fi network.</p>
<p><strong>12:01 pm:</strong>: Walt likes the device&#8217;s kickstand. It turns it into a sort of mini-TV. He draws a comparison with the Dell (DELL) tablet we saw yesterday and notes that that device&#8217;s screen size is not much larger than the EVO&#8217;s.</p>

<p><strong>12:02 pm:</strong> Walt&#8211;So this is an Android device. You&#8217;re still making Windows phones, but are you making more Android phones now?</p>
<p>Chou: We&#8217;re committed to both platforms. We want to design great products for both. Different people like different things, so what we try to do is get a good mix of technology and design. And Android and Windows cater to different users. Windows users tend to like Windows. They are loyalists. Windows has a lot of value.</p>
<p>Walt: What about Android?</p>
<p>Chou: Android provides a different Internet experience. It caters to people who are interested in things like social networking, he says.</p>
<p><strong>12:05 pm:</strong> Walt wonders why, if HTC is committed to both platforms, it doesn&#8217;t differentiate its handset design. The company&#8217;s Windows phones look a lot like Android phones. There&#8217;s an HTC layer on them&#8211;HTC Sense.</p>
<p>Chou: Well, what we do is try to add value on top of Android and Windows. HTC Sense focuses on things like the social networking experience. Our philosophy is that we don&#8217;t force the customer to take what we offer; they have the freedom to personalize their devices.</p>
<p>Walt: So you can take HTC software off these phones?</p>
<p>Chou: Yes.</p>
<p><strong>12:07 pm:</strong> Walt&#8211;Is there a consumer awareness of your brand? When customers buy a Nexus One, do they know it&#8217;s made by HTC?</p>
<p>Chou says they do. Since last year, the company has been working on brand positioning, and that has bolstered consumer awareness of its offerings.</p>
<p><strong>12:08 pm:</strong> Chou offers an anecdote about meeting a guy at an airport and comparing HTC devices with him. &#8220;I think the HTC name is getting more awareness.&#8221;</p>
<p><strong>12:09 pm:</strong> Walt&#8211;Do you think it&#8217;s confusing to customers that there are now three brands involved in a phone: The carrier, the manufacturer of the phone and then the operating system? Can you have too many brands on a device?</p>
<p>Chou: This is an ecosystem. We have  a lot of stakeholders. We&#8217;re trying to minimize that a little bit, by putting some of those logos on the back.</p>

<p><strong>12:12 pm:</strong> Walt&#8211;Talk a bit about this concept of a lower-tier of smartphone device.</p>
<p>Chou: Our vision is to bring the smartphone to the mass market&#8230;We believe the smartphone is improving people&#8217;s lives, so we&#8217;re trying to offer it to more consumers, but sometimes, smartphone prices are too high, even with carrier subsidies. And mass-market consumers sometimes perceive smartphones as overly complex devices, so we&#8217;re trying to bring prices down and simplify devices at the same time. We&#8217;re doing this with the HTC smart. This is a $150 phone [as opposed to the typical $400 smartphone].</p>
<p>Walt: Is HTC Smart an Android phone?</p>
<p>Chou: No. It uses Qualcomm (QCOM) BREW.</p>
<p>Walt: Does it have a different Web browser? Is it as good as WebKit?</p>
<p>Chou says it&#8217;s not&#8211;at least not yet. He says the device has been relatively well received though. He also notes that given the low price, it can be offered by carriers at very low prices.</p>
<p><strong>12:17 pm:</strong> Walt&#8211;Is there fragmentation in Android? Some app developers tell me Android&#8217;s landscape is too cluttered. Is HTC Sense making this worse?</p>
<p>Chou: HTC Sense is not causing the problem here. We try not to fragment. All apps can run on HTC Sense. There&#8217;s no fragmentation, though there may be confusion there. The operating system itself may cause a bit of a problem. But it&#8217;s a small one&#8230;and it occurs more with older devices. We try to be careful to do good porting on our devices &#8230;</p>
<h4 class="subhed">Questions &amp; Answers</h4>
<p><strong>Q: What are you doing to improve battery life in these new devices?</strong> [Walt notes that the EVO's battery runs down "alarmingly fast"]</p>
<p>A: We understand that if your a heavy mobile user, the battery is a concern. The EVO&#8217;s battery is removable&#8211;not like the iPhone. [I think he's suggesting that users carry an extra one.] We are trying to innovate here. We&#8217;re aware of the problem. I hope someday this won&#8217;t be an issue.</p>
<p><strong>Q: Any other phones in your pockets?</strong></p>
<p>A: Chou chuckles.</p>
<p><strong>Q: Can you talk about HTC&#8217;s plans to expand into other areas of electronics&#8211;tablets for example.</strong></p>
<p>A: We&#8217;re very focused on smartphones today. We&#8217;re focusing our business on mobile operators. However, as an innovator, one of our defining characteristics is to create new technologies. So in our labs, we&#8217;re developing new devices like the HTC Shift [a tablet, I think].</p>
<p><strong>Q: What&#8217;s your take on the Foxconn suicides?</strong></p>
<p>A: I don&#8217;t know details about this. What I know is from the news. But this is a very well-equipped factory. There must be something there beyond manufacturing or salary issues, something cultural maybe. Times change, China changes and the value system may have also changed, and working long hours under very strict management may be very tough for some people. I&#8217;m not in a position to speak about this though, because we own a factory as well. We value our employees, we treat them well, we treat them as an asset. It&#8217;s really difficult for me to comment on Foxconn.</p>
<p><strong>Q: Will you list your stock in the U.S.?</strong></p>
<p>A: We&#8217;ve thought about it. But we need to think more about timing. These days, I&#8217;m spending most of my time thinking about products. Perhaps with some investment bank help, we can do that.</p>

<p>Before Apple lobbed a patent infringement lawsuit at Taiwanese handset manufacturer HTC yesterday, we were lucky to get its CEO, Peter Chou, to agree to appear at the <a href="http://allthingsd.com/d/speakers/">eighth <strong>D: All Things Digital</strong> conference</a> in June to talk about its work making smartphones for Google and others.</p>
<p>That interview with Chou (pictured above) obviously got a whole lot more interesting with the epic legal action by Apple (AAPL) alleging that HTC infringed some 20 patents related to the iPhone&#8217;s graphical user interface, underlying architecture and hardware.</p>
<p><a href="http://digitaldaily.allthingsd.com/20100302/apple-sues-htc/">Wrote Digital Daily&#8217;s John Paczkowski</a>:</p>
<p>&#8220;The company is asking for a permanent injunction barring HTC from importing or selling infringing phones in the U.S., along with triple damages and maximum interest.</p>
<p>&#8216;We can sit by and watch competitors steal our patented inventions, or we can do something about it. We&#8217;ve decided to do something about it,&#8217; Apple CEO Steve Jobs said in a press release announcing the action. &#8216;We think competition is healthy, but competitors should create their own original technology, not steal ours.&#8217;&#8221;</p>
<p>HTC denied the allegations, not surprisingly, and was backed up in a statement of support by Google (GOOG). That is also not a surprise, since its Android operating system, which is in the HTC-made Nexus One phone, is mentioned prominently in the lawsuit.</p>
<p>Whatever happens, it all makes for what is likely to be a head-spinning technology rumble over the next months and underscores how important the burgeoning mobile arms race and the fight over innovation will be.</p>

<p>Asked for his thoughts on iPhone rivals during a January 2009 earnings call, Apple COO Tim Cook said the company would not stand for having its intellectual property ripped off. </p>
<p>&#8220;We are watching the landscape,&#8221; <a href="http://digitaldaily.allthingsd.com/20100302/apple-sues-htc/">Cook said</a>. &#8220;We like competition, as long as they don’t rip off our IP, and if they do, we’re going to go after anybody that does&#8230;.We think competition is good; it makes it us all better. But we’re ready to suit up and go against anyone.&#8221;</p>
<p>Well, looks like Apple (AAPL) is suiting up, and against a big opponent. This morning, the iPhone maker filed suit against HTC, a Taiwanese handset manufacturer that makes a number of Android smartphones, including the operating system&#8217;s marquee device, <a href="http://digitaldaily.allthingsd.com/20100105/nexus-on/">Google’s Nexus One</a> (Read the suits in their entirety <a href="http://digitaldaily.allthingsd.com/20100302/apples-suits-against-htc-both-documents/">here</a>.) </p>
<p>In a lawsuit filed concurrently with the U.S. International Trade Commission and U.S. District Court in Delaware, Apple alleges that HTC infringed some 20 patents related to the iPhone&#8217;s graphical user interface, underlying architecture and hardware. The company is asking for a permanent injunction barring HTC from importing or selling infringing phones in the U.S., along with triple damages and maximum interest.</p>
<p>&#8220;We can sit by and watch competitors steal our patented inventions, or we can do something about it. We&#8217;ve decided to do something about it,&#8221; Apple CEO Steve Jobs said in a press release announcing the action. &#8220;We think competition is healthy, but competitors should create their own original technology, not steal ours.&#8221;</p>
<p>HTC appears to have been totally blindsided by the suit. As of this writing, <em>it hasn&#8217;t even been served</em>. </p>
<p>&#8220;We only learned of Apple&#8217;s actions based on Apple&#8217;s press release,&#8221; the company said in a statement. &#8220;We have not been served any papers yet so we are in no position to comment on the claims. We respect and value patent rights but we are committed to defending our own innovations. We have been innovating and patenting our own technology for 13 years.&#8221;</p>
<p>It&#8217;s not yet clear whether Google (GOOG) is implicated here. But it certainly seems possible. After all, HTC manufactures a number of Android devices, and while <a href="http://digitaldaily.allthingsd.com/20100105/nexus-on/">Google insisted at the Nexus One launch that it didn&#8217;t design the device</a>, the search giant clearly played a role in its development.</p>
<p>Of course, it could be that Apple is suing HTC because it can&#8217;t, for some reason, sue Google. More details to follow once I&#8217;ve read through the suits.</p>

<p>How much longer does Apple plan to continue its iPhone exclusivity contract with AT&#038;T? Some say <a href="http://digitaldaily.allthingsd.com/20100120/iphone4g-verizon/">until June</a>, when the device arrives on Verizon&#8217;s airwaves. Others say fall.</p>
<p>Not unreasonable predictions given <a href="http://digitaldaily.allthingsd.com/20091201/att-ranked-last-in-consumer-reports-best-cell-phone-service-survey/">issues with AT&#038;T’s network</a> and the simple fact that adding Verizon (VZ) would more than <a href="http://digitaldaily.allthingsd.com/20091002/iphone-market-share-would-double-without-exclusivity/">double the iPhone’s addressable market</a>. But perhaps a bit overeager, particularly in light of Apple COO Tim Cook’s remarks about the carrier during a <a href="http://digitaldaily.allthingsd.com/20100125/apple-earnings-3/">company earnings call Monday</a>. </p>
<p>Asked about AT&#038;T (T), the bad press its network has been receiving lately and the impact of negative reports on the Apple (AAPL) brand, Cook defended the carrier.</p>
<p>&#8220;First of all, AT&#038;T is a great partner,&#8221; he said. &#8220;We&#8217;ve been working with them since well before we announced the first iPhone. And I think it is important to remember they had more mobile broadband usage than any other carrier in the world.&#8221;</p>
<p>Emphasizing the large view, Cook continued, &#8220;And in the vast majority of locations we think that iPhone customers are having a great experience, from the research that we have done. As you know, AT&#038;T has acknowledged that they are having some issues in a few cities and they have very detailed plans to address these. We have personally reviewed these plans, and we have very high confidence that they will make significant progress toward fixing them.”</p>
<p>Now, Cook’s remarks certainly don’t preclude the possibility that Apple will end its exclusivity arrangement with AT&#038;T. But his eager defense of the carrier suggests there’s at least a chance that his company will renew it. </p>
<p>Of course, Apple did a hell of a job talking up the PowerPC architecture too&#8211;<a href="http://www.apple.com/pr/library/2005/jun/06intel.html">right up until it dumped it for Intel&#8217;s (INTC) x86 design</a> in 2006.</p>

			<content:encoded><![CDATA[<p>A federal appeals court on Tuesday affirmed a $290 million patent-infringement judgment that will bar Microsoft Corp. (MSFT) from selling current versions of its flagship Word software.</p>
<p>Microsoft said it has been preparing modified versions of the affected programs that should be ready when the injunction goes into effect on Jan. 11, allowing sales to continue without interruption. The company also indicated the ruling shouldn&#8217;t affect its highly anticipated Office 2010 software, due out next year. It also doesn&#8217;t affect copies of Word that have already been sold.</p>
<p>The U.S. Court of Appeals for the Federal Circuit on Tuesday affirmed a ruling in a case brought by i4i Inc., a Toronto-based technology company that convinced a Texas jury last May that recent versions of Microsoft Word infringed a company software patent that deals with manipulating the architecture of a document.</p>

<p>Yahoo (YHOO) confirmed the break to BoomTown.</p>
<p>In recent days, many inside the company had mistakenly thought the 44-year-old EVP for Product Architecture &#038; Strategy was departing the company for good.</p>
<p>Actually, it&#8217;s more of a sabbatical for Patel (pictured here). But it could turn out Patel will not come back from it at all.</p>
<p>For now, Yahoo is saying he will.</p>
<p>&#8220;Ash will be taking some well-deserved time off  to spend time with his family,&#8221; said Yahoo in a statement to me. &#8220;He will be returning to Yahoo! in early 2010.&#8221;</p>
<p>In his latest of many jobs at Yahoo, where he has been employed since 1996, Patel works with its products organization, run by CTO and EVP of Products Ari Balogh, &#8220;to drive the development of a comprehensive product strategy, as well as potential strategic deals, helping to evolve and evaluate its audience product and technology strategy.&#8221;</p>
<p>It&#8217;s one of many leadership positions Patel has had at Yahoo, as the company has reorganized many times over the years, including as EVP of its Audience Products Division, EVP of Platforms and Infrastructure, SVP of Platform Engineering and chief product officer.</p>
<p>He also played a key role as architect of several major Yahoo products, such as MyYahoo!, Yahoo! Finance, Yahoo! Messenger, Yahoo! Chat and many others.</p>
<p>In fact, Patel <a href="http://kara.allthingsd.com/20080625/yahoo-reorg-will-be-announced-thursday/">ended up in a major exec role in a reorg</a> that former Yahoo CEO and co-founder Jerry Yang did in the summer of 2008.</p>
<p>But the appointment of Patel to head the new Global Products group was greeted with some internal dissent, since many were pushing for faster change and new management at the Silicon Valley icon.</p>
<p>Yang was said to have insisted that Patel remain on as planned. He reported directly to President Sue Decker.</p>
<p>Patel stayed on after new CEO Carol Bartz got the top job in January, which was the <a href="http://kara.allthingsd.com/20090225/whither-ash-patel-can-longtime-yahoos-learn-new-tricks/">subject of much interest among longtime Yahoo staff</a>, since he has been one of the few true Yahoo veterans left in a high-ranking role.</p>
<p>In <a href="http://kara.allthingsd.com/20090226/new-yahoo-management-structure-the-entire-memo/">another reorg in late February</a>, this time by Bartz, Patel got his latest title and was placed under Balogh.</p>

			<content:encoded><![CDATA[<p>Now that both Microsoft and Apple have finally shipped the new versions of their operating systems, <a href="http://ptech.allthingsd.com/20091007/a-windows-to-help-you-forget/">Windows 7</a> and <a href="http://ptech.allthingsd.com/20090826/apple-changes-leopards-spots/">Snow Leopard</a>, respectively, it&#8217;s time for my annual fall computer-buying guide.</p>
<p>This guide stresses laptops, which have become the prevalent choice, but most of its specs also apply to desktops. As always, it is aimed at average consumers doing typical tasks, such as Web surfing, email, social networking, word processing, photos, video and music. It doesn&#8217;t apply to businesses, hard-core gamers or serious media producers—groups that need specialized or heftier hardware.</p>

<p>Consumers shopping for new computers this fall have a wide variety of choices with the new operating systems pre-installed, making the machines faster and better. Windows PCs are no longer burdened with the disliked Vista OS.</p>
<p>That&#8217;s the good news. The bad news is that the Windows hardware makers and retailers generally are trying to nudge you to spend more. They are anxious to guide consumers away from the popular, but low-profit, stripped-down netbooks to somewhat larger Windows 7 laptops from which they can make more money. This larger-size category goes by a variety of names, which can be confusing.</p>
<p><strong>Windows vs. Mac: </strong>The arrival of Windows 7 makes PCs from Hewlett-Packard (HPQ), Dell (DELL) and others much better choices than their Vista-equipped predecessors were. Microsoft (MSFT) has closed most of the gap with Apple&#8217;s (AAPL) Mac OS X operating system. Also, Windows PCs are often priced hundreds of dollars lower than Macs, and offer many more choices.</p>
<p>But Apple&#8217;s hardware is stylish and sturdy, and, in my tests, Macs usually boot faster than Windows machines. Plus, Apple&#8217;s chain of retail stores offers a better buying experience and strong post-purchase support. Also, in my view, Apple&#8217;s built-in software still has the edge. Snow Leopard is fast and reliable. And it comes with a full suite of excellent built-in programs, including email, photo and video software. Microsoft has stripped Windows 7 of such programs. Some PC makers have restored some or all of these in certain models, although I consider Apple&#8217;s counterparts better. Another huge plus: The Mac isn&#8217;t susceptible to the vast majority of viruses and spyware.</p>
<p><strong>Cost: </strong>Prices on Windows PCs are creeping upward. You can buy a Windows PC for under $500, but many stores are pushing costlier models. And those $250 netbooks are much scarcer. Now, they typically run between $300 and $450. Apple has mostly stuck with its same, higher, prices, though it has boosted the specs on many models. The cheapest Mac desktop, the minimalist Mac mini, is $599. The cheapest Mac laptop, the new MacBook, is $999. The heart of Apple&#8217;s line starts at $1,199.</p>
<p><strong>New category:</strong> Windows PC makers this season are pushing a category of laptop that is meant to fit between a netbook and a full-size laptop. It goes by a variety of confusing names, such as &#8220;ultrathin&#8221; or &#8220;thin and light,&#8221; though these models are often no thinner or lighter than some laptops of the past. They typically cost between $500 and $800, and often have 13-inch  screens.</p>
<p><strong>Memory: </strong>All Macs come with at least two gigabytes of memory, which is plenty for running Snow Leopard well. Mainstream Windows PCs have at least three gigabytes. But the cheapest Windows machines sometimes come with less. I recommend at least two gigabytes.</p>
<p><strong>64-bit: </strong>PCs have long been based on something called a 32-bit architecture, but many models now use a 64-bit architecture, allowing properly written software to use more memory and run faster. If possible, buy a 64-bit computer, which is likely to dominate eventually, even though some software and add-on hardware may be incompatible at first.</p>
<p><strong>Graphics: </strong>The new operating systems allow software makers to speed up some tasks by offloading them from the main processor onto the graphics chip. So, if possible, get a &#8220;discrete&#8221; graphics processor, which has its own memory. Otherwise, find a potent &#8220;integrated&#8221; graphics chip, which shares your main memory.</p>
<p><strong>Processor: </strong>Mainstream Windows PCs sport fast, dual-core processors from Intel (INTC) or its rival, AMD (AMD). These pack the equivalent of two brains onto one chip. But many lower-price Windows PCs have slower processors, such as the Intel Atom, which are best suited for light duty. Apple models all use Intel&#8217;s dual-core processors, except for the highest-priced desktops, which come with quad-core chips.</p>
<p><strong>Hard disks:</strong> A 250-gigabyte hard disk should be the minimum on most PCs. On a netbook, look for at least a 160-gigabyte disk. Solid-state disks are faster and use less battery power, but often add hundreds of dollars to the price tag.</p>
<p><strong>Touch: </strong>Windows 7 lets you control the computer by touching the screen with your fingers, and some PC makers add their own touch-screen features. But this only works fully with newer types of touch screens, adding cost. Make sure any touch-screen model you buy has a full multitouch screen that supports all Windows 7 gestures. Apple uses the laptop touch pad, or its new mouse, as the multitouch, finger-gesture mechanism, instead of the screen. </p>
<p>As always, don&#8217;t buy more machine than you need.</p>

			<content:encoded><![CDATA[<p class="question"> I&#8217;m looking to purchase a laptop, and I am quite intrigued with the newer touch-screen models. Do you know when there will be more of these available, especially with larger screens?</p>
<p>A: You will begin to see more touch-screen laptops after Oct. 22, when Windows 7 comes out, because that new operating system has optional fingertip touch-screen navigation built in. In addition, many of the major Windows PC makers are adding their own touch-navigation systems to newer models.</p>
<p>However, I&#8217;d offer two caveats. First, not every touch screen will be capable of performing all the multitouch actions and gestures Windows 7 will offer. Some are more limited in their capabilities.</p>
<p>Second, the hardware makers will likely be cautious at first about adding fully capable touch screens to all or most of their laptops.</p>
<p>This is partly because these screens can add significant cost in a price-conscious market, and partly because nobody is certain how popular touch-screen navigation will be on laptops as opposed to, say, on all-in-one desktops where reaching for the screen is more obvious and natural.</p>
<p class="question"> I have an Apple iMac, and an Apple iPhone with around 122 apps. My question is, why don&#8217;t these iPhone apps work on the iMac? Both units use the same operating system, so why not?</p>
<p>A: While the iPhone and the iMac each use a version of the same operating system, Apple&#8217;s OS X, they aren&#8217;t the same operating systems. The version on the iPhone is stripped down, and has been modified to support an entirely different user interface, navigation system and set of hardware capabilities.</p>
<p>So there are two separate collections of apps, or programs, that run on the two platforms.</p>
<p class="question"> I am currently running Windows Vista Ultimate on my Dell PC. I have regretted it ever since I upgraded from XP because of its terribly slow performance. I have heard good things about Windows 7 but I am afraid I will have to buy the more expensive Ultimate upgrade (which I don&#8217;t really need) instead of an upgrade to Home Premium or Professional. Is that true?</p>
<p>A: According to Microsoft, owners of Vista Ultimate can only perform an &#8220;in-place upgrade&#8221; to Windows 7 Ultimate, not to lesser versions. An &#8220;in-place upgrade&#8221; is the type most people think of, the type where all your programs and files and settings are preserved just as they were, but you emerge with the new operating system.</p>
<p>Even then, you must be careful to buy the edition of Ultimate that matches the type of architecture your machine possesses, either 32-bit or 64-bit.</p>
<p>However, you can downgrade to the Home Premium or Professional versions of Windows 7, if you are willing to do a lot more work, by opting for what Microsoft calls a &#8220;custom installation,&#8221; something commonly known as a &#8220;clean install.&#8221; This typically means, first, backing up all your files and settings to an external hard disk, then allowing the Windows 7 installation disk to wipe your hard disk clean before installing your preferred version of Windows 7.</p>
<p>You would then copy back all your files. But you cannot do the same with your programs. For these, you would have to reinstall every one, from their original disks or downloaded installation files, and then download and re-install all the patches and program upgrades that have been issued by their makers since you acquired them.            </p>

<p>Confused? Don&#8217;t worry&#8211;the world&#8217;s search pros are trying to figure out the difference between plain-vanilla Google and the new version, which Google (GOOG) is previewing via a <a href="http://googlewebmastercentral.blogspot.com/2009/08/help-test-some-next-generation.html">blog post</a>.</p>
<p>Google engineers tell us that Caffeine is a &#8220;a secret project: a next-generation architecture for Google&#8217;s web search,&#8221; but don&#8217;t expect to see any obvious differences in the new approach, even though Google says it will &#8220;push the envelope on size, indexing speed, accuracy, comprehensiveness and other dimensions.&#8221;</p>
<p>Or so the company says. Put the two engines up in a head-to-head test and you will see slightly different results, but only if you squint at them closely: My <a href="http://www2.sandbox.google.com/#hl=en&amp;q=peter+kafka&amp;aq=f&amp;oq=&amp;aqi=&amp;fp=68WRWBJ5ZlA">vanity search</a> replaces my <a href="http://www.google.com/url?sa=t&amp;source=web&amp;ct=res&amp;cd=1&amp;url=http%3A%2F%2Fpeterkafka.blogspot.com%2F&amp;ei=TEqBSsiHC6m_twf-_OnHCg&amp;usg=AFQjCNGhWTJAgrCtMLGZ-f6qQSkEdi-r4Q&amp;sig2=gwlc-RJvD1fn09SYgKWn0Q">personal blog</a> with my <a href="http://www2.sandbox.google.com/url?sa=t&amp;source=web&amp;ct=res&amp;cd=1&amp;url=http%3A%2F%2Fmediamemo.allthingsd.com%2F&amp;ei=REqBSuK5LYnIMLC_vfwH&amp;rct=j&amp;q=peter+kafka&amp;usg=AFQjCNEigJYm9TG71kzyjD55RIFYk1bb5A&amp;sig2=CHqAj0azJTEZubySQ4uSFQ">work site</a> as the top result and doesn&#8217;t include image results on the first page, which is probably a good thing.</p>
<p>And sometimes new Google gives you more results, or fewer results, than old Google. But since the vast majority of searchers never get past the first page of results, this doesn&#8217;t seem relevant. Same with the supposed speed differences: Google tells me that <a href="http://www2.sandbox.google.com/#hl=en&amp;q=blackberry+tour&amp;aq=f&amp;oq=&amp;aqi=g-p3g7&amp;fp=68WRWBJ5ZlA">this search for &#8220;BlackBerry Tour&#8221;</a> came back in 0.14 seconds, compared to <a href="http://www.google.com/search?hl=en&amp;client=firefox-a&amp;rls=org.mozilla%3Aen-US%3Aofficial&amp;q=blackberry+tour&amp;aq=f&amp;oq=&amp;aqi=g-p3g7">this one</a>, which took a whopping 0.19 seconds. But I&#8217;m going to have to take its word on this.</p>
<p>If today was April 1, I&#8217;d be wary that Google was pulling our leg here and trying to pull off some meta-prank. Maybe one that involved getting lots of bloggers&#8211;or more importantly, engineers from Microsoft (MSFT) and Yahoo (YHOO)&#8211;to spend time deciphering the differences between two search engines that weren&#8217;t actually different at all. But you don&#8217;t do that sort of thing in mid-August, right?</p>

			<content:encoded><![CDATA[<p>This week&#8217;s Mailbox is devoted to the most common of the hundreds of questions I received in response to last week&#8217;s Personal Technology column describing how difficult and time-consuming it will be to upgrade a Windows XP computer to Microsoft&#8217;s forthcoming Windows 7 operating system.</p>
<p class="question">To avoid the difficulties you described last week with migrating from Windows XP to Windows 7, what do you think about a two-step approach whereby we buy Vista, upgrade from XP to Vista, and then go from Vista to Windows 7?</p>
<p>That would work, since&#8211;unlike those running XP&#8211;PCs running Vista can be upgraded to Windows 7 directly, without wiping their hard drives, displacing any files or re-installing any programs. </p>
<p>However, you&#8217;d be doing twice the work and paying for two new versions of Windows instead of one.</p>
<p class="question">If I bought a Vista computer, but had it downgraded at the factory to XP, will my situation be any different than what you described should I choose to migrate to Windows 7?</p>
<p>According to Microsoft, the answer is no. Your computer is now a Windows XP computer, and thus still has no direct upgrade path to Windows 7. You would still have to remove and later restore your personal files, wipe your hard disk clean, and then re-install all your programs. However, if you received Windows Vista installation disks with the machine, you could upgrade it to Windows Vista first, and then, upgrade it directly to Windows 7, a process that doesn&#8217;t require any of those cumbersome steps.</p>
<p class="question">Does the difficult scenario of moving from Windows XP to Windows 7 that you described last week also apply to those of us who run XP on Macs in virtual-machine programs like Parallels or Fusion?</p>
<p>Yes. Microsoft says the same migration steps are necessary whether the Windows XP computer is physical or virtual, and that includes Macs running XP via the Parallels or Fusion software. </p>
<p>It also applies if you are running XP on a Mac using Apple&#8217;s Boot Camp program and wish to move to Windows 7. </p>
<p class="question">After Windows 7 comes out in October, will Microsoft somehow force us XP users to stop using it? Is there any reason I have to upgrade, or can I keep using XP, which meets my needs perfectly?</p>
<p>You can keep using Windows XP and all your current programs on your current computer. It won&#8217;t suddenly expire.</p>
<p class="question">Especially in light of how hard it will be to upgrade, can you please explain what advantages Windows 7 will have over XP, which is tried and true? I deliberately skipped Vista and am inclined to skip this new Windows version as well.</p>
<p>People should never feel stampeded to upgrade their technology and should keep using whatever meets their needs and makes them comfortable. </p>
<p>However, based on my testing of pre-release versions of Windows 7, I would say it is significantly better than XP, which, after all, was designed a decade ago, an eternity in computer time.</p>
<p>I&#8217;ll cite just a few examples. Microsoft says that Windows 7 is more secure than XP, because its underlying architecture allows more defenses against malicious software than in the older product. Microsoft claims, and my tests bear out, that Windows 7 makes networking computers much simpler, quicker and more reliable than XP does. And the company says that Wi-Fi networks work better and faster than they do with XP.</p>
<p>I would add that, if Windows 7 catches on in a way that Vista didn&#8217;t, you may gradually find that new software and hardware makers will stop bothering to make their products compatible with XP, though this process will take years.</p>

So slow that the U.S. Army is planning a major upgrade of its information systems&#8211;<a href="http://www.army.mil/-news/2009/05/20/21389-army-migrating-computers-to-vista/"> to Microsoft’s  (MSFT) Windows Vista OS</a>.</p>
<p>Though Windows 7 is expected at market by the end of the year, the United States military has set that as a deadline for its migration from Windows XP to the <a href="http://ptech.allthingsd.com/20070118/vista-worthy-unexciting/">&#8220;worthy, but largely unexciting&#8221;</a> Windows Vista and from Office 2003 to Office 2007.</p>
<p>The Army has been testing Vista since 2006 and its decision to move forward with a migration of its  744,000 desktops&#8211;on both classified and unclassified networks&#8211;was apparently driven by the OS’s improved security. &#8220;First, they see real value in Windows Vista&#8217;s improved security architecture,&#8221; <a href="http://news.cnet.com/8301-13860_3-10246768-56.html">Microsoft senior director Gavriella Schuster said in a statement</a>. &#8220;Second, it shows large organizations have unique needs and timetables for deployment. These things take time&#8211;they have been rigorously testing internally&#8211;and it makes sense that they have approached deployment in a measured and well-planned way, especially given the number of seats they are migrating to Windows Vista.&#8221;</p>

			<content:encoded><![CDATA[<p>In a really fine <a href="http://www.nytimes.com/2007/11/20/arts/design/20time.html?_r=1&#038;oref=slogin">review of the New York Times&#8217; new headquarters building</a>, which appeared in that paper yesterday, the critic Nicolai Ouroussoff made some interesting observations about the interplay of the design with current digital trends.</p>
<p>The 52-story skyscraper, only part of which is used by the famed newspaper, was designed by Italian architect Renzo Piano and is located between 40th and 41st Streets in midtown Manhattan.</p>

<p>He wrote:</p>
<blockquote><p>Journalism, too, has moved on. Reality television, anonymous bloggers, the threat of ideologically driven global media enterprises&#8211;such forces have undermined newspapers’ traditional mission. Even as journalists at the Times adjust to their new home, they worry about the future. As advertising inches decline, the paper is literally shrinking; its page width was reduced in August. And some doubt that newspapers will even exist in print form a generation from now.</p>
<p>&#8220;Depending on your point of view, the Times Building can thus be read as a poignant expression of nostalgia or a reassertion of the paper’s highest values as it faces an uncertain future. Or, more likely, a bit of both.&#8221;</p></blockquote>
<p>It&#8217;s an interesting insight about the changing nature of traditional journalism, whose very architecture might be shifting (more open and transparent) as its business does.</p>
