Cashing Out Start-Ups Gets More Complicated

For acquisitions of private companies backed by venture capital, it’s becoming increasingly complicated to collect cash after the deal has been signed. In contrast to a decade ago, when many such deals went through with little trouble, today’s venture-backed acquisitions are fraught with landmines that can result in delayed payments and reduced purchase prices long after the deal has been struck, say venture capitalists, entrepreneurs and deal attorneys.

SAP: Please Gag Oracle

With hearings in its intellectual property battle with Oracle set to begin on Nov. 1, SAP is steeling itself for what promises to be some raucous gladiatorial litigating. Last Friday, the company asked a California court to slap a gag order on Oracle’s legal counsel ahead of the trial, which will determine the damages SAP will pay for its TomorrowNow division’s admitted theft of Oracle intellectual property.

Google Asks Court to Toss Oracle’s Android Lawsuit

Silicon Valley’s latest Goliath versus Goliath battle is officially on. Google today responded to Oracle’s claims that its Android OS infringes copyrights and patents related to Java, which Oracle acquired as part of its purchase of Sun Microsystems earlier this year. This morning, the search sovereign filed an answer to Oracle’s suit, denying all seven of its patent-infringement charges, and asking that the company’s copyright-infringement claim be dismissed because Google feels it is “legally deficient.”
