		<description><![CDATA[Didn't watch MTV's award show? No need.]]></description>
			<content:encoded><![CDATA[<p>Big live events like sports and award shows are supposed to be TV&#8217;s antidote to eyeball-shrinking technology like DVRs and Web video. If you want to enjoy the next day&#8217;s watercooler banter, the theory goes, you have to watch them live.</p>
<p>But I find that it&#8217;s easier than ever to be fully informed about What Was On The Teevee Last Night without ever turning on the set. Twitter, in particular, is good/bad about this &#8212; even if I have no interest in, say, last night&#8217;s MTV Video Music Awards, my feed makes sure I&#8217;ve got all the relevant info.</p>
<p>In case your Twitterfeed doesn&#8217;t look like mine, there were two big take-aways:</p>
<p>A) Beyonce looks pregnant and is encouraging everyone to believe that this is the case.</p>
<p>B) Adele, the only person in the world who is selling lots of recorded music these days, gave the night&#8217;s best performance.</p>

<p>Obligatory digital media business notes:</p>
<ul>
<li>The part where Twitter gives me the ability to learn about stuff that happened 12 hours ago is a little different from <a href="http://allthingsd.com/20110212/howard-stern-and-twitter-just-made-me-watch-private-parts-again/">Twitter&#8217;s current pitch to TV programmers and advertisers</a>. Dick Costolo and company like to argue that <a href="http://allthingsd.com/20110410/twitter-loves-tv-and-the-feeling-is-mutual/">Twitter makes live TV <em>more</em> essential</a>. The two ideas aren&#8217;t mutually exclusive &#8212; it&#8217;s possible that Twitter actually does boost live TV ratings at the same time it makes catch-up easier &#8212; but since there&#8217;s a lot less money in the catch-up business than in the live TV business (see: Hulu) you won&#8217;t hear much about that.</li>
<li>Easy to forget, but true &#8212; MTV parent <a href="http://allthingsd.com/20101203/viacom-asks-for-a-do-over-on-youtube/">Viacom is still suing Google and YouTube</a>. Which means that the clip I provided above should be hard to find, at the very least. But this one popped up as the second result under &#8220;Adele&#8221; on YouTube this morning.</li>

			<content:encoded><![CDATA[<p><a href="http://mediamemo.allthingsd.com/files/2010/02/vizio-ad.png"><img class="alignright size-medium wp-image-16052" title="vizio ad" src="http://mediamemo.allthingsd.com/files/2010/02/vizio-ad-275x160.png" alt="" width="275" height="160" /></a>Yep, Google did indeed take out its <a href="http://twitter.com/ericschmidt/status/8738388895">first Super Bowl ad</a> last night&#8211;a tweaked version of the<a href="http://mediamemo.allthingsd.com/20100125/google-advertises-google-advertising/"> &#8220;Search Stories&#8221; clip it has been showing on the Web for several months</a>.</p>
<p>But Google also got a second promotion during last night&#8217;s game, though I&#8217;m guessing it didn&#8217;t pay for this one. An ad promoting Internet-connected TVs from Vizio featured a battery of viral video stars made famous via Google&#8217;s YouTube&#8211;without ever mentioning Google (GOOG) or YouTube by name.</p>
<p>The spot does give formal, if very fast, shoutouts to Web services like Facebook, Pandora, Twitter, Vudu, Yahoo (YHOO) and Yahoo&#8217;s Flickr. Oh. And Beyonc&eacute;.</p>

<p>Swing and a miss, in my humble amateur advertising critic&#8217;s opinion.</p>
<p>For one thing, anyone who&#8217;s going to recognize the likes of Tay Zonday and the Numma Numma guy knows that the whole &#8220;cramming all of YouTube&#8217;s stars into one bit&#8221; bit has been done by lots of people before, most notably <a href="http://mediamemo.allthingsd.com/20100104/oh-my-god-they-still-havent-deposed-kenny/">South Park</a>. Everyone else will just wonder who the fat kid and the skinny dude are.</p>
<p>The other problem with this ad is one common to many efforts to sell Internet-connected TVs: It doesn&#8217;t explain the most compelling use for these things.</p>
<p>Because you may not want to watch YouTube on your big screen (or to use Twitter or call up Pandora, etc.). But you may very well want to watch streaming movies and TV shows from services like Netflix (NFLX) and Vudu.</p>
<p>You&#8217;d have to squint very hard to see that the Vizio spot was showing a clip from &#8220;The Hangover,&#8221; though. And chances are that almost no one who saw the ad has heard of Vudu (hence its <a href="http://mediamemo.allthingsd.com/20100112/is-wal-mart-ready-to-try-web-tv-again-with-vudus-help/">sale talks</a>).</p>
<p>So there&#8217;d be no way for anyone to know that Internet-connected TVs make this stuff really easy. Too bad. If you see this stuff demoed in person, it&#8217;s really compelling&#8211;it gets close to the <a href="http://d7.allthingsd.com/20090527/d7-interview-liberty-medias-john-malone/">&#8220;500 channels&#8221;</a> pitch we used to hear about in the early 90s, in the best possible way.</p>
<p>At some point in the next few years, there will be no <em>need</em> to pitch this, because the majority of new TVs sold will be Internet-connected. In the same way HD is now more or less standard on new sets.</p>
<p>But for now, this stuff is still a novelty. A good way to change this might be with an effective ad.</p>

<p>While an iPad out in the wild&#8211;held up by Stephen Colbert&#8211;got a lot of ink, here&#8217;s a video from last night&#8217;s Grammy Awards, which went all &#8220;Avatar&#8221; during a tribute to the late Michael Jackson&#8211;when a panoply of belt-it-out singers performed one of his posthumous songs with a 3-D twist.</p>

			<content:encoded><![CDATA[<p>Indie rockers Nataly Dawn and Jack Conte are pioneers in the new VideoSong movement, soon to hit a computer near you. The Stanford University graduates in the summer of 2008 formed the band Pomplamoose, recording high-energy video covers of popular tunes like Beyonce’s “Single Ladies” and Michael Jackson’s “Beat It.” Filmed and recorded out of Conte’s childhood bedroom (his old blankets double as sound dampeners on the wall), the videos make use of clever editing and split screens to show off Dawn on vocals and Conte playing one of the two-dozen instruments lying around the room.</p>
<p>Inspired by the avant-garde Dogme 95 movement in cinema, Conte says he started recording songs on video about two years ago as a quick way to create music that felt “organic and raw,” he says. He made up the word “videosong” and attached some rules to it: No lip-synching for instruments or voice, and no hidden sounds&#8211;what you see is what you hear.</p>

But that doesn&#8217;t mean Viacom and Google (GOOG) can&#8217;t work together to prevent the cable giant&#8217;s videos from showing up on YouTube.</p>

Go to YouTube and try to find a clip of the <a href="http://mediamemo.allthingsd.com/20090914/the-internet-loves-mtv-taylor-swife-and-kanye-west-but-youtube-keeps-its-distance/">Kanye West/Taylor Swift/Beyonc&eacute;</a> incident from Sunday night&#8217;s Video Music Awards. Everyone&#8217;s still talking about it (I don&#8217;t know why, really, but I guess I&#8217;m out of the demo), but if you want to watch it on YouTube, you&#8217;re stuck watching <a href="http://www.youtube.com/results?search_type=videos&amp;search_query=kanye&amp;search_sort=video_date_uploaded">shaky, grainy footage</a> created when people film their TV sets with a camcorder.</p>
<p>That&#8217;s the result of Viacom (VIA) and YouTube using the site&#8217;s <a href="http://www.youtube.com/t/contentid">Content ID system</a>&#8211;which YouTube installed after Viacom filed suit more than two years ago. Content ID allows YouTube to track copyrighted material on the site as long as the copyright owner tells it what to look for.</p>
<p>It&#8217;s not a plug-and-play solution: On Sunday, Viacom had to have staff work through the night to provide YouTube with &#8220;reference files&#8221; from the live show so that the Google&#8217;s video service could find the offending clips and take them down.</p>
<p>But it worked pretty well. Decent-quality clips of the Kanye incident were taken down fairly quickly, and the grainy shots had only generated some 700,000 views by Monday afternoon, according to video-tracker <a href="http://www.tubemogul.com/">TubeMogul</a>. Meanwhile, <a href="http://www.mtv.com/videos/misc/435995/taylor-swift-wins-best-female-video.jhtml#id=1620605">MTV&#8217;s official version</a> was approaching two million views (it&#8217;s now above three million).</p>
<p>You could argue that both Google and MTV would be better served if the official clip was on YouTube. And one day, that might happen. But first, they have to settle their court case.</p>
<p>That looks less likely today than it did a week ago, by the way, because of the recent ruling in the <a href="http://mediamemo.allthingsd.com/20090914/universal-music-gets-slapped-in-court-what-does-that-mean-for-veoh-and-youtube/">Universal Music/Veoh</a> case. Team Viacom says the case, which appears to be quite similar to its own, won&#8217;t have any bearing on the how the company proceeds, while the YouTube guys see it as an affirmation of their position. Translation: More legal back and forth and fewer Viacom clips on the world&#8217;s biggest video site.</p>
<p>Here&#8217;s one of the low-fi versions, by the way. Not recommended if you&#8217;re prone to motion sickness:</p>

<p>A couple of years ago, it was <a href="http://www.businessinsider.com/2007/9/thanks-britney-">Britney Spears wobbling across the stage</a>; this time around, it&#8217;s Kanye West interrupting Taylor Swift on behalf of Beyonc&eacute; and&#8230;pfft.</p>
<p>I can&#8217;t work up the enthusiasm to describe it, but happily for Viacom (VIA), MTV&#8217;s corporate parent, there are plenty of people who will do that for you: The story is dominating <a href="http://search.twitter.com/">Twitter</a> and <a href="http://www.google.com/trends">Google</a> (GOOG), and it&#8217;s the lead story on <a href="http://m.www.yahoo.com/">Yahoo&#8217;s (YHOO) front page</a>.</p>
<p>You can also see the incident on <a href="http://www.youtube.com/results?uploaded=d&amp;search_query=vmas&amp;search=tag&amp;search_type=videos">Google&#8217;s YouTube</a>, of course. But you&#8217;ll have to do a little bit of hunting since Viacom clips aren&#8217;t supposed to be on the most popular video site in the world&#8211;because Viacom is still suing Google and YouTube for $1 billion.</p>
<p>Remember that copyright case? It&#8217;s still motoring along, slowly but steadily: Executives from both companies are still being deposed, and if things keep moving forward, there will actually be a trial in 2010&#8211;some three years after Viacom filed its first complaint.</p>
<p>In any case, here&#8217;s the official version, served up by <a href="http://www.mtv.com/videos/misc/435995/taylor-swift-wins-best-female-video.jhtml#id=1620605">MTV</a>, which says it has generated more than  1.1 million views of the clip since last night.</p>

TuneUp Media and MusicBrainz Picard aim to clean up and properly label personal digital-music collections.]]></description>
			<content:encoded><![CDATA[<p>My digital music collection is over a decade old, and it’s as disorderly as a drawer of mismatched socks.</p>
<p>Many songs are missing the correct album titles and cover art—or just show up in Apple Inc.’s (AAPL) iTunes with mysterious names like “Track04.” Over the years I’ve used several programs to import and buy music, resulting in wild inconsistencies in my collection. I’ve got songs by Beyoncé (with accent), Beyonce (without accent), Beyoncé Knowles (with accent) and Beyonce Knowles (without accent).</p>
<p>Several companies have developed programs that tap into vast databases of songs to tame music collections. I’ve been testing one by San Francisco startup TuneUp Media that’s available to download online and buy in Apple’s stores. While I was reluctant to pay $19.95 for a year’s subscription to a service I reckon should be in iTunes for free, TuneUp has largely delivered on its promise to scrub my music collection with minimal effort, making sure tracks were properly titled and adding extras like album cover art.</p>
<p>TuneUp’s greatest asset is that it works seamlessly with iTunes (for Mac and PC). With TuneUp hooked on to the right side of the iTunes program, you drag “dirty,” or mislabeled, songs into a box identified by a spray bottle of cleaner. The software identifies songs by taking clues from information you’ve embedded in your music, as well as sampling the song’s digital fingerprint. TuneUp looks for a match to those clues in a database of songs maintained by Sony Corp.’s (SNE) Gracenote.</p>
<p>Some matches are a slam dunk, but almost half of my collection proved to be problematic. Of the 500 most-played songs in my pop-oriented collection, TuneUp found “matches” for songs across 79 albums and “likely matches” for songs across 209 albums. It couldn’t identify 10 songs. The company says it counts matches as a 90% or higher chance of a match, and “likely” as at least 75% chance of a match. Songs with a likelihood under 75% are labeled “not found.”</p>
<p>TuneUp gives you the chance to review each of the matches before it adjusts your catalog. (It comes with an undo button.) Accepting all of the sure matches is easy enough, but slogging through the likely matches is troublesome. TuneUp gives you only the option to accept or reject its one recommendation after listening to the file, if you want.I worried that I might be inadvertently mislabeling a song, but haven’t yet found evidence of errors in my collection. The company says it cut out alternative matches to simplify the cleaning process, but is working on adding them to future releases of the software.</p>
<p>Once a song has been cleaned by TuneUp, it is given a consistent name, track number, album cover and other helpful information, such as the year it was released. Now I’ve got songs by just Beyoncé (with accent) and almost all of my songs feature the album cover art that looks so nifty on iPhone screens. The software assigns your songs genre identifications, which can be handy for matching music to your mood. Most of the classifications aren’t terms I would have come up with: Beyoncé is dubbed “urban crossover,” while Michael Jackson is either “disco” or “other pop” depending on the era—but at least they’re consistent. You also can tell TuneUp not to change any specific part of a song’s existing catalog listing, including genre.</p>

<p>TuneUp takes a few seconds, depending on your computer and Internet speed, to identify and re-classify each song. Attempting to scrub a whole collection—mine has more than 10,000 songs—can be a lengthy affair. The company suggests cleaning 500 songs at a time, but you can do many more than that if you leave it running over night.</p>
<p>I tried out a free competitor to TuneUp called MusicBrainz Picard, which matches songs based on a database collected by a swarm of Internet users, rather than one particular company. TuneUp and MusicBrainz, which is run by a nonprofit, are as different as Britannica and Wikipedia in their approaches to cataloging information.</p>
<p>The MusicBrainz approach to building a user-generated database is powerful and has been tapped by companies such as the BBC and Amazon.com (AMZN) to improve the way they keep track of music on their sites. Some of my songs that TuneUp couldn’t identify, such as the song “This Way” by hip hop group Dilated Peoples, were a breeze for MusicBrainz. To date, MusicBrainz has about 700,000 “releases” (such as whole albums) and 8,000,000 individual “tracks” in its database.</p>
<p>But MusicBrainz’s database has limitations, such as the inability to catalog album-cover images or song lyrics, both of which are copyrighted material. The free Picard program lets you tap the MusicBrainz database from your own computer. Serious music fans will be attracted to Picard because it is more precise than TuneUp; Picard guides you to choose from a variety of options when it isn’t certain of a match. But the software is rudimentary and requires concentration and time to use. Picard also doesn’t connect directly into iTunes’ catalog. To use it with iTunes, you have to first clean up all of your music files with Picard and then re-import your songs into iTunes.</p>
<p>I recommend TuneUp for the average music fan who might view cleaning up a music collection as the sort of task that shouldn’t take much longer than one rainy Sunday afternoon. Picard is better for people for whom maintaining an orderly music collection is a never-ending project.</p>
<p>TuneUp comes with a feature called “Tuniverse,” which fills the right side of the screen with information related to whatever song iTunes is playing at the time. That information includes YouTube videos, biographical details from Wikipedia, Google (GOOG) News, music recommendations from Amazon and tickets from StubHub to coming concerts in your area. While I initially worried Tuniverse would feel like added advertising on the screen, I’ve come to enjoy the extra information. And once again, I was left wondering why Apple hasn’t built these capabilities directly into iTunes. I, for one, learned from Tuniverse that Beyoncé has a concert in San Francisco next week, and I just might buy a ticket.</p>

More of a somber memorial, really: There&#8217;s a special exhibit at Sony&#8217;s archive, but that&#8217;s about it.</p>
<p>Why so reserved? Maybe it&#8217;s because Sony (SNE) is <a href="http://digitaldaily.allthingsd.com/20090514/sony-earnings-fall-from-ugly-tree-hit-every-branch-on-the-way-down/?mod=ATD_search">struggling</a> through yet  another <a href="http://digitaldaily.allthingsd.com/20090227/all-hail-sir-howard-king-of-sony/?mod=ATD_search">restructuring</a>, so a big party would seem inappropriate. Maybe because Sony views the Walkman&#8217;s birthday as a lot of middle-aged people view their birthdays: Markers of bygone eras and missed opportunities. Or else it&#8217;s just Apple&#8217;s (AAPL) fault. <a href="http://finance.yahoo.com/news/Sony-struggling-as-Walkman-apf-307060754.html?x=0&amp;.v=3">Associated Press</a>:</p>
<blockquote class="memo"><p>The manufacturer, which also makes Vaio personal computers and Cyber-shot cameras, hasn&#8217;t had a decisive hit like the Walkman for years, and has taken a battering in the portable music player market to Apple Inc.&#8217;s iPod.</p>
<p>Sony has sold 385 million Walkman machines worldwide in 30 years as it evolved from playing cassettes to compact disks then minidisks &#8212; a smaller version of the CD &#8212; and finally digital files. Apple has sold more than 210 million iPod machines worldwide in eight years&#8230;.</p>
<p>The archival exhibit shows other Sony products that have been discontinued or lost out to competition over the years &#8212; the Betamax video cassette recorder, the Trinitron TV, the Aibo dog-shaped robotic pet.</p></blockquote>
<p>I do remember hearing some Sony folks mutter hopeful words about a new line of Walkmans that came preloaded with music from Sony artists like Beyonc&eacute; and were supposedly flying off the shelves at Wal-Mart (WMT). But that was a while ago, come to think of it, and I haven&#8217;t heard about it since.</p>

<p>And they are also posting a lot of original online videos, especially at <a href="http://www.youtube.com/user/JonasBrothersMusic">their YouTube channel</a>.</p>
<p>Unfortunately, the digital hawking includes the one below, which is due to some fan request that has landed Joe Jonas in spike heels and a leotard, doing a bizarre dance interpretation of Beyoncé&#8217;s infectious and very viral music video, &#8220;Single Ladies (Put A Ring On It).&#8221;</p>
<p>After that video soared last fall, a lot of fans did their own versions, including a very funny spoof by Justin Timberlake, essentially doing the same gig as Jonas (except funny).</p>
<p>But, you be the judge.</p>
<p>Here are all three: Beyoncé in the original, TImberlake in the spoof (a bad version&#8211;sorry) and Joe Jonas in, well, it is hard to describe:</p>

So, rather than be on the edge of your seat about all these endless, alleged late-stage high jinks, here is a five-step list to cut out and keep when the questionable rumors of "late-stage negotiations" with Microsoft, News Corp., Verizon, Cisco and more inevitably show up.]]></description>

<p>Not so much late-stage, I guess, with a gestation period that seems <em>interminable</em> (and BoomTown has been there, so can speak from experience about interminable pregnancies).</p>
<p>In fact, I&#8217;m still waiting for the Google (GOOG) takeover news floated inaccurately back then to cross our desk at <strong>All Things Digital</strong> HQ, although it&#8217;s more likely Godot will show up first.</p>

<p>In fact, both Twitter co-founders, Evan Williams and Biz Stone, are in New York today to attend the 2009 &#8220;Time 100&#8243; dinner, which fetes this year&#8217;s influential people honorees selected by the magazine. <a href="http://www.time.com/time/specials/packages/article/0,28804,1894410_1893837,00.html">Which they are</a>.</p>
<p>So, if they are in serious talks with Apple, they better grab that award and head on home <em>tout de suite</em>.</p>
<p>In point of fact, <a href="http://kara.allthingsd.com/20081124/when-twitter-met-facebook-the-acquisition-deal-that-fail-whaled">talks with Facebook last year</a> were actually the only truly deep sale discussions that Twitter has been involved in, and those went south.</p>
<p>Oh, the very notion of Apple and Twitter is a Techmeme dream-ticket, sure to be chewed over for days on end. (I once considered doing a post that just said &#8220;AppleTwitterAppleTwitterAppleTwitter&#8230;&#8221; for 1,000 words to see how much idiotic traffic I would get.)</p>
<p>But given that it is too good to be true for now, rather than be on the edge of your seat about all these endless, alleged late-stage high jinks, here is a five-step list to cut out and keep when the rumors of &#8220;late-stage negotiations&#8221; with Microsoft (MSFT), News Corp. (NWS), Verizon (VZ), Yahoo (YHOO), Time Warner (TWX) online unit AOL, Comcast (CMCSA), Cisco (CSCO) and more inevitably show up.</p>

<p><strong>1.) Belle of the Geek Ball</strong></p>
<p>Everyone is indeed actually interested in buying Twitter and each has expressed a proper level of interest to the company&#8217;s execs&#8211;especially to over-contacted CEO Williams&#8211;about said interest.</p>
<p>And, because this is America, a bid for Twitter could come at any time and in any amount.</p>
<p>That&#8217;s why Apple has indeed said hello. Why Microsoft&#8217;s business development team has been busy formulating a valuation. Why Google&#8217;s M&#038;A guy, David Lawee, has called into Twitter&#8217;s HQ many times with kind expressions of desire. And why News Corp. execs, including Rupert Murdoch himself, have murmured tweet nothings to the Twitter team.</p>
<p>Please note: This is not the same thing as &#8220;late-stage negotiations.&#8221; Not at all; so don&#8217;t believe such things, as you will see this one coming down the pike for miles (see Step #4 below).</p>
<p>If there ever were an Apple deal to be done, it would not be living in some tidy vacuum.</p>
<p>For example, does one imagine Google CEO Eric Schmidt&#8211;who is on the Apple board, <a href="http://digitaldaily.allthingsd.com/20090505/time-to-give-up-that-apple-board-seat-eric/">much to the FTC&#8217;s chagrin</a>, it seems&#8211;would decline to enter the fray? Oh, he&#8217;d be up to his conflicted eyebrows in it at this point.</p>
<p>(Full disclosure: <strong>ATD</strong> is also considering making a bid for Twitter, but only if I get to name who is called Chief Twit.)</p>
<p><strong>2.) We Feel Pretty, Oh So Pretty</strong></p>

<p>Twitter&#8217;s Williams, as well as Stone, do not really want to sell just yet, given the huge traffic over the last year, goosed even further by the whole <a href="http://kara.allthingsd.com/20090416/i-cant-believe-i-am-now-following-ashton-kutcher-on-twitter-because-cnn-just-cannot-win/">Oprah-Ashton Kutcher axis of Tweetvil</a>.</p>
<p>Twitter is growing and growing and growing. Does that mean it has peaked or is just crossing over into the mainstream?</p>
<p><a href="http://kara.allthingsd.com/20090405/with-inbox-clogged-with-admirers-twitter-should-ignore-the-hype-and-get-back-to-work">I would say the latter</a> and so would its investors and execs.</p>
<p>I have done a lot of reporting and have found that most of them would like a chance to ride this rocket ship and see if they can prevent it from being a shooting star by figuring out some viable, innovative and lucrative business plan.</p>
<p>&#8220;Twitter really could make a lot of money,&#8221; said one investor. &#8220;And we are not just making that up either.&#8221;</p>
<p>Well, phew, because <a href="http://kara.allthingsd.com/20090305/twitter-business-plan-count-up-day-1">I have been a little worried</a> about that.</p>

<p><strong>3.) We&#8217;re Living in a Material World, and I Am a Material Girl</strong></p>
<p>That said, as Madonna sings, a pile of cash is a pile of cash and if one of the suitors makes a big move with $600 million or more in cash, it would be hard for Twitter to completely ignore such an offering.</p>
<p>But, in any case, there will be no late-stage negotiations with one player.</p>
<p>Instead, an epic free-for-all wrestling match to the death would break out among all of them, especially Google and Microsoft.</p>
<p>This will be great for me and all the other tech writers as it will be ugly, competitive and tailor-made for breathless reporting.</p>
<p>Google is the likely winner here, although Microsoft is quite intent on the possibilities of integrating Twitter technology with its business offerings.</p>
<p>Someone will, I can predict with certainty, lose an eye.</p>

<p><strong>4.) All the Single Ladies&#8230;Cuz if You Liked It, Then You Should Have Put a Ring on It</strong></p>
<p>And, even with that kind of offer&#8211;which I would take in a New York minute, as would some Twitter investors&#8211;<a href="http://kara.allthingsd.com/20090414/twitters-co-founders-evan-williams-and-biz-stone-speak">there is a sense when you talk to Twitter&#8217;s founders</a> and investors that they truly believe they are onto some very important interactive communications paradigm shift in the Internet arena with their start-up.</p>
<p>I would have to agree given that the real-time and status-update concepts that Twitter has perfectly touched on are a very important one.</p>
<p>Thus, Twitter would prefer to remain independent for now.</p>
<p>Whether Twitter will prevail or not is never assured, but it would be really a shame if it gave up before the story was over.</p>

<p>Let&#8217;s be honest: There is no real downside here for Twitter.</p>
<p>If the service turns out to be be a flash in the pan and it is not sold for big bucks, Twitter still has heralded a very important new era in the digital industry.</p>
<p>And, if it grows like crazy even more, better still.</p>
<p>Also, <a href="http://kara.allthingsd.com/20090403/twitters-no-biz-model-stone-on-the-colbert-report">Stone got to go on &#8220;The Colbert Report&#8221;</a> and Williams on &#8220;Oprah.&#8221;</p>
<p>Best of all, in a shameless plug, they will both be captive on stage with Walt Mossberg and me at the <a href="http://kara.allthingsd.com/20090504/welcome-to-lucky-d7-gambling-on-the-future-of-tech/">seventh <strong>D: All Things Digital</strong> conference</a> exactly three weeks from today, where we can ask them about all this and more.</p>
<p>So, I am thrilled too.</p>

The contract accomplishes what YouTube and Warner Music Group have been unable to do&#8211;figure out a way to keep the label&#8217;s music on the world&#8217;s biggest video site while sharing revenue with both sides.</p>
<p>The deal, which extends a previous agreement, has been finalized but not formally announced, multiple sources familiar with the matter tell me. A spokesman from Google&#8217;s (GOOG) YouTube said the company would not comment on &#8220;rumor or speculation&#8221;; Sony&#8217;s (SNE) music label declined to comment. Last week, <a href="http://news.cnet.com/8301-1023_3-10156255-93.html">CNET reported</a> that the two companies were &#8220;very near&#8221; to a deal.</p>
<p>It&#8217;s unclear what the final deal terms are, but people familiar with the matter tell me that the negotiations revolved around three components: an upfront payment from YouTube to Sony, the minimum amount Sony will receive each time someone plays a Sony video on the site, and the way the two sides will split revenue generated by any of the label&#8217;s videos.</p>
<p>Those terms had previously <a href="http://mediamemo.allthingsd.com/20081220/warner-music-group-disappearing-from-youtube-both-sides-take-credit/">tripped up Warner Music and YouTube in December</a>, and Warner Music (WMG) artists have been taken off the site while the two companies try to work out a new licensing deal. Sony Music&#8217;s artists range from Britney Spears and Beyonc&eacute; to Bruce Springsteen and Bob Dylan.</p>
<p>Music videos are some of YouTube&#8217;s most popular offerings, but they have also been expensive for the video site. Under the terms of its old deals with the labels, YouTube agreed to pay the music companies either a per-stream fee or a share of ad revenue associated with the clip, whichever is greater. Since YouTube is just beginning to get serious about selling ads next to its content, it’s usually paying the per-stream fee, which industry executives peg at about half a penny per clip.</p>
<p>The music labels have been angling to increase that fee to perhaps eight-tenths of a penny, while Google has been pushing in the other direction, where the two sides would simply share any revenue the clips create.</p>
<p>Infuriatingly, seemingly all of Sony Music&#8217;s official YouTube videos have had their embedding function turned off, which means I can&#8217;t share them with you. So here&#8217;s an unofficial but still excellent clip of The Clash, who recorded for the company&#8217;s Columbia label.</p>

<p>Now, back to our regularly scheduled programming: I&#8217;m seeing more and more evidence that Apple (AAPL) notwithstanding, the industry&#8217;s last few months were bad even by the industry&#8217;s own <a href="http://mediamemo.allthingsd.com/20081231/the-music-business-bids-good-riddance-to-2008-gets-ready-to-say-the-same-thing-to-2009/">terrible standards</a>.</p>
<p>Earlier this week, a music industry exec told me he thinks that the CD sales decline, which started nearly a decade ago, accelerated at the end of 2008: &#8220;[Retail] floor space shrank even more, [unsold CDs] came back even faster, everything got worse, faster,&#8221; he told me.</p>
<p>The newest data point: Awful results from Sony&#8217;s (SNE) third-quarter earnings report, which covers the last three months of 2008. The company&#8217;s Sony Music Entertainment label saw sales shrink 22 percent compared to the previous year due to the &#8220;accelerated decline in the worldwide physical music market resulting from the worldwide economic slowdown.&#8221;</p>
<p>It&#8217;s possible that we&#8217;ll see a bit of variation in results from the other big music labels&#8211;EMI Music Group, Vivendi&#8217;s Universal Music Group, and Warner Music Group (WMG)&#8211;based on the makeup of their artist rosters, etc. But the worrisome thing is that Sony&#8217;s arsenal included three of last year&#8217;s biggest stars: AC/DC, Beyonc&eacute; and Britney Spears.</p>
<p>So while it&#8217;s possible that Warner Music, which reports next Thursday, won&#8217;t have equally brutal results, it&#8217;s a fair bet that it will.</p>

<p>Ouellette achieved a brief bit of Internet celebrity last year when his free music-streaming site caught on with the the Web cognoscenti, but then folded after receiving complaints from the music labels&#8217; trade group. Now he&#8217;s back with a legal version of the site, which will have much smaller ambitions.</p>

And it&#8217;s no wonder, considering that sites like YouTube conduct their hunts by looking at a clip&#8217;s &#8220;contextual metadata&#8221; &#8212; tags, video title and description &#8212; and thus can often be misled by false information. For example, a homemade video about cooking might be inaccurately tagged with a popular search word like &#8220;Obama&#8221; so as to get more traction.</p>

<p>This week I tested <a href="http://VideoSurf.com" rel="external">VideoSurf.com</a>, a site that claims to be the first to search videos by &#8220;seeing&#8221; images that appear in these videos. The company says its technology can analyze a clip&#8217;s visual content, as well as its metadata &#8212; especially when searching for people. VideoSurf has analyzed and categorized more than 12 billion visual moments on the Web to understand who the most important characters and scenes are in a video, and it uses this knowledge to sort clips according to relevancy.</p>
<p>Search results on VideoSurf spread out videos in a filmstrip-like format, distinguishing one scene from the next. Users can choose an option to show only faces, which helps if you&#8217;re looking for a specific person in a long video or movie. And when looking at videos from certain sources, you can select a scene from the filmstrip and jump ahead to that scene rather than sit through the entire clip.</p>
<p>When it works, VideoSurf is one of those technologies that make you wonder why someone didn&#8217;t think of it sooner. The site aggregates content from about 60 sources, including YouTube, CNN Video, Hulu, ESPN and Comedy Central, and a sorting tool weeds out unwanted results like the irksome slideshows that are labeled as videos. VideoSurf can find videos on all kinds of subjects, but it really shines when it finds well-known people.</p>
<p>But VideoSurf has some rough edges and doesn&#8217;t always work as it should. In its defense, the site is still in its public beta, or trial, stage, and plans to be full-blown by early next year. Right now, one of its best features, the ability to jump ahead to specific scenes, works with video from only a handful of sources including YouTube, MetaCafe, DailyMotion and Google (GOOG) Video. Videos from Hulu.com confusingly allow jumping ahead only from certain screens.</p>
<p>Additionally, I came across a couple of videos that were no longer available, though they were listed in search results. And a customizable VideoSurf home page for users with accounts on the site saves searches but not specific clips; VideoSurf plans to fix this next week by adding a favorites page where users can store and share favorite videos with others.</p>
<p>Still, I really grew to like VideoSurf&#8217;s clear way of displaying content that would be otherwise buried within videos. Rather than trying to guess a video&#8217;s contents by looking at a single representative image, VideoSurf&#8217;s filmstrip views showed me exactly what I&#8217;d be watching. In many cases, I viewed a video I might not have otherwise watched because its filmstrip showed shots of scenes that looked interesting.</p>
<p>On the left-hand side of the search-results page, VideoSurf users can narrow results according to Content Type, Categories and Video Sources to see just what they&#8217;re looking for &#8212; or, often more important, what they&#8217;re not looking for. Content Type, for example, includes slideshows, Web series, full television episodes and full movies; a search can include only videos in a particular category (say, slideshows) or exclude that category altogether by unmarking the box beside it.</p>
<p>Most search-results pages include tiled still images at the top representing the characters in the videos. By selecting one of these characters, users can refine search results to show only videos with that character. For example, I typed the title of a favorite television show, &#8220;Brothers and Sisters,&#8221; into the search box and saw the names and images of seven actors on the show at the top of the screen. I selected Sally Field and was redirected to results of videos featuring only the mother she plays on the show.</p>
<p>I used VideoSurf to search for Beyonce&#8217;s &#8220;Single Ladies&#8221; music video, and then changed the date parameters to find only videos posted this week. This retrieved a Saturday Night Live skit in which the pop singer spoofs her own video with help from three men in tights &#8212; including Justin Timberlake. While the SNL skit ran, a list of related videos appeared in a column on the right, including clips of J.T.&#8217;s past SNL skits.</p>
<p>Occasionally, annotations appear on videos, but these come from the source &#8212; not VideoSurf. If overlaid text appears on YouTube videos, it can be turned off using an icon in the bottom right of the YouTube screen. Video-sharing sites that use introductory pages such as pre-rolls before each video will still show those pages.</p>
<p>VideoSurf makes it easy to send specific clips of videos to friends. I did so by selecting a Share option and adjusting slide bars to trim the clip to start and end at scenes I preferred. Clips shared with friends via email are sent with the VideoSurf filmstrip, giving others the ability to also know what the video will include so that they, too, can discern whether or not they want to watch it.</p>
<p>Clips can be shared on social-networking sites like del.icio.us, MySpace and Facebook, though VideoSurf&#8217;s helpful filmstrip didn&#8217;t show up on these sites like it did in emails.</p>
<p>I also tested an add-on for the Mozilla Firefox browser called Greasemonkey that works with VideoSurf. When installed, this displays VideoSurf&#8217;s helpful filmstrip beneath search results from Google Video, YouTube, Yahoo (YHOO) or CBS.com (CBS). Once installed, filmstrips illustrating important scenes appear along with the normal text results for videos, and some of the filmstrips enable jumping ahead to specific scenes. This somewhat techie Greasemonkey extension can save people the extra step of making a separate visit to VideoSurf.com to watch a specific clip.</p>
<p>VideoSurf uses smart technology that can save people the aggravation of watching videos that aren&#8217;t what they appear to be. Since so much Web content now includes videos, a visual search tool that can better assess videos like VideoSurf is a good idea. When this site improves its now-flaky ability to jump ahead to specific scenes in videos, it will be even more valuable.</p>
