			<content:encoded><![CDATA[<p><img src="http://newenterprise.allthingsd.com/files/2011/01/LAWSUITS_DigitalDaily-150x150.jpg" alt="" title="LAWSUITS_DigitalDaily-150x150" width="150" height="150" class="alignright size-full wp-image-1378" />When the U.S. Department of Interior said it would move to using Microsoft&#8217;s cloud-based email and collaboration services, it was seen as a big validation of cloud computing by a big organization. That is, unless you&#8217;re Google.</p>
<p>In November, Google <a href="http://digitaldaily.allthingsd.com/20101101/google-to-u-s-whos-being-anticompetitive-now/">sued the Department of Interior</a>, arguing that the Google Apps platform was frozen out of the bidding. Today, a federal judge, Susan Braden, <a href="http://online.wsj.com/article/SB10001424052748704405704576063713471775694.html">sided with Google</a> by issuing a preliminary injunction preventing the department from deploying Microsoft&#8217;s Business Productivity Online Suite. Braden also found that Google had made a preliminary showing that the department had violated a 1984 regulation on competitiveness in government contracts.</p>
<p>Google and a reselling partner, Onix Networking, had argued in court that the Interior Department&#8217;s request for bids specifically excluded Google Apps by stating the system had to include the Microsoft product.</p>
<p>The case isn&#8217;t over, but it&#8217;s certainly not looking good for the Interior Department, which may be forced to reconsider Google Apps for the contract.</p>

In <a href="ftp://ftp.software.ibm.com/annualreport/2008/2008_ibm_letter.pdf">an exuberant letter to shareholders</a> today, Palmisano wrote that IBM (IBM) will not cower before the current economic turmoil. “Many companies are reacting to the current global downturn by drastically curtailing spending and investment, even in areas that are important to their future,&#8221; he said. &#8220;We are taking a different approach. Of course, we must continue to improve our competitiveness. But while we maintain discipline and prudence in the near term, we also maintain the discipline to plan for the future. We’re not looking back, we’re looking ahead. We’re continuing to invest in R&#038;D,  in strategic acquisitions, in growth initiatives&#8211;and most importantly, during these difficult times, in our people. In other words, we will not simply ride out the storm. Rather, we will take a long-term view, and go on offense.&#8221;</p>
<p>Ignoring for a moment the irony of a company that&#8217;s<a href="http://www.endicottalliance.org/jobcutstatusandcomments.php"> laid off 4,600 employees</a> in the past few months professing to invest in its people,  Palmisano&#8217;s remarks are quite interesting. Certainly, they&#8217;re anomalous to much of what we&#8217;ve been hearing lately. No gloom and doom from ol&#8217; Sam, only contrarian bluster. Perhaps just enough to justify that 14 percent pay increase he accepted in 2008&#8230;.</p>

And according to reports, the company is <a href="http://online.wsj.com/article/SB123300431170916831.html?">eliminating about 2,800 jobs</a> in North America&#8211;mostly in its sales and software units.</p>
<p>While confirming that these &#8220;resource actions&#8221; are indeed taking place, IBM (IBM) refused to discuss details. Instead, it offered up the standard staff reduction obfuscations as comment. &#8220;We are not going to discuss specific numbers or locations,&#8221; <a href="http://www.poughkeepsiejournal.com/article/20090122/BUSINESS01/901220332">spokesperson Doug Shelton told The Poughkeepsie Journal</a>. What I can tell you is that managing resources and skills is an ongoing component of our business model. IBM continuously evaluates its mix of skills and resources, and makes changes as needed. The nature of our business is that we must constantly assess employee skills and resources and at any given time, give IBM the flexibility to match the current and future needs of our clients (skills that the client needs). Managing talent in this way promotes the continued competitiveness of our operations and matches our skills and capabilities with the evolving needs of our clients.&#8221;</p>
<p>So much for IBM&#8217;s lifetime employment concept.</p>

This morning the online auctioneer <a href="http://online.wsj.com/article/SB122329498978907449.html">sacked about 1,000 permanent employees</a> and a few hundred temps, about 10 percent of its workforce. That&#8217;s a bit less than <a href="http://www.reuters.com/article/marketsNews/idUSN1442239820080914">the 1,500 workers</a> for whom the company was rumored to be writing up pink slips, but it&#8217;s substantial just the same. The cuts, according to eBay (EBAY), are &#8220;intended to simplify and streamline eBay&#8217;s organization, improve the company&#8217;s cost structure and strengthen the overall competitiveness of the company&#8217;s existing businesses.&#8221; They were announced in concert with<a href="http://biz.yahoo.com/bw/081006/20081006005605.html"> two acquisitions</a>. EBay is purchasing online-payment company Bill Me Later for $820 million in cash and approximately $125 million in outstanding options. It&#8217;s also acquiring Denmark&#8217;s leading online classifieds site, dba.dk, and vehicles site bilbasen.dk for approximately $390 million in cash.</p>
<p>For eBay, whose shares have <a href="http://www.bloomberg.com/apps/news?pid=20601103&amp;sid=am30o.Q66i3o&amp;refer=news">plummeted some 43 percent in the last year</a>, the moves are further efforts to prop itself after the declining performance of its core marketplace division.</p>
