<p>BoomTown scrambled the <strong>All Things Digital</strong> jet (aka, United Airlines, Seat 7A) late last night to get up to Microsoft&#8217;s big event for its online advertising clients today.</p>
<p>Called &#8220;Imagine 2011: Marketing Leadership Summit&#8221; and held at its Redmond, Wa. HQ, the two-day gathering is designed to wow peeps by trotting out a spate of <em>strategery</em> concepts those who buy advertising on Microsoft&#8217;s various digital offerings from its Bing search service to MSN to Xbox to Windows Phone 7.</p>
<p>Some program topics: &#8220;Elsewhere USA,&#8221; &#8220;Teens Hanging Out, Messing Around, and Geeking Out&#8221; and &#8220;Audience Buying Goes Real-Time: True or False?&#8221;</p>
<p>Presumably the goal of all this heavy-duty thinkery is to get these marketers to buy more ads from Microsoft by warning them about being left behind on the platform as the train chugs inevitably off to the digital future.</p>
<p>And just in case that doesn&#8217;t work, there will be a free concert tonight featuring the hipster band Train for the Imagine 2011 attendees at Microsoft Co-founder Paul Allen&#8217;s Experience Music Project venue to open those ad wallets.</p>
<p>Hey, Geek Mister: Stop sending all those digital marketing bucks to Google and Facebook and give them to us!</p>

<p>Before a panoply of various social, design and anthropology experts pontificated, Microsoft CEO Steve Ballmer kicked off the day with his patented loud and lovable Ed McMahon act, complete with the booming catchphrases.</p>
<p><em>Hey-Yo!</em></p>
<p>&#8220;You have to move forward or die!&#8221; (About the Web.)</p>
<p>&#8220;If you wanna get big, you have to think big!&#8221; (About the Windows 7 Phone smartphone deal with Nokia.)</p>
<p>I love the U.S. government, I don&#8217;t want to give it a hard time.&#8221; (About its crappy Web site, not the antitrust conviction thing.)</p>
<p>Ballmer outlined some key trends, which are not new to anyone paying attention over the last five years: Location; social; pervasive displays; ubiquitous connectivity; computers everywhere; cloud; data; and natural user interaction</p>
<p>He also joked about how there were 10 fake Steve Ballmers on Facebook, all using Steve Ballmer photos. <em>Imagine that!</em></p>
<p>You&#8217;d think Microsoft&#8217;s badillion-dollar investment in the social networking site would get you a verified account!</p>

<p>Actually, pissed off is more related to the fact that the person who conceived and organized the Imagine 2011 event was former global ad sales head Carolyn Everson.</p>
<p>But, she <a href="http://kara.allthingsd.com/20110215/exclusive-facebook-grabs-microsoft-ad-head-everson">left the company</a> in mid-February after only six months, for essentially the same job at Microsoft partner Facebook.</p>
<p>Since then Microsoft and Facebook have been wrangling over the talent raid, including Microsoft even considering <a href="http://kara.allthingsd.com/20110302/exclusive-microsoft-mulls-legally-poking-facebook-over-ad-talent-raid/">legal action to block the move</a>.</p>
<p>Nonetheless, the show must go on and it did in a pretty classy way.</p>
<p>But not without another road bump in today&#8217;s action&#8211;the news that Microsoft&#8217;s own marketing head, longtime company veteran <a href="http://kara.allthingsd.com/20110330/awkward-as-microsoft-marketing-event-opens-its-longtime-marketing-head-announces-retirement/">Mich Mathews</a>, was leaving the software giant later this year.</p>
<p>The departure had the halls buzzing about what happened and who will be taking over the big job with a $1 billion marketing budget.</p>
<p>Maybe some external CMO sitting right there in the audience or perhaps some internal Microsoft candidate such as Yusuf Mehdi or Capossela?</p>
<p>I suppose it&#8217;s time for some strategery <em>stat</em>!</p>

They run a vast variety of applications, from productivity programs to games, that mimic what laptops do. Their biggest limitations for serious work, gaming, Web surfing and multimedia are their small screens, cramped keyboards and tinny speakers.</p>

<p>So, what if you could use the brains and connectivity of such a hand-held computer to drive a laptop-size screen, keyboard and speakers, thus overcoming these limitations? Well, Motorola Mobility has devised a new phone and accessory that aim to do just that: to make the phone the only computer you need.</p>
<p>I&#8217;ve been testing this new phone, the Atrix 4G, an Android device that will cost $200 with a two-year contract and will run on AT&amp;T&#8217;s network. It&#8217;s slated to be available by March 6. I&#8217;ve also been testing its unusual and clever accessory called the laptop dock, which looks like a large netbook, with an 11.6-inch screen, full keyboard, touch pad, and stereo speakers. This dock, the price of which depends on when you buy it, has  no processor, no file storage and no connectivity of its own. It&#8217;s dormant until you plug the Atrix into a slot behind the screen.</p>
<p>When you dock the phone, the faux laptop comes alive. It duplicates the phone&#8217;s screen on its larger display and lets you use its connectivity and apps. It also contains a battery that charges the phone. The image of the phone&#8217;s screen, and any of its apps you run, can be actual size or blown up to use the dock&#8217;s larger screen.</p>

<h5 class="subhed">Full-Screen Firefox</h5>
<p>Even more interestingly, the dock gives you access to a full, and full-screen, PC version of the Firefox Web browser. Firefox is tucked away inside the Atrix but is available only when the phone is plugged into the laptop dock or a second, smaller dock that&#8217;s meant to connect to a TV or desktop monitor. The smaller dock lacks a built-in keyboard, battery or screen.</p>
<p>The laptop dock costs $500, but AT&amp;T will knock the price down to $300, after rebates, if you buy it at the same time you buy the phone. That brings the combined price of both devices to $500—the same as the separate price for the dock. The smaller dock, called the multimedia dock, costs $190.</p>
<p>In my tests, the Atrix and the laptop dock performed mostly as advertised. The phone had no trouble driving the larger screen or the full Firefox browser. </p>
<p>I was even able to insert a flash drive into one of the dock&#8217;s two USB ports and copy songs, photos, videos and documents into the phone&#8217;s internal memory using the keyboard and touch pad. I edited and wrote text in an app called Quickoffice on the phone using the laptop dock&#8217;s keyboard, and ran various other apps, including the popular game Angry Birds, on the larger screen.</p>
<p>The Firefox browser worked as normal, using either the phone&#8217;s cellular or Wi-Fi connections to access the Internet. And both the phone itself and Firefox can run Flash videos, which mostly played fine.</p>
<p>But the combination of the phone and dock wasn&#8217;t as fast, smooth or versatile as having a real laptop, even though to use them you&#8217;re essentially carrying around a light laptop (the dock weighs 2.4 pounds). Many apps on the phone aren&#8217;t as polished or powerful as typical PC apps, and I found them clumsier to use with the keyboard and touch pad, as opposed to the touch screen for which they were designed. </p>
<h5 class="subhed">Installation Issue</h5>
<p>Also, other than Firefox, you can&#8217;t install PC programs. You can use Web apps inside Firefox, such as Google Docs or the stripped-down Web versions of Microsoft&#8217;s Office apps. For email, you can either use the program based in the phone or any Web-based program via the Firefox browser, such as Gmail or Yahoo Mail. But you can&#8217;t, say, install iTunes, or PC-based games, or the full versions of Outlook or Microsoft Word. </p>
<p>And there is only a primitive file system, limited to the capacity of the phone, which is just 16 gigabytes, with an option to expand to 48 gigabytes.</p>
<p>The dock&#8217;s screen required a lot of scrolling when using Firefox, partly because the browser has a lot of menus and toolbars. To address this, Motorola lets you convert Web pages to versions with the Firefox controls stripped out, so you just see the content. </p>
<p>There&#8217;s another problem with the laptop dock. When you make or receive a voice call while the phone is docked, you must rely on the phone&#8217;s microphone and speakers, hidden behind the screen of the dock. As a result, calls sounded muffled on both ends, even though the phone automatically switches into speakerphone mode. Motorola says it is working on this issue.</p>
<p>Despite the drawbacks, some folks will surely be attracted to this innovative combination. </p>
<p>If you mostly do your computing tasks on a phone or a PC Web browser, storing files in the cloud and using phone or Web-based apps, Motorola has you covered. And the fact that the dock can charge the phone is a big plus.</p>

<h5 class="subhed">The Phone Side</h5>
<p>What about the phone itself? </p>
<p>Well, it&#8217;s one of the nicest smartphones I&#8217;ve tested. Its processor makes it fast, and it has a 4-inch, high-resolution screen—almost as high as the iPhone 4&#8242;s, though not quite as sharp to my eye. It runs an older version of Android, but Motorola is promising an upgrade.</p>
<p>The phone also has good battery life. It lasted a full day while I was testing it and Motorola claims up to nine hours of talk time. Photos and videos I took with the phone were sharp, and it has a front camera for video calls.</p>
<p>The Atrix also has two other notable features. First, it can take advantage of AT&amp;T&#8217;s souped-up 3G network, which the carrier calls 4G because it can supposedly achieve 4G data speeds. </p>
<p>In my tests, in the D.C. and New York areas, the speed wasn&#8217;t especially impressive, averaging just a bit better than 3G speeds on other AT&amp;T phones I&#8217;d tested.</p>
<p>There is also a fingerprint sensor built into the phone, which you can use instead of a pass code to secure the phone. It worked fine for me.</p>
<p>Overall, this is a very nice Android phone that can imitate a limited version of a laptop. That may be enough for some folks, but fall short for others.</p>

<p class="mailbox-question"><em> I have a Windows PC. Microsoft sends regular updates to their &#8220;computer protection&#8221; software. Do I still need other security software?</em></p>
<p class="mailbox-a">A:</p>
<p> It depends what you mean by &#8220;computer protection&#8221; software. </p>
<p>If you are using Microsoft Security Essentials, then you already have security software and don&#8217;t need another brand, unless you are unhappy with it. </p>
<p>If you are referring to general security updates to Windows, these do close vulnerabilities in Windows, but don&#8217;t obviate the need for security software.</p>
<p class="mailbox-q">Q:</p>
<p class="mailbox-question"><em> I&#8217;m an accountant and do a few tax returns for my clients in my spare time. Would you please give me some recommendations on a computer that I could use for preparing tax returns and filing them electronically?</em></p>
<p class="mailbox-a">A:</p>
<p> While preparing tax returns might require some skill on your part, it doesn&#8217;t require an especially powerful computer, or one configured in any particular manner. Pretty much any PC or Mac on the shelves can do it. </p>
<p>If you have a favorite tax software program, perhaps one geared more to accountants than to average consumers, you might check its system requirements and be guided by these. </p>
<p>For instance, if it runs on only certain versions of Windows, or requires a certain amount of memory, you should buy accordingly.</p>
<p class="mailbox-q">Q:</p>
<p class="mailbox-question"><em> We have two new iPads, the models with only Wi-Fi connectivity. Can I use the Wi-Fi hot-spot feature of an Android phone to provide them with Internet access?</em></p>
<p class="mailbox-a">A:</p>
<p> Although I haven&#8217;t tested this scenario, I see no reason why not. </p>
<p>The hot-spot feature creates a Wi-Fi network from a cellular data connection and should work with any Wi-Fi capable device, including your iPads.</p>

<p>Let&#8217;s get this out of the way right now&#8211;WakeMate co-founder Arun Gupta said the start-up is finally shipping all pre-orders of the long-awaited sleep tracking gadget.</p>
<p>Gupta said, “Our goal is to fill all pre-orders by Christmas.”</p>
<p>And I can even verify that the unit exists, since I have been using one for a week now.</p>
<p>So why all the skepticism?</p>
<p>Because WakeMate&#8211;which began as an idea for a smart alarm clock back in 2006 and graduated out of the Y Combinator incubator in summer of 2009&#8211;has had more than a few delays in delivering product.</p>
<p>To be fair, the tiny company might have bit off a fair amount to chew. WakeMate chose a solution to the sleep-tracking problem that required it to build original hardware, a main Web application, as well as apps for Apple&#8217;s iPhone, Google&#8217;s Android and Research in Motion&#8217;s BlackBerry.</p>
<p>Thus, Gupta describes the first version of its product as “really, a public beta.&#8221;</p>
<p>And, WakeMate is indeed a little rough around the edges.</p>
<p>For example, the unit itself&#8211;with its semi-exposed electronics and shrink-tube wrapper&#8211;looks a little more like something hacked together on top of one of the mini DIY Arduino boards than it does a finished consumer electronics device.</p>
<p>But if you have any experience programming microcontrollers, you might appreciate the sort of sophistication that goes into coordinating this sleepy symphony of data gathering.</p>
<p>(Pardon us for a minute, while I get a little &uuml;ber-geeky and explain how the WakeMate wristband works. If this doesn&#8217;t concern you, feel free to fast-forward a few paragraphs to get to Gupta&#8217;s predictions for WakeMate&#8217;s future.)</p>
<p>When you flick the small switch on the WakeMate wristband, just prior to going to sleep, the device connects via Bluetooth to your iOS, Android or BlackBerry device.</p>
<p>You then open the WakeMate app and enter a 20-minute window during which you&#8217;d like to be woken.</p>
<p>The app talks to the wristband and transmits that time information. Then, both app and device enter a sort of low-power state. At this stage, the WakeMate becomes little more than a data logger.</p>
<p>There is a fairly standard, solid-state, three-axis accelerometer on board, much like the one that allows you to &#8220;shake to shuffle&#8221; your iPhone.</p>
<p>WakeMate then spits out three fields of data&#8211;X,Y and Z axis readings&#8211;40 times per second, which are stored in its flash memory all night.</p>
<p>That means an eight-hour sleep cycle will produce about 3.5 million unique data points, not including metadata.</p>
<p>The onboard clock&#8211;for the computer, not for human time-telling&#8211;waits until your pre-selected 20-minute window and then figures out, based on frequency and severity of wrist movement, when you are closest to being awake on your own.</p>
<p>When that moment comes, it wakes the Bluetooth connection, connects to the phone, sounds the alarm and starts uploading the data it collected all night directly to the phone and immediately sends the information to WakeMate&#8217;s servers.</p>
<p>And, not to worry, if the WakeMate dies mid-sleep, the phone knows to sound the alarm anyway.</p>
<p>It is quite a concert that needs to be played flawlessly for connectivity and battery life to remain intact.</p>
<p>Impressive data tricks aside, the world in which WakeMate was conceived looked a little different from the one into which it has been born, and that means a different set of competitive realities.</p>
<p>When WakeMate left Y Combinator, the world of iOS device-connected movement sensors was limited to the Nike Fit, which links running performance via a shoe-attached device.</p>
<p>It was also a world without Fitbit, another popular activity and health tracker.</p>
<p>And, unlike now, there were no sleep apps claiming to do what WakeMate does.</p>
<p>But now, even with all the new rivals, Gupta believes WakeMate still has the edge.</p>
<p>He explained: &#8220;In the early days of sleep-tracking studies, doctors decided to monitor non-dominant wrist movement as part of the data collected to determine sleep state. That continues today, so there is a ton of research that has been collected over the years on correlating wrist movement with sleep cycle.&#8221;</p>
<p>He added that WakeMate has built an algorithm that fits the data collected by its wristband to these medically relevant sleep-cycle models and spits out graphs mapping your sleep states, your waking moments and even times when you were in deepest sleep.</p>
<p>&#8220;All the competing tools out there aren&#8217;t at all based on any kind of accepted research&#8211;no one is studying pillow movement or waistband movement or anything,&#8221; Gupta said. &#8220;But we know how you are sleeping when you move your wrist.&#8221;</p>
<p>The major questions facing WakeMate as a company revolve around what one might expect from a start-up with such a complex beta product.</p>
<p>Gupta said it will focus on innovating and revising its wristband, as well as doing more interesting things with the data it will collect.</p>
<p>&#8220;On the macro level, we&#8217;re really doing the biggest sleep study that has ever been done,&#8221; he said. &#8220;We&#8217;ll be able to tell you how people are sleeping in San Francisco versus New York, based on seasons and all kinds of things.&#8221;</p>
<p>Gupta added that while he doesn’t know what the next step is, WakeMate is prototyping ideas where it could correlate sleep data with other metrics about health, occupation and stress to provide a more complete tool set.</p>
<p>But as more companies work on the problem of digitizing the analog data of human life, the harder questions to answer are really in front of the consumer.</p>
<p>Gupta said he doesn&#8217;t know what a world would look like if a health insurance company could access your sleep data, or when information about your apparent insomnia is grabbed by some hacker.</p>
<p>What WakeMate hopes for, he said, is a world where more people have access to the kind of medical data collection that has previously only been collectable by trained technicians in controlled settings.</p>
<p>But more data is better, as far as WakeMate is concerned&#8211;it is hoping that its vision puts its products at the center of an all-day biometric data collection future.</p>

With the iPad juggernaut rolling inexorably forward and a groaning board of rival tablets headed to market in the months ahead, some analysts are suggesting that RIM may not sell quite as many PlayBooks as it hopes (an interesting exercise, considering few outside of RIM have even used the device).</p>
<p>&#8220;Given the competitive environment heading into CY11 with the influx of more than 80 new competitive tablet offerings, we believe [selling 10 million units] may be challenging for RIM to achieve, particularly as the PlayBook is positioned as a &#8216;professional&#8217; device and initially as a companion linked to a BlackBerry,&#8221; Susquehanna analyst Jeffrey Fidacaro said in a note to clients today, suggesting that sales of eight million is likely a better estimate. Which seems reasonable, particularly since the PlayBook will only support 3G data connectivity through a tethered BlackBerry.</p>

<p>The Slate 500, which has an 8.9-inch screen, will run Microsoft Corp.&#8217;s Windows 7 operating system, and is targeted at business customers. IPads have a 9.7-inch screen.</p>

<p>And Masan’s speeds are blazing fast. It’s the only city in the report with average connection speed above 20 megabits per second. In contrast, the fastest city in the U.S., Monterey Park, Calif., had an average speed of 6.9 Mbps.</p>
<p>It’s not clear why exactly Masan, a coastal city with a population of about half a million and a name that means “horse mountain,” ranks so highly. But the top 10 cities in the report were all in South Korea, which simply has a different technology environment from that in the U.S. For years the Korean government has spent billions on high-speed networks and subsidies to encourage broadband connections. And unlike in the U.S., competition between broadband services in Korea is cutthroat, driving down prices.</p>
<p>The quarterly report by Akamai highlights how the U.S. is being pummeled by cities in Asia and Europe when it comes to Internet connectivity. It’s part of the justification for the Federal Communications Commission’s push to spread the accessibility of high-speed broadband.</p>

<p class="mailbox-question"><em> I&#8217;m wondering about wireless specs for a laptop. I suspect the &#8220;n&#8221; version of Wi-Fi is best but &#8220;g&#8221; is adequate. Any advice would be appreciated.</em></p>
<p>A. It depends on how and where you intend to use your laptop&#8217;s wireless connectivity. The &#8220;n&#8221; version of Wi-Fi can be much faster than &#8220;g&#8221;  and can have much greater range. However, the speed difference won&#8217;t matter much if your sole use is connecting to the Internet with a typical home or public hotspot service, since the maximum speed of these services is almost always well below &#8220;g&#8221; and &#8220;n&#8221; capabilities.  But if you are streaming video at home or backing up large files wirelessly among computers and networked hard disks on a home network, you&#8217;d be much better off with &#8220;n,&#8221; assuming all devices involved support it. The same goes for range. In a small apartment, it likely won&#8217;t matter. In a large home, it could. </p>
<p class="mailbox-q">Q:</p>
<p class="mailbox-question"><em> I&#8217;m thinking about getting the updated Apple MacBook Pro 13&#8242; with the Intel Core 2 Duo Processor. I very much like size and weight of this laptop, but is it wise these days to invest in an Intel Core 2 Duo instead of the newer Intel chips? I mainly need it for &#8220;Office Work&#8221; (email, Internet, Word, Excel, etc.).</em></p>
<p>A. As I said in my recent PC buyer&#8217;s guide, Intel&#8217;s newest processors can give you extra speed for demanding scenarios and then ratchet down to save battery life under simpler situations. But there&#8217;s nothing  wrong with the older Core 2 Duo, or competing processors from AMD (AMD), for mainstream tasks. I wouldn&#8217;t hesitate to buy a laptop with a Core 2 Duo for the kind of tasks you anticipate, or even heavier use.</p>
<p>As for battery life, Apple (AAPL) rates the Mac model you&#8217;re considering at up to 10 hours of use between charges. In my harsh battery test, it got 7 hours. In normal use, I&#8217;d guess it would easily exceed 8 hours.</p>

Just two days at market and already some new iPad owners are flocking to Apple’s support forums, <a href="http://discussions.apple.com/thread.jspa?threadID=2387493&#038;tstart=0">complaining about temperamental Wi-Fi connectivity</a>.</p>
<p>&#8220;I have&#8230;noticed very weak wifi signal in my 16GB iPad,&#8221; one post to Apple’s iPad support discussions reads. &#8220;Even when standing in front of the wlan router the signal fluctuates from strong to very weak. The router has very strong signals as every other computer here has full signal strength, even 20-30 meters from the router. So there is definitely a wifi signal issue here with the iPad.&#8221;</p>
<p>&#8220;I&#8217;m having the same problem,&#8221; reads another. &#8220;iMac, Macbook, Macbook Pro and iPhone all work great 3 rooms from my house (all connecting through an airport). My iPad is only getting 1/3 on Wifi and frequently dropped the connection.&#8221;</p>
<p>This is obviously a supremely annoying problem since Wi-Fi is the iPad&#8217;s only means of connecting to the Internet.</p>
<p>It is not yet clear how widespread this issue is. As I write, there are several <a href="http://discussions.apple.com/forum.jspa?forumID=1363&#038;start=15">iPad Wi-Fi-related discussions on Apple&#8217;s support forums</a>, the largest of which hosts about six pages of comments. </p>
<p>That said, I have not had any problem with my iPad&#8211;moments ago, I streamed a Netflix (NFLX) movie to it from the sidewalk in front of my house&#8211;and my informal poll of friends and colleagues who own the device turned up no reports of weak or temperamental Wi-Fi connections. Which is not to say they don’t exist or that they&#8217;re the result of user error, just that they appear to be fairly limited in scope at this point.</p>
<p>In any event, Apple (AAPL) has posted two support documents (<a href="http://support.apple.com/kb/TS3237">1</a>, <a href="http://support.apple.com/kb/TS3304">2</a>) for iPad owners to troubleshoot ornery Wi-Fi connections.</p>
<p><strong>UPDATE:</strong> A commenter below points out a <a href="http://appletoolbox.com/2010/04/ipad-weak-signalslow-wi-fi-internet-fixes/">list of potential fixes</a>.</p>

This antenna-enhanced box sends data to and from desktops, laptops, smart phones and TiVos (TIVO) throughout the house. Its indicator lights glow, signaling all is well with the network. </p>

<p>But setting it up can be a major ordeal. People beg their techie friends for help. Some sit for hours on the phone with customer support. A few brave souls muddle through a sea of acronyms and secure codes in an attempt to install the router. Once it is set up, many are afraid to change its settings for fear of disrupting it and losing Internet connectivity.</p>
<p>Enter Valet (<a href="http://thevalet.com/">TheValet.com</a>), a new wireless router designed for people who are tired of being intimidated by a blinking box. Valet is designed by the people who brought us the Flip video camcorders, the ultra simple handhelds with ultra simple software that just work. And it comes from Cisco (CSCO), which also owns Linksys—a router brand that people know and trust.</p>
<p>I&#8217;ve been using Valet for the past week, but it took me only 10 minutes, from start to finish, to get it going, thanks to a simple USB key that plugs into the computer and sets everything up in the background in less than five minutes. I tried it on a Windows 7 PC running and on an iMac, as well as on mobile devices, including a BlackBerry, Palm (PALM) Pre and the HTC HD2. The Valet is available Wednesday for $100 on Amazon.com (AMZN), TheValet.com and Staples (SPLS) stores. Over the next two weeks, it will be sold at Best Buy (BBY), Target (TGT) and Wal-Mart (WMT). There&#8217;s also the $150 Valet Plus, with a Wi-Fi range about 20% greater than the Valet.</p>
<p>I ran into a bug while trying to install the Valet software on a Mac: I plugged in the USB key but its built-in software didn&#8217;t install and I got a message telling me that Valet wasn&#8217;t able to set up on my computer. A Cisco representative said this was a rare Mac bug that will be fixed over this week and next week.</p>
<p>Along with its simple setup, Valet automatically creates a guest network to go with the main network so visitors can log onto a household&#8217;s Wi-Fi—either with or without a password, depending on settings—and not gain access to files shared within that network. The Valet software has parental controls that make it a cinch to set up restrictions like blocking certain Web sites or cutting off Internet access after a certain time on school nights or weekends. </p>

<p>The Valet isn&#8217;t the first router to enable parental controls and guest-network access. Apple Inc.&#8217;s (AAPL) $179 AirPort Extreme Base Station allows users to set up guest networks. Likewise, Netgear&#8217;s (NTGR) six most recently introduced routers, priced from $70 to $190, offer guest networks and parental controls. But just as the Flip camera&#8217;s built-in software simplified the process of editing, uploading and sharing home videos, the Valet&#8217;s software makes networking approachable for anyone—regardless of technical skill.</p>
<p>The Valet comes in a box with a USB Easy Setup Key, wireless router, Ethernet cable and power adapter (the last two are hidden under the box&#8217;s interior packaging). Instructions on the box told me to plug the USB key into a PC or Mac. Then on-screen directions popped up, instructing me to plug the Valet router into the wall with the power adapter and then into my home&#8217;s modem using the Ethernet cable. I selected the &#8220;connect&#8221; option on the computer screen, and four minutes later, the network was set up. </p>
<p>The device&#8217;s software, called Cisco Connect, is divided into four categories: Computers &#038; Devices, Parental Controls, Guest Access and Settings. With these, I could quickly see how many devices were connected to my network and learn the name and password for the guest network if I forgot it. (Valet networks have pre-set, randomly selected names and passwords that people can easily change. My network&#8217;s default name was RubyPanda and its password was mango62—both simple word/number combinations that are easy to remember.) If the guest network is password-protected, guests have to enter that password on a Web browser page, like at a hotel. This could be confusing for people used to entering network passwords at the operating-system level, right as they select the Wi-Fi network. A Cisco representative said using a Web browser page is a more consistent way of entering passwords and it saves people from having to answer questions they may not be able to answer if they&#8217;re logging onto the main network, like the name of the &#8220;WPA key.&#8221;</p>
<p>If people get stuck during setup, which happened with me when I ran into the Mac bug, a screen immediately displays a customer-service number for Valet that&#8217;s available 24 hours a day, seven days a week. I spoke to a woman who tried several troubleshooting methods, but she didn&#8217;t know about Valet&#8217;s rare Mac bug. Once a computer is set up with the Valet network, the USB key can be taken to other computers to update them with the same network passwords and settings. </p>
<p>Using the parental controls couldn&#8217;t have been easier. After a password is set up, Web content can be blocked at a teen or child level on some or all devices. Specific sites can be blocked, and when I blocked Facebook on a connected Mac, it wouldn&#8217;t open on that computer without the parent password. Time restrictions on Internet usage can be set up here, with different settings for school nights and weekends.</p>
<p>Though the $100 Cisco Valet is more than twice as expensive as some wireless routers, its built-in software puts great emphasis on simplicity and ease of use, and turns setting up and using a a home network into an unusually pleasant experience.</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2010/03/jobs_att.jpg" alt="" title="jobs_att" width="200" height="171" class="alignright size-full wp-image-36014" />Here’s the real reason AT&#038;T was able to offer such a <a href="http://digitaldaily.allthingsd.com/20100127/new-ipad-old-carrier-apple-sticks-with-att/">breakthrough price on data plans for Apple’s iPad in the U.S.</a>: The carrier doesn’t expect many people to buy them. </p>
<p>Though $14.99 per month for 250MB of data and  $30 per month for unlimited data are bargains, particularly considering that 3G service for laptops costs an average of $60 a month, AT&#038;T (T) doesn’t see many people taking advantage of them.</p>
<p>During an appearance at the Morgan Stanley (MS) conference in San Francisco Tuesday, AT&#038;T CEO Randall Stephenson said he doesn’t expect Apple&#8217;s (AAPL) iPad to generate a lot of new 3G service subscriptions for the carrier. </p>
<p>&#8220;It will be interesting to see customer reaction to the iPad,&#8221; Stephenson said. &#8220;My expectation is that there&#8217;s not going to be a lot of people out there looking for another subscription. We think it&#8217;s going to be a largely WiFi-driven product.&#8221;</p>
<p>That seems like an odd remark from the CEO of a company that’s got the exclusive on iPad 3G connectivity in the U.S. Honest, though. The consensus among analysts seems to be that most folks in the market for an iPad will buy the Wi-Fi-only version. At $499-$699, the iPad is a real head-turner and relatively easy on the wallet. But at $629-$829, it becomes more of a &#8220;Do I <i>really</i> need this thing?&#8221; question.</p>
<p>One last point worth noting here: Asked about the fate of the company’s iPhone-exclusivity deal with Apple, Stephenson said he expects the iPhone to be a staple of AT&#038;T&#8217;s business for &#8220;quite some time.&#8221;</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2010/02/images-1.jpeg" alt="" title="images-1" width="132" height="113" class="alignright size-full wp-image-34118" />Apple and Google both issued updates to their respective super-smartphones today, Apple (AAPL) rolling out iPhone OS 3.1.3, Google (GOOG) an <a href="http://googlenexusoneboard.blogspot.com/2010/02/new-software-update-for-nexus-one.html">unnumbered point release to the Nexus One’s software</a>. </p>
<p>The new iPhone release is a bit of a yawner, resolving an issue that caused some third-party applications to have difficulty launching, improving the accuracy of reported battery level on the iPhone 3G S and <a href="http://support.apple.com/kb/HT4013">fixing some security issues</a>.</p>
<p>The Nexus One update is quite a bit meatier. It adds Google Goggles to the All Apps menu, <a href="http://www.engadget.com/2010/01/18/select-nexus-one-users-complaining-of-touchscreen-calibration-3/">improves 3G connectivity</a> (or promises to) and, significantly, enables multitouch in the phone&#8217;s Browser, Gallery and Maps applications. Seems the Nexus One dev team got over whatever aversion it had to pinch-to-zoom.</p>
<p>This update is being rolled out gradually, so some Nexus One owners may not see it until later this week.</p>

<p>On Friday, <a href="http://mediacenter.motorola.com/content/detail.aspx?ReleaseID=12334&amp;NewsAreaID=2">Motorola filed a complaint against Research In Motion</a> with the U.S. International Trade Commission, claiming the BlackBerry maker has infringed five of its patents related to Wi-Fi access, user interface and power and application management.</p>
<p>&#8220;These patented technologies are important to Motorola as they allow for more comprehensive connectivity, a better user experience and lower product costs,&#8221; Motorola (MOT) said in its complaint that requests an exclusion order to stop RIM (RIMM) from importing any BlackBerry device found to infringe its patents and from selling or marketing such devices if they have already been imported.</p>
<p>&#8220;Through its early-stage development of the cellular industry and billions of dollars spent on research and development, Motorola has created an industry-leading intellectual property portfolio that is respected by the entire telecommunications industry,&#8221; Jonathan Meyer, senior VP of intellectual property law at Motorola said in a statement. </p>
<p>&#8220;In light of RIM’s continued unlicensed use of Motorola’s patents, RIM’s use of delay tactics in our current patent litigation, and RIM’s refusal to design out Motorola’s proprietary technology,&#8221; Meyer added, &#8220;Motorola had no choice but to file a complaint with the ITC to halt RIM’s continued infringement.&#8221;</p>
<p>RIM has not yet commented on Motorola’s charges.</p>

<p>Verizon has carried just about every smartphone Palm has ever built, so it was really just a matter of time before the carrier began selling Palm&#8217;s Pre and Pixi. <a href="http://www.businessweek.com/news/2010-01-05/palm-pre-and-pixi-said-to-debut-on-verizon-this-month-update1-.html">According to Bloomberg, Verizon will be doing just that</a> in the months ahead. </p>
<p>&#8220;Persons who decline to be named&#8221; tell the business news service that the carrier will announce the <a href="http://digitaldaily.allthingsd.com/20091217/palm-to-announce-verizon-att-deals-at-2010-ces-event/">addition of the Palm smartphones to its lineup this week at the Consumer Electronics Show</a> in Las Vegas. Both will boast enhancements beyond those currently offered; the Pixi, for example, will gain the Wi-Fi connectivity it sorely lacks. </p>
<p>Great news for Palm (PALM), which will obviously benefit from the sizable addressable market Verizon (VZ) offers, as <a href="http://digitaldaily.allthingsd.com/20100105/palms-biggest-problem-sprint/">I noted yesterday</a>. While Sprint (S) has been a faithful partner for Palm, it is hemorrhaging subscribers and lags Verizon, the industry leader in the U.S. </p>
<p>As Morgan Stanley analyst Ehud Gelblum recently noted, Palm’s primary trouble has been its limited distribution through Sprint. </p>
<p>Said Gelblum: &#8220;We believe the single most important factor for Palm over the next year is the reach of its distribution network, which we expect to expand markedly in 2010 as Palm’s exclusivity agreement with Sprint expires, and the strength of its branding and advertising campaign, which has just been gutted, revamped and restarted. We believe both of these events should lead to market share gains, and ultimately margin expansion through greater scale.&#8221;</p>
<p>Reached for comment, Palm declined to offer one.</p>

			<content:encoded><![CDATA[<p>Amazon&#8217;s Kindle has been the king of the nascent, much-hyped, category of wireless e-readers since it came out in 2007. Now, numerous companies are determined to challenge the Kindle with dedicated, mass-market gadgets for reading digital books and periodicals. The latest, and potentially most important, of these is a contender called the Nook, produced by the giant bookstore chain Barnes &#038; Noble Inc. (BKS), which started shipping it this week.</p>
<p>The two devices look very similar, but have key differences in capabilities, user interface and polish. Overall, after testing the Nook for about a week, I don&#8217;t think it&#8217;s as good as the Kindle, at least not yet. At launch, the Nook has the feel of a product with great potential that was rushed to market before it was fully ready.</p>

<p>Like the latest standard-size Kindle, which came out earlier this year, the Nook is a roughly 8-inch by 5-inch, ivory-colored plastic tablet that costs $259 and connects wirelessly to an online store. The two devices have essentially identical reading screens, 6 inches when measured diagonally, that allow for only monochrome text and gray-scale graphics, not color. Both come with two gigabytes of internal memory, enough to hold about 1,500 digital books.</p>
<p>Nook&#8217;s most obvious difference from Kindle is that it also boasts a second, smaller color screen beneath the main reading screen. This touch screen is used for navigating and for typing via an on-screen keyboard when performing searches or adding notes to books. Also, when the touch screen is dark, it can be swiped to turn pages instead of using the physical page-turning buttons at the sides of the main screen.</p>
<p>The competing Kindle (formerly called the Kindle 2, but now back to just Kindle) uses a joystick, Menu and Home buttons, and pop-up menus on the main screen for navigating. It has a physical keyboard below the screen for typing and can turn pages only using physical buttons.</p>

<p>Also, unlike the Kindle, the Nook lets you lend certain digital books to others for a limited period, an innovation that removes one of the most common complaints about buying books electronically instead of on paper.</p>
<p>Another big difference: Nook claims a catalog of just over one million digital books, versus 389,000 for the Kindle. But this is somewhat misleading, because over half of the Nook catalog is made up of free out-of-copyright titles published before 1923, the vast majority of which are likely to be of little interest to average readers. Barnes &#038; Noble refuses to say how many modern commercial titles it offers, or even whether it has more or fewer of these than Amazon (AMZN).</p>
<p>Amazon says it already has nearly 20,000 of the most popular such older books available and plans to add hundreds of thousands more in the coming months, to bring its total selection to more than one million.</p>
<p>Amazon also offers well over 100 newspapers and magazines and 7,500 blogs. Barnes &#038; Noble says it will have about 45 periodicals in the coming weeks, but no blogs.</p>

<p>Both devices offer downloads of most best-sellers, but in a random, unscientific test I performed using print books from around my house, I found Amazon&#8217;s commercial e-book catalog superior. Barnes &#038; Noble lacked digital versions of two recent historical biographies I own, and had no digital editions of the works of one of my favorite contemporary mystery writers, Donna Leon. Amazon had all these books in Kindle editions. Barnes &#038; Noble says titles like these are being added.</p>
<p>During my tests, I found the Nook slower, more cumbersome to use and less polished than the Kindle. I ran into various crashes and bugs. And, while the Kindle&#8217;s navigation system isn&#8217;t exactly world class, it ran circles around the Nook&#8217;s, despite the great possibilities offered by the latter&#8217;s use of the touch screen.</p>
<p>The Nook may be wonderful one day, but, as of today, it&#8217;s no match for the Kindle, despite advantages such as lending, because it&#8217;s more annoying to use.</p>
<p>For instance, the Nook constantly delayed taking me to books while the main screen displayed a message that said &#8220;formatting.&#8221; Its standard practice is to open books you select not at the actual start of the book, but at a description of the book. Turning pages inside books was slower than on the Kindle. Looking up a word in the built-in dictionary, a quick process on the Kindle, was far harder on the Nook. Even swiping the touch screen to turn pages would suddenly stop working for periods of time.</p>
<p>The good news for those who have ordered a Nook, which is currently sold out, is that its software can be updated, and Barnes &#038; Noble is promising to fix the problems, starting with a wirelessly delivered patch next week that it says will improve the speed a bit, get you closer to the start of the book, and repair some of the bugs. </p>
<p>Two things are worth noting here. First, I also criticized the design of the original Kindle and the original Sony (SNE) e-reader, both of which have improved in subsequent iterations. (Sony, which was in this market early, is promising to release its first wireless e-reader later this month.)</p>
<p>Second, the entire e-reader market is still in its infancy. The lack of color in books and periodicals alone is a huge drawback. One day, I suspect both of these products will look like a 1996 Palm (PALM) PDA does compared with an Apple (AAPL) iPhone. </p>
<p>The Nook is a bit shorter and narrower than the Kindle, but it is an ounce heavier and significantly thicker. It has a cleaner look, because the bezel around the screen is narrower and there is no physical keyboard. The touch screen adds a dash of color, though it often goes dark to save battery life.</p>
<p>Like the Kindle, the Nook has built-in cellular connectivity with no monthly charges. But it also adds Wi-Fi, which is free at Barnes &#038; Noble stores, though mostly unusable at other commercial hotspots, because the Nook lacks a Web browser that would allow you to log in. The Kindle has a crude Web browser, but no Wi-Fi.</p>
<p>Speaking of battery life, the Nook&#8217;s is worse than the Kindle&#8217;s. It claims about 10 days of typical use with wireless off, and just two days with wireless on. In my week of tests, with wireless on constantly, I had to charge it three times. Amazon rates the Kindle at 14 days of typical use with wireless off and seven days with wireless on, which squares with my own Kindle experience.</p>
<p>The Nook beats the Kindle in a few areas. Lending is a key one, though only about half of  the commercial titles are eligible for lending, you can lend each one only once to a given person, and loans expire after two weeks. In my tests, lending worked OK after a couple of false starts.</p>
<p>Another is that Barnes &#038; Noble takes advantage of its stores. In addition to getting free Wi-Fi, Nook owners who enter a Barnes &#038; Noble store can read books on their Nooks for free, and get help from staff members.</p>
<p>Unlike the Kindle, the Nook also has a slot for expandable memory cards and a replaceable battery. Barnes &#038; Noble also has companion PC, Mac, iPhone and BlackBerry software for reading e-books, even if you don&#8217;t own a Nook. Amazon has such software, so far, only for the iPhone and PC.</p>
<p>But, while Amazon will synchronize your last page read if you switch from reading a book on one device to using another, Barnes &#038; Noble lacks that capability yet, though it says it will have it soon.</p>
<p>One more thing: The latest standard-size Kindle allows wireless book purchasing in multiple countries. The Nook does so only in the U.S.</p>
<p>My recommendation on the Nook is to wait, even if you prefer its features to the Kindle&#8217;s. It&#8217;s not fully baked yet. </p>

<p>&#8220;Foxconn Electronics (Hon Hai Precision Industry) will be the manufacturing partner for an upcoming tablet PC device from Apple, according to market sources,&#8221; the publication claims. &#8220;The sources indicated they believe the tablet PC features will focus more on e-book functionality rather than music, and that based on Apple&#8217;s marketing strategy, long battery life, quick Internet connectivity and an easy-to-use user interface will be key features of the device.&#8221;</p>

<p>Not a week after <a href="http://digitaldaily.allthingsd.com/20090819/a-nokia-netbook-seriously/">confirming its interest in the netbook market</a>, Nokia leapt into it, <a href="http://www.nokia.com/press/press-releases/showpressrelease?newsid=1336683">uncrating the Booklet 3G</a>&#8211;a 2.8-pound “mini-laptop” with 3G, WiFi and A-GPS support, a 10-inch HD-ready display and a claimed 12 hours of battery life. The machine will feature an Intel (INTC) Atom processor and likely run a version of Microsoft&#8217;s (MSFT) Windows. Finally, it will support Ovi, Nokia’s (NOK) version of Apple’s (AAPL) App Store.</p>
<p>&#8220;A growing number of people want the computing power of a PC with the full benefits of mobility,&#8221; Kai Oistamo, Nokia&#8217;s executive vice president for devices, said in a statement. &#8220;We are in the business of connecting people and the Nokia Booklet 3G is a natural evolution for us. Nokia has a long and rich heritage in mobility and with the outstanding battery life, premium design and all day, always on connectivity, we will create something quite compelling. In doing so we will make the personal computer more social, more helpful and more personal.&#8221;<br />

Quite a pledge. And one that Nokia must deliver on if it’s to become a full-fledged mobile solution provider.</p>
<p>&#8220;Nokia is not trying to move into the extremely competitive market for PCs in general, even though it describes the Booklet 3G as a mini-laptop. What it is doing is moving to protect its key markets,&#8221; said Gold Associates analyst Jack E. Gold. &#8220;Indeed, netbooks are increasingly being sold as mobile device alternatives (or supplements) to smartphones. Many have 3G radios included, can make voice calls (via VoIP) and are increasingly being sold and subsidized by traditional wireless carriers. Therefore, it is logical to see Nokia make this move.&#8221;</p>

<p>&#8220;Contrary to published reports, Apple has not rejected the Google Voice application, and continues to study it.&#8221;</p>
<p>So begins <a href="http://www.apple.com/hotnews/apple-answers-fcc-questions/">Apple’s response to the Federal Communication Commission’s inquiry into its rejection of the app</a> and of its App Store approval process. Seems Google Voice was withheld from the App Store not because of any ill feeling toward Google or a nefarious request from AT&#038;T, but because it too closely mimics the iPhone OS, including management of calls, voicemail and text messages. From Apple’s statement:</p>
<blockquote class="memo"><p>
<strong>Question 1. Why did Apple reject the Google Voice application for iPhone and remove related third-party applications from its App Store?</strong></p>
<p>The application has not been approved because, as submitted for review, it appears to alter the iPhone’s distinctive user experience by replacing the iPhone’s core mobile telephone functionality and Apple user interface with its own user interface for telephone calls, text messaging and voicemail. Apple spent a lot of time and effort developing this distinct and innovative way to seamlessly deliver core functionality of the iPhone. For example, on an iPhone, the “Phone” icon that is always shown at the bottom of the Home Screen launches Apple’s mobile telephone application, providing access to Favorites, Recents, Contacts, a Keypad, and Visual Voicemail. The Google Voice application replaces Apple’s Visual Voicemail by routing calls through a separate Google Voice telephone number that stores any voicemail, preventing voicemail from being stored on the iPhone, i.e., disabling Apple’s Visual Voicemail. Similarly, SMS text messages are managed through the Google hub—replacing the iPhone’s text messaging feature. In addition, the iPhone user’s entire Contacts database is transferred to Google’s servers, and we have yet to obtain any assurances from Google that this data will only be used in appropriate ways. These factors present several new issues and questions to us that we are still pondering at this time.</p>
<p><strong>Question 2. Did Apple act alone, or in consultation with AT&#038;T, in deciding to reject the Google Voice application and related applications? If the latter, please describe the communications between Apple and AT&#038;T in connection with the decision to reject Google Voice. Are there any contractual conditions or non-contractual understandings with AT&#038;T that affected Apple’s decision in this matter?</strong></p>
<p>Apple is acting alone and has not consulted with AT&#038;T about whether or not to approve the Google Voice application. No contractual conditions or non-contractual understandings with AT&#038;T have been a factor in Apple’s decision-making process in this matter.
</p></blockquote>
<p>In <a href="http://wireless.fcc.gov/releases/8212009_ATT_Response_FCC_iPhone_Letter.pdf">a response of its own</a>, AT&#038;T (T) also said this was the case:</p>
<blockquote class="memo"><p>
<strong>1(a). What role, if any, did AT&#038;T play in Apple’s consideration of the Google Voice and related applications?   </strong></p>
<p>AT&#038;T had no role in Apple’s consideration of Google Voice or related applications.</p>
<p><strong>1(b). What role, if any, does AT&#038;T play in consideration of iPhone applications generally?  </strong></p>
<p>The Apple App Store is owned, operated and controlled by Apple, not AT&#038;T, and Apple makes the decisions regarding the specific applications that are approved for use on the iPhone or included in the Apple App Store. AT&#038;T does not participate in Apple’s day-to-day consideration of specific applications, nor does Apple typically notify AT&#038;T prior to including applications in the App Store. Apple also does not usually advise AT&#038;T after specific applications have been added to the App Store, which reportedly contains more than 65,000 applications. AT&#038;T has had discussions with Apple regarding only a handful of applications that have been submitted to Apple for review where, as described below, there were concerns that the application might create significant network congestion.
 </p></blockquote>
<p>And what is Google&#8217;s (GOOG) public reply to the whole affair? Nada. The company had more to say to the government, via a response to FCC queries. But in <a href="http://wireless.fcc.gov/releases/8212009_google_filing_iPhone_Inquiry_PUBLIC_REDACTED.pdf">the copy of the document that&#8217;s been released for public consumption</a>, the most interesting stuff has been redacted. To wit: &#8220;What explanation was given (if any) for Apple&#8217;s rejection of the Google Voice application?&#8230;Please describe any communications between Google and AT&#038;T or Apple on this topic and a summary of any meetings or discussion.&#8221; (Click on text below to enlarge.)</p>

<p>Now that&#8217;s a little odd, isn&#8217;t it? Why would Google ask the FCC to redact portions of its statement? <a href="http://wireless.fcc.gov/releases/8212009_Google_Filing_iPhone_Inquiry_CONFIDENTIALITY.pdf">Says Google</a>: &#8220;[Because the redacted] information relates specifically to private business discussions between Apple and Google and, as such, it constitutes commercial data &#8216;which would customarily be guarded from competitors.&#8217;&#8221;</p>
<p>That satisfy your curiosity? Doesn&#8217;t satisfy mine, either.</p>

<p><strong>UPDATE:</strong> AT&#038;T may not participate in &#8220;Apple’s day-to-day consideration of specific applications,&#8221; but its presence is still felt during the approval process. From Apple&#8217;s (AAPL) response:</p>
<blockquote class="memo"><p>There is a provision in Apple&#8217;s agreement with AT&#038;T that obligates Apple not to include functionality in any Apple phone that enables a customer to use AT&#038;T&#8217;s cellular network service to originate or terminate a VoIP (voice over Internet Protocol) session without obtaining AT&#038;T&#8217;s permission. Apple honors this obligation, in addition to respecting AT&#038;T&#8217;s customer terms of service, which, for example, prohibit an AT&#038;T customer from using AT&#038;T&#8217;s cellular service to redirect a TV signal to an iPhone. From time to time, AT&#038;T has expressed concerns regarding network efficiency and potential network congestion associated with certain applications, and Apple takes such concerns into consideration.</p></blockquote>
<p><strong>UPDATE:</strong> An interesting nugget from AT&#038;T&#8217;s statement:</p>
<blockquote class="memo"><p>It is widely recognized by economists and jurists that parties to strategic alliances in competitive markets may enter into contracts to promote and protect their respective business interests and to refrain from taking actions adverse to those interests.12 Consistent with such lawful, economically efficient practices common among parties to strategic alliances, including participants in the mobile wireless marketplace,13 AT&#038;T and Apple agreed that Apple would not take affirmative steps to enable an iPhone to use AT&#038;T’s wireless service (including 2G, 3G and Wi-Fi) to make VoIP calls without first obtaining AT&#038;T’s consent. AT&#038;T and Apple also agreed, however, that if a third party enables an iPhone to make VoIP calls using AT&#038;T’s wireless service, Apple would have no obligation to take action against that third party&#8230;.AT&#038;T indicated to Apple that it does not object to Apple enabling VoIP applications for the iPhone that use Wi-Fi connectivity (including connectivity at more than 20,000 Wi-Fi hotspots operated by AT&#038;T that may be used by iPhone customers for no additional charge) rather than AT&#038;T’s 2G or 3G wireless data services&#8230;.we plan to take a fresh look at possibly authorizing VoIP capabilities on the iPhone for use on AT&#038;T’s 3G network.</p></blockquote>

<p>&#8220;Contrary to published reports, Apple has not rejected the Google Voice application, and continues to study it.&#8221; </p>
<p>So begins <a href="http://www.apple.com/hotnews/apple-answers-fcc-questions/">Apple’s response to the Federal Communication Commission’s inquiry into its rejection of the app</a> and of its App Store approval process. Seems Google Voice was withheld from the App Store not because of any ill feeling toward Google or a nefarious request from AT&#038;T, but because it too closely mimics the iPhone OS, including management of calls, voicemail and text messages. From Apple’s statement:</p>
<blockquote class="memo"><p>
<strong>Question 1. Why did Apple reject the Google Voice application for iPhone and remove related third-party applications from its App Store?</strong> </p>
<p>The application has not been approved because, as submitted for review, it appears to alter the iPhone’s distinctive user experience by replacing the iPhone’s core mobile telephone functionality and Apple user interface with its own user interface for telephone calls, text messaging and voicemail. Apple spent a lot of time and effort developing this distinct and innovative way to seamlessly deliver core functionality of the iPhone. For example, on an iPhone, the “Phone” icon that is always shown at the bottom of the Home Screen launches Apple’s mobile telephone application, providing access to Favorites, Recents, Contacts, a Keypad, and Visual Voicemail. The Google Voice application replaces Apple’s Visual Voicemail by routing calls through a separate Google Voice telephone number that stores any voicemail, preventing voicemail from being stored on the iPhone, i.e., disabling Apple’s Visual Voicemail. Similarly, SMS text messages are managed through the Google hub—replacing the iPhone’s text messaging feature. In addition, the iPhone user’s entire Contacts database is transferred to Google’s servers, and we have yet to obtain any assurances from Google that this data will only be used in appropriate ways. These factors present several new issues and questions to us that we are still pondering at this time.</p>
<p><strong>Question 2. Did Apple act alone, or in consultation with AT&#038;T, in deciding to reject the Google Voice application and related applications? If the latter, please describe the communications between Apple and AT&#038;T in connection with the decision to reject Google Voice. Are there any contractual conditions or non-contractual understandings with AT&#038;T that affected Apple’s decision in this matter?</strong></p>
<p>Apple is acting alone and has not consulted with AT&#038;T about whether or not to approve the Google Voice application. No contractual conditions or non-contractual understandings with AT&#038;T have been a factor in Apple’s decision-making process in this matter.

<p>In <a href="http://wireless.fcc.gov/releases/8212009_ATT_Response_FCC_iPhone_Letter.pdf">a response of its own</a>, AT&#038;T (T) also said this was the case:</p>

<strong>1(a). What role, if any, did AT&#038;T play in Apple’s consideration of the Google Voice and related applications?   </strong></p>
<p>AT&#038;T had no role in Apple’s consideration of Google Voice or related applications.   </p>
<p><strong>1(b). What role, if any, does AT&#038;T play in consideration of iPhone applications generally?  </strong></p>
<p>The Apple App Store is owned, operated and controlled by Apple, not AT&#038;T, and Apple makes the decisions regarding the specific applications that are approved for use on the iPhone or included in the Apple App Store. AT&#038;T does not participate in Apple’s day-to-day consideration of specific applications, nor does Apple typically notify AT&#038;T prior to including applications in the App Store. Apple also does not usually advise AT&#038;T after specific applications have been added to the App Store, which reportedly contains more than 65,000 applications. AT&#038;T has had discussions with Apple regarding only a handful of applications that have been submitted to Apple for review where, as described below, there were concerns that the application might create significant network congestion.

<p>And what is Google&#8217;s (GOOG) public reply to the whole affair? Nada. The company had more to say to the government, via a response to FCC queries. But in <a href="http://wireless.fcc.gov/releases/8212009_google_filing_iPhone_Inquiry_PUBLIC_REDACTED.pdf">the copy of the document that&#8217;s been released for public consumption</a>, the most interesting stuff has been redacted. To wit: &#8220;What explanation was given (if any) for Apple&#8217;s rejection of the Google Voice application?&#8230;Please describe any communications between Google and AT&#038;T or Apple on this topic and a summary of any meetings or discussion.&#8221; (Click on text below to enlarge.)</p>

<p>Now that&#8217;s a little odd, isn&#8217;t it? Why would Google ask the FCC to redact portions of its statement? <a href="http://wireless.fcc.gov/releases/8212009_Google_Filing_iPhone_Inquiry_CONFIDENTIALITY.pdf">Says Google</a>: &#8220;[Because the redacted] information relates specifically to private business discussions between Apple and Google and, as such, it constitutes commercial data &#8216;which would customarily be guarded from competitors.&#8217;&#8221;</p>
<p>That satisfy your curiosity? Doesn&#8217;t satisfy mine, either.</p>

<p><strong>UPDATE:</strong> AT&#038;T may not participate in &#8220;Apple’s day-to-day consideration of specific applications,&#8221; but its presence is still felt during the approval process. From Apple&#8217;s (AAPL) response:</p>
<blockquote class="memo"><p>There is a provision in Apple&#8217;s agreement with AT&#038;T that obligates Apple not to include functionality in any Apple phone that enables a customer to use AT&#038;T&#8217;s cellular network service to originate or terminate a VoIP (voice over Internet Protocol) session without obtaining AT&#038;T&#8217;s permission. Apple honors this obligation, in addition to respecting AT&#038;T&#8217;s customer terms of service, which, for example, prohibit an AT&#038;T customer from using AT&#038;T&#8217;s cellular service to redirect a TV signal to an iPhone. From time to time, AT&#038;T has expressed concerns regarding network efficiency and potential network congestion associated with certain applications, and Apple takes such concerns into consideration.</p></blockquote>
<p><strong>UPDATE:</strong> An interesting nugget from AT&#038;T&#8217;s statement: </p>
<blockquote class="memo"><p>It is widely recognized by economists and jurists that parties to strategic alliances in competitive markets may enter into contracts to promote and protect their respective business interests and to refrain from taking actions adverse to those interests.12 Consistent with such lawful, economically efficient practices common among parties to strategic alliances, including participants in the mobile wireless marketplace,13 AT&#038;T and Apple agreed that Apple would not take affirmative steps to enable an iPhone to use AT&#038;T’s wireless service (including 2G, 3G and Wi-Fi) to make VoIP calls without first obtaining AT&#038;T’s consent. AT&#038;T and Apple also agreed, however, that if a third party enables an iPhone to make VoIP calls using AT&#038;T’s wireless service, Apple would have no obligation to take action against that third party&#8230;.AT&#038;T indicated to Apple that it does not object to Apple enabling VoIP applications for the iPhone that use Wi-Fi connectivity (including connectivity at more than 20,000 Wi-Fi hotspots operated by AT&#038;T that may be used by iPhone customers for no additional charge) rather than AT&#038;T’s 2G or 3G wireless data services&#8230;.we plan to take a fresh look at possibly authorizing VoIP capabilities on the iPhone for use on AT&#038;T’s 3G network.</p></blockquote>
