Court Says eBay Sales of L'Oréal Samples Breach Trademark

EBay Inc. may have to change the way it protects L’Oréal SA’s trademarks after Europe’s highest court said Thursday that the cosmetics company can prohibit the sale on the auction site of free samples and products intended for outside Europe. However, the European Court of Justice’s advocate general, Niilo Jaaskinen, in giving his opinion, said eBay could continue to purchase advertising keywords, including L’Oréal trademarks, in order to direct users of Internet search engines to its site.

Electronic Mirrors Sell Lipstick and a Makeover

Cosmetics aisles in supermarkets and drugstores are adding electronic makeover specialists with the help of an Israeli start-up. Retailers including Wal-Mart Stores Inc., France’s Carrefour SA and Superdrug Stores PLC in Britain are testing EZface Inc.’s “virtual mirrors” in their stores to simulate what makeup and hair dye would look like on shoppers.

French Court Fines eBay €1.7 Million

LVMH Moet Hennessy Louis Vuitton said Monday that a French court fined eBay €1.7 million ($2.6 million) over perfume listings, despite filtering technology that the online auctioneer said is screening out unlawful items. The court accused eBay of “the unlawful marketing” of Christian Dior, Givenchy and other LMVH cosmetics.

L’Oréal Unable to Do It eBay

Cosmetics giant L’Oréal is 0-5 in its legal cases against eBay over the counterfeit perfumes and face creams listed on the auction site. Today the High Court in London ruled that eBay was “not jointly liable” for trademark infringements committed by its users, though it could do more to prevent them.
