				<content:encoded><![CDATA[<p>Apple has asked the judge overseeing its patent case with Samsung to hold a hearing to discuss her recent moves to uphold part of a jury&#8217;s billion-dollar <a href="http://allthingsd.com/20120824/samsung-found-in-violation-of-apple-patents/">verdict</a> and <a href="http://allthingsd.com/20130301/judge-reduces-damages-in-apple-samsung-case-orders-new-trial-for-some-products/">order a new trial on other parts of the damages</a>.</p>

<p>In a filing on Wednesday, Apple made the case that it shouldn&#8217;t have to wait to collect on the $600 million in damages that the judge upheld. Judge Lucy Koh had encouraged both sides to exhaust any appeals before returning to discuss the damages issues.</p>
<p>&#8220;Apple takes seriously the Court’s encouragement, but after careful analysis, Apple believes that until the damages retrial is held and supplemental damages are decided, appellate review of the March 1 Order will not be obtainable,&#8221; Apple wrote in its court papers.</p>
<p>Plus, Apple said, &#8220;Samsung benefits enormously from any delay, even delay resulting from a failed attempt at an immediate appeal.&#8221;</p>
<p>&#8220;Samsung must now pay $600 million, and it faces the prospect that it will be liable for hundreds of millions more following a new trial,&#8221; Apple wrote. &#8220;Moreover, despite the jury’s verdict and Samsung’s representations to the Court that an injunction was unnecessary because Samsung was discontinuing all infringing products and implementing design-arounds, Samsung continues to sell the same and additional infringing products without making any payment to Apple. Every day that a final judgment is deferred, Samsung benefits.&#8221;</p>
<p>Samsung not only opposes the request, but in paperwork filed on Thursday, the company asked for more than its allotted five pages because of the substantive issues raised in Apple&#8217;s motion.</p>
<p>&#8220;Samsung respectfully submits that Apple’s motion, which involves fundamental questions involving the scope and timing of any new trial, is not a proper use of the rule governing Motions for Administrative Relief, which may address &#8216;miscellaneous administrative matters,&#8217;&#8221; Samsung said in its filing on Thursday. &#8220;Samsung respectfully requests that it be allotted 10 pages for response.&#8221;</p>
<p>The ball is now back in Koh&#8217;s court to see just what sort of filings and hearings will be allowed.</p>

				<content:encoded><![CDATA[<p><a href="http://allthingsd.com/files/2012/10/redacted.jpg"><img src="http://allthingsd.com/files/2012/10/redacted-380x234.jpg" alt="" title="redacted" width="380" height="234" class="alignright size-medium wp-image-261813" /></a>Apple used its private financial data to <a href="http://allthingsd.com/tag/apple-samsung/">great effect</a> in its recent courtroom brawl with Samsung, winning a <a href="http://allthingsd.com/20120824/samsung-found-in-violation-of-apple-patents/">$1.05 billion damages award</a>. But not without some cost to the notoriously secretive company: The public disclosure of that data.</p>
<p>U.S. District Judge Lucy Koh on Thursday denied Apple&#8217;s request to seal many of the documents the company used to make its damages case, ordering it to release key financial information regarding &#8220;product-specific unit sales, revenue, profit, profit margin, and cost data.&#8221; Koh argues that Apple cannot both use its financial data to seek multibillion dollar damages and product injunctions, and keep that data secret.</p>
<p>&#8220;Apple’s motion seeks to permanently enjoin the sale of 26 Samsung products that have already been on the market for varying lengths of time, and seeks an enhancement of $535 million on top of the $1.05 billion in damages awarded by the jury,&#8221; Koh said in her ruling. &#8220;Such remedies would have a profound effect on the smartphone industry, consumers, and the public. As the extensive media coverage indicates, this is a truly extraordinary case of exceptional interest to the public. Apple’s reasons would have to be very compelling indeed to overcome the unsually robust public interest in access.&#8221;</p>
<p>And, in Koh&#8217;s opinion, they&#8217;re simply not. Apple&#8217;s main argument for protecting this data is that they are trade secrets that would provide its rivals with a competitive advantage. But evidently that&#8217;s not reason enough. And while Koh agreed to a temporary stay, pending federal court appeal, Apple may soon find itself forced to reveal important sales data that it has long kept private. A blow to the company, but great news for investors and analysts that have long guessed at what it might be.</p>

<p>Oracle said last month that it plans to appeal a federal judge&#8217;s ruling setting aside the <a href="http://allthingsd.com/20101123/oracle-sap-verdict/">$1.3 billion in damages</a> awarded by a federal jury in November of 2010. The German company lost in court after admitting that people in its now-shuttered TomorrowNow unit <a href="http://allthingsd.com/20101109/sap-attorney-board-knew-tomorrownow-was-infringing-at-time-of-acquisition/">illegally downloaded</a> millions of copies of Oracle software. SAP had admitted to the infringement.</p>
<p>Last September, the judge hearing the case <a href="http://allthingsd.com/20110901/judge-throws-out-1-3-billion-judgment-against-sap-as-grossly-excessive/">threw out the damages award</a> as &#8220;grossly excessive,&#8221; and told Oracle it could accept $267 million or seek a new trial. Oracle <a href="http://allthingsd.com/20120207/oracle-to-court-lets-try-sap-again/">opted for a new trial</a>.</p>
<p>Last month, <a href="http://allthingsd.com/20120802/sap-will-pay-oracle-306-million-over-copyright-infringement/">Oracle agreed to accept $306 million from SAP</a>, averting the need for a retrial, and freeing Oracle to appeal the judge&#8217;s ruling on the larger damages award to the Ninth Circuit Court of Appeals. The $1.3 billion award is the largest ever awarded by a jury in a copyright case.</p>
<p>SAP sent a statement essentially saying that it would get the whole thing over and done with: </p>
<blockquote class="memo"><p>
SAP is disappointed that Oracle continues to prolong the case. We agreed to reasonable terms in this case, as we believe it’s gone on long enough. We remain determined to work through the legal process to bring this case to resolution.</p></blockquote>
<p>SAP&#8217;s admission prompted a criminal case, which SAP <a href="http://allthingsd.com/20110908/former-sap-unit-settles-criminal-case/">settled last year</a>. Oracle first filed suit against SAP in April of 2007.</p>

<p>If anyone had any question what irony is exactly, consider this: Today is the <a href="http://allthingsd.com/20110824/steve-jobs-resigns-as-ceo-of-apple/">one-year anniversary of the day Steve Jobs stepped down from his job</a> as the charismatic and legendary leader of Apple, as well as the very moment that the company he co-founded <a href="http://allthingsd.com/20120824/samsung-found-in-violation-of-apple-patents/">has largely won an epic legal battle with Samsung</a> over patent infringement.</p>
<p>The late Apple co-founder was particularly vocal at various times on the issue of copying innovations that he felt his company had pioneered.</p>
<p>That&#8217;s been especially true related to Google Android operating system that Samsung and many other device makers are using.</p>
<p>In a quote by Jobs from Walter Isaacson&#8217;s biography of him, he famously said: </p>
<p>&#8220;I will spend my last dying breath if I need to, and I will spend every penny of Apple&#8217;s $40 billion in the bank, to right this wrong. I&#8217;m going to destroy Android, because it&#8217;s a stolen product. I&#8217;m willing to go thermonuclear war on this.&#8221;</p>
<p>And that has certainly been at the center of the landmark trial over who stole what in the aggressive race to dominate the market for popular smartphones and tablet devices, including Apple&#8217;s iPhone and iPad.</p>
<p>Right now, the <a href="http://allthingsd.com/20120824/apple-samsung-the-verdict-is-in/">verdict from a California jury</a> &#8212; who deliberated for less than 24 hours &#8212; is being read in a San Jose courtroom. </p>
<p>And, so far, it is largely favoring the Silicon Valley-based Apple over the South Korean consumer electronics giant on the wide-ranging patent infringement case.</p>
<p>As <a href="http://live.theverge.com/apple-samsung-verdict-live/">The Verge&#8217;s liveblog of the verdict</a> noted: &#8220;Apple didn&#8217;t win everything &#8212; not by a long shot &#8212; but it won enough to make this a very important day.&#8221;</p>
<p>Indeed.</p>
<p>Those wins include patents related to touchscreen features, such as zooming, as well as on designs. </p>
<p>In addition, so far, Samsung has been ordered to pay Apple $1.05 billion in damages. </p>
<p>The jurors determined that Samsung violated six of seven patents and found that it willfully infringed in five instances. Also: The jury said that all seven of Apple&#8217;s patents were valid, which Samsung had contested.</p>
<p>The findings in the complex case are still being read in court, because it involves many patent infringement allegations on both sides related to dozens of devices.</p>
<p>Legions of lawyers for Apple and Samsung went back and forth on who invented what and whether it was a matter of copying or simple inspiration. </p>
<p>Samsung, naturally, said the various devices might be similar, but not the same. Apple begged to differ.</p>
<p>Jobs would have been in agreement, too, had he lived to see the verdict &#8212; he <a href="http://allthingsd.com/20111005/steve-jobs-has-died/">died of pancreatic cancer in October</a> of last year, only months after stepping down.</p>
<p>But, in his <a href="http://allthingsd.com/20110824/steve-jobs-resignation-letter-i-have-made-some-of-the-best-friends-of-my-life-at-apple/">resignation letter a year ago</a>, he wrote about the importance of innovation:  </p>
<p>&#8220;I believe Apple&#8217;s brightest and most innovative days are ahead of it. And I look forward to watching and contributing to its success in a new role. I have made some of the best friends of my life at Apple, and I thank you all for the many years of being able to work alongside you.&#8221;</p>

				<content:encoded><![CDATA[<p><a href="http://allthingsd.com/20111219/facebooks-social-ad-strategy-suffers-legal-blow/lawsuits_380/" rel="attachment wp-att-155109"><img src="http://allthingsd.com/files/2011/12/lawsuits_380.png" alt="" title="lawsuits_380" width="380" height="285" class="alignright size-full wp-image-155109" /></a>The poet Robert Frost once observed that &#8220;&#8230; A jury consists of twelve persons chosen to decide who has the better lawyer.&#8221; How then to interpret the mixed-bag verdict delivered yesterday in the first phase of the lawsuit pitting software giant Oracle against the search engine concern Google, over the use of parts of Java to build the Android mobile operating system?</p>
<p>Asked to decide whether Google had infringed upon Oracle&#8217;s copyrights to certain parts of the Java programming language, the jury agreed that it had. But then, when asked to decide on four specific examples of that infringement, jurors could agree on only one: The rangeCheck method in TimSort.java and ComparableTimSort.java. Don&#8217;t ask me to explain exactly what it is, but it is being described widely as &#8220;nine lines of code.&#8221; And, unfortunately for Oracle, the damages it can collect are limited to somewhere in the neighborhood of $150,000 to $200,000, or less than pocket change for either company, not the $1 billion or more Oracle had said it wanted.</p>
<p>Jurors were also unable to decide if the portions of Java code that it copied could be protected by the long-established doctrine of <a href="http://en.wikipedia.org/wiki/Fair_use">Fair Use</a>, under which certain infringements can be excused. Google lawyers pounced on this, and said they would move for a mistrial.</p>
<p>The conclusion is that Oracle proved at least part of its argument, but failed to prove the dramatic injury it said it had suffered. It also proved that Google knew that it needed a license to Java in order to use the portions of Java that it did use. The complication there was the fact that one flavor of Java is compatible with other flavors of Java: It still operates under the old &#8220;write once, run anywhere&#8221; principle that Sun Microsystems envisioned when it created Java. Oracle still wants Google to take out a commercial license that would require Google to maintain Java compatibility with other platforms.</p>
<p>Still undecided &#8212; and this is the big issue that has the eyes of the software industry watching this case closely &#8212; is whether Oracle can prevail on the issue of protecting software APIs using a copyright in the first place. Jurors were instructed to proceed under the assumption that this was a matter of settled law, <a href="http://allthingsd.com/20120415/its-on-oracle-and-google-to-meet-in-world-series-of-ip-lawsuits/">when in fact it is not</a>. Judge William Alsup will decide on this issue later, and it is unclear exactly how the jury verdict in the first phase of this case will affect his decision.</p>
<p>Had Oracle won a more ringing endorsement from the jury, that portion of the argument might seem to be stronger. It&#8217;s an important point that Google argued against, saying APIs shouldn’t be subject to copyright protection, because they’re more like tools and techniques that programmers use to build software. You can copyright a given program because it’s unique, but you can’t copyright the language it’s written in. The possibly strained analogy I came up with before is this: You can copyright a musical composition like Miles Davis&#8217;s &#8220;<a href="http://www.youtube.com/watch?v=DEC8nqT6Rrk">So What</a>,&#8221; but you can&#8217;t copyright the form of music known as <a href="http://en.wikipedia.org/wiki/Jazz">jazz</a>.</p>
<p>Oracle argued at trial that copyright law offers the only proper protection for original expression in software, mainly because software advances are incremental, building upon previous advances and innovations. Laws governing trade secrets and patents don&#8217;t get the job done. Oracle lawyers contended that copyright law, while still imperfect, protects innovations and advances at a more granular level, but mainly against copying.</p>
<p>Also still ahead is the patent phase of the trial, where Oracle will assert that Google violated Java patents in building Android. After that, there will be a third phase, where the two parties will wrangle over damages. So far, it seems &#8212; unless Oracle prevails in the patent portion &#8212; that there won&#8217;t be much to wrangle over.</p>
<p>At least for now, it appears that Google has escaped the worst of Oracle&#8217;s accusations. That was the conclusion of shareholders of both companies. Google shares rose by more than 2 percent on the news of the verdict yesterday, closing at $607.55 a share. Oracle shares fell by more than 1 percent to close at $27.92 a share. The case isn&#8217;t over, and Google hasn&#8217;t exactly come out of it looking virtuous. But if the point of defending against a lawsuit is to escape paying huge monetary damages, Google won the day.</p>

<p>The jury has had the case since Monday, and as yet there&#8217;s no indication of when its deliberations will be complete.</p>
<p>The basic questions jurors are wrestling with concern whether and how it is or isn&#8217;t okay for a company to copy portions of software code that would otherwise require a commercial license. Also looming large over the proceedings is whether or not a programming language can by itself by protected by copyright. Oracle lawyers argued at trial that it can, but this is by no means a legal slam dunk.</p>
<p>Google lawyers, for their part, argued that the copying was insignificant, or  &#8220;<a href="http://allthingsd.com/20120501/jury-deliberates-oracle-google-trial-the-world-waits/">no big deal whatsoever</a>.&#8221;</p>
<p>Oracle sued Google in 2010, after acquiring Sun Microsystems and becoming the owner of the Java programming language. Google stands accused of using some parts of Java to create Android without having first obtained the relevant licenses, first from Sun, then from Oracle, a license that among other things required compatibility with other flavors of Java.</p>
<p>Once the jury comes back, which could be as soon as today (but we thought that earlier this week), the trial will shift to a second phase over patents. After that, assuming Oracle prevails in one or both of the first two phases, a third phase will determine the amount of damages, if any. The full trial is expected to last two months.</p>
<p>Lots of people are waiting on the outcome of this first phase, however. To all of them, I dedicate Tom Petty&#8217;s &#8220;The Waiting.&#8221;</p>

<p>On the sixth page of its <a href="http://allthingsd.com/20120312/breaking-yahoo-sues-facebook-for-patent-infringement/">just-filed patent lawsuit</a> against Facebook, Yahoo quotes the social networking company&#8217;s CEO and co-founder Mark Zuckerberg: </p>
<p>&#8220;Getting there first is not what it&#8217;s all about.&#8221;</p>
<p>The quote, which Yahoo contends shows Zuckerberg has &#8220;conceded that the design of Facebook is not novel and based on the ideas of others,&#8221; is woefully taken out of context, but it&#8217;s an attempt to hit home one point:</p>
<p>We were here first and we have more patents. </p>
<p>Even if, as it has turned out, Yahoo has done little over the years with the innovation those patents might represent. Meanwhile, Facebook has run the bases with the wide range of the advertising, messaging, customization, privacy and social networking concepts involved.</p>
<p>Of the 10 patents Yahoo is using in the 19-page lawsuit, filed today in California, the company said: &#8220;For much of the technology upon which Facebook was based, Yahoo was there first.&#8221;</p>
<p>First but <em>worst</em>, as Yahoo has struggled in recent years to make itself more relevant and prevent the decline of its once mighty business.</p>
<p>Via a series of ineffective leaders and strategies, that has not worked at all, as its business has declined. Now &#8212; under the much more in-your-face reign of new CEO Scott Thompson &#8212; Yahoo is hoping that courts will determine that what it says it invented counts for something.</p>
<p>&#8220;Facebook&#8217;s entire social network model, which allows users to create profiles for and connect with, among other things, persons and businesses, is based on Yahoo&#8217;s patented social networking technology,&#8221; Yahoo&#8217;s lawsuit reads, in part. </p>
<p>That includes in the legal action, Yahoo alleges, Facebook&#8217;s popular News Feed, advertising methods, privacy settings and more. The company adds that Facebook has been &#8220;free riding&#8221; on Yahoo&#8217;s intellectual property and that royalty payments alone will not suffice.</p>
<p>So what does Yahoo want for this alleged free ride? Triple damages and to enjoin Facebook from operating by using said patents.</p>
<p>Given the scope of the patents Yahoo said it has, that means it wants Facebook to essentially close down.</p>
<p>Therefore, I would be expecting Facebook to poke back in three &#8230; two &#8230; one &#8230;</p>

<p>In what is either the boldest gamble of its history or the most boneheaded, Yahoo has filed a massive patent infringement lawsuit against Facebook.</p>
<p>The attack by the Silicon Valley Internet icon against perhaps the most powerful consumer social networking site today &#8212; also based in tech&#8217;s heartland and also an important partner of Yahoo &#8212; is sure to be a controversial one, pitting Yahoo against a company that has surpassed it handily in recent years in regards to popularity among consumers.</p>
<p>&#8220;Facebook&#8217;s entire social network model, which allows users to create profiles for and connect with, among other things, persons and businesses, is based on Yahoo&#8217;s patented social networking technology,&#8221; Yahoo&#8217;s lawsuit reads, in part. </p>
<p>That includes, Yahoo alleges, Facebook&#8217;s popular News Feed, advertising methods, privacy settings and more. The company adds that Facebook has been &#8220;free riding&#8221; on Yahoo&#8217;s intellectual property and that royalty payments alone will not suffice.</p>
<p>So what does Yahoo want for this alleged free ride? Triple damages and to enjoin Facebook from operating by using said patents.</p>
<p>The <a href="http://allthingsd.com/20120312/worst-but-first-yahoo-uses-words-of-facebooks-zuckerberg-to-poke-him-in-patent-lawsuit/">19-page lawsuit over 10 patents</a> &#8212; related to advertising, privacy, customization, messaging and social networking &#8212; comes as Yahoo is seeking to right itself under new CEO Scott Thompson.</p>
<p>Multiple sources said he is primarily driving this new aggressiveness from Yahoo. </p>
<p>Since Yahoo told the New York Times that it was considering such a move last week, the issue has been <a href="http://allthingsd.com/20120228/so-its-the-kodak-strategy-for-yahoo-the-last-refuge-of-the-vaguely-patented/">widely debated within the company</a>, with many top techies there opposed to it, due to the company&#8217;s longstanding ethos of using patents for defense rather than offense. </p>
<p>Thus, the decision to move was closely held, sources said, with only Thompson and legal chief Michael Callahan largely working on it.</p>
<p>Still, patent lawsuits have become ever more prevalent among tech companies, as they seek to battle for advantage in a rapidly changing competitive landscape. Apple, Google, Microsoft and others are involved in several legal actions, although they are largely related to mobile technology.</p>
<p>Yahoo&#8217;s lawsuit is the most prominent in the social networking arena, a sector that has seen a huge explosion of late. Its timing could not be worse for Facebook, since it is in a quiet period for its upcoming IPO, which is expected to value the company at close to $100 billion. </p>
<p>Yahoo has done this kind of thing before, of course, having wrangled with Google until right before it went public in 2004 over search patents from its Overture acquisition. The pair settled 10 days before the Google IPO, with Yahoo getting several million more shares of that stock.</p>
<p>Yahoo is shaking Facebook down for much more here and with much higher stakes for both companies. If successful, Yahoo could seriously damage Facebook&#8217;s initial public offering; if not, Yahoo will cement its growing reputation as a company with nothing to lose, whose value is built not on its current business, but on non-operating assets. </p>
<p>More importantly, at least initially, the move did nothing to boost Yahoo&#8217;s moribund shares &#8212; the stock was down about one percent to $14.49 in after-hours trading.</p>

<p>Said Yahoo, in its statement: </p>
<p>&#8220;Yahoo! has invested substantial resources in research and development through the years, which has resulted in numerous patented inventions of technology that other companies have licensed. These technologies are the foundation of our business that engages over 700 million monthly unique visitors and represent the spirit of innovation upon which Yahoo! is built. Unfortunately, the matter with Facebook remains unresolved and we are compelled to seek redress in federal court. We are confident that we will prevail.&#8221;</p>
<p>Facebook, obviously, disagrees, and also threw in a jab about the lack of discussions over the issue between the pair:</p>
<p>&#8220;We&#8217;re disappointed that Yahoo, a longtime business partner of Facebook and a company that has substantially benefited from its association with Facebook, has decided to resort to litigation. Once again, we learned of Yahoo&#8217;s decision simultaneously with the media. We will defend ourselves vigorously against these puzzling actions.&#8221;</p>
<p>I&#8217;ll admit to also being puzzled about the <em>strategery</em> here, but I am sure there will be much more to come.</p>

<p>And here is what I wrote last week on the subject:</p>
<blockquote class="memo"><p>Apparently, Yahoo&#8217;s new motto: If you can&#8217;t beat &#8216;em &#8212; and it <em>can&#8217;t</em> &#8212; sue &#8216;em.</p>
<p>That would be Yahoo &#8212; the perpetual 98-pound weakling of the Internet these days &#8212; threatening powerful Facebook, which had cleanly bested it by attracting hordes of users with a plethora of popular products and services.</p>
<p>Yahoo has already lost its audience to Facebook, which was most recently followed by its frittering away a commanding lead in display advertising, too.</p>
<p>That would also be the Yahoo whose most recent success in improving its increasingly tenuous connections with customers was, in fact, by deeply integrating Facebook&#8217;s social hooks into its Web properties.</p>
<p>That would be the Yahoo which has failed time and again to innovate its own offerings so drastically over the years that it has now apparently decided that its first and best strategic move under Thompson’s rule is a shakedown.</p>
<p>Such a cynical move on rights Yahoo has long held seems more a play for the cheap seats of Wall Street, given that the company needs to look like it is doing everything it can to turn things around right now as it faces a proxy challenge.</p>
<p>First, it ended difficult talks with its Asian partners, Alibaba Group and SoftBank, over selling back lucrative stakes there.</p>
<p>Now, according to sources, Yahoo&#8217;s Thompson has actually been trying to make very nice with activist shareholder Daniel Loeb of Third Point &#8212; on-the-down-low chitchats that might have played a part of this latest unusual move.</p>
<p>At least Kodak had a good excuse. The once iconic camera company had recently been trying to take advantage of its trove of patents as a way to stave off declaring bankruptcy.</p>
<p>That didn&#8217;t work for Kodak, and it will also not work for Yahoo, whose only real option is to try to innovate its way out of the mess it has landed itself in.</p>
<p>You know, with good ideas.</p>
<p>Instead, the company&#8217;s leadership has opted for a road that could rain down trouble and paint Yahoo as a company bereft of talent to win any other way.</p>
<p>And while a range of intellectual property lawsuits have broken out all over the digital sector, involving Apple, Microsoft, Google and many others, such a strategy for Yahoo could be dangerous if it fails in its legal effort to take advantage of its 1,000-plus patents, including those related to search and advertising.</p>
<p>Others &#8212; including such tech luminaries as LinkedIn&#8217;s Reid Hoffman, who co-owns the seminal Six Degrees patent for constructing a networking database and system &#8212; hold a number of critical social networking patents, too, so who knows where this thing will go.</p>
<p>Nonetheless, Yahoo has decided to emulate those companies with one of the few valuable assets it might have, waging its little war, right as Facebook is in the midst of its initial public offering period.</p>
<p>Yahoo has done this before, of course, having wrangled with Google until right before it went public in 2004 over search patents from its Overture acquisition. The pair settled 10 days before the Google IPO, with Yahoo getting several million more shares of that stock (which it then, of course, sold too soon).</p>
<p>That certainly could happen here, with Yahoo managing to grab a chunk of Facebook&#8217;s pre-IPO stock.<br />
That would mean that Yahoo’s most valuable asset would be those shares, as well as its stake in Asian companies it bought a while back for a bargain and now makes up a bulk of the company&#8217;s valuation.</p>
<p>As to Yahoo&#8217;s core business &#8212; investors consider it almost entirely worthless.</p>
<p>And let&#8217;s not forget: Facebook could also sue right back, which it very well might do. Or, perhaps, cut off agreeable ties that have aided Yahoo in recent years.</p>
<p>In other words, in poking Facebook, Yahoo might now learn what it is really like to be de-friended.</p></blockquote>

<p>The Singapore-based media group, which publishes 18 newspapers here, seeks unspecified damages from Yahoo Southeast Asia Pte. Ltd. for the alleged copyright infringements, as well as a legal injunction to prevent further infringements, according to a writ filed last week to the city-state&#8217;s High Court.</p>

<p>The latest sticking point: A recommendation from Oracle&#8217;s damages expert arguing the company is owed more than $2 billion for copyright infringement and $201.8 million more for patent infringement. </p>
<p>That&#8217;s significantly less than the $6.1 billion Oracle claimed Google owes it in court papers, but it&#8217;s still far too heady a figure for the search giant.  </p>
<p><a href="http://www.reuters.com/article/2011/09/21/us-google-oracle-idUSTRE78K3XL20110921">Reuters reports</a> that in a Tuesday letter to the judge presiding over the case, Google attorney Robert Van Nest urged the court to reject that recommendation, slagging it as deficient.  According to Van Nest, its failure to explain just how the figure was calculated and the forecast for how much revenue Oracle might have earned by partnering with Google on Android are grounds enough for ignoring it.</p>
<p>Meanwhile, talks between the dueling Larrys drag on, with an October trial date looming if they fail to reach a settlement.</p>

<p>Aghast at the U.S. International Trade Commission&#8217;s <a href="http://digitaldaily.allthingsd.com/20110325/itc-apple-did-not-infringe-nokia-patents/">ruling on its first complaint against Apple</a>, Nokia has filed a second, accusing Apple of infringing its patents &#8220;in virtually all of its mobile phones, portable music players, tablets, and computers.&#8221;</p>
<p>At issue in the complaint are seven patents that Nokia argues &#8220;are now being used by Apple to create key features in its products in the areas of multi-tasking operating systems, data synchronization, positioning, call quality and the use of Bluetooth accessories.&#8221; Taken together with the IP cited in Nokia&#8217;s  previous ITC complaint and related cases in the U.S., U.K., Germany and The Netherlands, the company has nearly four dozen patents in play in its suit against Apple.</p>
<p>&#8220;Our latest ITC filing means we now have 46 Nokia patents in suit against Apple, many filed more than 10 years before Apple made its first iPhone,&#8221; Paul Melin, Nokia&#8217;s VP of intellectual property said in a statement. &#8220;Nokia is a leading innovator in technologies needed to build great mobile products and Apple must stop building its products using Nokia&#8217;s proprietary innovation.&#8221;</p>
<p>Almost sounds like Nokia&#8217;s saying it invented the iPhone, doesn&#8217;t it? Which is ironic, considering the company is on the record professing its fondness for Apple’s handset.</p>
<p>Asked once about the striking similarities between a touchscreen device it was designing and the iPhone, Anssi Vanjoki, Nokia’s head of multimedia devices at the time, replied, “If there is something good in the world then we copy with pride.”</p>

<p>So says SAP in a new motion seeking to sharply reduce that award, which it says is in conflict with copyright law and founded on sheer speculation.</p>
<p>&#8220;The jury’s $1.3 billion &#8216;hypothetical license&#8217; fee award was an unreasonable amount that went far beyond what was needed to make Oracle whole,&#8221; <a href="http://www.tnlawsuit.com/uploads/1044%20-%20Defs%20Renewed%20Motion%20for%20JMOL%20and%20New%20Trial%20Motion.pdf">SAP argued in its motion</a>.  &#8220;The enormous fee did not&#8211;indeed, could not&#8211;represent Oracle’s actual damages because Oracle never lost a license fee from Defendants or anyone else. The Copyright Act does not permit such awards that are un-tethered to a plaintiff’s actual harm, and the hypothetical license claim should not have gone to the jury.&#8221;</p>
<p> And so SAP is asking the court to drop the award to no more than $408.7 million or order a new trial.</p>
<p> Oracle, of course, believes the verdict should stand and opposes SAP&#8217;s motion. But if its rival should be granted a new trial, Oracle wants to seek an additional half a billion dollars in damages that it feels it lost when the court unfairly excluded its up-sell and cross-sell projections.</p>
<p>&#8220;In the event the Court were to order a new trial, however, Oracle respectfully submits that this Court would be required to review all errors at trial, including those errors that prejudiced Oracle and resulted in a reduction of the damages to which it was entitled,&#8221; the company argues. &#8220;While Oracle believes the jury’s verdict fairly reflects the evidence properly admitted, it also notes that the verdict fell toward the bottom of the range of reasonable license amounts Oracle presented, and that the Court’s rulings on certain issues shifted that range significantly downward. &#8230; [It] cut half a billion dollars from the damages opinion that Oracle’s damages expert would have offered and that fact witnesses would have supported with additional testimony and documentary evidence.&#8221;</p>
<p>In other words, SAP&#8217;s motion is bogus, it doesn&#8217;t deserve a new trial, and if it&#8217;s granted one Oracle wants the chance at a $1.8 billion award. Oracle&#8217;s motion in full below.</p>

SAP would rather <a href="http://www.tnlawsuit.com/uploads/1021%20-%20Defs%20Response%20to%20Pltfs%20Proposed%20Judgment.pdf">not</a> pay Oracle interest on top of the $1.3 billlion in damages awarded the company last month. But it has to, now that a court has granted Oracle&#8217;s demand for prejudgment interest.</p>
<p>Late Tuesday a Federal judge ordered SAP to pay interest on the gargantuan sum Oracle won against it in a November copyright infringement trial. But it also agreed to calculate that interest using a different method from the one employed by Oracle. And in doing so it lopped about $195 million dollars off the prejudgment interest Oracle had originally sought.</p>
<p>So good news or, rather, significantly better bad news. Certainly, SAP was pleased to learn it&#8217;s not obligated to pile quite as much prejudgment interest atop Oracle’s award as it might have been.</p>
<p>&#8220;While we believe that Oracle should only be awarded damages, we appreciate that the Court agreed with SAP on the proper calculation of interest in this case which dramatically lowered the amount,&#8221; an SAP spokesman told me. &#8220;The interest the Court ordered, based on the statutorily-set interest rate of .3 percent and the accrual period of September 29, 2006 through December 23, 2010, is approximately $16.5 million, rather than the over 200 million Oracle was seeking.&#8221;</p>
<p>Of course, that doesn&#8217;t make Oracle&#8217;s damages award any less massive. But then SAP hopes to whittle that down as well.  As the company said in its filing last week: &#8220;Defendants plan to challenge that verdict on a variety of grounds in their post-judgment motions, including that it is excessive and overcompensates Oracle.&#8221;</p>
<p>Oracle declined comment.</p>

<p> In court papers filed Friday, the company demanded SAP pay it $212 million in interest on top of the $1.3 billion in damages it was awarded in the TomorrowNow lawsuit. Should Oracle&#8217;s demand be approved, SAP&#8217;s total penalties would rise to $1.63 billion.</p>
<p>SAP, which argued in court that it should be held liable for no more than $28 million, clearly has no plans to pay Oracle the interest to which it says it&#8217;s entitled.</p>
<p>Said an SAP spokesman, &#8220;We don&#8217;t believe that Oracle is entitled to any additional compensation beyond the final judgement in this case.&#8221; </p>
<p>Reached for comment, Oracle declined to give one.</p>

<p>This in addition to <a href="http://digitaldaily.allthingsd.com/20101102/saps-tab-in-oracle-case-120-million-and-counting/">the $120 million in attorneys’ fees</a> SAP agreed to pay when the trial first began.</p>
<p>SAP, which believed that the damages amounted to about $28 million, had argued that Oracle was looking for an undeserved bonanza out of the jury, while Oracle contended the market value of licensing the IP was between $1.65 billion and $3 billion. </p>
<p>As Nucleus Research&#8217;s Rebecca Wettemann notes, the damage award is &#8220;a drop in the bucket&#8221; to Oracle, but a stern warning to the industry. Looking forward, she said, &#8220;You have to bet Oracle will be reminding customers they&#8217;re choosing between thought leaders and intellectual property thieves&#8211;and what that indicates more broadly about how SAP does business.&#8221;</p>
<p>In a statement issued after the verdict , SAP was contrite:</p>
<blockquote class="memo"><p>&#8220;We are, of course, disappointed by this verdict and will pursue all available options, including post-trial motions and appeal if necessary.  This will unfortunately be a prolonged process and we continue to hope that the matter can be resolved appropriately without more years of litigation. The mark of a leading company is the way it handles its mistakes.  As stated in court, we regret the actions of TN, we have accepted liability, and have been willing to fairly compensate Oracle.  Throughout this matter, our customers, employees and partners have stood by us and, for that, we are grateful. Our focus now is looking forward, helping our customers be best run businesses, and extending our legacy of industry leadership well into the future.   We thank the jury for its diligent service through this lengthy trial and the Court for its supervision of this complex case.&#8221;</p></blockquote>
<p>On behalf of Oracle, President Safra Catz sounded as clinical as Jack Webb wrapping up an episode of &#8220;Dragnet.&#8221; &#8220;For more than three years, SAP stole thousands of copies of Oracle software and then resold that software and related services to Oracle&#8217;s own customers,&#8221; she said in a statement. &#8220;Right before the trial began, SAP admitted its guilt and liability; then the trial made it clear that SAP&#8217;s most senior executives were aware of the illegal activity from the very beginning. As a result, a United States Federal Court has ordered SAP to pay Oracle $1.3 billion. This is the largest amount ever awarded for software piracy.&#8221;</p>

In dueling statements issued Monday night, Oracle branded SAP an IP plunderer and SAP upbraided Oracle for its impolitic behavior and what it seems to view as poor form. Below, both statements in their entirety.</p>
<blockquote class="memo"><p>
<strong>ORACLE on SAP</strong><br />
&#8220;Oracle brought suit to stop the illegal conduct and hold SAP fully accountable for its actions.  Four years ago we discovered massive and indiscriminate downloading of software and support materials from an Oracle support Web site. </p>
<p>SAP immediately and, for three and a half years, repeatedly denied wrongdoing and responsibility. But on the eve of trial SAP began a series of admissions to claims of copyright infringement, violations of state and federal computer fraud laws, unfair competition, breach of contract, interference and other claims that settled liability before the trial began.  Trial evidence and testimony showed that the SAP Executive Board was fully aware of the illegal activity and still acquired TomorrowNow to unlawfully take Oracle support revenues and move Oracle customers to SAP products and to disrupt and discredit Oracle. SAP not only failed to take action to stop the behavior, but it expanded it for 18 months after Oracle filed suit.  </p>
<p>The pre-trial admissions and testimony over the last few weeks have exposed SAP’s scheme to capitalize on the use of stolen intellectual property. While Oracle seeks damages to fairly compensate it for this massive theft, it is perhaps more important to expose the illegal conduct by a dominant player in the industry and to send a message that intellectual property rights must be respected.&#8221;</blockquote class="memo">
<blockquote class="memo"><p>
<strong>SAP on ORACLE</strong><br />
 The time for testimony and sidewalk claims by plaintiff&#8217;s counsel are over.  The actual testimony took place in court.</p>
<p>We are very proud of the SAP legal team and our counsel Jones Day for their work in presenting our defense. We believe we have presented a solid case for the reasonable and appropriate compensation for damages by the limited actions of TomorrowNow.  This case is not about who knew what, did what or supervised what&#8230;those issues were handled by stipulations prior to trial. This case is only about the damages, and we trust now in the jury to examine the evidence and testimony and reach a fair and just conclusion. </p>
<p> SAP has a long history as a trusted partner and we believe our legacy will extend beyond this matter.  Throughout this matter over these three years, our customers and partners have stood by us and for that we are grateful.  The mark of a successful leading company is the way it handles it&#8217;s mistakes.  As indicated in court, we regret the mistakes of TN, we apologize to Oracle, and we have sought to address these mistakes by compensating Oracle for the damages.  All along, we have done the responsible thing by admitting to the mistakes, taking care of the customers, winding down the TN business, and accepting liability.  We are confident we can put this matter behind us and continue our leadership of this industry.</blockquote class="memo">

				<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2010/11/Larry_Billion.jpg" alt="" title="" width="350" height="281" class="aligncenter size-full wp-image-53073" />Closing arguments in the Oracle vs. SAP trial went about as expected, with Oracle attorney David Boies urging the jury to drop the hammer on SAP by awarding $1.7 billion in damages for infringement of intellectual property, and  SAP attorney Robert Mittelstaedt arguing that to do so would be asinine.</p>
<p>  &#8220;The defendants have admitted that their infringement was massive and prolonged,&#8221; Boies said in his closing statement. &#8220;It is clear that SAP&#8217;s board and top executives expected it would be worth billions of dollars.&#8221; And just because SAP wasn&#8217;t able to generate that kind of value from Oracle&#8217;s pilfered IP, doesn&#8217;t mean it shouldn&#8217;t pay full fare for its infringement. &#8220;They took it and they have to pay for it regardless of whether they did well or didn’t do well using it.&#8221;</p>
<p> But SAP would rather not pay what it describes as a poorly caluclated &#8220;bonanza&#8221; award.    &#8220;This case comes down to what is the best measure of compensation,&#8221;  SAP attorney Robert Mittelstaedt argued. &#8220;Oracle&#8217;s [proposed damages] are based on guesswork,&#8221; while SAP&#8217;s are &#8220;based on reality.&#8221;</p>
<p>  And evidently factoring &#8220;reality&#8221; into the equation cuts a hell of a lot of fat off the damages award at issue here. Because Mittelstaedt says SAP feels it owes Oracle just $28 million, which is, remarkably, even less than <a href="http://digitaldaily.allthingsd.com/20101117/damages-expert-to-sap-you-owe-me-14-million-and-oracle-four-times-that/">the  $40.6 million its high-paid damages expert suggested</a>.</p>

Testimony in the  Oracle vs SAP trial wrapped up on Friday with a second appearance by Oracle co-President Safra, who said SAP should pay <i>at least</i> $1.6 billion in damages for the copyright infringement&#8217;s of its TomorrowNow subsidiary and chided the company for its offer of $40 million.</p>
<p>&#8220;[Their offer] doesn&#8217;t value our intellectual property at all,&#8221; she said, adding that TomorrowNow&#8217;s infringement encompassed more than just support documentation. &#8220;Yes, there were documents and help guides and things like that, but there was also the software itself&#8211;probably millions of lines of code, which is what the products really are&#8230;.And we spend billions a year on R&#038;D. This is a business where intellectual property is worth billions.&#8221;</p>
<p>Greg Lanier, a Jones Day attorney representing SAP, pressed her on that point insisting that Oracle isn&#8217;t owed such a large damages award because the value that the company lost to TomorrowKnow&#8217;s infringement is that &#8220;Oracle doesn&#8217;t get the chance to sell that software to someone else.&#8221;</p>
<p>But Catz wasn&#8217;t having any of it.</p>
<p>&#8220;You know, if Warner Brothers had a little subsidiary that copied Disney&#8217;s entire library and started selling it for $2 a copy, and they got caught and then offered to give Disney back half of what they made, is Disney&#8217;s library only worth $50?&#8221; she asked. &#8220;I mean, really. It&#8217;s valuable. The fact that it was copied doesn&#8217;t change that it&#8217;s valuable.&#8221;</p>
<p>Lanier quickly dismissed Catz&#8217;s point as a &#8220;colorful analogy,&#8221; reminding her that there are only 358 lost customers at issue in this case. Hard to imagine that such a &#8220;colorful analogy&#8221; in an otherwise tedious enterprise software case didn&#8217;t resonate with the jury, though. </p>
<p>Closing arguments in the case begin on Monday, with jury deliberations to follow.</p>

Oracle called its last rebuttal witness early Friday and closing arguments will soon follow. In the end, Oracle opted not to show former SAP chief  Léo Apotheker’s videotaped deposition following the advice of lead attorney David Boies, who last week suggested <a href="http://digitaldaily.allthingsd.com/20101112/with-no-apotheker-at-sap-trial-oracle-lawyers-may-choose-insinuation-over-deposition/">leaving the Hewlett-Packard CEO&#8217;s role in all this to jurors’ imaginations</a> might be a better move strategically than showing them Apotheker’s now very dated testimony.</p>
<p>Indeed, speaking to reporters in the courtroom hallway this morning, Boies said that the evidence Oracle presented during the trial proved that Apotheker had knowledge of the copyright infringement scheme at issue in the case. &#8220;The testimony and evidence prove that Mr. Apotheker oversaw the copyright infringement scheme,&#8221; Boies said. &#8220;We did not show the 2 year old video deposition because it was taken before SAP stipulated to liability.&#8221;</p>
<p>Of course if Apotheker was as pivotal a figure as Boies maintains, one would think that there would at least be some content in his video deposition worth showing the jury. Certainly, that&#8217;s the view of SAP, which continues to maintain that Oracle&#8217;s repeated shots at Apotheker are more about the PR trial being conducted outside the courtroom than anything else.</p>
<p>&#8220;Today&#8217;s proceedings focused on the damages, and we remain confident that we have demonstrated a clear case for fair compensation to Oracle for the limited operations of TomorrowNow,&#8221; an SAP spokesperson said in a statement. &#8220;We trust now in the jury to bring this matter to an appropriate conclusion.&#8221;</p>
<p>HP has not yet commented on Boies&#8217;s remarks. The company reports earnings next week, and Oracle would obviously not be unhappy if any of this legal unpleasantness happened to lodge in investors&#8217; minds.</p>
<p><strong>UPDATE:</strong> Here&#8217;s HP&#8217;s official comment: &#8220;Oracle&#8217;s current stance is clear proof that they have been trying to harass Léo and interfere with his work at HP.  As HP has said repeatedly, Oracle had ample opportunity to question Léo in the two years after he gave a full-day deposition.  Léo was never asked to give an additional deposition. As HP and SAP have noted, Oracle chose not to include Leo as a live trial witness until after he was named CEO of HP.  Léo had a limited role in the matter.&#8221;</p>

SAP is expected to rest its case Thursday, after which Oracle will call rebuttal witnesses, among them one of its strongest to date&#8211;President Safra Catz, who last week described SAP&#8217;s offer of $40 million in damages as <a href="http://digitaldaily.allthingsd.com/20101109/oracle-co-president-on-saps-damages-offer-its-crazy/">&#8220;a reward for their bad behavior.&#8221;</a> Presumably, Catz will have a bit more to say on that matter, now that <a href="http://digitaldaily.allthingsd.com/20101117/damages-expert-to-sap-you-owe-me-14-million-and-oracle-four-times-that/">SAP&#8217;s high-priced damages expert has outlined the calculation that got him to that figure</a>. </p>
<p>Then it&#8217;s on to closing arguments, now scheduled for Monday, and finally deliberation. Odd to think that the case has reached this point with so few SAP board members actually testifying live in court. Looking over the final witness list for the trial reveals a number of noteworthy no-shows (beyond Hewlett-Packard CEO Léo Apotheker): Former SAP CEO Henning Kagermann, COO and board member Gerhard Oswald, co-founder and board chairman Hasso Plattner, and, most interestingly, <a href="http://www.sap.com/usa/company/pdf/White_Bio_2009.pdf">CFO Mark White</a>, SAP&#8217;s designated corporate representative for the trial and the guy <a href="http://www.tnlawsuit.com/uploads/file/SAP%20Announces%20Management%20Transition%20at%20TomorrowNow.pdf">tapped by its board to clean up the TomorrowNow mess</a>.</p>
<p> Why didn&#8217;t SAP put them on the stand? Perhaps it&#8217;s because Werner Brandt and <a href="http://digitaldaily.allthingsd.com/20101115/sap-co-ceo-apologizes-for-oracle-ip-theft/">SAP co-Chief Executive Officer Bill McDermott</a>, the only board members to take the stand, fared so poorly there. </p>
<p> Or perhaps it&#8217;s simply because of the way the trial has played out. &#8220;We&#8217;ve said from the start that our focus is on damages, that we are interested in resolution of this dispute and determining a reasonable number for damages, and putting the matter behind us,&#8221; an SAP spokesperson told me. &#8220;The witnesses we call support that focus.  Please keep in mind that there were 73 names on the witness list when it was submitted.  Since that list was submitted, the scope of the trial has been narrowed considerably and the length of the trial has been shortened.&#8221;</p>
<p><strong>UPDATE:</strong> I&#8217;m told Kagermann was prepared to testify live, but did not due to time constraints. His video deposition was played instead.</p>

Paul Meyer, its damages expert, puts that sum at about $1.7 billion.</p>
<p>But SAP damages expert Stephen Clarke argues it shouldn&#8217;t be more than $40.6 million. </p>
<p>Which is ironic considering SAP paid Clarke&#8217;s firm $14 million in fees to determine how much the company owed Oracle for infringing its IP. That&#8217;s more than 25 percent of the sum Clarke ultimately settled on (and $10 million more than the fees Oracle&#8217;s expert collected for his testimony).</p>
<p>But, according to Clarke, calculating damages accurately requires a certain detached objectivity and evidently it comes at a price. &#8220;There&#8217;s no anger or punishment allowed,&#8221; Clarke said Tuesday. &#8220;What happened as a result of that infringement is what matters. The only way to do that is focus on the actual number of contracts at issue here.&#8221;</p>
<p>And that number is just 358, well shy of the &#8220;thousands&#8221; of contracts SAP hoped to win away from Oracle. </p>
<p>Too bad there&#8217;s no dollar value on <a href="http://digitaldaily.allthingsd.com/20101115/sap-co-ceo-apologizes-for-oracle-ip-theft/">SAP co-CEO Bill McDermott&#8217;s apology to Oracle</a> yesterday.</p>
<p>Oracle&#8217;s cross-examination of Clarke is expected to continue into Thursday, after which SAP will likely show a bit of testimonial footage and rest its case. Presumably that will be followed by some rebuttal witnesses from Oracle on Friday and closing arguments sometime the following week.</p>

<p>Why is Oracle so intent on putting former SAP CEO and new HP chief L&eacute;o Apotheker on the stand in the trial that will determine damages in Oracle&#8217;s long-running IP battle with its German rival? </p>
<p>SAP insists it&#8217;s to create a <a href="http://digitaldaily.allthingsd.com/20101112/with-no-apotheker-at-sap-trial-oracle-lawyers-may-choose-insinuation-over-deposition/">&#8220;PR sideshow&#8221;</a>&#8211;which is true to an extent. But sometimes there&#8217;s more to a sideshow than meets the eye. Which is not to say that some nefarious scheme lies at the heart of all this, just that there is a lot of subtext to make sense of in this case. And it&#8217;s being written from two very different views of how damages should be calculated and how important Apotheker is as a variable in that calculation.</p>
<p>SAP&#8217;s view is that now that it has stipulated to liability, damages should be determined according to the actual number of contracts won by TomorrowNow and their value&#8211;not according to the number of contracts it hoped to win.</p>
<p>Oracle&#8217;s view is that damages should be determined by value of the intellectual property stolen from it and SAP&#8217;s ambitions for it. And while SAP&#8217;s stipulation to liability prevents Oracle from introducing evidence on liability, it leaves it free to introduce evidence for &#8220;context&#8221; on damages.</p>
<p>And that&#8217;s where Apotheker comes in.</p>
<p>According to evidence presented in the case, Apotheker chaired the launch of the Safe Passage program, of which the TomorrowNow acquisition was one part. And in his depositions, former SAP board member Shai Agassi clearly identified Apotheker as having  some responsibility for TomorrowNow post acquisition, along with Gerd Oswald.</p>
<p>&#8220;I was the guy who led the the evaluation [of TomorrowNow] with Werner Brandt, who managed the acquisition teams at the time,&#8221; Agassi said. &#8220;The day of the acquisition, it was  basically moved to Gerd Oswald, and the sales effort was moved over to Apotheker. So Safe Passage was managed by Apotheker and Oswald.&#8221;</p>
<p>Add to this the fact that Apotheker reported on TomorrowNow and the Safe Passage program in SAP earnings calls and was the only senior SAP exec quoted in a company release touting the program&#8217;s success, and it seems reasonable to expect that he might be able to provide some of the &#8220;context&#8221; Oracle is looking for (click document below to enlarge). One could argue that his expectations and forecasts for the program&#8217;s success speak directly to Oracle&#8217;s damages.</p>

<p>Or one could argue, as SAP and HP do, that his involvement was incidental and that he had no responsibility for TomorrowNow&#8217;s day-to-day operations and hence no knowledge of its transgressions. </p>
<p>But unless he testifies under oath, we&#8217;ll never know who&#8217;s right. And with Apotheker quietly going about his business at an undisclosed location, it&#8217;s looking like that&#8217;s how things will end up.</p>

				<content:encoded><![CDATA[<p>LimeWire LLC, potentially liable for hundreds of millions of dollars in damages for copyright infringement, issued a cease-and-desist notice of its own Wednesday, trying to prevent anonymous computer programmers from distributing a &#8220;pirate edition&#8221; of its file-sharing software.</p>
<p>A federal court has permanently enjoined the New York company from distributing its software, which lets users upload and download free, often illegal, copies of songs and other media. But earlier this week a new version, &#8220;LimeWire Pirate Edition,&#8221; surfaced online, purportedly created by a &#8220;secret&#8221; team of software developers.</p>
<p>&#8220;We demand that all persons using the LimeWire software, name, or trademark in order to upload or download copyrighted works in any manner cease and desist from doing so,&#8221; said a statement on LimeWire.com. The statement also asserted that the company is &#8220;taking all steps to comply with the injunction.&#8221;</p>
