			<content:encoded><![CDATA[<p><img src="http://allthingsd.com/files/2011/12/Victory-is-mine.png" alt="" title="Victory-is-mine" width="340" height="256" class="alignright size-full wp-image-152186" />Apple has been dealt another setback in its ongoing patent battle with Samsung.</p>
<p>This morning, a Dutch court <a href="http://translate.google.com/translate?sl=auto&amp;tl=en&amp;js=n&amp;prev=_t&amp;hl=en&amp;ie=UTF-8&amp;layout=2&amp;eotf=1&amp;u=http%3A%2F%2Fzoeken.rechtspraak.nl%2Fdetailpage.aspx%3Fljn%3DBV1612%26amp%3Bu_ljn%3DBV1612">dismissed</a> Apple&#8217;s appeal of an earlier ruling which denied it an injunction against Samsung&#8217;s Galaxy Tab 10.1. Apple claims Samsung has copied the look and feel of the iPad, and that the Galaxy Tab 10.1 infringes its patented designs.</p>
<p>Issued by a higher court in The Hague, the <a href="http://fosspatents.blogspot.com/2012/01/dutch-appeals-court-says-galaxy-tab-101.html">ruling allows Samsung to continue selling the Galaxy Tab 10.1 in the Netherlands</a>. More importantly, it allows the company to continue distributing them to other European Union markets via the port of Rotterdam, through which it moves a lot of its EU merchandise.</p>
<p>Samsung was overjoyed by the decision.</p>
<p>&#8220;Samsung welcomes today&#8217;s ruling by the court in the Hague, which affirms the August 2011 ruling that the design of the Galaxy Tab 10.1 is distinctive and does not infringe Apple&#8217;s intellectual property rights,&#8221; the company said in a statement. &#8220;This ruling again demonstrates that Apple&#8217;s products simply do not warrant the intellectual property protections that it believes.&#8221;</p>

<p>A German investment group has purchased the company&#8217;s assets and has installed a new CEO, Michael Bogatzki. Here&#8217;s his <a href="http://www.sellaband.com/news/116-a-little-message">introduction</a> to Sellaband&#8217;s artists and users, who have pledged more than $3 million toward various projects to date. <p>We can&#8217;t verify this directly with the company, since its <a href="http://www.sellaband.com/">site is down</a> and has been for several days. &#8220;Dear Artists and Believers,&#8221; it says. &#8220;We have extended our maintenance window. We expect to be back tomorrow at the end of the day.&#8221;</p>
<p>But <a href="http://www.hypebot.com/hypebot/2010/02/sellaband-files-for-bankruptcy.html">Hypebot</a> points to a document filed in a Dutch court yesterday that appears to indicate that the company has filed for bankruptcy. UPDATE: Sellaband&#8217;s <a href="http://sellaband.com/">site</a> now says it is indeed in bankruptcy, but that &#8220;the completion of a transaction with a potential buyer of the business, is to be expected soon.&#8221;</p>
<p>The giant caveat: <a href="http://www.prefixmag.com/news/sellaband-files-for-bankruptcy-in-amsterdam/37842/">None</a> of the <a href="http://musically.com/blog/2010/02/23/confusion-surrounds-sellaband-future-after-insolvency-declaration/">reports</a> on this story seem to be written by anyone who speaks or reads Dutch or understands the Dutch legal system. <p>Meanwhile, some background on Sellaband: Founded in 2006, it was designed to let musicians, ranging from groups you&#8217;ve never heard of to ones you used to hear a long time ago, finance recordings by soliciting their fans.</p>
<p>Sellaband would distribute the albums&#8211;the company negotiated a deal with <a href="http://www.amazon.com/gp/feature.html?ie=UTF8&amp;docId=1000355471">Amazon</a> (AMZN) to help move the discs&#8211;and would sell advertising against the artists&#8217; fan pages. At some point, in theory, revenue would be distributed to both the acts and their fans/investors.</p>
<p>Sellaband claimed to have raised more than <a href="http://eu.techcrunch.com//2009/10/06/sellaband-teams-up-with-public-enemy/">$2.5 million for several dozen albums</a> this way. But a recent campaign to fund a new record by hip hop pioneer Public Enemy had <a href="http://www.billboard.biz/bbbiz/content_display/industry/e3iedf10d16b35b1c7a7f19c0c8c376308f">stalled and was moving backward</a> as of last week.</p>

<p>Here&#8217;s the first of two videos I have done while in <a href="http://kara.allthingsd.com/20080923/kara-visits-picnic-in-amsterdam-and-hopes-head-does-not-explode/">Amsterdam for the PICNIC conference</a>, which has been taking place in the picturesque Netherlands city for the past few days.</p>
<p>In it, BoomTown bikes along the canals to the interesting event, which is being held until the end of today at the Westergasfabriek, a renovated facility that was formerly a gas factory.</p>
<p>And I found out quickly that the digital Dutch are very different from the geeks in Silicon Valley&#8211;with birds, unusual art installations and more, which they mix extravagantly and very creatively with Web technologies.</p>
<p>At the end of the video is a snippet of a speech at PICNIC by Amsterdam Mayor Job Cohen and an interview I did with PICNIC&#8217;s Program Director Monique van Dusseldorp.</p>
