This morning, a Dutch court dismissed Apple’s appeal of an earlier ruling which denied it an injunction against Samsung’s Galaxy Tab 10.1. Apple claims Samsung has copied the look and feel of the iPad, and that the Galaxy Tab 10.1 infringes its patented designs.

Issued by a higher court in The Hague, the ruling allows Samsung to continue selling the Galaxy Tab 10.1 in the Netherlands. More importantly, it allows the company to continue distributing them to other European Union markets via the port of Rotterdam, through which it moves a lot of its EU merchandise.

Samsung was overjoyed by the decision.

“Samsung welcomes today’s ruling by the court in the Hague, which affirms the August 2011 ruling that the design of the Galaxy Tab 10.1 is distinctive and does not infringe Apple’s intellectual property rights,” the company said in a statement. “This ruling again demonstrates that Apple’s products simply do not warrant the intellectual property protections that it believes.”

A German investment group has purchased the company’s assets and has installed a new CEO, Michael Bogatzki. Here’s his introduction to Sellaband’s artists and users, who have pledged more than $3 million toward various projects to date. Check out the comments, though–some Sellaband fans/investors are awfully grumpy.

We can’t verify this directly with the company, since its site is down and has been for several days. “Dear Artists and Believers,” it says. “We have extended our maintenance window. We expect to be back tomorrow at the end of the day.”

But Hypebot points to a document filed in a Dutch court yesterday that appears to indicate that the company has filed for bankruptcy. UPDATE: Sellaband’s site now says it is indeed in bankruptcy, but that “the completion of a transaction with a potential buyer of the business, is to be expected soon.”

The giant caveat: None of the reports on this story seem to be written by anyone who speaks or reads Dutch or understands the Dutch legal system. So it’s possible that all of this means something else entirely. If you want to take a crack at it yourself, here you go.

Meanwhile, some background on Sellaband: Founded in 2006, it was designed to let musicians, ranging from groups you’ve never heard of to ones you used to hear a long time ago, finance recordings by soliciting their fans.

Sellaband would distribute the albums–the company negotiated a deal with Amazon (AMZN) to help move the discs–and would sell advertising against the artists’ fan pages. At some point, in theory, revenue would be distributed to both the acts and their fans/investors.

Sellaband claimed to have raised more than $2.5 million for several dozen albums this way. But a recent campaign to fund a new record by hip hop pioneer Public Enemy had stalled and was moving backward as of last week.

Here’s the first of two videos I have done while in Amsterdam for the PICNIC conference, which has been taking place in the picturesque Netherlands city for the past few days.

In it, BoomTown bikes along the canals to the interesting event, which is being held until the end of today at the Westergasfabriek, a renovated facility that was formerly a gas factory.

And I found out quickly that the digital Dutch are very different from the geeks in Silicon Valley–with birds, unusual art installations and more, which they mix extravagantly and very creatively with Web technologies.

At the end of the video is a snippet of a speech at PICNIC by Amsterdam Mayor Job Cohen and an interview I did with PICNIC’s Program Director Monique van Dusseldorp.
