Apple Loses Bid for Galaxy Tab Ban in the Netherlands

According to Apple, Samsung’s Galaxy Tab 10.1 tablet infringes on the look and feel, or so-called “community design,” of its iPad. But according to the Supreme Court of the Netherlands, it does not. And in a Friday ruling, it dismissed Apple’s appeal for a preliminary injunction against the sale of the Galaxy Tab 10.1, saying its design rights are too limited in scope to justify such an action. Apple declined a request for comment.

Apple Motion to Ban U.S. Sales of Samsung Galaxy Tab Delayed

Apple’s bid to get a ban on sales of Samsung’s Galaxy Tab 10.1 tablet in the U.S. has been thwarted — for the time being. Late Monday, a district court judge declined to grant a ban on Samsung’s tablet, saying that it can’t do so prior to the U.S. Court of Appeals for the Federal Circuit in Washington, D.C., issuing a mandate in the case. Once that has happened, Apple can renew its request, the judge said.
