Is AT&T capping data uploads on Apple’s (AAPL) iPhone 4? Not on purpose. Turns out a software issue is responsible for reports of dramatic drops in data upload speeds in some regions of the country, including New York and Philadelphia. AT&T (T) tells me that a software defect in some of Alcatel-Lucent’s equipment has been crippling 3G HSUPA performance in the markets in which it has been deployed. The good news is Alcatel-Lucent is working on a fix. The bad news is AT&T doesn’t yet have an ETA for its delivery.

Here’s the company’s statement on the issue:

AT&T and Alcatel-Lucent jointly identified a software defect–triggered under certain conditions–that impacted uplink performance for Laptop Connect and smartphone customers using 3G HSUPA-capable
wireless devices in markets with Alcatel-Lucent equipment. This impacts less than two percent of our wireless customer base. While Alcatel-Lucent develops the appropriate software fix, we are providing normal 3G uplink speeds and consistent performance for affected customers with HSUPA-capable devices.

AT&T’s iPhone exclusivity deal with Apple is set to expire as early as next year, but that doesn’t necessarily mean it won’t be renewed–despite complaints about the carrier’s network. That’s the word from iSuppli, which predicts Apple will extend its agreement with AT&T because it has no reason not to.

“Speculation is rife that Apple will end its exclusive U.S. iPhone service deal with AT&T when the current contract expires in June 2010 and begin to offer phones that work with the Verizon network,” iSuppli analyst Francis Sideco said in a research note today. “However, iSuppli doesn’t believe this will be the case. The main reason Apple is likely to stick with AT&T beyond 2010 is the relatively wide usage and growth expected for the HSPA air standard used by the carrier for 3G data.”

As Sideco explains, “Cumulative global subscribers of HSPA wireless services, consisting of High-Speed Downlink Packet Access (HSDPA) and High-Speed Uplink Packet Access (HSUPA), are set to rise to 1.4 billion in 2012, up from 269.1 million in 2009. In contrast, cumulative subscribers for the EVDO standard used by Verizon will amount to 304.6 million in 2013, up from 145.2 million in 2009.”

A point worth noting, though it’s hard to imagine that Apple (AAPL) doesn’t harbor some resentment toward AT&T (T), which has undermined its carefully crafted iPhone experience. And if that’s the case, wouldn’t it make more sense for the company to extend its deal with AT&T, but not as an exclusive? That would allow Apple to hammer out a second deal with Verizon (VZ), which, according to some analysts, would more than double U.S. iPhone sales in the near term.

As Bernstein Research analyst Toni Sacconaghi noted this summer, “Verizon’s postpaid subscriber base is not only larger than AT&T’s, but more importantly, is untapped whereas we estimate more than 10 percent of AT&T’s postpaid users already have an iPhone.”

AT&T (T) is on track to complete the upgrade of its 3G mobile broadband network by the end of June.

Good thing, too. Because we’re just weeks away from the eagerly anticipated launch of Apple’s 3G iPhone and AT&T–Apple’s exclusive wireless carrier in the states–certainly doesn’t want to foul up the debut of the second-generation iPhone, the way it did the first. Because if it does, AT&T Mobility CEO Ralph de la Vega won’t be activating his own 3G iPhone until it’s been surgically removed by a doctor. Apple (AAPL) CEO Steve Jobs does have a bit of a temper.

Anyway … AT&T’s network upgrade is just six markets away from first-phase completion in 275 cities (second-phase roll-out will extend it to another 75). And when it launches, it will be the first and only network to run on a technology called HSUPA, or High Speed Uplink Packet Access. HSUPA should provide speeds of 1.4 Mbps down and 800Kbps up, which AT&T asserts “will be as speedy as logging onto the high-speed Internet service that many consumers enjoy at home.”

Hope so, because logging onto AT&T’s Edge network is about as speedy as logging onto the Internet with a 56.6 Kbps fax/modem.
