<p>This morning, the country&#8217;s Antitrust Authority <a href="http://www.google.com/hostednews/afp/article/ALeqM5hY2uGXfCwQ019Pa7X_sSNKr0XDzg?docId=CNG.97cd2e25bfe59f112cd712d9159e32e9.351"> slapped Apple with a $1.2 million fine</a>, penalizing its Apple Sales International, Apple Italia S.R.L. and Apple Retail Italia divisions for what it describes as &#8220;unfair commercial practices.&#8221;</p>
<p>&#8220;Sanctions of a total of 900,000 euros have been imposed on the Apple group after it was found responsible for bad commercial practices that harmed consumers,&#8221; the agency said in a statement.</p>
<p>According to the Antitrust Authority, Apple has been selling its Italian customers AppleCare extended warranties, despite the fact that they overlap with the standard two-year product warranty required by European law. In other words, it has been upselling customers additional warranty protection without properly explaining the two years of free assistance they are already entitled to under Italian law. Essentially, Apple has been <a href="http://www.agi.it/english-version/business/elenco-notizie/201112271250-eco-ren1031-mega_900_000_euro_fine_for_apple_from_antitrust">recognizing only the conventional one-year guarantee</a> it offers on most of its products, and the additional coverage provided with the purchase of AppleCare.</p>
<p>Now, in addition to paying the fine levied against it, Apple must, within 90 days, add to its AppleCare plan details of the two-year guarantee required by European law.</p>
<p>Apple has not yet responded to a request for comment.</p>

<p>With its <a href="http://allthingsd.com/20110617/with-yahoo-shares-dropping-below-15-will-shareholder-patience-collapse-too/">annual meeting</a> this coming Thursday, you&#8217;d think Yahoo CEO Carol Bartz would be taking a rest.</p>
<p><em>Not so!</em></p>
<p>She has been a regular Carmen Sandiego, in fact, jetting to Yahoo hotspots around the globe from Dubai to Milan to New York and then back to Yahoo&#8217;s Sunnyvale, Calif., HQ.</p>
<p>As do Yahoos, I get most of the Friday emails she sends out, but I usually don&#8217;t bother to post them.</p>
<p>That said, I liked the can-do tone of this one, shades of Bartz early in her term, even in the face of a <a href="http://allthingsd.com/20110617/with-yahoo-shares-dropping-below-15-will-shareholder-patience-collapse-too/">stock price that&#8217;s dropped almost eight percent this month</a> to close at $14.69 on Friday.</p>
<p>(To be fair, the shares of Google are down by a little more in the same time, although its CEO Larry Page seems to prefer to remain holed up in his digital cave in Mountain View and lick his stock wounds.)</p>
<p>No matter, as Bartz writes, it&#8217;s nothing a little retail therapy can&#8217;t fix!</p>
<p>I myself am off on an international biking vacation in Ireland next week, so while I am gone, please enjoy Carol&#8217;s letter to Yahoos:</p>
<blockquote class="memo"><p>Last week was a crazy one -– Dubai and Milan in five days! You may not know it, but the Middle East and Italy are two of our hottest markets in the EMEA region (and I do mean hot &#8212; it was 114 Fahrenheit and very humid in Dubai &#8212; I thought I was going to melt!). </p>
<p>First on the itinerary was Dubai, where I met with government officials, advertisers, the media, and our awesome Yahoos there.</p>
<p>I kicked things off Monday with the Deputy Ruler of Dubai, Shaikh Maktoum Bin Mohammed Bin Rashid Al-Maktoum. Turns out he is a BIG Yahoo! fan. He told me that he&#8217;s on our sites every day to check the latest news and sports headlines.  It makes sense &#8212; we&#8217;re huge in the Middle East and North Africa. Since we acquired Maktoob a year and a half ago, we’ve grown from 30 million to 53 million users. That&#8217;s impressive in a region with more than 70 million people online today.</p>
<p>We&#8217;re tops in entertainment with omg! Arabic, and with our women&#8217;s lifestyle site, Helwa. And we&#8217;re a strong #2 in News, thanks in part to our new Arabic homepage that launched six months ago. Already, it&#8217;s our fourth most popular homepage in the world &#8212; right behind the U.S., India and Taiwan. Meanwhile, Yahoo! is #1 in the Middle East and North Africa for display advertising with 40% market share. </p>
<p>Then on Wednesday it was off to Milan, where I visited with advertisers and our passionate Yahoos there. (I love that our Italian headquarters also happens to be located in one of the fashion capitals of the world &#8212; so convenient! An hour of retail therapy goes a long way).</p>
<p>We are winning it Italy. In a business review, our folks called themselves the Yahoo! &#8220;Italian Racing Team,&#8221; and I believe it.  They&#8217;re firing on all cylinders. The country boasts some of the highest engagement numbers for us in the EU. We reach 66% of the online population in Italy. We&#8217;re top three in seven content categories, and #1 in four of them: Mail, News, Answers and Flickr. Plus, these #1 sites are growing faster than the market. And on the ad side, May was a record month for our display advertising in Italy &#8212; we&#8217;re taking share while growing revenue.</p>
<p>Throughout my trip to Italy and the Middle East, one thing came through loud and clear: Our local teams are able to execute and grow user engagement more quickly than ever before. This is thanks, in large part, to the great work of our Products org.</p>
<p>Take, for instance, our new Yahoo! Publishing Platform (aka LEGO). Our editors have put it to good use on our Italian Movies site. We&#8217;ve seen a 90% increase in page views, and a 60% increase in users. And that&#8217;s just in the first three weeks! This is exactly what we&#8217;ve been working so hard on for the past two years. We&#8217;ve completely re-architected our infrastructure, and it&#8217;s incredibly satisfying to see it pay off in so many parts of the world.</p>
<p>After all that fun, I headed back across the Atlantic and spent two good, solid days covering a lot of business in the Big Apple &#8212; press, investors, agencies and Yahoo! Sales leaders. Then it was back here to Sunnyvale for CEO staff meetings and a great &#8220;Coffee with Carol&#8221; with 30+ Yahoos.</p>
<p>I&#8217;m off to have a good weekend, hope you do too &#8212; especially you Dads on Father&#8217;s Day!</p>

<p>Under the shareholders&#8217; agreement, Mr, Bernabe&#8211;whose three-year mandate expires in April&#8211;will become executive chairman, retaining powers over extraordinary operations, legal issues, regulatory and institutional relations, the people said.</p>
<p>The agreement comes ahead of Telecom Italia&#8217;s shareholders meeting, which on April 12 will appoint the company&#8217;s new board and management.</p>
<p>Mr. Patuano, who now heads Telecom Italia&#8217;s domestic operations, will be promoted to the role of CEO overseeing the Italian market, while TIM Brasil CEO Luca Luciani will oversee the Latin American operations as chief operating officer. Both Messrs. Patuano and Luciani will report to Mr. Bernabe, the people added.</p>

Together, Privalia is forecasting that they will achieve triple-digit revenue growth this year to around 400 million euros. 			<content:encoded><![CDATA[<p>A new Nielsen report finds that young people around the world are the biggest adopters of mobile technology, though how they do so tends to vary by both location and gender.<br />

According to the report, China is the biggest spot for the mobile Internet, with 73 percent of Chinese youths age 15 to 24 citing mobile Internet usage as among the things they used their cell phones for in the past month. By comparison, less than half of American and British cell-phone toting youths used the Internet from their mobile devices, while the rest of Europe had rates less than 25 percent.</p>
<p>Mobile messaging is also big, though in most parts of the world young women are far more likely than young men to send text and picture messages. There were some exceptions, such as India, where men were twice as likely as women to send texts and four times more likely to send pictures.</p>
<p>The Nielsen research was conducted in 19 countries, though the report broke out  results only for the U.S., UK, India, Italy, Brazil, China, Spain, Russia and Germany. In most countries Nielsen surveyed 5,000 young people, though in the U.S. it surveyed 75,000 youths. In some countries the research was done face-to-face and in others the survey was done online.</p>
<p>In most countries across the globe, young men are more likely than women to have smartphones, though the U.S. is an exception with young women making up 55 percent of smartphone owners between 15 and 24. The adoption of smartphones versus feature phones also varies widely. In India, for example, feature phones outnumber smartphones 9 to 1 among young people, while in Italy smartphone adoption is nearing 50 percent among the younger set.<br />

Advanced data usage was highest in the U.S and China, where about 17 in 20 young people did more than just make calls and send text and picture messages. That type of data use was least common in India, where only 13 percent did so, However, another 51 percent of Indian youths used their phones for text and/or picture messages.</p>
<p>The Nielsen study also looked at other patterns including use of more than one SIM card and whether phones are prepaid or postpaid, although those trends seemed to have more to do with how the country&#8217;s cell phone industry is set up as opposed to indicative of trends among youth.</p>

That in itself is rare enough an occurrence that when it happens, it usually makes news.</p>
<p>However, when it first happened, many assumed that Anonymous&#8211;the loose affiliation of digital troublemakers who last week overwhelmed the Web sites of <a href=http://online.wsj.com/article/SB10001424052748703493504576007182352309942.html?mod=WSJ_Tech_LEFTTopNews>Mastercard and Visa</a>&#8211;was making trouble again. Not so. <a href="http://www.bloomberg.com/news/2010-12-13/amazon-denies-hacker-attack-caused-shutdown-of-european-sites.html">In a statement to Bloomberg News</a>, Amazon officially blamed the outage on the failure of some of its hardware at a facility in Dublin. Web monitoring service Netcraft has confirmed this by its own <a href=http://news.netcraft.com/archives/2010/12/12/amazon-goes-offline-in-europe.html>independent observations</a>.</p>
<p>Amazon had last week come into the <a href=http://newenterprise.allthingsd.com/20101204/paypal-to-wikileaks-youre-cut-off/>crosshairs</a> of WikiLeaks supporters for its <a href=http://newenterprise.allthingsd.com/20101202/amazon-cuts-off-wikileaks-joe-lieberman-claims-pointless-victory/>removal</a> of files related to the organization&#8217;s leaks of previously secret U.S. diplomatic cables.</p>
<p>And indeed Anonymous had planned to attack Amazon but realized the target was too big and <a href=http://news.netcraft.com/archives/2010/12/09/operation-payback-aborts-attack-against-amazon-com.html>switched to PayPal</a> instead.</p>

<p class="mailbox-question"><em> I&#8217;m from Italy. Since the new iPhone 4 is not on sale in Italy yet, I was wondering if it&#8217;s possible to buy it in the U.S. without a contract and if I would be able to use it with an Italian carrier&#8217;s plan when I go home.</em></p>
<p class="mailbox-a">A:</p>
<p>According to AT&#038;T, the answer is essentially no. It&#8217;s a bit complicated, but AT&#038;T (T) says it offers a &#8220;no commitment&#8221; iPhone 4 starting at $599, or $400 more than the same model costs with a two-year contract. For this price, you don&#8217;t need to sign a contract or pay an early termination fee, though you still need a monthly plan. However, AT&#038;T says all the iPhone models it sells in the U.S., including these no-commitment phones, are locked and cannot be used with other carriers&#8217; SIM cards. So, you could almost certainly &#8220;use&#8221; it in Italy and pay high AT&#038;T roaming fees, but you couldn&#8217;t just pop in a SIM card from an Italian carrier and switch to that carrier&#8217;s plan from AT&#038;T&#8217;s.</p>
<p>As with prior iPhone models, it might be possible to &#8220;jailbreak,&#8221; or modify, the new model to get around this restriction, but doing that can have downsides, including security vulnerabilities and incompatibility with future official software updates.</p>
<p class="mailbox-q">Q:</p>
<p class="mailbox-question"><em> Is it possible to buy an unlocked iPhone overseas and use it in the U.S. on T-Mobile instead of AT&#038;T?</em></p>
<p class="mailbox-a">A:</p>
<p>Apple says that, in some countries, though not all, you can buy completely unlocked iPhones that can be mated with any compatible carrier&#8217;s SIM card. However, if you are referring to the new iPhone 4, note that it uses a new type of much smaller SIM card than most phones, and T-Mobile or whatever other carrier you wanted to use would have to offer such cards.</p>
<p class="mailbox-q">Q:</p>
<p class="mailbox-question"><em> When will the iPhone be available on the Verizon network, not just AT&#038;T?</em></p>
<p class="mailbox-a">A:</p>
<p>Neither Apple (AAPL) nor Verizon (VZ) has confirmed they are in serious negotiations, though there have been numerous rumors. Nor, as far as I know, does anyone outside Apple and AT&#038;T know for sure when their exclusive arrangement expires, despite lots of speculation. So, while I hope Apple will add a second U.S. carrier at some point, I have no idea when, or whether it will be Verizon.</p>

<p>But it&#8217;s basically what editor Terry McDonell promised last fall and what the magazine&#8217;s peers are also delivering on Apple&#8217;s (AAPL) platform: All of the weekly magazine is there, plus some bells and whistles, like additional photos, an extra story and some videos. (The ads, though, are not the same as those in the magazine, which is different from rival Condé Nast&#8217;s strategy.)</p>
<p>In this case, the app it also looks and functions quite a bit like Time magazine&#8217;s iPad app, with good reason: Time Warner&#8217;s (TWX) Time Inc. unit is using the same outside collaborators, The Wonder Factory and WoodWing Software, for all its magazine apps.</p>
<p>So if you liked the <a href="http://mediamemo.allthingsd.com/20100405/why-is-time-charging-5-for-its-ipad-app/">Time app</a>, you may like this one. The price is the same, too: $4.99 an issue, though  a subscription plan in the works will end up shaving the per-issue price down a bit.</p>
<p>But here&#8217;s the thing: The &#8220;magazine plus&#8221; app concept, which works nicely for titles like <a href="http://mediamemo.allthingsd.com/20100526/wireds-flash-free-app-makes-on-to-the-ipad-after-all/">Wired</a>, feels like a liability with Sports Illustrated. Because much of the magazine&#8217;s content is dated as soon as hits the page, and SI is happy to let it stay that way on the iPad.</p>
<p>Every mag app grapples with this, of course. And so far all of them are trying to steer away from the Web model, where they&#8217;re expected to provide timely updates, but don&#8217;t make much money doing so. Better to resell the magazine they&#8217;ve already made without having to create much in the way of new stuff.</p>
<p>When you hold a print version of SI, timeliness doesn&#8217;t feel like a problem. Presumably because you don&#8217;t have any other expectations. But when you&#8217;re reading it in digital form, on a device connected to the Web&#8230;</p>
<p>Case in point: Today&#8217;s issue has a feature story on the U.S. World Cup team&#8217;s exploits. But it was written before the thrilling Algeria game. So there&#8217;s no mention of that result.</p>
<p>And while the app does have some links into SI&#8217;s Web site and the ability to provide updated scores, it does so in a limited way: Right now, it&#8217;s only offering up baseball scores. So when the SI team was demoing the app for me this morning, I heard oohs and aahs from a nearby office, where people were watching the Italy-Slovakia game. But the app couldn&#8217;t give me the score of that match: If I had wanted to check it out, I&#8217;d have had to head out of the app and into Apple&#8217;s Safari browser.</p>
<p>The SI guys say this is a very deliberate design choice. McDonell says the app provides readers with a &#8220;curated experience&#8221; instead of the &#8220;firehose&#8221; of data flooding from the Web. I&#8217;d buy that for some titles, even for a news magazine like Time.</p>
<p>But not here: If Sports Illustrated really wants me to pay up for this one, it needs to plug in, too.</p>
<p>Chris Hercik, the SI creative director, who listened to all of my gripes yet remained good-natured about it, sat down for a quick interview this morning. Apologies for the poor lighting &#8212; one thing you get on the SI app that you don&#8217;t get here is video made by people who know what they&#8217;re doing:</p>

<p>If you like statistics: That&#8217;s approximately 33,000 iPads per day, 1,388 iPads per hour and 23 iPads per minute.</p>

<p><strong>Who</strong>: Ben Zotto, lead everything (it&#8217;s a one-man shop).</p>
<p>Ben was at Microsoft and worked for Xoopit, the email-enhancement start-up acquired by Yahoo (YHOO).</p>

<p><strong>What</strong>: Ben&#8217;s Penultimate brings a Moleskine notebook-style user interface to the iPad. He just released an update that allows you to rest your palm on the screen while writing, the same way you might with a pad and paper.</p>
<p><strong>Why</strong>: It has been in the top tier of the Apple (AAPL) App Store for weeks.</p>
<p><strong>Where</strong>: <a href="http://www.cocoabox.com/">cocoabox.com</a> (Web site); <a href="http://twitter.com/cocoabox">@cocoabox</a> (Twitter); San Francisco (analog place)</p>
<p><strong>Who Else</strong>: Apps like PaperDesk and Idea Boards use the pen-and-surface interface. Penultimate does drawing a little differently, though. Ben says it&#8217;s about the ink.</p>
<h4 class="subhed">Five Stats You Won&#8217;t Find in His Facebook Profile:</h4>
<p><strong>Worst Job</strong>: I&#8217;ve been pretty privileged. I was a short-term photocopy runner for the Junior World Ice Hockey Championships in Geneva when I was in my teens. It wasn&#8217;t bad, but I don&#8217;t suppose it played to all of my strengths.</p>
<p><strong>School Days</strong>: I grew up in Boston, but we moved to Switzerland during my high school days. I left eighth grade in Massachusetts, maybe never before having left the state. And within a month of arriving in Geneva, we were on a history class trip to Florence. It was awesome.</p>
<p><strong>Geek Crush</strong>: There are a lot of guys from my Microsoft (MSFT) days who are my programming heroes. Guys like Tracy Sharpe and Dinarte Morais. I&#8217;m also a big fan of Wil Shipley.</p>
<p>It&#8217;s something about his combination of making beautiful and functional software and being fiercely independent&#8211;you know, a coffee shop denizen&#8211;that I&#8217;m attracted to. I actually found the designer I worked with on Penultimate through him.</p>
<p><strong>Gadget Freak</strong>: I don&#8217;t carry a lot of gadgets. I am pretty picky about my work set-up, though. I use an Apple extended keyboard from the 1980s with the heavy-duty key switches that I rescued off eBay (EBAY) and the Microsoft optical IntelliMouse, which is, for my money, the best mouse developed so far.</p>
<p><strong>Early Internet Memory</strong>: Right after I moved to Switzerland, I had a friend back in Boston who would email me. It was probably 1992, so it wasn&#8217;t really email. He found some dial-up number at MIT that had an open gateway.</p>
<p>It wasn&#8217;t obvious then how you would send an email to an internal address where my dad worked. It was one of those early u-u gateway/bang-this/bang-that things. He finally figured out how to get it to work, and my dad&#8217;s secretary would print out these letters from my friend Micah back in Boston.</p>
<p>That was how I heard the news from Massachusetts for a little while. Micah is a recent recipient of a Ph.D in computer science from UPenn. Not a fool.</p>

<p>Ben had an international childhood. He has worked at Microsoft, Xoopit and Yahoo. He writes software that he hopes is beautiful and useful.</p>

<h4 class="subhed">The Five Questions</h4>
<p class="question"><em>How long have you been developing <em>Penultimate</em>? Why is it a killer app when so many others don&#8217;t seem to be?</em></p>
<p>Originally, I developed an app called Handwriting for the iPhone. There was potential there, with the touchscreen, to give a personal touch to messages through handwriting that wasn&#8217;t there before. For that reason, I spent a lot of time working on the graphics math for the ink.</p>
<p>I wanted the input to really resemble the handwriting of the user. It turns out that getting digital ink to look real is a really subtle thing. I spent a lot of time getting it to move right, getting it to feel smooth and whatnot. I finally got it where I was happy with it.</p>
<p>I released the app and basically, nobody bought it.</p>

<p>People responded well, but I realized that anyone who used the app would only use the surface that they could see within the bounds of the iPhone screen, even though I made it so that you could scroll around easily to get a bigger surface for writing.</p>
<p>Size was clearly an issue.</p>
<p>The iPad coming out meant that all of a sudden something that was just more of a single tool like handwriting could be scaled up into an app with real uses, and all it took was more screen real estate.</p>
<p class="question"><em>Steve Jobs, in his iPad release presentation, said that if they&#8217;d added a stylus, they&#8217;d have gotten it wrong. Does the success of your app fly in the face of that vision?</em></p>
<p>It&#8217;s funny, I&#8217;d never heard that until now. I didn&#8217;t watch that speech.</p>

<p>When the iPad came out, I got this vision of doctors walking around making notes, and it looked like there would be lots of use cases where a keyboard just wasn&#8217;t ideal.</p>
<p>People would need to input info standing up, while moving and in portrait mode. From the pictures, it wasn&#8217;t clear the keyboard would be great for that.</p>
<p>I developed Handwriting and Penultimate to be used with your finger, and that&#8217;s how I use them most. And I think Apple has good reasons for not pushing that. They could have developed handwriting recognition, but for them, that draws away from what they are really trying to sell.</p>
<p>Handwriting recognition is really hard, and as soon as you do that and say you are going to do it with a finger, you have people saying, &#8220;Why doesn&#8217;t this thing recognize my handwriting better?&#8221;&#8211;instead of marveling at all the amazing things you can do with the platform.</p>
<p class="question"><em>Have you faced issues from Apple, developing a popular app that goes a little against the grain?</em></p>
<p>I&#8217;ve heard complaints about the App Store, but I&#8217;ve had a pretty good experience so far. It usually takes them about 48 hours to approve updates for my stuff. That said, there are some hardware things I&#8217;ve run into.</p>
<p>A big one is trying to get palm rejection in my app so that you can place your hand on the screen to write and not have it register as a touch.</p>
<p>On the iPad, Apple doesn&#8217;t expose those drivers to developers. On the MacBook, for instance, you can hook in the driver and get all the data&#8211;the width of the touch, rotation, everything.</p>
<p>All that is closed off for the iPad, so getting the natural handwriting position has been really challenging. I&#8217;m playing with that right now because it&#8217;s been one of the loudest requests.</p>
<p class="question"><em>You are embracing this use case that Apple seems to wish wasn&#8217;t there. What other requests are you getting from users who want to be able to write on their iPads?</em></p>
<p>I think form-filling is a big one. There are apps that do that, but their ink technology isn&#8217;t as good as mine, which is why I think I get those requests even though there are other apps in the field.</p>
<p>I got this great email from the head of a police department, who said that out in the field there are all these forms he has to fill, and he wants to take them with him and not have to bring paper.</p>
<p>There are all kinds. I got mail from a roofing contractor who wants to be able to snap his drawn lines to a grid to draw quick plans.</p>
<p>I&#8217;ve got friends who are doctors who think it&#8217;s a great idea, but say they could never use it because of HIPAA.</p>
<p>There seems to really be a lot of uses for being able to write by hand and make notes in this very natural way.</p>
<p class="question"><em>You worked in regular software before you did this. What is fundamentally different about developing for this platform? What are people missing about that?</em></p>
<p>I think a big difference today is that people expect updates much faster than before. It&#8217;s fundamentally different than shrink-wrapped software world, where you would spend lots of time making and refining a product, packaging it and shipping it out.</p>
<p>Today, people expect to see some kind of update or fix every couple of weeks and they expect them to be free. If you don&#8217;t issue an update for a while, people might begin to think you are dead.</p>
<p>Because the mobile platform apps are these single-use things, there is a perception that they are smaller or more simple and that therefore there is an entitlement to future updates. It&#8217;s great for users but really hard for developers.</p>
<p>There&#8217;s this ever-present question: &#8220;How much software is &#8216;three dollars worth&#8217;?&#8221;</p>

<p>Apple (AAPL) will start accepting pre-orders for both the 3G and Wi-Fi models on Monday, May 10. And on May 28, Apple will begin shipping units in Australia, Canada, France, Germany, Italy, Japan, Spain, Switzerland and the U.K. </p>
<p>The launch will continue in July when the iPad arrives in nine additional countries: Austria, Belgium, Hong Kong, Ireland, Luxembourg, Mexico, Netherlands, New Zealand and Singapore.</p>
<p>Apple has already sold <a href="http://digitaldaily.allthingsd.com/20100503/apple-1-million-ipads-sold/">more than one million iPads in the U.S.</a> since the launch of the Wi-Fi-only model on April 3 and the 3G version on April 30. Given these sales figures and Apple&#8217;s supply issues to date, it will be interesting to see how the international rollout goes.</p>

<p>Initially, only Wi-Fi models will be available, with their 3G counterparts to follow later in the month. Late April will also see the device going on sale in Australia, Canada, France, Germany, Italy, Japan, Spain, Switzerland and the U.K.</p>
<p>Given the time between the launch date of the Wi-Fi-only and 3G versions, will any early adopter be patient enough to wait for the latter?</p>

<p>Earlier this week, Yahoo CEO Carol Bartz was all over the place talking up the company on the <a href="http://kara.allthingsd.com/20100302/yahoo-celebrates-its-15th-anniversary-now-is-it-finally-time-to-buy-aol-as-a-gift-to-itself">occasion of its 15th birthday</a>.</p>
<p>Here&#8217;s a video of a longish interview she did with CBNC, embedded below, where she cracks wise a lot, but says little.</p>
<p>My favorite part: When the interviewer oddly asks if Yahoo (YHOO) is a trinket and Bartz pipes up that it is a <em>bracelet</em>!</p>
<p>Thankfully, we have the critical jewelry issue around Yahoo settled.</p>
<p>Bartz also gets a good one off about Facebook&#8217;s lack of revenue compared with Yahoo, after being asked why Yahoo was not as hot as the social networking phenom.</p>
<p>&#8220;Remind me, what’s their revenue?&#8221; she asked.</p>
<p>Bartz&#8217;s week also included a lunch with a group of reporters at its Sunnyvale, Calif., HQ&#8211;pretty much Lady BoomTown and a dozen dudes&#8211;Tuesday, at which she talked about a range of things, offered Sprinkles cupcakes and broke no substantive news.</p>
<p>She did give good quote though.</p>
<p>Bartz, for example, said she didn&#8217;t &#8220;wish antitrust on anybody,&#8221; when asked about Google (GOOG) and its issues with regulators in Europe.</p>
<p>She also noted, talking about the search giant&#8217;s <a href="http://kara.allthingsd.com/20100301/whats-more-embarrassing-to-italian-americans-than-jersey-shore-um-that-would-be-italy-and-its-google-ruling">recent conviction in Italy</a> and its potential impact: &#8220;The [European Union] concerns me.&#8221;</p>
<p>But when talking about Google&#8217;s <a href="http://digitaldaily.allthingsd.com/20100112/google-threatens-to-leave-china">threat to leave China over censorship issues</a>, Bartz was less kind. &#8220;It looked to me like it was more of a statement than an action,&#8221; she said. &#8220;If they wanted to pull out, they should have pulled out.&#8221;</p>
<p>Perhaps the most controversial remark was when she seemed to compare herself with Apple (AAPL) CEO Steve Jobs, pointing out that his innovative turnaround of the iconic Silicon Valley computer company took a lot of time after he returned in 1996.</p>
<p>&#8220;He knew the DNA better than anyone and it took him four years,&#8221; she declared, noting her tenure was just over a year.</p>
<p>Perhaps her most important quote was related to losing search market share and seeing Facebook&#8217;s user growth close in on Yahoo.</p>
<p>Bartz said the real point at Yahoo was more &#8220;the fight to get ad dollars around relevant users.&#8221;</p>
<p>As in, from a jewelry point of view: Finding a diamond in the rough.</p>

<p>Oh, there&#8217;s no question in the often paranoid mind of BoomTown that Google is one scary company, mostly due to its huge market share in search across the globe.</p>
<p>Check out this eye-popping <a href="http://online.wsj.com/article/SB10001424052748703510204575086534063777758.html?mod=WSJ_hps_LEFTWhatsNews">chart below from a story in The Wall Street Journal</a> today on this very subject, for example, if you care to share my wariness.</p>

<p>Thus, there is no doubt that the preliminary scrutiny over antitrust complaints the company is getting from the European Commission, which Google (GOOG) has forcefully denied, is not untoward, <a href="http://digitaldaily.allthingsd.com/20100226/microsoft-to-google-quit-whining-ya-big-baby/">even if those complaints have been leveled</a> by companies affiliated with archrival Microsoft (MSFT).</p>
<p>There will be more to come, of course, as Google&#8217;s growing power is targeted by those interested in stopping its growth&#8211;both those with pure motives and not-so-pure.</p>
<p>But no matter how you slice the monopolistic pie, Google most certainly did not deserve, nor should anyone tolerate, the conviction in Italy of three of its execs on privacy violations.</p>
<p>A judge in Milan said the trio had not complied with Italian law because they allowed a disparaging video of a boy with Down Syndrome being harassed by other teens to be posted on the company&#8217;s former Google Video site, even though it was quickly yanked,</p>
<p>An appeal is already in the works, which is a good thing since it&#8217;s hard to imagine how such a ruling will stand and how any company can police itself so stringently given the mass of user-generated content.</p>
<p>While every online company must have strict rules to prevent such abuses, this case is a little like blaming the telephone company if one gets an abusive call.</p>

<p>And while Google most certainly deserves some of the legal attention it is getting, this ruling should make every U.S. Internet firm&#8211;including Microsoft&#8211;scared not of Google&#8217;s frighteningly powerful search algorithm, but of Italy&#8217;s horrifyingly idiotic legal system.</p>
<p>Italian-Americans&#8211;of which I am one&#8211;or anyone else can gripe all they want about <a href="http://kara.allthingsd.com/20091223/viral-video-the-real-situation-yes-more-jersey-shore">&#8220;The Situation.&#8221;</a></p>
<p>But&#8211;make no mistake&#8211;this is the <em>real</em> situation.</p>

<p>In China, the <a href="http://mediamemo.allthingsd.com/20100114/white-house-to-china-were-with-google-on-this-one/">search giant is battling hackers and the government</a>, who may be one and the same. In Europe, the company is being <a href="http://digitaldaily.allthingsd.com/20100224/why-the-big-smile-mr-ballmer-google-been-slapped-with-an-antitrust-probe-in-europe/">hauled in front of an antitrust review</a>. And Italy? Total disaster.</p>
<p>Yesterday, an Italian court convicted three Google (GOOG) executives of privacy violations in a <a href="http://digitaldaily.allthingsd.com/20090219/still-no-direct-translation-of-safe-harbor-into-italian/">case</a> that stems from a <a href="http://digitaldaily.allthingsd.com/20090203/google-che-diavolo-italia/">clip uploaded to Google Video in 2006</a>. The executives, who include former CFO George Reyes, have been sentenced to six-month prison sentences.</p>
<p>And that verdict follows a December ruling whereby an <a href="http://mediamemo.allthingsd.com/20091216/google-loses-a-round-in-italian-court-will-youtube-have-to-pay-up/">Italian court found the company guilty of copyright violations on YouTube</a>, the video site it bought in 2006. Mediaset, the broadcaster that brought the suit&#8211;and which is controlled by Prime Minister Silvio Berlusconi&#8211;is looking for more than $730 million in damages.</p>
<p>Google has responded to the video convictions with an <a href="http://googleblog.blogspot.com/2010/02/serious-threat-to-web-in-italy.html">outraged blog post</a>. Note that the language is more forceful than the company used to describe its China problem. But also note that the company isn&#8217;t threatening to pull out of Italy altogether. Maybe it should.</p>

In late 2006, students at a school in Turin, Italy filmed and then uploaded a video to Google Video that showed them bullying an autistic schoolmate. The video was totally reprehensible and we took it down within hours of being notified by the Italian police. We also worked with the local police to help identify the person responsible for uploading it and she was subsequently sentenced to 10 months community service by a court in Turin, as were several other classmates who were also involved. In these rare but unpleasant cases, that&#8217;s where our involvement would normally end.</p>
<p>But in this instance, a public prosecutor in Milan decided to indict four Google employees&#8211;David Drummond, Arvind Desikan, Peter Fleischer and George Reyes (who left the company in 2008). The charges brought against them were criminal defamation and a failure to comply with the Italian privacy code. To be clear, none of the four Googlers charged had anything to do with this video. They did not appear in it, film it, upload it or review it. None of them know the people involved or were even aware of the video&#8217;s existence until after it was removed.</p>
<p>Nevertheless, a judge in Milan today convicted 3 of the 4 defendants&#8211;David Drummond, Peter Fleischer and George Reyes&#8211;for failure to comply with the Italian privacy code. All 4 were found not guilty of criminal defamation. In essence this ruling means that employees of hosting platforms like Google Video are criminally responsible for content that users upload. We will appeal this astonishing decision because the Google employees on trial had nothing to do with the video in question. Throughout this long process, they have displayed admirable grace and fortitude. It is outrageous that they have been subjected to a trial at all.</p>
<p>But we are deeply troubled by this conviction for another equally important reason. It attacks the very principles of freedom on which the Internet is built. Common sense dictates that only the person who films and uploads a video to a hosting platform could take the steps necessary to protect the privacy and obtain the consent of the people they are filming. European Union law was drafted specifically to give hosting providers a safe harbor from liability so long as they remove illegal content once they are notified of its existence. The belief, rightly in our opinion, was that a notice and take down regime of this kind would help creativity flourish and support free speech while protecting personal privacy. If that principle is swept aside and sites like Blogger, YouTube and indeed every social network and any community bulletin board, are held responsible for vetting every single piece of content that is uploaded to them&#8211;every piece of text, every photo, every file, every video&#8211;then the Web as we know it will cease to exist, and many of the economic, social, political and technological benefits it brings could disappear.</p>
<p>These are important points of principle, which is why we and our employees will vigorously appeal this decision.</p>

<p>“It was clear that internationally, just as in the US, MySpace’s staffing had become too big and cumbersome to be sustainable in current market conditions,” said MySpace CEO Owen Van Natta. “Today’s proposed changes are designed to transform and refine our international growth strategy.” Operations in Argentina, Brazil, Canada, France, India, Italy, Mexico, Russia, Sweden and Spain are “under review,” he added, and face possible closure.</p>
<p>The cuts follow a 30 percent reduction in headcount in the states last week and the hastening erosion of MySpace’s position in the social-networking market. MySpace lost the title of world’s most popular social network to rival Facebook last year and was overtaken by it in the U.S. last month as well.</p>

<p>In other words, Julius Caesar conquered Rome, but Twitter definitely has not.</p>
<p>In fact, the conference being held here is aptly called &#8220;Tutto Cambio, Cambiamo Tutto?&#8221; (I came here to interview Huffington Post editrix Arianna Huffington and LinkedIn founder and CEO Reid Hoffman onstage about innovation and online trends.)</p>
<p>That roughly translates into &#8220;Everything changes, let&#8217;s change everything?&#8221;</p>
<p>This is not a question that is much asked in Silicon Valley, which changes just like the weather, embracing change for change&#8217;s sake.</p>
<p>But here, whether or not to change is much more of a debate&#8211;one in which change does not always come out on top.</p>
<p>Internet penetration is much lower here than elsewhere in Europe, as is everything from per capita computer ownership to online advertising spending. Television still dominates most media.</p>
<p>&#8220;We&#8217;re 2,000 years old&#8221; is something you hear a lot from people as an explanation for approaching everything, from social networking to iPhones to anything interactive, with some wariness.</p>
<p>While most people here note that they like Facebook, prounounced &#8220;FAY-sa BOO-ka,&#8221; hardly anyone sees the point of Web 2.0&#8242;s trend du jour, Twitter (&#8220;TWEE-tur&#8221;).</p>
<p>In fact, few have heard of it, and those who have don&#8217;t use it.</p>
<p>And while several people have iPhones, no one seems over the moon about the Apple (AAPL) phenom or captivated by its potential to herald Web 3.0 as the mobile revolution.</p>
<p>In any case, here is a video I did, speaking to both Huffington (here is <a href="http://www.huffingtonpost.com/arianna-huffington/rome-diary-metaphysical-s_b_173878.html">her blog on the event</a>) and Hoffman, as well as to several Italians at the conference:</p>
