			<content:encoded><![CDATA[<p>A couple of days ago, just before I headed to the theater at the Las Vegas Hotel &#038; Casino for our <strong>AllThingsD</strong> <a href="http://allthingsd.com/20120109/coming-up-live-ballmers-last-act-in-vegas-and-the-bcs-championship-in-3-d/">FootBallmer dual-blog</a>, I realized I had misplaced my laptop charger. It sent me into a mild panic. </p>
<p><em>How would I survive CES?</em></p>
<p>Fortunately, I was able to locate a spare charger (they&#8217;re not hard to find in the vicinity of the Consumer Electronics Show). But in case some Good Samaritan had returned it, today I made a trip to the CES Lost &#038; Found. <img src="http://allthingsd.com/files/2012/01/photo-7-380x262.png" alt="A treasure chest of lost iPhones. " title="photo-7" width="380" height="262" class="alignright size-medium wp-image-162989" /></p>
<p>I made my way down the crowded central hallway at the Las Vegas Convention Center to a dark, elevated booth. A security dispatcher was sitting on a chair in front it; two others worked inside the forbidding-looking structure. </p>
<p>In order to inquire about the lost item, I had to stand on tiptoe and speak through a hole in the protective glass &#8212; as if I were making a bank deposit or talking to a cabbie back in New York. A dispatcher shook her head at me through the window when I asked if a charger had been brought in. </p>
<p>No luck for me.</p>
<p>But for most CES-goers, it seems, all is not actually lost: The Lost &#038; Found department at CES has a better than 50 percent return rate, according to the security dispatcher, whose name is Olivia Huguet. During a conference like CES, she said, the Las Vegas Convention and Visitors Authority fields about 50 misplaced items a day. </p>
<p>&#8220;It depends on what&#8217;s going on, obviously. If it&#8217;s not so busy, people don&#8217;t bring in as many things,&#8221; Huguet said. &#8220;We try to return every item, even after CES is over. We take the time to investigate if there&#8217;s some way to identify the owner.&#8221; </p>
<p>&#8220;We get a lot of iPhones. <em>Tons</em> of iPhones,&#8221; Huguet added. &#8220;We&#8217;re able to return almost every one. But we get other things, too.&#8221;</p>
<p>When I asked what the strangest item is she&#8217;s seen so far at CES, she shrugged. &#8220;Nothing too off-the-wall. Some tripod case today. But other times, we get everything. We&#8217;ve gotten hearing aids, we&#8217;ve gotten teeth. Entire sets of teeth. Sometimes we even see drugs.&#8221;</p>
<p>No comment on whether visitors try to reclaim those.</p>

<p>SAN FRANCISCO POLICE ASSIST APPLE SECURITY WITH THIER LOST PROPERTY INVESTIGATION</p>
<p>After speaking with Apple representatives, we were given information which helped us determine what occurred. It was discovered that Apple employees called Mission Police station directly, wanting assistance in tracking down a lost item. Apple had tracked the lost item to a house located in the 500 block of Anderson Street. Because the address was in the Ingleside Police district Apple employees were referred to Officers in the Ingleside district. Four SFPD Officers accompanied Apple employees to the Anderson street home. The two Apple employees met with the resident and then went into the house to look for the lost item. The Apple employees did not find the lost item and left the house.</p>
<p>The Apple employees did not want to make an official report of the lost item.</p></blockquote>

			<content:encoded><![CDATA[<p><a href="http://mediamemo.allthingsd.com/files/2011/05/the-event.jpeg"><img class="alignright size-medium wp-image-32840" title="the-event" src="http://mediamemo.allthingsd.com/files/2011/05/the-event-246x300.jpg" alt="" width="246" height="300" /></a>Netflix CEO Reed Hastings says <a href="http://mediamemo.allthingsd.com/20110506/netflix-ceo-reed-hastings-swears-hes-not-going-to-kill-hbo-we-compete-like-football-and-baseball/">he might get into the TV salvage business</a>&#8211;footing all or part of the bill for a show that the networks want to cancel, so that his customers can keep watching new episodes.</p>
<p>So here&#8217;s a candidate: &#8220;The Event,&#8221; a &#8220;Lost&#8221;-style serial that NBC had big hopes for last fall, but doesn&#8217;t want anymore.</p>
<p>Comcast&#8217;s broadcast network has cancelled the show in advance of Monday&#8217;s upfront presentation, where it will try to sell its new stuff to advertisers. But <a href="http://www.deadline.com/2011/05/nbc-cancels-the-event-too/">Deadline.com</a> floats the notion that the producers of &#8220;The Event&#8221; will find a new home for the show, and reporter Nellie Andreeva says she hears &#8220;new original programming player Netflix&#8217;s name tossed around.&#8221;</p>
<p>Netflix spokesman Steve Swasey won&#8217;t comment on the report, but I&#8217;ll go ahead and file it under &#8220;possible but not likely.&#8221; That&#8217;s because:</p>
<ul>
<li>It&#8217;s not unheard of for shows that start out on one network to find new life somewhere else. But those are usually shows that have lasted multiple seasons. &#8220;The Event&#8221; just limped through a single one.</li>
<li>That short run also makes it seem like &#8220;The Event&#8221; would be a hard sell for Netflix. If the service had access to past seasons of the show, and had seen significant subscriber interest, it&#8217;d be easier to justify. But in this case, it would have to guess that something that didn&#8217;t appeal to NBC&#8217;s audience would resonate with Netflix users. That&#8217;s a pretty big leap.</li>
</ul>
<p>Then again, I said the same thing about reports that Netflix was going to foot a big part of the bill for a &#8220;House Of Cards,&#8221; a new HBO-style series from Kevin Spacey. And that turned out to be true. So I&#8217;ll leave myself just a bit of wiggle room here: Ya never know!</p>

The energy company has <a href="http://www.cnn.com/2011/US/03/29/bp.lost.laptop/">lost a laptop</a> containing the personal information of thousands of people who filed claims related to last year&#8217;s Deepwater Horizon oil spill.</p>
<p>Lost on a business-related trip in early March, the laptop held the names, Social Security numbers, phone numbers and addresses of some 13,000 claimants. And the only security measure protecting them was a password.</p>
<p>Evidently <a href="http://www.bloomberg.com/news/2011-02-15/swashbuckling-bp-was-ruthless-operator-even-before-the-blowup-interview.html">BP&#8217;s culture of risk, noncompliance and incompetence</a> extends to  IT management as well. At least it&#8217;s consistent.</p>
<p>&#8220;There is no evidence that the laptop or data was targeted or that anyone&#8217;s personal data has in fact been compromised or accessed in any way,&#8221; BP said in a statement. &#8220;We have sent written notice to individuals impacted by this event to inform them about the loss of their personal data and to offer them free credit monitoring services to help protect their personal information.&#8221;</p>
<p>So no harm, no foul, right? Just don&#8217;t ask us to explain why the personally identifiable information of 13,000 Gulf disaster victims were on an unencrypted laptop in the first place.</p>
<p>If this is the sort of care BP gives to claimant data, the company&#8217;s just bolstered the case against it for negligence.</p>

			<content:encoded><![CDATA[<p>Although World Cup tweeting caused <a href="http://mediamemo.allthingsd.com/20100624/newsflash-big-world-cup-game-lots-of-web-traffic-twitter-fail-whales/">record high volume</a> and <a href="http://mediamemo.allthingsd.com/20100618/twitter-no-longer-bothering-to-tell-you-that-its-down/">infrastructure demands</a> on Twitter, the most-discussed topic on Twitter in 2010 was actually the Gulf oil spill, said the San Francisco-based company tonight. The South Africa-hosted World Cup came in at No. 2.</p>

<p>(Of course, Twitter hasn&#8217;t revealed the secret formulas that helped it aggregate, tabulate and rank these topics.)</p>
<p>In the Twitterverse, after the BP oil spill and soccer, the next most popular topic of conversation in 2010 was the movie &#8220;Inception,&#8221; followed by the Haiti earthquake and the vuvuzela. The iPad, Android, Justin Bieber, Harry Potter and Pulpo Paul round out the top 10. It&#8217;s an odd list, indeed.</p>
<p>The person most discussed on Twitter in 2010 was obviously <a href="http://gizmodo.com/5632095/justin-bieber-has-dedicated-servers-at-twitter">he of the dedicated servers</a>, Mr. Bieber. (It&#8217;s somewhat shocking that world events and tech gadgets were able to keep the teen phenom out of the overall top spot.) Beating out her royal highness Lady Gaga, the No. 2 person on Twitter was Brazilian president-elect Dilma Rousseff (pictured).</p>

<p>But don&#8217;t expect to use Netflix to watch shows that aired last night, or even in the last few weeks or months. In most cases, Netflix is adding shows that are a year old or more.</p>
<p>And in the case of the handful of shows that Netflix <em>does</em> run in the same season they appear on TV, it is increasing the &#8220;window&#8221; between their air date and the time they show up on the company&#8217;s streaming service.</p>
<p>Netflix previously had the ability to stream some Disney Channel shows, like &#8220;Wizards of Waverly Place,&#8221; the day after they aired. But now it will wait 15 days to run them, says Netflix content boss Ted Sarandos. The flip side: Netflix will get access to other Disney/ABC-owned shows that it hasn&#8217;t had in the past, like &#8220;Scrubs,&#8221; and in some cases it will get a deeper catalog, like more episodes of &#8220;Lost.&#8221;</p>
<p>Which makes this deal similar to other deals Netflix has cut in the past year with movie studios like Sony and Time Warner&#8217;s Warner Bros. for their offerings: Netflix writes a big check and agrees to wait longer to distribute some content, in exchange for the rights to more content, overall.</p>
<p>So what if you want to watch TV shows that ran last night? There are plenty of other places to get that, like Hulu, Apple&#8217;s iTunes or video-on-demand offerings from cable providers.</p>
<p>&#8220;Day-after broadcast is not core to our strategy. We&#8217;re not in that business, particularly,&#8221; Sarandos says. &#8220;I highly value completeness over freshness. For our customers, it&#8217;s much more about being able to watch the entire run of a show, as it is about being able to see time-shifted episodes.&#8221;</p>
<p>Translation: <em>Hey Hollywood and TV executives! Don&#8217;t believe what you hear and read&#8211;we don&#8217;t want to blow up your existing distribution models. We just want to write you big checks for stuff after you&#8217;re done with it.</em></p>
<p>Earlier this fall, Netflix announced a similar deal with GE&#8217;s NBC, and Sarandos says he thinks his agreement with News Corp.&#8217;s Fox is fairly robust (News Corp. also owns this Web site).</p>
<p>Which means we should expect to see something from CBS down the pipe, too, right? &#8220;We&#8217;re constantly in talks&#8221; with other content owners, Sarandos says.</p>
<p>Translation: <em>Hey Les Moonves! <a href="http://www.mediaweek.com/mw/content_display/news/national-broadcast/e3ie20540bfc5c51d6112c457bf8f162b12">We&#8217;re no Google.</a> How much do you want for &#8220;The Mentalist&#8221;?</em></p>

Is it a good place to see Internet shows that talk about shows that just ran on TV?</p>

<p>Plans are underway for a Hulu-only mini-show slated to run on the video site daily, offering up zippy commentary about TV and pop culture.</p>
<p>Some limited details: The show, which is casting now, will run five minutes an episode Monday through Friday. It&#8217;s supposed to offer  &#8220;a quick and humorous survey of the past 24 hours of Media and pop culture.&#8221;</p>
<p>In other words, think of all of the TV shows that do something like this already&#8211;pretty much everything that runs on E! and half of what runs on VH-1&#8211;and shrink it down to a bite-size Web creation. They&#8217;re not reinventing the wheel here.</p>
<p>You can glean a tiny bit more about the show, via a casting call ad, at the bottom of this post. An actress who auditioned last week tells us the sessions were &#8220;mobbed.&#8221;</p>
<p>(Of course! But note that anyone who does get the gig won&#8217;t be hitting the jackpot&#8211;$1,000 a week, leave your SAG card at home.)</p>
<p>I&#8217;m assuming that &#8220;HD Films,&#8221; the show&#8217;s producer, is the same studio that is already producing &#8220;<a href="http://www.hulu.com/the-jace-hall-show">The Jace Hall Show</a>,&#8221; a Web show about videogames, which runs on Hulu and other sites. Jace Hall is listed as a producer on this one, too.</p>
<p>Hulu rep Elisa Schreiber declined to discuss the show, telling me via email that &#8220;we&#8217;re not sharing any details because it&#8217;s still in the early stages.&#8221;</p>
<p>So why do we care? Because Hulu&#8217;s primary purpose in life, for now, is to provide a place for people to watch bona fide TV shows on the Web&#8211;and primarily shows from its three broadcast TV owners: News Corp.&#8217;s Fox, GE&#8217;s NBC and Disney&#8217;s ABC. (News Corp. also owns this Web site.)</p>
<p>But it has also been dabbling in Web originals over the past year or so: See &#8220;<a href="http://thelxd.com/">The LXD</a>,&#8221; and &#8220;<a href="http://mediamemo.allthingsd.com/20091218/hulu-makes-its-first-move-outside-the-u-s-courtesy-of-a-reality-show-you-dont-know/">If I Can Dream</a>.&#8221;</p>
<p>Hulu now has an original show in the works starring <a href="http://en.wikipedia.org/wiki/Whitney_Port">Whitney Port</a> (who was on &#8220;The Hills,&#8221; Google tells me), designed to promote <a href=" http://news.tubefilter.tv/2010/10/29/who-needs-tv-networks-mattel-grabs-whitney-port-and-goes-right-to-hulu/">Mattel&#8217;s Ken doll</a> (really). And there&#8217;s <a href=" http://www.autoblog.com/2010/10/04/ford-teaming-with-the-amazing-race-producers-for-focus-ra/">something coming</a> from Ford and the producing team behind &#8220;The Amazing Race.&#8221;</p>
<p>The through-line behind all of this stuff: Webby takes on reality shows, which are cheap to produce for conventional TV and  even more so on the Web (again, note the union-free note on the casting info below).</p>
<p>Nothing revolutionary, but it does point to an interesting question: At what point does the line between the best Web video and mediocre TV disappear?</p>
<p>No one thinks the Web is going to replace TV at its best&#8211;expensive original fare like &#8220;Lost&#8221; or &#8220;Glee,&#8221; or big-time events like the Super Bowl and the Oscars. But there&#8217;s not <em>that</em> much high-end, original stuff on TV.</p>
<p>And lots and lots of your programming grid is filled with repeats, which the Web can do just fine. And then lots of less exciting, and less expensive, fare like &#8220;The Biggest Loser&#8221; and the like, which the Web hasn&#8217;t done. Yet.</p>
<p>But there&#8217;s no reason that it couldn&#8217;t. And when and if that starts happening with some frequency, there will be even less reason to keep paying for expensive TV packages&#8230;.</p>

The pitch for Hulu Plus: Pay us $9.95 a month and you can watch even more episodes of those same shows.</p>
<p>But Hulu Plus can&#8217;t show subscribers <em>all</em> of the episodes of <em>all</em> the shows in Hulu&#8217;s catalog. Rights issues mean that certain shows will flit on and off the service, and it&#8217;s up to subscribers to figure that out for themselves.</p>
<p>Example: &#8220;Modern Family,&#8221; ABC&#8217;s award-winning hit sitcom, <a href="http://mediamemo.allthingsd.com/20100903/steve-levitan-gets-his-wish-modern-family-leaves-hulu-briefly/?mod=ATD_rss">disappeared from both Hulu and Hulu Plus this summer after its first season</a>. Now<a href="http://www.hulu.com/modern-family"> it&#8217;s back</a>. But both services are only offering shows from the current season&#8211;there&#8217;s no way to go back and catch up on last year&#8217;s shows, even if you&#8217;re paying.</p>
<p>I think, but haven&#8217;t been able to confirm, that this has to do with DVD sales for the show, which is produced by News Corp.&#8217;s (NWS) 20th Century Fox. I&#8217;ve got queries into both Fox and Disney&#8217;s (DIS) ABC to try to confirm.</p>
<p>Meantime, here&#8217;s what Hulu has to say:</p>
<blockquote class="memo"><p>Yes, the first season of Modern Family is no longer on Hulu Plus.  We acknowledge this can sometimes be confusing for TV fans, so we do all we can to provide as much advance notice as possible when shows are slated to come down. Below is an example from our Saturday Night Live show page on Hulu Plus. You’ll notice it says “New episodes are posted Sunday afternoons and are available for 17 days.”  This is consistent across all our content.</p>
<p>Of course, we keep content on Hulu and Hulu Plus for as long as possible. We can’t offer a specific reasons why a particular video may be taken down, as streaming clearances differ from show to show.</p></blockquote>

<p>And sure enough, if you head to each show&#8217;s Hulu page, you&#8217;ll find a different set of availabilities.</p>
<p>Regular Hulu users can only see the last five episodes of &#8220;<a href="http://www.hulu.com/family-guy">The Family Guy</a>,&#8221; for instance, while Hulu Plus subscribers can see all nine seasons. But even if you&#8217;re a paying customer, Hulu can only show you five episodes of &#8220;<a href="http://www.hulu.com/the-simpsons?c=Animation-and-Cartoons">The Simpsons</a>,&#8221; period.</p>
<p>Meanwhile, the last season of &#8220;<a href="http://www.hulu.com/lost">Lost</a>&#8221; fell off both the free and paid services last month, and the other five seasons will go away at the end of the year. Etc.</p>
<p>To be fair to Hulu, it&#8217;s certainly not the only service negotiating the frustrating rights/windows patchwork. Everyone who deals with digital media has to navigate this stuff. And none of it makes sense to viewers who just want to watch their shows, when they want to watch them.</p>
<p>But the patchwork is a bigger deal for Hulu, because the service&#8217;s primary pitch is that it&#8217;s a one-stop shop for all your TV viewing (or at least your <a href="http://mediamemo.allthingsd.com/20100630/hulu-ceo-jason-kilar-were-no-cable-killer-we-swear/">broadcast TV viewing</a>). Instead it&#8217;s really closer to a half-stocked Super Target: There&#8217;s a lot of stuff in there, but you still may not find what you need.</p>
<p>Hulu competitor Netflix (NFLX) offers lots of TV shows via its paid streaming service, too. But it pointedly doesn&#8217;t play up the presence of any particular show&#8211;Reed Hastings and company simply tell consumers that they&#8217;ll find shows they like.</p>
<p>But if you&#8217;ve ponied up $10 a month for Hulu Plus and find that you still can&#8217;t watch a show that aired a few months ago, you may not be cool with that at all.</p>
<p>Gaps in Hulu&#8217;s free service may not be as frustrating for users, because they&#8217;re not out any cash. But it is a problem for the joint venture <a href="http://mediamemo.allthingsd.com/20101008/hulu-still-beating-the-ipo-drum/">as it ponders a public offering</a>, premised on the notion that its TV partners/owners&#8211;ABC, Fox and GE/Comcast&#8217;s NBC&#8211;are in it for the long haul.</p>
<p>But if Hulu can&#8217;t tell users that it has all the rights it needs, how can it convince investors?</p>
<p>Meanwhile, a similarly confusing story:<br />

Because <a href="http://mediamemo.allthingsd.com/20100608/why-tv-still-wont-embrace-the-web-quite-yet/?mod=ATD_rss">the eyeballs it attracts don&#8217;t do him any good</a>.</p>
<p>Wish granted! Temporarily.</p>
<p>Turns out, Levitan&#8217;s show <em>has</em> been off the free Web&#8211;Hulu, ABC.com and ABC&#8217;s free iPad app&#8211;for the past month or so. Hulu, which is co-owned by News Corp.&#8217;s (NWS) Fox, Disney&#8217;s (DIS) ABC, and GE&#8217;s (GE) NBC, <a href="http://www.hulu.com/modern-family">explains that its streaming rights for the show expired on July 27</a>. And that the show will be back this fall.</p>
<p>That seems a little weird, because you can still watch online episodes of most other big network shows that aired last year. But I&#8217;m told that while some ABC executives were actually in favor of taking Levitan at his word, &#8220;Modern&#8217;s Family&#8221;&#8216;s temporary absence isn&#8217;t a punishment, but has to do with the release of the show&#8217;s first DVD set, <a href="http://www.amazon.com/Modern-Family-Complete-First-Season/dp/B002JVWQSW">due out later this month</a>.</p>
<p>Which makes sense. Because even in 2010, Hollywood&#8211;in this case News Corp.&#8217;s Fox, which produces the show&#8211;still values analog dollars more than anything the Web can produce. So if the TV guys think there&#8217;s a chance that free Web shows cut into DVD sales&#8230;.</p>
<p>And while these windows/channel conflicts aren&#8217;t going away anytime soon, they remain confusing.</p>
<p>For instance, you can still watch the last episode of &#8220;Lost&#8221; on Hulu, even though the <a href="http://www.amazon.com/Lost-Complete-Sixth-Final-Season/dp/B0036EH3XE/ref=sr_1_2?ie=UTF8&amp;s=dvd&amp;qid=1283541832&amp;sr=8-2">DVDs</a> of the last season went on sale a couple of weeks ago. But <a href="http://www.hulu.com/lost">Hulu</a> says the series finale  will disappear from its site on September 20. And that it won&#8217;t be showing seasons 1 to 5 after the end of 2010. Go figure.</p>
<p>But! You can still watch &#8220;Modern Family&#8221; on the Web, without breaking the law. All you need to do is wrangle a Hulu Plus invite, and you can watch it on your Web browser, or on your Apple (APPL) iPad or iPhone, for that matter. Is that worth $10 a month to you?</p>
<p>In the meantime, cheapskates will have to get by on free Web clips like this one:<br />

<p>The opening line of the classic J.M. Barrie book &#8220;Peter Pan&#8221; reads, &#8220;All children, except one, grow up.&#8221;</p>
<p>Actually, that one grew up, too, and now the whole Internet is angry at Google (GOOG) and taking shots, because of the Silicon Valley search giant&#8217;s recent <a href="http://mediamemo.allthingsd.com/20100809/live-google-verizon-talk-policy/">joint public-policy proposal with Verizon</a> (VZ) over net neutrality.</p>
<p>Many are claiming Google&#8211;in the most cynical of ways&#8211;sold out its long-standing commitment to the open Internet to make a corporately favorable deal.</p>
<p>Thus, Google&#8211;in this case, Richard Whitt, Washington Telecom and Media Counsel&#8211;took to the <a href="http://mediamemo.allthingsd.com/20100812/google-tries-explaining-its-network-neutrality-non-deal-with-verizon-again/">corporate blog yesterday to explain it all away in a post</a> titled &#8220;Facts About Our Network Neutrality Policy.&#8221;</p>
<p>It practically begs for translation, so BoomTown shall not disappoint:</p>
<p><strong>Google wrote:</strong> <em>Over the past few days there&#8217;s been a lot of discussion surrounding our announcement of a policy proposal on network neutrality we put together with Verizon. On balance, we believe this proposal represents real progress on what has become a very contentious issue, and we think it could help move the network neutrality debate forward constructively.</p>
<p>We don&#8217;t expect everyone to agree with every aspect of our proposal, but there has been a number of inaccuracies about it, and we do want to separate fact from fiction.</em></p>
<p><strong>Translation:</strong> Wait, the hypnotic multicolored letters aren&#8217;t working anymore? What about the cute logos on the homepage&#8211;didja see our whimsical &#8220;Wizard of Oz&#8221; montage? Hey, our founders still wear wacky shoes!</p>
<p>And look over here at the Googleplex: Segways with wings and coconut-water lattes for all!</p>
<p>Okay, we&#8217;ll come clean: This band of Lost Boys&#8211;and Wendy who runs search&#8211;didn&#8217;t want to grow up, either.</p>

<p>But Sheryl Sandberg did an Indian talent raid and convinced Tinkerbell to take all her fairy dust to work on magical social-marketing features at Facebook. Also, Captain Hook and that alligator are working up some geo-location thing with the ticking clock over at Foursquare.</p>
<p>In other words, that&#8217;s Mr. Peter <em>Man</em> to you now.</p>
<p><strong>Google wrote:</strong> <em><strong>MYTH: Google has &#8220;sold out&#8221; on network neutrality.</strong></p>
<p>FACT: Google has been the leading corporate voice on the issue of network neutrality over the past five years. No other company is working as tirelessly for an open Internet.</p>
<p>But given political realities, this particular issue has been intractable in Washington for several years now. At this time there are no enforceable protections&#8211;at the Federal Communications Commission or anywhere else&#8211;against even the worst forms of carrier discrimination against Internet traffic.</p>
<p>With that in mind, we decided to partner with a major broadband provider on the best policy solution we could devise together. We’re not saying this solution is perfect, but we believe that a proposal that locks in key enforceable protections for consumers is preferable to no protection at all.</em></p>
<p><strong>Translation:</strong> We caved. In fact, we spelunked. All right, we journeyed to the center of the earth. Second to the right and straight on till morning, times a google.</p>
<p>But it is not technically selling out, since we got no money in the deal. I mean, not <em>yet</em>.</p>

<p>We&#8217;re not saying the solution is perfect. But we believe that a proposal that locks in key moneymaking fees for us is preferable to having to struggle later&#8211;like those losers at Microsoft (MSFT) do today&#8211;when the search business goes the way of boxed software.</p>
<p><strong>Google wrote:</strong> <em><strong>MYTH: This proposal represents a step backwards for the open Internet.</strong></p>
<p>FACT: If adopted, this proposal would for the first time give the FCC the ability to preserve the open Internet through enforceable rules on broadband providers. At the same time, the FCC would be prohibited from imposing regulations on the Internet itself.</p>
<p>Here are some of the tangible benefits in our joint legislative proposal:</p>
<p>* Newly enforceable FCC standards<br />
* Prohibitions against blocking or degrading wireline Internet traffic<br />
* Prohibition against discriminating against wireline Internet traffic in ways that harm users or competition<br />
* Presumption against all forms of prioritizing wireline Internet traffic<br />
* Full transparency across wireline and wireless broadband platforms<br />
* Clear FCC authority to adjudicate user complaints, and impose injunctions and fines against bad actors<br />
* Verizon has agreed to voluntarily abide by these same requirements going forward&#8211;another first for a major communications provider. We hope this action will convince other broadband companies to follow suit.</em></p>
<p><strong>Translation:</strong> Did you ever do the Hokey Pokey? Jockeying for political power in Washington is like that, except someone <em>always</em> loses an eye.</p>

<p><strong>Google wrote:</strong> <em><strong>MYTH: This proposal would eliminate network neutrality over wireless.</strong></p>
<p>FACT: It&#8217;s true that Google previously has advocated for certain openness safeguards to be applied in a similar fashion to what would be applied to wireline services. However, in the spirit of compromise, we have agreed to a proposal that allows this market to remain free from regulation for now, while Congress keeps a watchful eye.</p>
<p>Why? First, the wireless market is more competitive than the wireline market, given that consumers typically have more than just two providers to choose from. Second, because wireless networks employ airwaves, rather than wires, and share constrained capacity among many users, these carriers need to manage their networks more actively. Third, network and device openness is now beginning to take off as a significant business model in this space.</p>
<p>In our proposal, we agreed that the best first step is for wireless providers to be fully transparent with users about how network traffic is managed to avoid congestion, or prioritized for certain applications and content. Our proposal also asks the Federal government to monitor and report regularly on the state of the wireless broadband market. Importantly, Congress would always have the ability to step in and impose new safeguards on wireless broadband providers to protect consumers&#8217; interests.</p>
<p>It&#8217;s also important to keep in mind that the future of wireless broadband increasingly will be found in the advanced, 4th generation (4G) networks now being constructed. Verizon will begin rolling out its 4G network this fall under openness license conditions that Google helped persuade the FCC to adopt. Clearwire is already providing 4G service in some markets, operating under a unique wholesale/openness business model. So consumers across the country are beginning to experience open Internet wireless platforms, which we hope will be enhanced and encouraged by our transparency proposal.</em></p>

<p><strong>Translation:</strong> By transparency, we mean a backroom deal so covered in the fog of compromise that it was like the Smoke Monster in &#8220;Lost.&#8221;</p>
<p>And you know what happened when he (she? it?) showed up. Not pretty.</p>
<p>Neither was the fact that we had to throw wireless&#8211;the most promising of networks&#8211;under the bus right now. While there is likely to be some crushing of competition and mangling of the bones of this little baby, you can be sure Congress can always step in to protect consumers&#8217; interests with regard to wireless broadband.</p>
<p>In fact, Congress just hired Kate and Jon Gosselin to give parenting tips on how not to completely take advantage of the wired Internet&#8217;s most valuable offspring.</p>
<p><strong>Google wrote:</strong> <strong><em>MYTH: This proposal will allow broadband providers to &#8220;cannibalize&#8221; the public Internet.</strong></p>
<p>FACT: Another aspect of the joint proposal would allow broadband providers to offer certain specialized services to customers, services which are not part of the Internet. So, for example, broadband providers could offer a special gaming channel, or a more secure banking service, or a home health monitoring capability&#8211;so long as such offerings are separate and apart from the public Internet. Some broadband providers already offer these types of services today. The chief challenge is to let consumers benefit from these non-Internet services, without allowing them to impede on the Internet itself.</p>
<p>We have a number of key protections in the proposal to protect the public Internet:</p>
<p>* First, the broadband provider must fully comply with the consumer protection and nondiscrimination standards governing its Internet access service before it could pursue any of these other online service opportunities.</p>
<p>* Second, these services must be &#8220;distinguishable in purpose and scope&#8221; from Internet access, so that they cannot over time supplant the best effort Internet.</p>
<p>* Third, the FCC retains its full capacity to monitor these various service offerings, and to intervene where necessary to ensure that robust, unfettered broadband capacity is allocated to Internet access.</p>
<p>So we believe there would be more than adequate tools in place to help guard against the &#8220;cannibalization&#8221; of the public Internet.</em></p>
<p><strong>Translation:</strong> Yes, the very same government that protected its citizens from the sub-prime mortgage mess by monitoring those giant, risk-mad banks so well.</p>
<p>The same government that was making sure oil giants like BP adhered to strict safety standard for its offshore wells.</p>

<p>Of sharkish telcom companies, yes. Of man-eating lions from the cable business, certainly.</p>
<p>But of multicolored, letter-decorated piranhas who look harmless with their big squishy balls and organic guava smoothies but will cut you as soon as you stick one consumer finger in the digital pond?</p>
<p>Let&#8217;s just say: Don&#8217;t go in the water.</p>
<p><strong>Google wrote:</strong> <em><strong>MYTH: Google is working with Verizon on this because of Android.</strong></p>
<p>FACT: This is a policy proposal&#8211;not a business deal. Of course, Google has a close business relationship with Verizon, but ultimately this proposal has nothing to do with Android. Folks certainly should not be surprised by the announcement of this proposal, given our prior public policy work with Verizon on network neutrality, going back to our October 2009 blog post, our January 2010 joint FCC filing, and our April 2010 op-ed.</em></p>
<p><strong>Translation:</strong> Rachel, are you in London or back in Mountain View? Please ring us up asap, as you need to come up with some fancy new talk. I don&#8217;t think they are buying this policy-proposal-not-a-business-deal pablum.</p>
<p>In fact, I am even giggling every time I write it.</p>
<p><strong>Google wrote:</strong> <em><strong>MYTH: Two corporations are legislating the future of the Internet.<br />

<p>FACT: Our two companies are proposing a legislative framework to the Congress for its consideration. We hope all stakeholders will weigh in and help shape the framework to move us all forward. But iPad users can <em>already</em> watch ABC shows on the iPad via the network&#8217;s free app. What gives?</p>
<p>That&#8217;s the question a lot of people in the media industry have asked since the Disney (DIS) unit launched its app in April. The usual response, after a shrug&#8211;perhaps <a href="http://mediamemo.allthingsd.com/20100422/why-10-a-month-for-hulu-is-too-much-and-too-little/?reflink=ATD_yahoo_ticker">Disney CEO Bob Iger wanted to do something nice for Apple&#8217;s (AAPL) Steve Jobs</a>, who happens to be the biggest single owner of Disney shares.</p>
<p>And that may well be the case. But I&#8217;ve since heard a slightly more detailed justification for the free app. Bear with me:</p>
<p>The shows offered by the ABC app are the same ones ABC offers up for free on its Web site. Which means, because of the terms of <a href="http://mediamemo.allthingsd.com/20090501/why-it-took-more-than-four-months-and-millions-of-dollars-to-get-lost-on-hulu/">ABC&#8217;s deal with Hulu</a>, that those same shows are available for free on Hulu.</p>
<p>But the Hulu subscription service will feature ABC shows that aren&#8217;t available <em>anywhere</em> online for free. So you&#8217;ll see different shows on ABC&#8217;s free app than on Hulu&#8217;s paid offering. Which means they aren&#8217;t really competitive at all.</p>
<p>Got it?</p>
<p>Admittedly, that logic will track, if you&#8217;re paying attention. And if you follow the TV and movie industry&#8217;s use of &#8220;windows&#8221; and the disruptive threat digital media pose to Hollywood, it won&#8217;t sound completely foreign.</p>
<p>And perhaps the first several million iPad buyers will be savvier than most TV watchers. But for most people, it&#8217;s going to remain a head-scratcher: Why do I get to watch some episodes of &#8220;Lost&#8221; for free on this app, but it costs $10 a month to watch other episodes of the same show on <em>that</em> app?</p>
<p>And if anyone asks you that question, feel free to mention this post. It&#8217;s free, after all.</p>

<p>Oh dear, here it comes round again, like a bout of the flu&#8211;the indefatigable narrative about how Microsoft is headed downhill at an alarming speed, how CEO Steve Ballmer is about to get the boot and how it is all really, really true since the echo chamber of tech keeps repeating it.</p>
<p>Over the past two weeks, for example, I have gotten numerous &#8220;tips&#8221; that all these things are about to happen. Except when I go to check them out by doing some actual reporting, they turn out to be more chatter than reality, more barstool musing than concrete, and without much in the way of those pesky facts.</p>
<p>Today, we get yet another from the Olympic champion of traffic-goosing headlines on blogs, Henry Blodget of Silicon Alley Insider, in what is quite a humdinger of a title: <a href="http://www.businessinsider.com/microsofts-business-could-collapse-2010-6">&#8220;The Odds Are Increasing That Microsoft&#8217;s Business Will Collapse.&#8221;</a></p>
<p><em>Holy Guacamole!</em> Really?</p>
<p>You mean the Microsoft that still&#8211;despite all the Google Apps machinations&#8211;has a hammerlock on the enterprise software market? The company with a badillion dollars in cash in the bank? The one that can lose more than $700 million in its Online Services division and not blink an eye?</p>
<p>Actually, the headline is the most exciting part of the whole article that follows, which hedges mightily as it also dredges up old news about Microsoft&#8217;s business challenges.</p>
<p><img src="http://kara.allthingsd.com/files/2010/06/lost-smoke-monster-cerberus-esau-275x163.jpg" alt="" title="lost-smoke-monster-cerberus-esau" width="275" height="163" class="alignleft size-medium wp-image-29626" /></p>
<p>The short version: The Internet is everything that&#8217;s not good for Microsoft; Apple (AAPL) is rocking the mobile market; Google (GOOG) is disrupting all over the place; and, <em>natch</em>, the oncoming cloud-computing incursion is worse than the Smoke Monster from &#8220;Lost&#8221; for Microsoft&#8217;s cash-generating Windows and Office businesses.</p>
<p>All true in a very broad-brush way. But, of course, Blodget pulls a complete on-one-hand-on-the-other at the end, although he cannot resist a final over-the-top statement:</p>
<blockquote class="memo"><p>Right now, the investors are concluding that Microsoft will gradually become the equivalent of a technology utility&#8211;a boring but necessary provider of the software that runs the world&#8217;s business community. A smaller, more optimistic crowd is still arguing that, one day, Microsoft will be able to turn its fortunes around, and fight its way back into an industry leadership position.</p>
<p>What almost no one is talking about is a third possibility, one that becomes more likely by the day: The possibility that, a couple of years down the road, Microsoft&#8217;s business may just completely collapse.</p></blockquote>
<p>Here&#8217;s the simple and less flashy situation:</p>
<p>Microsoft, as all tech companies do, needs to change, and a lot faster than it has so far; the company has been trying mightily to do so in search and recently, in mobile, where it is woefully far behind; its leadership under Ballmer, who took over from co-founder Bill Gates, has been <em>meh</em> enough to keep its stock moribund.</p>
<p>But, by no means recently&#8211;even if there is a better CEO for Microsoft out there than Ballmer&#8211;have I found the company execs ignorant about the tougher issues or unwilling to consider changes needed.</p>

<p>In fact, in its high-flying days, Microsoft did have a tin ear to criticism. No longer, and I would call its execs appropriately concerned about fixing its issues, although their efforts do suffer from the company&#8217;s massive size and inertia in making the right moves.</p>
<p>Thus, they certainly might not be successful at innovating, although these are the very kinds of problems Apple CEO Steve Jobs solved when he returned to a rotten company in what, in its current glory days, seems eons ago.</p>
<p>And Microsoft has been getting the same questions that are beginning to be asked about Google.</p>
<p>But can you imagine anyone not mocking a likely headline-to-come about the search giant: &#8220;Search: If That&#8217;s All There Is, My Friend, Then Let&#8217;s Keep Surfing (<em>to Oblivion!</em>)&#8221;?</p>
<p>That&#8217;s why&#8211;at this point&#8211;I can see no need for panic to set in about Microsoft. Next year, perhaps. Five years, with no change and not listening to the obvious, definitely.</p>
<p>As for today, even though we are all terminal, the sky looks like it will remain intact at Microsoft for a little bit longer.</p>

<p>A public service announcement for those of you eager to start paying for Hulu: Be patient. You&#8217;re going to have to keep waiting.</p>
<p>Last month, the <a href="http://latimesblogs.latimes.com/entertainmentnewsbuzz/2010/04/hulu-pushes-forward-with-995-subscription-service.html">Los Angeles Times</a> said Hulu was set to roll out a subscription service &#8220;as soon as May 24.&#8221; That&#8217;s next Monday. But people familiar with the company say there&#8217;s no way a Hulu Plus will be up and running by then.</p>
<p>When will the long-discussed premium service be ready? I don&#8217;t know. I&#8217;m still not entirely convinced that the joint venture&#8211;owned by News Corp.&#8217;s (NWS) Fox, Disney&#8217;s (DIS) ABC and GE&#8217;s (GE) NBC&#8211;has completely settled on terms of the plan, though <a href="http://mediamemo.allthingsd.com/20100422/why-10-a-month-for-hulu-is-too-much-and-too-little/?reflink=ATD_yahoo_ticker">I think they&#8217;ve agreed on the broad strokes</a>: $10 a month for access to a deeper catalog of broadcast shows and to the service on devices like Apple&#8217;s (AAPL) iPad. (Regular Hulu, which is on a pace to <a href="http://mediamemo.allthingsd.com/20100331/hulu-were-profitable-booming/">generate $200 million in advertising</a> this year, remains free).</p>
<p>And even if Hulu and all of its partners are seeing eye-to-eye&#8211;not a given&#8211;getting the rights from various programming partners to sell their shows could be a slog.</p>
<p>The upside: Your patience will be rewarded, Hulu subscribers of the future. One person familiar with the company&#8217;s plans tells me the new service will be &#8220;revolutionary.&#8221; <a href="http://www.apple.com/ipad/">Popular claim</a> these days. Let&#8217;s see if it holds up.</p>

<p>That&#8217;s not really out of character for Jobs, I suppose, but it does speak to just how deeply involved he is in keeping Apple’s (AAPL) new products secret until he decides it’s time to show them to the public.</p>

<p>The network is the only one of the four broadcasters offering much programming on Apple&#8217;s device at launch Saturday. As <a href="http://mediamemo.allthingsd.com/20100401/the-ipad-will-be-great-for-free-and-cheap-tv-shows-but-not-this-weekend/">previously reported</a>, the Disney (DIS) unit is offering about 20 of its shows, including &#8220;Lost&#8221; and &#8220;Grey&#8217;s Anatomy,&#8221; for free via a <a href="http://abc.go.com/site/abc-player-for-ipad">new app</a>.</p>
<p>But that&#8217;s about it. Come Saturday, CBS (CBS) will only be streaming full episodes of &#8220;Survivor&#8221; at its iPad-friendly site. And News Corp.&#8217;s (NWS) Fox and GE&#8217;s (GE) NBC aren&#8217;t streaming any full-length shows at all. If you want to watch &#8220;CSI,&#8221; &#8220;The Simpsons&#8221; or &#8220;30 Rock&#8221; on your Web browser this weekend, you&#8217;ll need to use something other than an iPad.</p>
<p>CBS says it will offer more shows over time, but NBC and Fox aren&#8217;t even promising that. When the Hulu app arrives, those two networks&#8217; shows will be available there, but under current plans, <a href="http://mediamemo.allthingsd.com/20100219/will-you-pay-for-hulu-on-the-ipad-it-may-be-your-only-choice/">they&#8217;ll be available only to paying subscribers</a>.</p>
<p>The holdouts&#8217; logic is that the iPad is a mobile device. And while the networks are basically okay with streaming their stuff for free on the Web, they think that mobile is a different ballgame, and one they can charge for (though even that&#8217;s confusing &#8212; NBC does stream full-length shows for free to the iPhone, but won&#8217;t do the same for the iPad).</p>
<p>But if that&#8217;s the reasoning, why is ABC, <a href="http://mediamemo.allthingsd.com/20090501/why-it-took-more-than-four-months-and-millions-of-dollars-to-get-lost-on-hulu/">which joined up with Hulu a year ago</a>, putting up its stuff for free on the iPad? The fact that Apple (AAPL) boss Steve Jobs is Disney&#8217;s largest single shareholder can&#8217;t be the only reason.</p>
<p>ABC may be able to thread the needle here because it is only making its shows available via Wi-Fi streaming, not over AT&amp;T&#8217;s (T) network. But that kind of &#8220;windowing&#8221; is going to seem awfully arbitrary to most casual users, and those are the ones both Apple and the networks are supposed to be targeting here. So something&#8217;s going to have to give. Stay tuned.</p>

<p>Nielsen says 13.3 percent of Americans who watched the Oscars also used the Web during this month&#8217;s telecast and that 14.5 percent of those watching last month&#8217;s Super Bowl did the same thing (see table below; click to enlarge). </p>
<p>These numbers are both up from last year, and the only surprise here is that they&#8217;re so low. But remember: Not everyone spends as much time on the Web as you do&#8211;a <a href="http://www.smartplanet.com/business/blog/smart-takes/fcc-35-of-americans-dont-have-broadband-internet-access/4520/">third of the country still doesn&#8217;t have broadband</a>.</p>
<p><a rel="lightbox" href="http://mediamemo.allthingsd.com/files/2010/03/nielsen-simultaneous.png"><img class="alignnone size-large wp-image-17484" title="nielsen simultaneous" src="http://mediamemo.allthingsd.com/files/2010/03/nielsen-simultaneous-600x180.png" alt="" width="350" height="104" /></a></p>
<p>Nielsen says that online/offline viewers spent the majority of their Web time at Facebook, Google (GOOG) and Yahoo (YHOO), which isn&#8217;t surprising. It&#8217;s a little bit interesting that Twitter.com doesn&#8217;t crack Nielsen&#8217;s list of Top 10 domains for simultaneous viewing. But perhaps most people who Twitter during TV time are doing so from their phones.</p>
<p>Speaking of which, many thanks to all of you who have <a href="http://mediamemo.allthingsd.com/20100202/lost-twitter-and-the-tragedy-of-the-commons-a-semi-modest-proposal/">refrained from Twittering during and immediately after &#8220;Lost&#8221; this season</a>&#8211;my stream has been nice and quiet so far. Or perhaps no one&#8217;s watching &#8220;Lost&#8221; anymore. I wouldn&#8217;t blame them; this season has been frustrating even by the show&#8217;s frustrating standards.</p>

<p>Hi there! Salivating for tonight&#8217;s show? Me too.</p>
<p>But I have a request. Please hear me out.</p>
<p>Like you, I&#8217;ve invested an embarrassingly substantial number of hours in this thing. And I can&#8217;t wait for one last season with Jack, Locke, et al. (Especially Locke. Can&#8217;t get enough Locke.)</p>
<p>But unlike some of you, I&#8217;m probably not going to be able to watch every show in real-time. Various life requirements are going to force me to watch at least some of these a day or two later on the DVR (or ABC.com or Hulu in a pinch).</p>
<p>Which would be fine, except that I&#8217;m also on Twitter <a href="http://twitter.com/pkafka">a lot</a>, and so are many of you. And many of you want to tweet about the show while it&#8217;s running and during its aftermath.</p>
<p>I don&#8217;t know why that is. I get the idea of Twittering along with live communal events like &#8220;American Idol&#8221; or <a href="http://twitter.com/pkafka/status/8173128673">pro football</a>. But you guys realize that &#8220;Lost&#8221; episodes were taped months ago, right?</p>
<p>Anyway, I&#8217;m not here to judge! Just to ask for your help.</p>
<p>My ask: It&#8217;d be really great if you folks could lay off the &#8220;Lost&#8221; tweets until a few days after each show. Because otherwise, I&#8211;and, I suspect many other people, as well&#8211;will have to make an unpleasant choice: Stop using Twitter for several days a week or wade through lots and lots of spoilers. (This is apparently not a <a href="http://itre.cis.upenn.edu/~myl/languagelog/archives/001909.html">Hobbesian Choice</a> but a <a href="http://en.wikipedia.org/wiki/Morton%27s_Fork">Morton&#8217;s Fork</a>. Thanks, Wikipedia!)</p>
<p><a href="http://mediamemo.allthingsd.com/files/2009/04/whatsinthehatch.jpg"><img class="alignleft size-medium wp-image-6709" title="whatsinthehatch" src="http://mediamemo.allthingsd.com/files/2009/04/whatsinthehatch-250x166.jpg" alt="" width="250" height="166" /></a>Yes, I think it&#8217;s theoretically possible for me to set up Twitter clients like Tweetdeck to strike some &#8220;Lost&#8221;-related tweets from my stream. But not all of them.</p>
<p>I also suppose we could also ask Biz Stone and crew to somehow filter out &#8220;Lost&#8221; tweets from the mainstream, but I think those guys have more <a href="http://mediamemo.allthingsd.com/20100127/will-apple-break-twitter/">important</a> <a href="http://mediamemo.allthingsd.com/20090916/twitter-goes-for-broke-if-broke-means-a-lot-of-money-new-funding-round-at-1-billion-valuation/">stuff</a> to do. (One other alternative would be to ask all you Twittering real-time &#8220;Lost&#8221; watchers to head somewhere else for a bit, like <a href="http://mediamemo.allthingsd.com/20091125/hot-potato-is-ready-to-eat-do-twitter-facebook-users-want-another-realtime-chatter-service/?mod=ATD_search">Hot Potato</a>, which is supposed to work for just this sort of thing. But I can understand if you&#8217;re not up for embracing yet another messaging service.)</p>
<p>So. What do you think ? I&#8217;m not asking for much, I think. Just a little near-term restraint. Let&#8217;s say two days, max.</p>
<p>That lets the rest of us catch up&#8211;remember, East Coasters, that the poor folks on the other side of the country are three hours behind to begin with. And then we can join the rest of you, and we can all discuss this awesome show in 140 or fewer characters.</p>

The good news: Some people paid up.</p>
<p>And from YouTube&#8217;s perspective, that&#8217;s all that matters. Because the Google (GOOG) unit certainly didn&#8217;t make any money from the exercise: 2,684 people paid $3.99 a pop to rent indie movies from Sundance, netting all of $10,709.16, <a href="http://bits.blogs.nytimes.com/2010/02/02/youtubes-take-from-movie-rentals-1070916/">the New York Times notes</a>.</p>
<p>But since YouTube hadn&#8217;t ever rented a single piece of video to anyone who wasn&#8217;t a Google employee before, the company can plausibly claim this was a success. It has been testing <a href="http://online.wsj.com/article/SB125192241524880801.html?mod=djemalertNEWS">movie rentals</a> internally for some time, and Google execs have suggested both <a href="http://mediamemo.allthingsd.com/20091216/youtube-paid-video-could-come-in-the-not-too-distant-future/">publicly</a> and privately that they&#8217;ll be renting films&#8211;and <a href="http://mediamemo.allthingsd.com/20091201/is-youtube-ready-for-prime-time-google-wants-to-stream-tv-for-a-fee/">perhaps TV shows</a>&#8211;in the near future.</p>
<p>But among other things, they need to show Hollywood that they can actually do this, so the Sundance experiment could be useful no matter how many dollars it generates.</p>
<p>I&#8217;d assumed that the standard pricing/windowing/biz-dev issues were holding up YouTube&#8217;s entry into paid video, but some industry executives have told me that there are technical issues to deal with as well, like making sure video files are handled securely. So Sundance has to help, right?</p>
<p>Meanwhile, here&#8217;s the trailer from &#8220;Be Kind Rewind,&#8221; a movie about movies I haven&#8217;t seen but would like to. Maybe once this season of &#8220;Lost&#8221; ends.</p>

<p>The show is premiering the first episode of its final season next week, and the Fine Brothers want some answers about the convoluted plot of the often vexing program.</p>
<p>Using &#8220;Downtown&#8221; as its tune, the spoof is long, but spot-on&#8211;the part about Jin is especially hysterical. And that&#8217;s coming from someone who gave up on &#8220;Lost&#8221; after the weird second season.</p>
