<p>In a <a href="http://blogs.adobe.com/conversations/2011/11/flash-focus.html">blog post by one of its execs</a>, titled &#8220;Flash to Focus on PC Browsing and Mobile Apps; Adobe to More Aggressively Contribute to HTML5,&#8221; Adobe said what had already been reported: That it would no longer be developing its well-known Flash for mobile devices.</p>
<p>Here&#8217;s the key graph:</p>
<p>&#8220;Our future work with Flash on mobile devices will be focused on enabling Flash developers to package native apps with Adobe AIR for all the major app stores. We will no longer continue to develop Flash Player in the browser to work with new mobile device configurations (chipset, browser, OS version, etc.) following the upcoming release of Flash Player 11.1 for Android and BlackBerry PlayBook. We will of course continue to provide critical bug fixes and security updates for existing device configurations. We will also allow our source code licensees to continue working on and release their own implementations.&#8221;</p>
<p>Last night, <a href="http://allthingsd.com/20111108/gone-in-a-flash-adobe-said-halting-development-on-mobile-version-of-its-plug-in/">reports surfaced</a> that the high-profile software company &#8212; whose Flash technology has been a flagship product &#8212; was halting development on the mobile version of its browser plug-in.</p>
<p>Now, Adobe will focus its PC Web browser business on tools that allow Flash developers to create mobile apps by packaging their code to run on Adobe&#8217;s AIR platform.</p>
<p>The move has big implications for Adobe going forward and also for mobile device makers, such as Google and Research In Motion. But <a href="http://allthingsd.com/20111109/horse-flash-apples-steve-jobs-on-adobe-vendetta-in-2010-at-d8-video/">not Apple</a>.</p>
<p>As Ina Fried wrote: </p>
<p>&#8220;The move, if true, would be a major blow to Android device makers, who have long touted Flash compatibility as a key competitive advantage over Apple&#8217;s iPhone and iPad.</p>
<p>It would also mark a posthumous vindication for former Apple CEO Steve Jobs, who took a controversial stand by not supporting Flash on Apple&#8217;s mobile products.&#8221;</p>
<p>Turns out Jobs was prescient, as usual.</p>

<p>Adobe is all about enabling designers and developers to create the most expressive content possible, regardless of platform or technology. For more than a decade, Flash has enabled the richest content to be created and deployed on the web by reaching beyond what browsers could do. It has repeatedly served as a blueprint for standardizing new technologies in HTML. Over the past two years, we&#8217;ve delivered Flash Player for mobile browsers and brought the full expressiveness of the web to many mobile devices.</p>

<p>After a series of increasingly disappointing quarterly earnings announcements, Wall Street is hoping that Research in Motion will deliver better results today.</p>
<p>The Canadian phone maker &#8212; most famous for its iconic Blackberry devices &#8212; will be reporting its second-quarter earnings after the markets close later today.</p>
<p>Analysts are predicting earnings of 87 cents a share for the period, which is within RIM&#8217;s own guidance range of adjusted profit &#8212; between 75 cents and $1.05 per share.</p>
<p>Higher would be better, based on the hope that sales of its most recent smartphones with the Blackberry 7 operating system, and also its lackluster PlayBook tablet, will help its results after a downward slide that has been painful.</p>
<p>That&#8217;s been especially tough, since both Apple&#8217;s iOS and Google Android are surging ahead in the mobile market. </p>
<p>RIM hopes to also get a boost from the first phone using the QNX operating system it bought last year.</p>

		<description><![CDATA[Things that make you go "Boom!!!": Google's $12.5 billion purchase of handset maker Motorola.]]></description>
			<content:encoded><![CDATA[<p><a href="http://allthingsd.com/files/2011/08/explosion.png"><img src="http://allthingsd.com/files/2011/08/explosion-150x150.png" alt="" title="explosion" width="150" height="150" class="alignright size-thumbnail wp-image-109998" /></a>With the entry of Google into the handset-making market, the search giant has just declared a number of things, most especially that its own future is all about mobile. </p>
<p>With the <a href="http://allthingsd.com/20110815/gulp-google-buying-motorola-mobility-for-12-5-billion/">$12.5 billion purchase of Motorola Mobility</a>, the iconic but struggling maker of mobile devices, Google has put a huge stake in the ground in this highly competitive market and thereby shaken up the entire ecosystem. </p>
<p>A lot of this is about patents, as <a href="http://googleblog.blogspot.com/2011/08/supercharging-android-google-to-acquire.html">Google CEO Larry Page said in his blog post</a> about the megadeal this morning, and about acquiring a bigger portfolio that Google has long sought for its Android mobile operating system and has been unsuccessful at getting for itself, despite onerous efforts. Since Motorola has been in the mobile arena for so long, it has a large trove of important ones. </p>
<p>But the dramatic acquisition by Google is also a declaration that mobile is more important to it than the skein of alliances it has built for Android with phone makers worldwide, as part of its objective of making it the dominant mobile platform for smartphones and tablets globally.</p>
<p>While Google has been reaching out to other hardware partners to assure them, and has said they all will remain the same in Android-land, the large mobile manufacturers who have placed their trust in Google &#8212; especially Samsung or HTC &#8212; have to be wondering what to do now.</p>
<p>Make no mistake &#8212; they already resent Google from time to time, the way Compaq or Dell has resented Microsoft in the PC business.</p>
<p>But, since Google already showed favoritism to Motorola by letting them do the first Honeycomb tablet, the Xoom (although it didn&#8217;t do any good), that discomfort will only increase now.</p>
<p>While Google managed to get them into lockstep on today&#8217;s announcement, with a whole <a href="http://www.google.com/press/motorola/quotes/">Web page titled &#8220;Quotes From Android Partners,&#8221;</a> each of them <a href="http://allthingsd.com/20110815/defense-spending-google-arms-itself-with-moto-patents/">using the exact same phrase &#8220;defending Android&#8221; in their quotes</a> feels a little like they are victims of Stockholm syndrome. </p>
<p>Yes, we concur with <em>everything</em> the Borg tells us to! Defending! Android! We&#8217;re Droids too! (Calling Patty Hearst, stat!)</p>
<p>The impact on everyone &#8212; from Microsoft and its partner Nokia to Apple to Research In Motion and, also, to all the wireless carriers &#8212; will be felt immediately.</p>
<p>And, of course, by government regulators, who have watched warily as Google has marched into business after adjacent business to its core search one.</p>
<p>This deal &#8212; which will require approval &#8212; is sure to even further put all of Google&#8217;s businesses in the crosshairs of rivals, who will agitate for fervent investigations.</p>
<p>While Android has been conceived at Google and has an &#8220;autonomous unit&#8221; with the company &#8212; run by longtime mobile vet Andy Rubin &#8212; it has now entered a new and perhaps dangerous phase for all involved, including Google.</p>
<p>Because while such a union is not uncommon in the mobile business &#8212; Apple and RIM do software and hardware together and Google has released its own Nexus phone (made by others) &#8212; no one has done it via acquisition and in such a definitive way.</p>
<p>And what an acquisition it is. Or, perhaps more accurately, <em>could</em> be.</p>

<p>Kno&#8211;the much-funded and high-profile Silicon Valley start-up aimed at making tablet computers focused at students&#8211;is considering selling off the entire hardware part of the business and is in talks with two major consumer electronics manufacturers to do so, according to sources close to the situation.</p>
<p>Sources said Kno execs have recently decided that the quicker-than-expected uptake in tablet production by a multitude of powerful device makers had made its efforts to package a seamless offering less critical.</p>
<p>Instead, the company will focus on its robust software and services to offer students on the Apple iPad, as well as upcoming tablets based on Google&#8217;s Android mobile operating system and others.</p>
<p>BoomTown could not determine which two companies Kno was in serious discussions with about unloading its hardware business, but the company has signed an NDA with one of them.</p>
<p>But, if a deal is struck, the move would be a dramatic shift for the company, which has yet to ship significant numbers of the student-focused touchscreen device as it has long touted.</p>
<p>In fact, Kno <a href="http://kara.allthingsd.com/20101108/kno-prices-its-student-tablets-at-599-and-899-to-ship-by-end-of-the-year">said in November</a> that it would ship a $599 and $899 version of the tablet by the end of the year.</p>
<p>The lower price was for its single-screen device, while the clamshell double-screen version was more expensive.</p>
<p>And, although it has been reported no pre-orders were fulfilled, Kno did indeed ship several hundred of them, built by China&#8217;s Foxconn, before stopping doing so recently.</p>
<p>Many have been dubious about Kno&#8217;s ambitious hardware efforts.</p>
<p>That&#8217;s because marketing a new and complex product like the Kno takes a lot of effort and cash, especially since it is an increasingly competitive market for mobile and portable computing products that includes Apple, Microsoft, Hewlett-Packard, Google, Amazon, Dell and many others.</p>
<p>Kno recently <a href="http://kara.allthingsd.com/20100908/heres-what-vcs-get-for-46-million-the-kno-tablet-d8-demo/">raised another $46 million in funding</a> to add to a $10 million round, and sources said that the Santa Clara, Calif., company was considering going <a href="http://kara.allthingsd.com/20101027/kno-hires-fancy-cfo-as-it-preps-tablet-launch-and-possible-new-funding-search">back out to raise even more</a>.</p>
<p>Its current backers include prominent venture players like Andreessen Horowitz and First Round Capital, along with investors Mike Maples and Ron Conway.</p>
<p>A Kno spokeswoman declined comment.</p>
<p>But sources said the shift to deliver textbook and other student-related delivery system would be a better path for all that investment money, since Kno has established a wide range of partnerships with colleges and universities.</p>
<p>In addition, Kno Co-founder <a href="http://voices.allthingsd.com/20100923/the-time-is-now-for-digital-textbooks">Osman Rashid has a lot of experience in digital education market</a>. He was also the co-founder of Chegg, the textbook rental business that is <a href="http://kara.allthingsd.com/20110201/holding-out-for-a-hero-the-next-web-ipos-might-surprise-you/">reportedly aiming for an IPO</a> soon.</p>

<p>The Sonos Controller for Android will officially introduce the app at the Mobile World Congress in Barcelona next week, although the Santa Barbara, Calif., company is announcing it today.</p>
<p>&#8220;It&#8217;s a no-brainer,&#8221; said Sonos CEO John MacFarlane in an interview with BoomTown yesterday. &#8220;It basically doubles our market space.&#8221;</p>
<p>The free app allows you to control Sonos&#8217;s various players wirelessly with a smartphone or tablet.</p>
<p>The impact of the iPhone and the iPad on sales of its various devices has been clear enough, said MacFarlane, as registrations of the app have escalated.</p>
<p>&#8220;There is more usage of the smartphone, but tablets are clearly happening, said MacFarlane. &#8220;But I have the same view of both that these devices are the Holy Grail everyone has always wanted.&#8221;</p>
<p>The move to Android will take longer to beta test, he said, since its ecosystem has a plethora of unit types from a variety of handset makers.</p>
<p>The app will be out in March.</p>

Cupertino shipped 11.5 million Macs and iPads in the fourth quarter of 2010, vaulting it into third place in global shipments, ahead of Dell and Lenovo and behind Acer and HP. While the industry&#8217;s PC sales grew 19.2 percent from the same period in 2009, Apple&#8217;s PC sales grew a jaw-dropping 241 percent. The catalyst for that growth: The iPad.</p>
<p><a href="http://digitaldaily.allthingsd.com/files/2011/01/canalys_tablets.png"><img src="http://digitaldaily.allthingsd.com/files/2011/01/canalys_tablets-380x222.png" alt="" title="canalys_tablets" width="380" height="222" class="aligncenter size-Medium380 wp-image-56472" /></a></p>
<p>&#8220;Each new product category typically causes a significant shift in market shares,&#8221; said Canalys senior analyst Daryl Chiam. &#8220;Apple is benefiting from pads, just as Acer, Samsung and Asus previously did with netbooks. The PC industry has always evolved this way, starting when Toshiba and Compaq rode high on the original notebook wave.&#8221;</p>
<p>And to those who contend that the iPad and similar devices shouldn&#8217;t be tallied in the same category as laptops and desktops?<br />
&#8220;Any argument that a pad is not a PC is simply out of sync,&#8221; said Chiam.</p>

			<content:encoded><![CDATA[<p>Looks like I&#8217;m far from the only one <a href="http://networkeffect.allthingsd.com/20101222/help-im-addicted-to-cityville/">addicted to CityVille</a>. The newest Zynga game has accomplished what no game maker, not even Zynga itself, has done in recent memory: Beat FarmVille&#8217;s number of active users.</p>
<p><img class="alignright size-medium wp-image-1636" title="Screen shot 2010-12-24 at 1.01.42 AM" src="http://networkeffect.allthingsd.com/files/2010/12/Screen-shot-2010-12-24-at-1.01.42-AM-275x98.png" alt="" width="275" height="98" />CityVille now has 61 million active users, compared to 56 million for FarmVille, <a href="http://appdata.com/">according to AppData</a>. Having only launched <a href="http://emoney.allthingsd.com/20101206/cityville-gets-290000-residents-in-first-day/?mod=ATD_search">at the beginning of this month</a>, it&#8217;s gotten huge faster than any game in history.</p>
<p>CityVille <a href="http://appdata.com/apps/facebook/291549705119-cityville">added 6.9 million users</a> on Thursday alone. I had previously noted the game gained 10 million users between Sunday night (when I first drafted a story about my addiction to it) and Wednesday morning (when we <a href="http://networkeffect.allthingsd.com/20101222/help-im-addicted-to-cityville/">published that story</a>). Those numbers are unheard of.</p>
<p>(By the way, I&#8217;m now at level 29, up from 26 at the time of writing, though I&#8217;ve had a busy week.)</p>
<p><img class="alignleft size-medium wp-image-1634" title="CityVille growth" src="http://networkeffect.allthingsd.com/files/2010/12/Screen-shot-2010-12-24-at-12.57.31-AM-275x155.png" alt="" width="275" height="155" />Of course, these social games all experience dropoff, and it&#8217;s unclear where CityVille&#8217;s numbers will eventually settle. FarmVille&#8217;s all-time high number of monthly active users was <a href="http://appdata.com/apps/facebook/102452128776-farmville">more than 83 million</a>.</p>
<p>Zynga hasn&#8217;t hit it out of the park every time with its previous FarmVille follow-ups. The company&#8217;s most recent launch, FrontierVille, which like CityVille was notable for its <a href="http://networkeffect.allthingsd.com/20101117/zynga-chooses-facebook-yet-again-for-exclusive-launch-of-next-game-cityville/">amped-up social features</a> and was considered quite successful, is currently at 30 million monthly active users.</p>

Palm&#8217;s new operating system, webOS, had been <a href="http://mediamemo.allthingsd.com/20090108/live-from-ces-palm-unveils-nova/">well received at the Consumer Electronics Show earlier in the year</a> and the company&#8217;s share price had ascended from $3 to $10 on its promise.</p>

<p><strong>2:57 pm</strong>:<br />
The session kicks off with video of a previous interview with Rubinstein <a href="http://digitaldaily.allthingsd.com/20100108/rubinstein/">in which he&#8211;the &#8220;father of the iPod&#8221;&#8211;claimed never to have used an iPhone</a>. </p>
<p>So, have you touched an iPhone yet? Kara asks.</p>
<p>Rubinstein laughs. &#8220;Oh, we&#8217;re going to go through this again? Have I used one as my own device? No. Have I touched one? Yes.&#8221;</p>

<p><strong>2:58 pm</strong>: Rubinstein continues: For me personally, we have lots of people who use iPhones and we have competitive analysis groups who review competing products, but I don&#8217;t want to be tainted by another experience. I want to come at this with a fresh perspective and I think what we&#8217;re seeing now in this industry is that everyone is copying the iPhone.</p>
<p><strong>3:00 pm</strong>: Sorry, we&#8217;re having some connectivity issues here&#8230;.</p>
<p>Moving on now to Palm and its ultimate acquisition by HP.</p>
<p>I think we did have many of the elements to be successful. We had a great team, a great product, a great product pipeline&#8230;.But I think the market moved too fast and when we looked forward we saw a very clear way to where we could get the company to profitability, but we didn&#8217;t see a way to get it to scale&#8230;.We could have been a small, successful company, but I don’t think that’s long-term sustainable in this business.&#8221;</p>
<p>So it was an issue of scale and not the &#8220;<a href="http://digitaldaily.allthingsd.com/20100406/palm-dumps-ad-agency/">creepy lady marketing</a>?&#8221; Kara asks.</p>
<p>Rubinstein says no, though he concedes the Palm Pre could have been marketed better.</p>
<p><strong>3:04 pm</strong>: Ultimately, says, Rubinstein, we just ran out of runway&#8230;. We looked at a variety of different alternatives, and at the end of the day we decided that the best thing to do was to hook up with a partner that could get webOS to scale&#8230;.The most expeditious outcome was to partner with HP.</p>

<p><strong>3:05 pm</strong>:  What other companies were interested in acquiring you? Kara asks. Rubinstein won&#8217;t say. What he will say is that the one that made the most sense was HP. &#8220;They didn&#8217;t have a great mobile strategy, but they had the means to get webOS to scale&#8230;.A company like HP needs to be in control of its own strategy&#8230;.This is not ‘game over.&#8221;</p>
<p><strong>3:07 pm</strong>: How badly did HP need Palm? &#8220;Look,&#8221; says Rubinstein, &#8220;HP is the largest computer company in the world&#8230;it needs a mobile strategy.  And it needs a mobile OS of its own&#8230;.They needed to be in this space, and now they&#8217;re very jazzed about webOS.</p>
<p><strong>3:08 pm</strong>: How about the Mark Hurd scandal? Was it much of a distraction for Palm? Rubinstein says it wasn&#8217;t. Palm was relatively new to the company when it occurred and was thus unaffected. &#8220;There was some turmoil for a few days,&#8221; he says. &#8220;That&#8217;s about it.&#8221;</p>
<p><strong>3:10 pm</strong>: Moving on now to Palm&#8217;s role within HP. &#8220;What we chose to do as part of the acquistion was to integrate part of Palm into HP and keep part of it separate&#8230;.The engineering team is essentially separate&#8230;things like HR and finance are handled by HP&#8230;.From my perspective, what we were planning on doing and what HP wanted to do were very well aligned.&#8221;</p>
<p>Post acquisition, says Rubinstein, as soon as we aligned our road maps, we were off and running. He notes that internal relationships with divisions like HP Labs have been quite helpful. </p>
<p>Will the Palm name continue? asks Kara.</p>
<p>[Sorry, more connectivity problems.]<br />
Rubinstein: That&#8217;s something we&#8217;re debating. What do you think we should do?</p>
<p>Kara: Get rid of it.</p>
<p>Rubinstein: Okay [jokingly]&#8230;.I don&#8217;t really have much of a connection to the Palm brand.</p>
<p><strong>3:16 pm</strong>: What&#8217;s Rubinstein&#8217;s view on the competitive environment? &#8220;Look, this is a huge market. The growth is phenomenal. If we roll back three years to when I started this Palm adventure, mobile was the place to be. And it still is today. I think we still have the chance to become a major player if we do the right things.&#8221;</p>
<p><strong>3:20 pm</strong>: What&#8217;s the more important device, the phone or the tablet? asks Kara. Rubinstein says he doesn&#8217;t think people will have just one device. &#8220;It used to be that people shared a device. These days, people have multiple devices. So the new question is how do these devices interact so there&#8217;s a seemless user experience across devices&#8230;.The ability to have a unified experience on all your devices is very important.&#8221;</p>

<p><strong>3:21 pm</strong>: The conversation moves on to carrier relationships. Rubinstein observes that AT&#038;T is doing pretty well in the Bay Area. &#8220;Just for you,&#8221; quips Kara.</p>
<p><strong>3:23 pm</strong>: And on to the Q&#038;A. First question from Engadget&#8217;s Josh Topolsky. What&#8217;s the Palm story that&#8217;s going to make people buy your phones? How do you convince a consumer to buy your stuff when you&#8217;re competing with the likes of Google and Apple?</p>
<p>Rubinstein: We really do have a unique experience compared to everyone else&#8230;.The other concept around this is the connected device strategy. We&#8217;re in this transition now where we&#8217;re integrating into HP, so we&#8217;re still ramping up.</p>
<p><strong>3:25 pm</strong>: Kara circles back, asks about differentiation and how HP can break through all the marketing noise. Where do you think the next radical change in the mobile market is going to come from? she asks.</p>
<p>I think it&#8217;s going to be incremental change, not a radical.  I think it&#8217;s all about bringing this vision of a more connected world to our users.</p>
<p>Kara asks about forthcoming webOS devices.</p>
<p>Rubinstein gives the standard answer: &#8220;Stay tuned.&#8221; But he added, &#8220;This will be a very different conversation next year.&#8221;</p>

			<content:encoded><![CDATA[<p>Owners of the Apple iPad are usually looking for a case with a certain analog aesthetic&#8211;and, as it turns out, they are willing to pay for it.</p>
<p>Thus, the San Francisco-based makers of <a href="http://www.dodocase.com/">DODOcase</a> have managed to sell tens of thousands of their pricey $55 to $65 cases. For many, the signature black faux-leather cover and elastic band give the hard-edged iPad an old-world tangibility and bespoke countenance, looking like&#8211;as it does&#8211;the famous Moleskine notebook that hipsters favor.</p>
<p>Today, the cult-popular business is releasing its second product, an Amazon Kindle-size DODOcase that wraps the plastic e-reader in its signature book-like binding.</p>
<p>Founders Patrick Buckley (the maker guy) and Craig Dalton (the business guy) have spent the last seven months tweaking the product and building the brand. But they took some time to give us a look into their Dogpatch manufacturing facility, which doubles as an actual book bindery, to see exactly what goes into the product.</p>
<p>As it turns out, the main ingredient is time.</p>

<p>The move comes as the manufacturers jockey for position in the increasingly competitive smartphone market ahead of the critical holiday shopping season.</p>
<p>Energized by the release of Apple Inc.&#8217;s (AAPL) iPhone in 2007, sales of smartphones have become increasingly popular and a driver of sales for many hardware makers. Global smartphone sales are expected to double to 506 million units within four years, industry tracker iSuppli said earlier this summer.</p>

			<content:encoded><![CDATA[<p>Last week, outside the Facebook f8 developers conference, BoomTown checked out the new 2011 Fiesta model, which will be the first vehicle in which smartphone apps can be voice-controlled via its in-car synching software.</p>
<p>While getting a test, I interviewed the Ford dude&#8211;Julius Marchwiki&#8211;who has been in all the YouTube videos of late touting its digital prowess.</p>
<p>Ford has been trying to fast-forward its automobiles in the digital space to try to differentiate itself from other car makers, using <a href="http://kara.allthingsd.com/20100420/ford-launches-voice-control-of-apps-in-car-no-more-phone-fiddling-while-driving">SYNC AppLink</a>, as well as other innovative Web-friendly features.</p>
<p>In December, Ford (F) said it would make the next generation of its <a href="http://kara.allthingsd.com/20091221/ford-to-enable-wifi-hotspots-in-some-cars-boomtown-rejoices">SYNC-enabled vehicles into Wi-Fi hotspots</a>, allowing drivers and passengers to connect to the Internet everywhere much more seamlessly in a moving car.</p>
<p>Presumably, the ultimate in mobile.</p>
<p>One speed bump: SYNC AppLink will work only with Google (GOOG) Android and Research in Motion (RIMM) BlackBerry devices for now, although Ford promises an Apple (AAPL) iPhone solution soon.</p>
<p>Pandora Internet radio, online <a href="http://kara.allthingsd.com/20100406/what-do-rush-and-npr-have-in-common-internet-talk-radio-hub-stitcher-nabs-6-million-from-benchmark">talk radio aggregator Stitcher</a> and mobile Twitter client OpenBeak are the first SYNC-enabled mobile applications.</p>

<p>Bright and early this morning at 8 am PT, BoomTown will be jacked into the matrix for an invitation-only media and analyst briefing to hear exactly what the heck Cisco (CSCO) has been yammering on about of late.</p>
<p>Last month, the networking giant said in a mysterioso email that it would be making &#8220;a significant announcement that will forever change the Internet and its impact on consumers, businesses and governments.&#8221;</p>
<p>Significant? Forever? It had better be good.</p>
<p>Like a jet pack from which you can communicate your Foursquare location (&#8220;I&#8217;m Mayor of the Clouds!&#8221;).</p>
<p>Or perhaps a chip you can implant in your head that will give you live updates of every single Apple (AAPL) iPad rumor.</p>
<p>Or a cogent explanation of how to extricate yourself from Google Buzz.</p>
<p>Or, at long last, maybe Cisco has figured out a way to fix the dropped calls crisis on the AT&#038;T (T) mobile network&#8211;a tech solution I would nominate for a Nobel Prize if it ever came to pass.</p>
<p>In all seriousness, due to the speculation around what Cisco will unveil, its stock hit a 52-week high yesterday&#8211;up 92 cents, or 3.7 percent, to $26.13&#8211;and analysts were speculating on what the company will say.</p>
<p>The consensus: A new router to improve&#8211;please, oh Lord, <em>please</em>&#8211;wireless transmission of Web video and heavy data that often slow mobile and ISP networks.</p>
<p>It&#8217;s part of a new focus on the ever-growing but ever-slowing wireless data networks.</p>
<p>Google (GOOG) said recently that it was <a href="http://digitaldaily.allthingsd.com/20100210/heads-we-call-it-brinternet-tails-sergeycom">planning to build a superspeedy broadband service</a>. In addition, the Federal Communications Commission is set to <a href="http://kara.allthingsd.com/20100223/new-fcc-report-reaching-the-digitally-distant-but-digital-hopefuls-too-well-ask-head-julius-genachowski-about-it-and-more-at-d8">unveil its own ambitious plan to improve high-speed Internet access</a> across the United States.</p>
<p>Well, it&#8217;ll be good, since the consumption of video online is growing like crazy and a constant bottleneck is likely without some relief.</p>
<p>Cisco has gotten deep into video of late, both in pushing networking gear and in acquiring video device maker like Pure Digital, the company behind my beloved Flip digital camera.</p>
<p>It is also working on innovative holographic and television-based home telepresence technologies.</p>
<p>So, is it too much to ask Cisco for a simple jet pack that works? I think not!</p>

This week, the company called for a permanent injunction against Psystar&#8217;s operations. </p>
<p>&#8220;Psystar&#8230;has built its business on infringing Apple’s copyrights and trademarks, free-riding on Apple’s research and development efforts, and trading on Apple’s hard-earned reputation for high quality, innovative and easy-to-use computers,&#8221; <a href="http://www.groklaw.net/article.php?story=20091124092210278">Apple said in its motion</a>. </p>
<p>&#8220;Psystar’s appropriation of Apple’s intellectual property and goodwill has been systematic and brazen, from the name of Psystar’s &#8216;OpenMac&#8217; computers to its deliberate pirating of Apple’s Mac OS X,&#8221; the company added. </p>
<p>&#8220;Psystar even seeks to profit from Apple’s efforts to protect its rights, extolling this litigation as Psystar’s &#8216;opportunity to gain market share,&#8217; in a pitch to venture capitalists&#8230;.Unless Psystar is permanently enjoined, it will not stop its unlawful conduct&#8211;conduct that is causing irreparable harm to Apple’s business, brand and goodwill.&#8221;</p>
<p>Catch that? Psystar was pitching VCs on its plan to use Apple’s IP to &#8220;compete directly against Apple.&#8221; Shameless. Little wonder Cupertino is so intent on burying the would-be rival.  </p>
<p>And make no mistake, Apple legal is going to grind Psystar into fine silicon dust. In addition to the injunction, Apple is requesting compensation for legal costs and statutory damages owed under the Copyright Act and the Digital Millennium Copyright Act. And <a href="http://www.groklaw.net/pdf2/Psystar-233.pdf">according to Apple’s expert witness</a>, statutory damages for the former should run &#8220;between $1500 and $300,000&#8243; and for the latter &#8220;between $449,500 and $4,495,000.&#8221;</p>
<p>Suffice it to say, that’s quite a bit more than the current value of Psystar’s assets which, according to its bankruptcy filing, are no more than $50,000.</p>

Now, Nokia (NOK) is looking with interest at the netbook market as well.</p>
<p>&#8220;&#8230;the PC and the mobile will continue to come closer and merge,&#8221; <a href="http://economictimes.indiatimes.com/Infotech/Nokia-plans-foray-into-netbook-segment/articleshow/4911799.cms">Nokia CEO Olli-Pekka Kallasvuo said at a press conference in New Dehli</a>. &#8220;A lot of opportunity can be seen in this converged area. We at Nokia is actively looking at this converged market&#8230;.We are looking at the netbook market to see what kind of opportunity is there.&#8221;</p>
<p>Likely a decent one for a cellphone maker like Nokia looking to diversify a bit from its core business. The company’s <a href="http://digitaldaily.allthingsd.com/20080624/symbianese-liberation-army/">Symbian smartphone platform</a> could likely be optimized for the task were Nokia to bring some of its $6 billion R&#038;D budget to bear on it. The OS already has a Microsoft-compatible office suite in MobiSystems OfficeSuite 4, so Nokia&#8217;s ahead of the game there. Question is: Might the company’s efforts be better directed toward developing a credible competitor to Apple&#8217;s (AAPL) iPhone?</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2009/07/9781604330465-150x150.jpg" alt="" title="" width="150" height="150" class="alignright size-thumbnail wp-image-20732" /> NetApp has <a href="http://www.businessweek.com/ap/financialnews/D998VFV00.htm">cleared all necessary U.S. regulatory hurdles</a> to proceed with its acquisition of Data Domain, though it seems unlikely that the company will prevail now that rival EMC has trumped its bid for the storage vendor.</p>
<p>This morning, <a href="http://www.emc.com/about/news/press/2009/20090706-01.htm">EMC raised its offer for Data Domain to $2.1 billion from $1.8 billion</a>, an 11 percent increase over its previous all-cash bid. Data Domain’s board had previously recommended that shareholders reject EMC’s $30-a-share cash bid in favor of a $30 cash-and-stock offer from NetApp (NTAP).</p>
<p>Hard to see the board doing so again now that the EMC (EMC) has sweetened the financial end of its proposal and removed some deal-protection provisions with which Data Domain (DDUP) had taken issue. With those gone,  EMC’s bid is clearly superior to NetApp’s, CEO Joe Tucci claims, and it would be hard to argue otherwise.</p>
<p>&#8220;Over the past several weeks we’ve received strong support from many Data Domain stockholders and customers, validating our belief that EMC is Data Domain’s best choice,&#8221; Tucci wrote in a letter to Data Domain’s leadership. &#8220;With regulatory requirements now fulfilled, and in light of the clearly superior proposal we submitted to Data Domain’s Board of Directors today, we expect Data Domain to sign our definitive agreement that will deliver superior value in cash to the Data Domain stockholders in as little as two weeks.&#8221;</p>
<p>Data Domain has until midnight on July 17 to accept the offer.</p>
<p><strong>UPDATE:</strong> NetApp responded to EMC&#8217;s announcement with the following statement:</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2009/07/9781604330465-150x150.jpg" alt="" title="" width="150" height="150" class="alignright size-thumbnail wp-image-20732" /> NetApp has <a href="http://www.businessweek.com/ap/financialnews/D998VFV00.htm">cleared all necessary U.S. regulatory hurdles</a> to proceed with its acquisition of Data Domain, though it seems unlikely that the company will prevail now that rival EMC has trumped its bid for the storage vendor. </p>
<p>This morning, <a href="http://www.emc.com/about/news/press/2009/20090706-01.htm">EMC raised its offer for Data Domain to $2.1 billion from $1.8 billion</a>, an 11 percent increase over its previous all-cash bid. Data Domain’s board had previously recommended that shareholders reject EMC’s $30-a-share cash bid in favor of a $30 cash-and-stock offer from NetApp (NTAP). </p>
<p>Hard to see the board doing so again now that the EMC (EMC) has sweetened the financial end of its proposal and removed some deal-protection provisions with which Data Domain (DDUP) had taken issue. With those gone,  EMC’s bid is clearly superior to NetApp’s, CEO Joe Tucci claims, and it would be hard to argue otherwise. </p>
<p>&#8220;Over the past several weeks we’ve received strong support from many Data Domain stockholders and customers, validating our belief that EMC is Data Domain’s best choice,&#8221; Tucci wrote in a letter to Data Domain’s leadership. &#8220;With regulatory requirements now fulfilled, and in light of the clearly superior proposal we submitted to Data Domain’s Board of Directors today, we expect Data Domain to sign our definitive agreement that will deliver superior value in cash to the Data Domain stockholders in as little as two weeks.&#8221;</p>
<p>Data Domain has until midnight on July 17 to accept the offer.</p>
<p><strong>UPDATE:</strong> NetApp responded to EMC&#8217;s announcement with the following statement:</p>

<p>On Monday the company once again said its bid for the data storage equipment maker Data Domain is <a href="http://biz.yahoo.com/prnews/090615/ne32496.html?.v=1">&#8220;superior&#8221; to a competing offer from NetApp</a>. This, despite the fact that Data Domain earlier in the day issued <a href="http://finance.yahoo.com/news/Data-Domains-Board-of-iw-15524382.html/print">a statement</a> recommending that shareholders reject EMC’s $30-a-share cash bid and instead accept a $30 cash-and-stock offer from NetApp.</p>
<p>&#8220;Our Board is committed to enhancing stockholder value and, after careful review with our outside advisors, determined that the $30 per share EMC Offer is not in the best interests of our stockholders at this time,&#8221; said Frank Slootman, president and CEO of Data Domain.</p>
<p>Why not? Well, among other things Data Domain hasn’t been able to discuss EMC’s offer because EMC hasn’t yet accepted the confidentiality and standstill agreement that would allow it to do so. For another, Data Domain must pay a $57 million termination fee if it should abandon its deal with NetApp&#8211;and that’s on top of a host of other considerable transaction expenses.</p>
<p>That’s understandable, I suppose. Still, it’s difficult to see why Data Domain insists that EMC’s all-cash offer is worth less than NetApp’s cash-and-paper bid. Unless it’s doing so to force EMC’s hand deeper into its wallet. And, indeed, that may be exactly what’s happening here. Sources say. EMC (EMC) could raise its offer to as much as $35 per share to win Data Domain (DDUP) or force NetApp (NTAP) to pay more than it can afford for it. &#8220;EMC is in the win-win box and NetApp is in the lose-lose box,&#8221; <a href="http://www.reuters.com/article/idUSTRE55B4LD20090612">a source close to the company told Reuters</a>. &#8220;EMC can pay more than NetApp can in a reasonable range. If NetApp wants to pay at an unreasonable range, that&#8217;s good for EMC.&#8221;</p>
