<p>Sidney Fitzwater, U.S. District Judge for the Northern District of Texas, declined to dismiss on summary judgment the Securities and Exchange Commission&#8217;s civil suit against Mr. Cuban. The SEC is entitled to present its case to a jury, Judge Fitzwater said in a written order Tuesday.</p>
<p>Mr. Cuban has denied wrongdoing.</p>

				<content:encoded><![CDATA[<p><a href="http://allthingsd.com/20110613/talk-about-discounting-groupon-gets-a-pre-ipo-smackdown/cuban-8/" rel="attachment wp-att-85874"><img src="http://i0.wp.com/allthingsd.com/files/2011/06/cuban.jpeg?resize=200%2C300" alt="cuban" class="alignright size-full wp-image-85874" data-recalc-dims="1" /></a>While most families light Yule logs and sit around the hearth on Christmas Eve (at least, in the Norman Rockwell vision of it), billionaire Mark Cuban took to Reddit with an &#8220;AMA&#8221; &#8212; or &#8220;<a href="http://www.reddit.com/r/IAmA/comments/15doqt/mark_cuban_this_is_my_ama/?limit=500">Ask Me Anything</a>&#8221; &#8212; thread. </p>
<p>He answered quite a few things (and as of noon PT on Monday, seems to still be going strong), but one topic in particular caught my eye: Cuban&#8217;s thoughts on Facebook. It&#8217;s pertinent, considering that just a month ago he was <a href="http://readwrite.com/2012/11/13/mark-cuban-facebooks-sponsored-posts-are-driving-away-brands">downplaying the importance of Facebook</a> as a platform for marketing the Dallas Mavericks, the basketball team Cuban owns, as well as other businesses he is involved in.</p>
<p>&#8220;Actually [drawing back from Facebook] has really helped,&#8221; Cuban wrote. &#8220;While we continue to use FB and even invested in a company, www.bad.gy, that works to optimize Facebook, we have taken the time to explore the new Myspace, work on Tumblr, Pinterest and other options.&#8221;</p>
<p>To be clear, Cuban hasn&#8217;t moved the <a href="http://blogmaverick.com/2012/11/19/what-i-really-think-about-facebook/">70-plus companies he works with off of Facebook</a>. But it&#8217;s certainly not the highest on his priority list. </p>
<p>&#8220;I believe the aggregate value of the other options will offer more opportunity for brands than FB alone,&#8221; Cuban wrote. He cites one business of his in particular &#8212; AXS.TV, an online live video site &#8212; benefiting from this new strategy.</p>
<p>My take: Looking at the growth rates alone, Pinterest and Tumblr seem to make at least some sense to focus on in terms of marketing efforts (though I can&#8217;t speak to their referral traffic numbers). I doubt you can seriously compare a foundering site like Myspace against Facebook, however, when simply looking at them in terms of scale.</p>
<p>The <em>real</em> question for Cuban: Why do an AMA on Christmas Eve?</p>

				<content:encoded><![CDATA[<p><a href="http://getlittlebird.com/">Little Bird</a> launches today a service that goes deeply and geekily into the world of online influence to find people in social media who are trusted on various topics.</p>
<p><a href="http://i1.wp.com/allthingsd.com/files/2012/10/LittleBird.jpg"><img class="alignright size-medium wp-image-257472" title="LittleBird" src="http://i0.wp.com/allthingsd.com/files/2012/10/LittleBird-380x270.jpg?resize=380%2C270" alt="" data-recalc-dims="1" /></a>The service helps marketing, media and PR companies figure out who can best spread their message.</p>
<p>Little Bird was founded by Marshall Kirkpatrick, a former writer for ReadWriteWeb who started dabbling in these sorts of social media analyses before he left tech blogging and was drawn over to the dark side to start his own company.</p>
<p>The company is backed with $1 million in funding led by Mark Cuban&#8217;s Radical Investments and including Howard Lindzon&#8217;s Social Leverage Group, Hubspot co-founder Dharmesh Shah and early Twitter engineer Blaine Cook.</p>
<p>Where Klout ranks the social media world in a sort of universal popularity contest, Little Bird is much more focused on the long tail of people who are trusted within a community around a certain topic.</p>
<p>Little Bird analyzes social graphs &#8212; basically, who follows who on Twitter &#8212; to spit out long lists of influencers, even from within small communities. Then it compiles those people&#8217;s blog content to offer archival search within the experts in a field. &#8220;It&#8217;s almost like a robot librarian,&#8221; Kirkpatrick said.</p>
<p>Kirkpatrick said the closest competitor is probably <a href="http://traackr.com/">Traackr</a>, but characterized that company&#8217;s process as more manual.</p>
<p>(By the way, the name for the Portland, Ore.-based start-up &#8212; which was formerly called Plexus Engine while in stealth mode &#8212; comes from the saying &#8220;a little bird told me,&#8221; not from the comedy show Portlandia&#8217;s excellent &#8220;<a href="http://www.youtube.com/watch?v=0XM3vWJmpfo">Put a Bird on It</a>&#8221; sketch. Though that would be fitting, too.)</p>
<p>After Twitter and blog content, Little Bird is adding LinkedIn, Google+ and academic research citations.</p>
<p>The service will have a free preview version and a corporate version starting at $250 per month. For now, it is in private beta.</p>

Tune in on Friday nights to ABC, where the reality show/start-up competition is in its fourth season. Mark Cuban makes a particularly excellent <a href="http://insidetv.ew.com/2012/09/14/shark-tank-mark-cuban/">hero/villain</a>.</p>
<p>Don&#8217;t want to watch TV on Friday nights? Don&#8217;t have a DVR? No problem.</p>

Hulu Plus. The $8-a-month subscription service offers only some of the show&#8217;s episodes from previous seasons.</p>
<p>To beat that into the ground: If you want to watch &#8220;Shark Tank&#8221; someplace other than ABC, you have several legal options. Hulu Plus, the service that&#8217;s <a href="http://allthingsd.com/20100629/as-promised-heres-hulu-plus-for-some-of-you/">supposed to give its customers more TV programming than the free version it hatched out of two years ago</a>, isn&#8217;t one of them.</p>
<p>Why not? Good question. An ABC rep says the company doesn&#8217;t have the rights to distribute the show on subscription video services. It says it&#8217;s up to Sony, which produces the show, to cut a deal with Hulu. But a Sony rep says ABC <em>does</em> have those rights. (<strong>Update</strong>: ABC now says the show is unavailable because of  a &#8220;business-related decision.&#8221;)</p>
<p>The net result is the same: Hulu Plus customers who want to watch the show on the service have to find another way, because of murky licensing issues.</p>
<p>It&#8217;s hard to get whipped up about this. As noted above, there are plenty of other ways to watch &#8220;Shark Tank.&#8221;*</p>
<p>The only people who are out of luck are the ones who wanted to watch the show on an Android phone or tablet (ABC doesn&#8217;t make an app for that OS), or for people who don&#8217;t have cable and want to watch the show on a device like a connected TV or an Apple TV.</p>
<p>I tried to watch the show via Apple TV on Saturday night. When that didn&#8217;t work, I ended up watching via Time Warner Cable. No big deal.**</p>
<p>And the good news is that these weird, <a href="http://allthingsd.com/20101013/hulus-modern-family-problem/">inexplicable-to-regular-humans licensing gaps seem to happen less often than they used to</a>, because Hulu (owned by Disney, News Corp., and Comcast***) and its programming partners have gotten better at ironing this stuff out. But they still happen. Another example: Hulu Plus customers can&#8217;t watch &#8220;<a href="http://www.hulu.com/the-simpsons">The Simpsons</a>&#8221; on their phones or TVs. Meanwhile, these <a href="http://allthingsd.com/20120815/why-you-cant-watch-the-best-show-on-hbo-on-hbo-go/">rights gaps aren&#8217;t limited to Hulu</a>.</p>
<p>The digital media utopia will be when media makers no longer care where or when we watch their stuff, because our eyeballs will be just as valuable on any platform. And we&#8217;re getting there! But it&#8217;s going to take awhile. If the media guys are lucky, we&#8217;ll be patient.</p>

		<description><![CDATA[What TV-app start-up Movl plans to do with its fresh round of funding.]]></description>
				<content:encoded><![CDATA[<p>Movl, maker of TV apps that wirelessly sync content across multiple electronic devices, has nabbed $500,000 from billionaire entrepreneur/investor Mark Cuban, to help fund its growth as it rolls out three new features. <a href="http://i1.wp.com/allthingsd.com/files/2012/02/MOVL.png"><img src="http://i0.wp.com/allthingsd.com/files/2012/02/MOVL-380x285.png?resize=380%2C285" alt="" title="MOVL" class="alignright size-medium wp-image-173209" data-recalc-dims="1" /></a></p>
<p>The tiny, Atlanta-based company launched in October 2010. Run by CEO Juan Pablo Gnecco and CTO Alan Queen, <a href="http://movl.com/">Movl</a> (pronounced (MOE-vul) develops what it calls “multiscreen, multidevice” apps that are meant to enhance the connected-TV experience. </p>
<p>In early 2011, Movl’s Pictionary-like <a href="http://www.prnewswire.com/news-releases/movl-launches-wedraw-app-for-samsung-smart-tvs-118071544.html">WeDraw app</a> won $200,000 as part of Samsung’s Smart TV apps competition. Last month, Movl announced that it had developed an app called <a href="http://www.theverge.com/2012/1/8/2691066/movl-swipeit-streams-content-ios-android-samsung-smart-tv">SwipeIt</a>, which works on Android phones and Samsung TVs (and is technically owned by Samsung), allowing users to &#8220;swipe&#8221; content from their phones and have it appear on their TV screens. </p>
<p>Now the company is working on something called Direct Connect, which adds to the existing Connect service and is designed to work with both the Wi-Fi and 3G capabilities of mobile devices. One example the company gave was tapping into a smartphone’s built-in accelerometer and using the phone as a game controller. </p>
<p>Movl is also experimenting with a multiscreen, interactive ad platform and something it has code-named Kontrol TV, which will offer shortcuts for users to find multiple TV apps from the same app &#8212; and not just channel apps, but also trends, tweets, and other social media references related to TV shows. The company is aiming for a May launch of Kontrol TV. </p>
<p>Essentially, Movl is to Samsung TVs what AirPlay is to TVs using the Apple TV box. While enabling users to “throw” content from their mobile devices to their TV screens, Movl also wants to package all the various TV-related apps on that mobile device into one “shell.”</p>
<p>The apps currently work on Samsung TVs, Google TV-equipped sets, iOS and Android devices. Movl said that it is becoming increasingly focused on developing everything in HTML5, which Gnecco and Queen say they see more smart TVs moving toward. </p>
<p>Cuban explained his interest in the company by saying he thinks smart TVs, as a platform, are getting ready to take off, as new TVs get more powerful by the day.</p>
<p>He also said he feels the <a href="http://allthingsd.com/20111025/apple-tv-bose-videowave/">introduction of an Apple TV</a> &#8212; as in an Apple-manufactured television set, not Apple TV in its current form &#8212; wouldn’t necessarily disrupt small fish like Movl, because they might have an already-established user base if or when an Apple TV comes out. Apple won’t ever have 100 percent of the TV market, and both Samsung and Vizio have a solid foothold, Cuban believes. </p>
<p>There’s also the question of whether Movl’s new applications could potentially raise the ire of cable operators, who have been introducing their own apps for mobile devices, and who might not like Movl’s idea to aggregate all TV-related apps into Movl’s Kontrol “shell,” as the company describes it. </p>
<p>But Movl says it&#8217;s not looking to usurp other apps &#8212; it mainly just wants to make it easier for a user to toggle between various TV apps during a multiscreen viewing experience. The company has been speaking with some cable providers that are interested in using Movl as a possible white-label solution, it says.</p>

<p>The voluble entrepreneur and investor, who made his fortune off Web video during the first Internet boom, is dabbling in it again: He has put money into <a href="http://revision3.com/">Revision3</a>, the Web video studio/network best known as the home of <a href="http://revision3.com/diggnation">Diggnation</a>.</p>
<p>The investment was part of a small round of funding Revision3 raised last year, which it hasn&#8217;t disclosed until now.</p>
<p>That wouldn&#8217;t be that noteworthy, except that Cuban, again and again, has argued that ever-rising expectations for Web video were overblown, and that the technology wouldn&#8217;t displace TV. Which happens to be where Cuban is betting heavily, via his <a href="http://www.hd.net/">HDNet</a> network.</p>
<p>A very brief summary of his argument:  Internet infrastructure can&#8217;t support TV-scale viewing; Web advertising can&#8217;t support TV-scale programming; people like TV.</p>
<p>And some representative blog posts where he make his case: <a href="http://blogmaverick.com/2009/01/27/the-great-internet-video-lie/">The Great Internet Video Lie</a>; <a href="http://blogmaverick.com/2009/03/20/why-do-internet-people-think-content-people-are-stupid/">Why Do Internet People Think Content People Are Stupid?</a>;  <a href="http://blogmaverick.com/2010/05/03/the-future-of-tv-is-tv/">The Future of TV Is&#8230;TV</a>.</p>
<p>And here&#8217;s a representative counter-argument: <a href="http://louderback.com/2009/cable-tv-is-screwd/">Cable TV Is Screwd</a>. It was written two years ago, by Cuban&#8217;s new partner, Revision3 CEO Jim Louderback.</p>
<p>So what gives? Is Cuban finally backing down? Not at all, the billionaire says. He&#8217;s merely investing in a potential source of content for his TV network.</p>
<p>The dollars he&#8217;s putting into Revision3 will give him what amounts to a first look on the video site&#8217;s programming, and the chance to turn some of it into TV shows.</p>
<p>&#8220;I think Jim can make some money from this. I don&#8217;t throw money away,&#8221; Cuban says via email. &#8220;But this investment really confirms my position on web video. While Revision3 will make some money on the web, the real money is [in] TV. And I wanted HDNet to have the option to be that outlet.&#8221;</p>
<p>Louderback, for his part, seems fine with a less than total endorsement of his industry&#8211;he&#8217;s the one highlighting Cuban&#8217;s investment. &#8220;I like to think that we&#8217;re doing some pretty innovative stuff, and [the investment] gives him a broader visibility into that space&#8221;, he says.</p>
<p>And since Revision3 won&#8217;t say how much money Cuban invested in the company, or the total size of the round&#8211;Louderback will only say that it was &#8220;relatively immaterial&#8221; for his company&#8211;it&#8217;s impossible to gauge what any of this really means from the outside.</p>
<p>In related can&#8217;t-really-judge-what-this-means news: Revision3 says its revenue, which it won&#8217;t disclose, grew 80 percent last year, and that the company turned a profit in Q4 of 2010. Louderback defines profitable in this instance as &#8220;EBIDTA-profitable,&#8221; and says his company should be &#8220;solidly in the black&#8221; by the middle of this year.</p>

<p>BlueCava hopes that its device identification system may eventually replace online tracking tools such as cookies. Instead, BlueCava hopes companies will track users based on their device IDs. Consumers will be able to visit BlueCava to see how they are being tracked and to choose not to be tracked.</p>
<p>“We represent a brand new way to disclose to consumers how they can receive targeted advertising,” said BlueCava Chief Executive David Norris. “Some people view us as the next generation of technology that will extend beyond what cookies can do.”</p>

<p>Mark Pincus can sure talk a blue streak. Mark Cuban can easily be classified as a chatterbox, both online and off. And Marc Andreessen certainly knows how to keep up his end of the conversation.</p>
<p>In other words, the pantheon of famous digital entrepreneurs is full of blabby Marks.</p>
<p>But Mark Zuckerberg, not so much.</p>
<p>So, when watching &#8220;The Social Network&#8221;&#8211;the movie about the rocky origins of Facebook&#8211;a person who has known the co-founder and CEO of the social networking powerhouse even longer than BoomTown has leaned over and said, &#8220;The Mark in this movie has said more in 15 minutes than I have heard the real Mark say in the first few years I knew him.&#8221;</p>
<p>And <em>how</em>.</p>
<p>If you want to know, although <a href="http://kara.allthingsd.com/20101001/the-facebook-movie-sorry-mark-but-they-like-it-they-really-like-it-plus-the-taiwanesed-version/">critics are raving over it</a>, it&#8217;s like a very talky, very geeky version of &#8220;The West Wing.&#8221;</p>
<p>The Mark Zuckerberg in the movie, as penned by master wordsmith Aaron Sorkin, is able to parry with top-notch lawyers and deliver perfectly crafted rejoinders one after the next to friend and foe alike.</p>
<p>He can conduct several conversation streams at once&#8211;so much so that a soon-to-be-ex-girlfriend remarks that talking to him was like &#8220;being on a StairMaster.&#8221;</p>
<p>I&#8217;d agree with that statement about the real Mark, except that the effort is quite the opposite of being dazzled by wild verbal gymnastics.</p>
<p>In fact, unlike a lot of Internet moguls, it has often been a struggle to get him to be fully articulate about the company, due mostly to a more taciturn, awkward and incredibly precise way of speaking.</p>
<p>When Zuckerberg famously asked <a href="http://kara.allthingsd.com/20080114/facebook-the-entire-60-minutes-segment">Leslie Stahl of &#8220;60 Minutes&#8221;</a> in a television interview&#8211;&#8221;Was that a question?&#8221;&#8211;right after she asked <em>a question</em>, I shuddered in recognition at the exchange.</p>

<p>In that way, he is a lot like the original leader of AOL (AOL), Steve Case, a person who created the first major social explosion online while also being incredibly shy and terse in real life.</p>
<p>Actor Jesse Eisenberg (pictured here) playing Zuckerberg in &#8220;The Social Network&#8221; certainly has the clipped delivery and often furrowed brow down&#8211;but the rest is a dude I certainly would love a chance to interview.</p>
<p>That said, he also plays Zuckerberg as a dour and wary person, also nothing like the real thing.</p>
<p>While I am in no way a personal friend of Zuckerberg&#8217;s, I have spent enough time with him to say that he strikes me as someone who generally tries to get along with people and makes a big effort to seem like a regular Joe, despite his fame and, well, billions of dollars worth of stock.</p>
<p>That does not mean he can&#8217;t be a bit robotic in tone or that he is not very much in charge at Facebook&#8211;indeed, one thing the movie does show is how very much the company is a creation of his single-minded devotion, restless innovation and intense forcefulness.</p>
<p>What I found perhaps most interesting about the movie was that it seems to, in fact, make the very case it is not trying to make.</p>
<p>Which is that, as the movie Zuckerberg says to the trio suing him for stealing the basic idea for Facebook: &#8220;If you guys were the inventors of Facebook, you&#8217;d have invented Facebook.&#8221;</p>
<p>Exactly. Because even if Zuckerberg did swipe the kernel of an idea about making a social network about friends from the Winklevoss twins at Harvard University&#8211;which seems obvious that he did indeed do&#8211; they were still incapable of creating what he created, even if they had gotten bigger head start.</p>

<p>Though hysterically played by actor Armie Hammer (pictured here, who does both of the Winklevii), these two seem more like rich kids with good chins, great bods and not much else.</p>
<p>So too Eduardo Saverin, Zuckerberg&#8217;s original partner in Facebook, who got left behind and then diluted out of his stake in the start-up.</p>
<p>While that move by Zuckerberg and his new investors was probably too cute by a half&#8211;and they had to pay up later for it&#8211;the movie makes clear that Saverin did almost nothing to make Facebook what it was, except write an early check.</p>
<p>In fact, in one scene, it&#8217;s clear he does not even know how to use it enough to change his relationship status. This, I believe.</p>
<p>(Also, incredibly, that Justin Timberlake&#8211;who plays the devilish Sean Parker&#8211;can actually act.)</p>
<p>Finally, there is the part about the impetus for Zuckerberg to make Facebook&#8211;which opens the movie&#8211;over a bad breakup with a girlfriend.</p>
<p>Again, it would be great for the origins of Facebook to be that interesting, but that trick is only there to provide a good ending shot of Zuckerberg hitting the refresh button.</p>
<p>And, of course, to lay out the big question of whether or not Zuckerberg is an &#8220;asshole&#8221; or not.</p>
<p>That&#8217;s from &#8220;The Social Network&#8221; and not me, which at the end twists that grand theme again.</p>

<p>Instead, it posits via a woman lawyer&#8211;the only truly positive portrayal of a woman in the entire film, by the way&#8211;to the Zuckerberg character that: &#8220;You are not an asshole, Mark. You&#8217;re just trying <em>so</em> hard to be one.”</p>
<p>I am afraid that is not really true either, at least in my experience.</p>
<p>Sure, Zuckerberg has been diffident, has treated some friends shabbily (even recently) and has even been borderline disingenuous once or twice with me.</p>
<p>But that&#8217;s not that different from a lot of people I cover in tech and that does not make him that proverbial &#8220;asshole&#8221; of the movie.</p>
<p>Oh, I sure have known a few of those in my time covering Silicon Valley, but that&#8217;s a list I&#8217;ll keep for <em>my</em> movie.</p>
<p>Kidding. Sort of. (You <em>know</em> who you are.)</p>

<p>Cuban&#8211;who is always up to some kind of amusing stunt (for example, see <a href="http://kara.allthingsd.com/20070828/mark-cuban-already-knows-how-to-tap-dance">his dance stylings on &#8220;Dancing With the Stars&#8221;</a> in 2007)&#8211;actually has already been in two episodes on the premium cable television service and it looks like he will also make the finale.</p>
<p>The story line has Cuban vying to nab a tequila company in Mexico out from under the nose of a very befuddled Turtle.</p>

And while it took nearly a year, the Cincinnati Bengals receiver finally got the league to flex its anti-social-media muscles, via a <a href="http://www.nfl.com/news/story/09000d5d819fb95a/article/ingame-tweeting-costs-bengals-ochocinco-25000">$25,000 fine</a> for two tweets sent out last Saturday.</p>
<p>Ochocinco (old-timers may remember when he went by the name Chad Johnson) sent <a href="http://twitter.com/OGOchoCinco/status/21701279772">this one</a> out about an hour before a preseason game against the Philadelphia Eagles:</p>

Which means he trumps <a href="../20090329/mark-cubans-twitter-bill-510-a-word/">Mark Cuban&#8217;s $510 per-word</a> Twitter fine he got from the NBA a year ago.</p>
<p>And <a href="http://twitter.com/OGOchoCinco/status/22025475058">Ochocinco is sorry</a>. Sort of. Because tweeting is great, but exotic luxury cars are expensive:</p>

Sometimes they show up early, panting and desperate to write checks.</p>
<p>Such is the case with 3-D, says Keith Richman, who is happy to help them out.* Richman&#8217;s Break Media, the dude-centric Web site network, is launching a 3-D Web video channel aimed at advertisers who want to connect themselves with anything 3-D right now. Oh, and people who want to watch 3-D Web video on their TVs and PCs, too.</p>
<p>How many of the latter group are there? Who knows. Can&#8217;t be <em>that</em> many, for the time being. But certain brands, like Dell&#8217;s (DELL) <a href="http://info.break.com/static/live/v1/pages/sponsors/dell-comic-con/dell-comic-con.html">Alienware</a>, which makes game-centric PCs, are happy to pay up for 3-D content, so Break is happy to make it for them. A sample:</p>

<p>Richman says 3-D video is about 300 percent more expensive to make than run-of-the-mill Web video, because the equipment is expensive and the talent pool that knows how to use it is limited. Cameras for 3-D, at least, will get cheaper within the next few months, but this stuff will be pricey for some time.</p>
<p>If 3-D joins Laserdiscs and Betamax in the great technology graveyard in the sky, then that&#8217;s wasted money for Richman and his sponsors. But if he&#8217;s right, the payoff is something like the one that HDNet&#8217;s Mark Cuban got for betting early on that technology about five years ago: A big head start on something that everyone now takes for granted.</p>
<p>*I&#8217;m paraphrasing, of course&#8211;Richman is much too politic to describe marketers as &#8220;desperate.&#8221; I&#8217;m sure he said &#8220;enthusiastic&#8221; or something like that.</p>

				<content:encoded><![CDATA[<p>Pundits keep telling us that the Web generation is happy to watch TV on a laptop. So who keeps buying all those TV sets?</p>
<p>Check out this chart from Nielsen (click to enlarge), which tells us that the average American household has nearly three televisions. In 1990, the average was two sets per home.</p>
<p><a rel="lightbox" href="http://i1.wp.com/mediamemo.allthingsd.com/files/2010/05/nielsen-tv.jpg"><img class="alignnone size-full wp-image-18997" title="nielsen tv" src="http://i1.wp.com/mediamemo.allthingsd.com/files/2010/05/nielsen-tv.jpg?resize=350%2C190" alt="" data-recalc-dims="1" /></a></p>
<p>What gives? Mark Cuban, who has been consistently bearish on Web video&#8211;except for the part where he convinced Yahoo (YHOO) to buy Broadcast.com for billions&#8211;says the answer is easy: &#8220;Consumers have made their choice to spend money on new HDTVs. Why? <a href="http://blogmaverick.com/2010/05/03/the-future-of-tv-is-tv/">Because they want to watch TV.</a>&#8221;</p>
<p>And it&#8217;s probably good to remind the early-adopter set&#8211;like people who read this site&#8211;that sating <em>all</em> your video needs with computers and &#8220;over the top&#8221; solutions is going to be a niche behavior for a long time.</p>
<p>But! There is a cake-and-eat-it answer here too: It&#8217;s perfectly reasonable to assume that most people will watch TV on their HDTVs. And then, when it makes sense, they&#8217;ll watch some video delivered over the Web on those same sets.</p>
<p>That&#8217;s already happening in real numbers. Netflix (NFLX) says nearly eight million people are watching TV and movies via its streaming video service, and not all of them are watching on small screens.</p>
<p>Nintendo, for instance, says <a href="http://www.businessinsider.com/nintendo-almost-1-million-wii-users-streaming-netflix-2010-5">one million of its customers are using the Netflix service</a>. And by definition, none of them are watching on a PC or laptop; if you&#8217;re using a Nintendo Wii, you&#8217;re using a TV.</p>
<p>These numbers will increase as more  Americans walk out of Best Buy (BBY) and Walmart (WMT) with an Internet-connected TV, whether they planned to buy one or not.</p>
<p>Over the next few years, it will become increasingly hard to buy a set that doesn&#8217;t have an ethernet connection, just as you have to go out of your way today not to buy an HD set. And that&#8217;s when things are going to get really interesting.</p>

<p>Here are two quotes that got me thinking about what would happen if Facebook&#8211;whose user base is inexorably marching toward 400 million&#8211;ever got serious about the news aggregation business.</p>
<p>First, perpetual apple-cart-upsetter Mark Cuban raised everyone&#8217;s hackles this week by taking aim at online sites that aggregate news from other sources, especially Google (GOOG).</p>
<p>Among other colorful things Cuban said during a keynote speech:</p>
<p>&#8220;Google is a vampire, and you run scared. There is no reason to be indexed in Google&#8230;.You haven&#8217;t gotten anything back except that you&#8217;ve turned into zombies&#8230;.You&#8217;ve got to realize they&#8217;re vampires and you can&#8217;t be the dumb blonde showing your neck.&#8221;</p>
<p>Then, yesterday, in a <a href="http://kara.allthingsd.com/20100203/liveblogging-the-aol-conference-call-to-everything-turn-turn-turn/">fourth-quarter earnings call</a>, AOL (AOL) CEO Tim Armstrong, answering a question about the renewal status of its search deal with Google, talked about how other outlets, especially Facebook, are now more important than ever to getting traffic for his company&#8217;s content.</p>
<p>&#8220;Our strategy on distribution is not relying on search,” said Armstrong. “Fragmentation is our friend.”</p>
<p>It was a curious way of putting it, but the message was clear and correct&#8211;it will be increasingly obvious that consumers are inevitably moving away from the only-search paradigm to that of discovery through social and other jacked-up affiliation networks.</p>

<p>Of course, this puts a site like Facebook in the catbird seat, given that vast seas of rich data flow through it all the time.</p>
<p>In fact, Facebook is already one of the bigger sources of traffic to media sites, behind just Google, Microsoft (MSFT) and Yahoo (YHOO).</p>
<p>That&#8217;s because, at any given moment, Facebook users are trading bazillions of links to articles, blogs, videos, photo images and more, pointing the way to their friends in a giant did-you-see-this mosh pit.</p>
<p>While this is dispersed widely all over the social networking service&#8211;on the Wall, on fan pages, in email, in comments&#8211;one has to wonder what would happen if Facebook ever decides to start corralling the information with some kind of aggregation method.</p>
<p>Could it pick the most linked and emailed stories of the day? Could it select the most popular photos? Could it tell you accurately what its little slice of humanity was buzzing about on a minute-by-minute basis?</p>
<p>Of course it could, but as more of a new sparkly &#8220;Twilight&#8221; vampire than the scary old-time one Cuban described.</p>
<p>Not that it will. I once queried Facebook COO Sheryl Sandberg about the idea that Facebook could make some sort of newfangled competitor to the still-powerful Yahoo News.</p>
<p>No, she replied pretty flatly, noting that the whole service was already about people sharing all kinds of news and information with their friends.</p>
<p>But, it is clear to me, that&#8211;much as Google moved into the automated new business&#8211;Facebook could do the same anytime it wants to and create what would probably be one of the top aggregation sites for any topic on the Web.</p>
<p>The Silicon Valley phenom certainly could not be as easily de-indexed as Google by worried media companies, because the skeins of information are so enmeshed that separating them is impossible. And why would you?</p>

<p>In his speech, Cuban urged traditional media creators to stop the aggregation madness.</p>
<p>&#8220;Show some balls,” he said. “If you turn your neck to a vampire, they are [going to] bite. But at some point the vampires run out of people’s blood to suck.”</p>
<p>In a deeply socially connected world though, it&#8217;s a very different story. And in that world, vampires really <em>do</em> live forever.</p>

<p>Rob Glaser (pictured here) called BoomTown when he landed in Washington, D.C., only a few hours after he announced Wednesday he was stepping down as longtime CEO of RealNetworks (RNWK).</p>
<p>Digital Daily <a href="http://digitaldaily.allthingsd.com/20100113/rob-glaser-out-as-realnetworks-ceo/">reported there was some contention between Glaser and the Real board</a> around his departure from the Seattle-based company he founded 16 years ago, a move that has actually been in the works for some time.</p>
<p>While Glaser did say that he had been through the &#8220;most intense two weeks of my life,&#8221; leading up to that, he declined to comment more about the specifics of his leaving.</p>
<p>That was fine with me, because&#8211;although execs come and go in various and sundry ways&#8211;you simply have to give Glaser credit for his pioneering work in bringing both audio and video to the Web.</p>
<p>So Glaser and I talked about this and more, from what he thinks are the key highlights of his Internet career until now to what he plans to do next.</p>
<p>First and foremost, Glaser did &#8220;give the Internet a voice,&#8221; as I wrote in a <a href="http://kara.allthingsd.com/20100114/boomtowns-1998-rob-glaser-profile-a-web-pioneer-does-a-delicate-dance-with-microsoft/">1998 profile of him for The Wall Street Journal</a> about his company&#8217;s introduction of its first RealAudio product:</p>
<p>&#8220;RealAudio was greeted with more than a little disdain from the Internet elite because it was a tinny and unsatisfying experience for most users. But it gave the Internet a voice, and Mr. Glaser kept plugging away, improving fidelity and striking deals with more content providers to use it on their Web sites.&#8221;</p>
<p>Glaser said that was the simple idea behind Real, to &#8220;turn the Web from text and static links to a dynamic media space for the mainstream to enjoy.&#8221;</p>
<p>That effort began in earnest in the mid-1990s, he noted, by selling &#8220;tech enablement,&#8221; which simply meant hawking servers and software to companies interested in adding audio and, later, video, to their Web sites.</p>
<p>So successful was Real then that many big companies tried to buy it for huge sums. But ever the aggressive entrepreneur, Glaser never sold&#8211;unlike Mark Cuban at Broadcast.com&#8211;although many wished he had.</p>
<p>But that was simply not his style, he said; plus, business was booming and it was &#8220;like selling pickaxes during the Gold Rush.&#8221;</p>
<p>It is an apt metaphor since the next major moment for the company came when the Web 1.0 bubble burst in 2000.</p>
<p>&#8220;A lot of great&#8211;and also not so great&#8211;companies just died,&#8221; he said.</p>
<p><a href="http://i1.wp.com/kara.allthingsd.com/files/2010/01/mammoth.jpg"><img src="http://i1.wp.com/kara.allthingsd.com/files/2010/01/mammoth-275x224.jpg?resize=275%2C224" alt="mammoth" title="mammoth" class="alignleft size-medium wp-image-23090" data-recalc-dims="1" /></a></p>
<p>To avoid that fate, &#8220;We pivoted in a hard way to consumer services and avoided the tailspin,&#8221; Glaser added. &#8220;It was kind of like when the woolly mammoth evolved into an elephant, while the pterodactyl did not turn into anything.&#8221;</p>
<p>That meant creating a variety of consumer-focused media offerings that used Real technology, such as its casual games business and its Rhapsody music service.</p>
<p>Real also shifted its tech licensing business to a carrier services model, Glaser said.</p>
<p>He regularly tangled with Microsoft (MSFT), where he started his career as a very brash 21-year-old. The software giant targeted Real&#8217;s business, but also cooperated with the company at times.</p>
<p>And, while the games unit and Rhapsody hit some major bumps, Real did score a whopping $761 million antitrust settlement in 2005 from Microsoft.</p>
<p>But that win was some time ago, and Real idled too much, as did its stock, in the following years, even as Glaser plugged away at creating a variety of new businesses and strategies.</p>
<p>Some were off limits, he said when I asked him why he did not come up with a service like YouTube, given Real&#8217;s advantages in video early on, noting that his public company could never had created a service that so antagonized Hollywood partners.</p>
<p>But Glaser did just that more recently with one such innovative idea for a &#8220;legal&#8221; DVD ripper, called RealDVD.</p>
<p>Though very interesting, RealDVD hit the skids quickly when a federal judge last week <a href="http://digitaldaily.allthingsd.com/20100111/judge-realdvd-antitrust-case-real-stupid/">dismissed Real&#8217;s claims against Hollywood studios</a> seeking to shut down the service before it could be widely distributed.</p>
<p>While that specific defeat was not the reason for his leaving RealNetworks, the idea that it was time to bring new blood to the company finally gained traction with investors, the board, employees and, yes, Glaser too.</p>
<p>What the notoriously hard-charging executive&#8211;&#8220;My intensity sometimes manifested itself in less positive ways,&#8221; Glaser conceded in my 1998 interview with him&#8211;will do next is anyone&#8217;s guess.</p>

<p>Glaser noted that he would remain chairman of Real, although his day-to-day engagement there is now over.</p>
<p>&#8220;It is a big transition for me, because I am closing a chapter I have been in for a very long time,&#8221; he said, adding that he would probably do more philanthropic and political work.</p>
<p>(That&#8217;s no surprise. After all, Real was once called Progressive Networks, after his liberal politics, and Glaser once had a newspaper column called &#8220;What&#8217;s Left&#8221; while at Yale University.)</p>
<p>Glaser said that on the flight to Washington he thought about the advice Lotus founder Mitch Kapor, one of Real&#8217;s earliest investors, gave him when he left Microsoft and was thinking about his next step:</p>
<p>You should take time to figure out what you want to do next and know why you want to do it. Because if it&#8217;s successful, once you get going you won&#8217;t have time to think through those issues as clearly as you can now.</p>

<p>That&#8217;s pretty much been Glaser&#8217;s modus operandi over his many years at Real and in the larger Internet space: He pushed his vision of a live Internet forth, he never cut and ran, he never sold, he kept pushing forward.</p>
<p>And you have to admire that kind of gumption, no matter the outcome.</p>
<p>In any case, it is likely Glaser will keep doing so in the years to come.</p>
<p>In fact, pointing out that the movement of entertainment and content online has &#8220;come a long way, but still has an even longer way to go,&#8221; Glaser started rattling off ideas about where the online media sector needs to go in exactly the same fashion I described a dozen years before.</p>
<p>I described Glaser then as: &#8220;speaking in staccato bursts and radiating so much intensity that his face resembles a clenched fist.&#8221;</p>
<p>In other words, for all the the lively entrepreneur has been part of as a key pioneer in the development of the Internet, some things will never ever change.</p>

He sat down with The Journal to talk about which gadgets he’s looking forward to seeing, why he thinks 2-D-to-3-D video processors are a “cheat,” and what exactly he was thinking when he compared 3-D to LSD.</p>
<p>The Wall Street Journal: What are you looking forward to seeing at CES this year?</p>
<p>Mr. Cuban: Anything 3-D-related, anything cellphone-related, but I’m particularly interested in seeing what types of products are being made for interactive television. Also, I’m curious what companies’ plans are for DTV spectrum, what happens if the FCC takes it back, what if they don’t take it back, and what kind of opportunities that would present.</p>
<p>I always like to walk through the small booths, just to see if there’s something that surprises me. Maybe they couldn’t afford a big booth, but they have something really interesting. I won’t spend a ton of time going through the big ginormous companies other than to visit friends.</p>

<p>“These revisions are punitive to the online world and unfairly distinguish between the same speech, based on the medium in which it is delivered,” he wrote in an open letter to the FTC on Thursday. The online-advertising trade group suggested the FTC try a do-over, after opening up the issue for discussion with bloggers and online advertisers…</p>

<p>Yesterday&#8211;in a somewhat rambling but also riveting blog post about charging for content&#8211;serial entrepreneur and perennial gadfly Mark Cuban made a very important point that execs at every large media company should take to heart as they try to cope with the digital challenge.</p>
<p><em>Use your noggins, why dontcha? </em></p>
<p>Cuban aimed the piece at News Corp. head Rupert Murdoch, who has been the most vocal media mogul of late about the issue of getting paid online for the copious amount of original content the various parts of the media giant he runs make.</p>
<p>(Such as this site, which is owned by Dow Jones, which is owned by News Corp.)</p>
<p>&#8220;Rupert, you didn&#8217;t ask my opinion on this, but since when has that ever stopped me,&#8221; wrote Cuban in his post titled <a href="http://blogmaverick.com/2009/08/08/my-advice-to-fox-myspace-on-selling-content-yes-you-can/">&#8220;My Advice to Fox &#038; MySpace on Selling Content&#8211;Yes You Can.&#8221;</a> &#8220;First the good news. You can sell content on the internet. People pay for content on and off the internet every second of every day. It&#8217;s easy to do. If you do it right.&#8221;</p>
<p>Then, Cuban followed up with a long series of suggestions&#8211;in general, Cuban had more interesting ideas in one post than I have collectively heard in a while.</p>
<p>Like all good brainstorms, some are defensive moves, some offensive, some very interesting and some probably unworkable.</p>
<p>But, in this time of massive change, all are well worth considering because Cuban&#8217;s piece had the feel of throwing a whole bunch of ideas on the table and just knocking anything around&#8211;with the goal of creating a more important sense of discovery and entrepreneurialism.</p>
<p>It&#8217;s kind of like that great scene in the movie, &#8220;Apollo 13,&#8221; when the engineers had to come up with a solution for a dire problem, so they threw a pile of doodads on the table and started tinkering fast.</p>
<p>I dearly hope that is precisely what&#8217;s going on inside all the various media companies as they seek to maneuver the storm-tossed seas of change they find themselves in instead of the more typical inclination to throw blame in a time of crisis.</p>
<p>The problem, as it always turns out, is that industries in trouble always tend to shoot down ideas as they arise rather than embrace even the truly insane ones&#8211;one of which might turn out to be the innovation needed.</p>
<p>As Cuban correctly pointed out, that is often due to infighting at big corporations.</p>
<p>To the negative, I saw that up close and personal a half-dozen years ago as AOL was systematically dismembered at Time Warner (TWX), due to very real wounds from the disastrous merger, at the exact moment when everyone should have been pulling for it.</p>
<p>To the positive, it is clear that the many failings of Microsoft (MSFT) in the search game were what finally got it to take a greenfields approach with its recently announced Bing, which is finally a competitive product.</p>
<p>I like that kind of gumption, and it was nice to see that in just one blog post Cuban could come up with at least 10 ideas, many of which would doubtlessly not fly.</p>
<p>In fact, after one, Cuban wrote: &#8220;I don&#8217;t know if it will work, but it is sure worth exploring!&#8221;</p>
<p>It sure is.</p>

<p>At the <strong>D7</strong> conference in May, Cuban declined to talk about the case, which revolved around allegations that he <a href="http://mediamemo.allthingsd.com/20081117/how-to-shut-mark-cuban-up-sec-insider-trading-charges/">dumped shares he owned in search engine Mamma.com</a> after learning of a secondary offering. But even his noncomment was interesting. From my transcript of his  <a href="http://d7.allthingsd.com/20090527/d7-interview-mark-cuban/?mod=ATD_search">interview with Kara Swisher and Walt Mossberg</a>:</p>
<blockquote><p>&#8220;Kara and Walt: Tell us about your fight with the SEC? Mark: No. [Pause] &#8216;When someone in the government wants you, it’s not a good place to be. You don’t want to be someone’s skin on the wall.&#8217; Kara: &#8216;Do you know how it’s going to turn out?&#8217; Mark: &#8216;Yes.&#8217;&#8221;</p></blockquote>
