After reminding the nation that “South Korean homes now have greater Internet access than we do,” he went on to call for a national wireless broadband network.

Within the next five years, we’ll make it possible for businesses to deploy the next generation of high-speed wireless coverage to 98 percent of all Americans. This isn’t just about–(applause)–this isn’t about faster Internet or fewer dropped calls. It’s about connecting every part of America to the digital age. It’s about a rural community in Iowa or Alabama where farmers and small business owners will be able to sell their products all over the world. It’s about a firefighter who can download the design of a burning building onto a handheld device; a student who can take classes with a digital textbook; or a patient who can have face-to-face video chats with her doctor.

It’s the latest attempt by Obama to try to solve the difficult problem of broadband penetration in America. In many places, most of them rural areas with low population density, cable and telco companies can’t make back the investments required to build out network infrastructure, and so they don’t build at all. As I’ve said here before, for Americans in those places, the options for participating in the digital culture the rest of us take for granted are few, and it often means the difference between participating and not in so much of the daily discourse that occurs online.

Part of the answer lies in taking back some radio spectrum that’s used for other things. In June, Obama signed a memorandum calling for the freeing up of certain radio frequency spectrum in the 500 MHz range. This is a block of spectrum largely owned by TV broadcasters for free over-the-air TV transmission. Broadcasters have been under pressure–and so far they are resisting–to voluntarily give those licenses up so that the spectrum can be re-auctioned off.

Julius Genachowski, chairman of the Federal Communications Commission, essentially telegraphed that this is going to be the commission’s major policy priority in comments at the Consumer Electronics Show in Las Vegas earlier this month. He has said he’d like to offer broadcasters incentives to give up their spectrum, but this would require a new law passed by Congress, and those in Congress have their own ideas about how this should be done. You can expect a lot of debate about this in Washington this year, but probably not a lot of progress.

Awesome! So says Tina Brown, in an “interview” her site is running with her today, to mark the Beast’s two-year anniversary: five million uniques, “ahead of projections” on advertising, etc. “A romping, vibrant, 2-year-old animal bursting with rude health.” (No mention of Howard Kurtz, though.)

In fact, it’s doing so great, Brown says, that Diller may end up pawning the thing off to Newsweek and new owner Sidney Harman.

Well, she doesn’t say that exactly. But she does acknowledge, out loud, for the first time, that the two sides are chatting:

We hear something is going on with Newsweek.

How clever of you to notice! Yes, there have been some interesting discussions going on, as we have with potential partners large and small all the time.

Here’s a more fleshed-out version of that discussion, via the NYT:

Mr. Harman and Ms. Brown met as recently as last week and are keen on working together. But whether The Daily Beast, which is financed by the billionaire investor Barry Diller, and Mr. Harman can reach a deal that is agreeable to all parties is still unknown, this person said, speaking anonymously to reveal privileged information.

Ms. Brown has gone as far as submitting a memorandum to Mr. Harman outlining how she would run Newsweek, but Mr. Harman was also interviewing other people for the job, this person added.

A few things:

• It’s astonishing, and also true, that Harman bought Newsweek from the Washington Post (WPO) without knowing who he would hire to run the operation.
• This also means that no one is really running things there now.
• Brown would be a pretty good choice, all things considered.
• And picking up the Beast wouldn’t be a terrible idea for Harman, assuming Diller can do it at the right price: Newsweek’s Web operations are okay, but not nearly as good as they look on paper. That’s because the site is largely dependent on MSNBC.com for its traffic, and that’s not a healthy affair. Say what you will about Brown’s start-up, but it hasn’t had the crutch of a big distribution partner.

Joost and Joltid filed a motion for preliminary injunction against former Joost CEO Michelangelo Volpi and Index Ventures, where Volpi now works as a partner, asking that he not use knowledge or confidential information he got at the video start-up in current dealings with Skype.

The move is yet another legal attack from the founders of Skype, who were on the losing side of the $2 billion deal to buy the Internet telephony giant from eBay (EBAY).

Opening the “Memorandum of Points and Authorities in Support of Plaintiff’s Motion for Preliminary Injunction,” which is shown below and is full of tough allegations about Volpi’s misbehavior:

“This action arises out of the acts of a faithless fiduciary, defendant Michelangelo Volpi, who, despite being the chief executive and Chairman of Joost, embarked on a systematic scheme to breach his fiduciary duties and promote his own self-aggrandizing campaign to become the next chairman of internet telephony leader Skype Inc.”

Volpi, who declined comment for now, was CEO of Joost, arriving at the much-hyped online video start-up to great fanfare in mid-2007.

But the London-based Joost never quite caught fire and began layoffs and contraction this summer.

As part of that development, Volpi then went to Index Ventures, a venture firm also based in London.

And, in one of Volpi’s first deals, Index was one of the smaller players on the winning side of the bid to buy Skype, putting up $75 million.

But also vying for the prize were the Internet telephony service’s founders, Niklas Zennström and Janus Friis, who had hooked up with a group of private equity investors.

To complicate things further, the innovative and entrepreneurial pair also own a company called Joltid, which has licensed key technology for Skype to eBay.

Joltid and eBay have been fighting in court over that agreement, bickering back and forth about whether eBay violated the terms of that deal or not.

Via Joltid, Zennström and Friis also filed suit again against Skype and its owner, eBay, for copyright violations in the U.S.

For good measure, they also added the winning buyout group, including Index, Silver Lake Partners, Andreessen Horowitz and the Canada Pension Plan Investment Board.

And both Joltid and Joost–aka Zennström and Friis–also sued Volpi personally, as well as Index again.

They allege tech skullduggery on Volpi’s part, in which he used confidential information he learned at Joost to thwart Joltid.

Wilmington, DE (Oct. 14, 2009)–Joost US, Inc., its indirect parent company Joost N.V., and Joltid Limited today filed a Motion for Preliminary Injunction against Michelangelo Volpi and Index Ventures Management in the United States District Court for the District of Delaware. In support of the Motion, the plaintiffs also filed a Memorandum of Points and Authorities containing facts and legal arguments, witness declarations and other evidence.

The Motion for Preliminary Injunction asks the Court to enjoin Index and Volpi from using any of Joost’s and Joltid’s confidential information regarding (among other things) the Global Index Software, the technology developed and owned by Joltid that provides the peer-to-peer capability embedded in the Skype program. The Motion also asks the Court to enjoin the defendants from: (i) using the confidential information in connection with the operation or strategic planning of Skype; (ii) communicating such information to other parties in the “Buyout Group” that has made a bid to acquire Skype from eBay Inc.; (iii) soliciting employees of Joost and Joltid with offers to join Skype; (iv) having communications with current or former employees of Joost or Joltid regarding the companies’ confidential information; and (v) further participating in the Skype acquisition or assuming any position with Skype until a final adjudication of the merits of the case.

The plaintiffs filed a lawsuit against the defendants on September 18, 2009, alleging breach of fiduciary duty against Volpi, aiding and abetting breach of fiduciary duty against Index, interference with prospective business advantage, misappropriation of trade secrets, breach of contract against Index, breach of confidence, and civil conspiracy. The Motion for Preliminary Injunction seeks interim relief until the lawsuit can be completed.

With the naming of Oracle (ORCL) President Charles Phillips to President Barack Obama’s 16-Member Economic Recovery Advisory Board a few days ago, another Silicon Valley tech mandarin fell off the list to become America’s first chief technology officer.

The job–which was promised by President Barack Obama during his campaign and underscored when he released a memorandum on transparency and open government that outlined some of the CTO duties the day after he was sworn in–remains unfilled.

In fact, so does the Federal Communications Commission chairman’s post, which insiders said a month ago would go to former IAC/InterActiveCorp (IACI) exec Julius Genachowski. But he has not been nominated yet.

Both Genachowski and Phillips were on a short list floated in November by The Wall Street Journal for CTO. The third name on it, Level 3 (LVLT) exec Don Gips, has since been named to a high-level White House job.

While the continuing economic crisis has sucked all the oxygen from the room, the Obama administration has still made a lot of promises about tech issues, from improving broadband to making the government more transparent and digital.

So, who is getting the job as head geek?

Could it be well-known entrepreneur Mitch Kapor? Google (GOOG) guru-in-resident and Internet father Vint Cerf? Or some other tech-savvy Silicon Valley figure?

BoomTown is, of course, rooting for Steve “Woz” Wozniak. Once he wins “Dancing With the Stars” this season, he will be the only nerd capable of the two-stepping one needs to survive in Washington.
