			<content:encoded><![CDATA[<p><img src="http://newenterprise.allthingsd.com/files/2010/12/Larry-Ellison-Samurai-1-272x300.jpg" alt="" title="Larry-Ellison-Samurai-1-272x300" width="272" height="300" class="alignright size-full wp-image-745" />A federal judge in Oakland, Calif., reaffirmed what a jury had already decided&#8211;that the German software company SAP owes Oracle $1.3 billion for the theft of Oracle&#8217;s intellectual property by SAP&#8217;s now defunct TomorrowNow unit. The order came down from Judge Phyllis J. Hamilton today.</p>
<p>SAP apparently has other plans. Having won in December a <a href="http://digitaldaily.allthingsd.com/20101229/sap-seeks-0-apr-damages-award-in-oracle-case/">small victory</a> over the amount of interest it will have to pay, today SAP said it plans to argue that it shouldn&#8217;t have to pay quite as much to Oracle.</p>
<p>In a statement, it called the judge&#8217;s order a &#8220;procedural matter,&#8221; and said it plans to make post-trial motions challenging the amount the jury awarded. If not successful, it may appeal, the company said. Its full statement is below.</p>
<blockquote><p>&#8220;Today the Court entered judgment in the Oracle v. SAP/TomorrowNow litigation, which is a procedural matter that occurs after a jury verdict. As stated before, we have accepted liability for the actions of TomorrowNow and have been willing to fairly compensate Oracle, but we believe that the amount awarded by the jury is disproportionate and wrong. Once the judgment is entered, SAP is permitted to challenge the jury&#8217;s award by way of “post-trial motions,” which are made to the trial judge. SAP will file these motions in the coming weeks asking the Court to reduce the amount of damages awarded or to order a new trial. We look forward to the Court’s resolution of the issues we will raise in our post-trial motions. Depending on the outcome of the post-trial motion process, SAP may also consider an appeal.&#8221;</p></blockquote>
<p>Oracle, on the other hand, was happy to take another victory lap. &#8220;We are very pleased that the court&#8217;s final judgment for $1.3 billion, plus the court-awarded interest and the $120 million SAP paid during trial to settle additional charges, confirms the jury&#8217;s verdict against SAP for its massive intentional copyright infringement,&#8221; Oracle said in an emailed statement.</p>

			<content:encoded><![CDATA[<p>Ask.com is in the process of reformulating itself, <a href="http://networkeffect.allthingsd.com/20101109/ask-adds-to-consensus-social-is-the-way-to-compete-with-google/">having dropped its algorithmic search offering</a> and laid off 150 employees in November. The company is billing the changes, which came after a community Q&amp;A launch in July, as a return to its &#8220;Ask Jeeves&#8221; question-answering roots.</p>
<p><img class="alignright size-medium wp-image-1681" title="Ask iPhone" src="http://networkeffect.allthingsd.com/files/2010/12/Ask-iPhone-201x300.png" alt="" width="201" height="300" />I recently had a chance to sit down with Ask.com President Doug Leeds, who was particularly high on the company&#8217;s efforts in mobile: A new iPhone app that includes the Q&amp;A feature has been downloaded 250,000 times since being released in November.</p>
<p>(It might be premature to say mobile is the future of Ask, considering it has yet to launch apps on other mobile platforms.)</p>
<p>Refocusing Ask around Q&amp;A on both the Web and mobile has already had an impact, even if it&#8217;s not fully rolled out. Leeds said 60 percent of Ask queries are in the form of a question now, up from 28 percent last year.</p>
<p>Questions are more monetizable than queries, he attested, because users stay on an Ask.com page rather than clicking to zoom off elsewhere on the Web. Ask has found that users who have their questions answered are 50 percent more likely to click on an ad.</p>
<p>Social search offers Ask.com a way to differentiate itself from the competition. Leeds said the company&#8217;s brand has long been a second-choice search engine: A huge percentage of Ask users go to Ask after Google fails to answer their query. That may not sound like something to brag about, but it&#8217;s made the company profitable, with consistent traffic as the sixth-largest U.S. site, at 90 million monthly visitors.</p>
<p>Ask <a href="http://www.thestreet.com/story/10939398/iac-cfo-we-might-sell-askcom-in-pieces.html">doesn&#8217;t seem to get a lot of love</a> within the halls of its owner, IAC, so it&#8217;s especially important for the company to grow its revenue, if not its traffic. Ask is hiring back 30 of the 150 positions it cut, for a total of 270 employees, said Leeds, who described the layoffs as a removal of satellite offices in order to consolidate operations at its Oakland, Calif., headquarters.</p>
<p>Leeds said that Ask has found social search works especially well on mobile, where, for instance, users can ask a question verbally using the free Ask.com iPhone app with speech recognition, put the phone back in their pocket and wait for a notification saying that a real person has answered the question.</p>
<p><img class="alignleft size-thumbnail wp-image-1687" title="DougLeeds" src="http://networkeffect.allthingsd.com/files/2010/12/DougLeeds-150x150.jpg" alt="" width="150" height="150" />The median answer time for questions posed to the Ask community is approaching five minutes. That&#8217;s eons in search time, but the fact that the answer is created within those five minutes matters, said Leeds.</p>
<p>According to <a href="http://www.prnewswire.com/news-releases/right-here-right-now-when-it-comes-to-questions-mobile-trumps-the-desktop-111913089.html">a Harris Interactive survey of mobile users sponsored by Ask</a>, 66 percent of respondents said timeliness matters more when they&#8217;re not in front of their computer, and 40 percent of smartphone users said they&#8217;re more influenced by users&#8217; opinions given within the last 24 hours than those from a month ago.</p>
<p>To be clear, Ask has not completely converted to social. Only 20 percent of visits are currently exposed to community Q&amp;A, and only after users say they want to ask a question or a search has failed to produce results. That&#8217;s because Ask doesn&#8217;t want to overtax its human question answerers, said Leeds. The majority of Ask user questions are answered through a machine process of extracting information from multiple Web pages (similar to the word definitions, flight status information and real-time weather you&#8217;ll get at the top of the search results page if you look for such things on Google or Bing).</p>
<p>To recruit and retain question answerers, Ask has a promotion going where it donates 10 cents per answer to Susan G. Komen for the Cure. &#8220;Altruism is the best incentive,&#8221; said Leeds. &#8220;We don&#8217;t want it to be a game; we want it to be useful.&#8221; Today, 65 percent of questions asked through community Q&amp;A get accurately routed to an answerer.</p>
<p>Next for Ask is a &#8220;nearby&#8221; feature of its iPhone app that will launch early next year. The ideal question, said Leeds, would be &#8220;Why is there a crowd over there?&#8221; Or users could ask about the current state of traffic on roads, crowding in a particular restaurant or whether they should be worried about that smoke they&#8217;re smelling in the air. Of course, for this to work well, Ask will need much deeper penetration than 250,000 iPhone users.</p>
<p>As it tries to get social, another limitation for Ask is it doesn&#8217;t have much of an existing membership system. Unlike, say, Yahoo, where users are virtually always logged in, Ask has never had a portfolio of products, just search. The company introduced a revamped log-in system in July, but it will have to get many more users to sign in before it can make use of personalization, social connections and network effects to get questions answered. (Hmm&#8230;isn&#8217;t this what Facebook Connect does?)</p>

<p>Sprint on Tuesday is officially announcing that its WiMax-based 4G service is available in San Francisco and San Jose, while AT&#038;T said it is creating a Wi-Fi &#8220;hot zone&#8221; along San Francisco&#8217;s Embarcadero that spans the city&#8217;s waterfront. Subscribers to AT&#038;T wireless or high-speed home Internet service can access the Wi-Fi areas for free.</p>
<p>AT&#038;T is also creating more hot zones in New York, bringing improved data service to at least a small part of two major cities where the carrier is <a href="http://mobilized.allthingsd.com/20101206/consumer-reports-slams-att-again/">often criticized for poor service</a>. The move offers an additional data option, but covers only a small area and won&#8217;t really help with dropped calls&#8211;a chief complaint among iPhone users in both places.</p>
<p>In New York, the company is expanding the Times Square hot zone launched earlier this year and adding additional ones near Rockefeller Center and St. Patrick&#8217;s Cathedral. It also has pilot Wi-Fi zones in Charlotte, N.C., and near Wrigley Field in Chicago. AT&#038;T says more than 350,000 wireless connections have been made in the three trial areas so far.</p>
<p>&#8220;Our initial AT&#038;T Wi-Fi hotzones have received great customer response and supported high data traffic,&#8221; AT&#038;T Chief Technology Officer John Donovan said in a statement. &#8220;The pilot demonstrated the clear benefits of having fast and readily-available Wi-Fi options for our customers and our network, and so we have decided to deploy hotzones in more locations.&#8221;</p>
<p>As for Sprint, it said WiMax service is now available in San Francisco, San Jose, Palo Alto and Oakland, joining 70 other markets across the country. </p>
<p>“The Bay Area is responsible for creating so much new technology and today we are bringing the power of 4G to our customers in that region who are hungry for fast mobile broadband,” Sprint 4G chief Matt Carter said in a statement.</p>
<p>Clearwire, which sells Wi-Max under the Clear brand and shares technology with Sprint, is also officially launching 4G service in the Bay Area on Tuesday.</p>

<p>One big surprise: The job market with the strongest growth in tech jobs&#8211;with a net gain of 900&#8211;was <a href=" http://www.techamericafoundation.org/cybercities2010-oklahoma-city">Oklahoma City</a>. Don&#8217;t pack up the U-Haul just yet. Yes, it added the most technology jobs of the 60 cities in the survey, but it also had one of the smallest overall tech job pools, accounting for only 18,000 jobs, ranking 57th of the 60.</p>
<p>The New York statistical area, which includes New York City, New Jersey and Pennsylvania, had the largest pool of tech jobs at 317,000. It lost 8,700 jobs during the survey period, which as we all know was during the worst throes of the recession and the catastrophe that struck the data-driven financial industry. Fifty-three out of 60 cities saw job losses. Nationally, the group found that the tech industry lost about a quarter million jobs in 2009.</p>
<p>Statistically, the TechAmerica report considers San Francisco, Oakland and the San Jose areas as separate. But if you added them all together, tech jobs would outnumber New York at 394,000. San Jose led the nation in tech pay, at an average of $132,100 per year, and not surprisingly had the highest concentration of tech jobs as a percentage of the workforce: One job in three is tech-related.</p>

<p>By making a rap video, of course.</p>
<p>CouchOne Inc., an Oakland, Calif-based company that makes a database built on open source software called CouchDB, produced the video partially on a whim and partially to bring attention to the start-up, which raised a $2 million Series A round last year from Redpoint Ventures and is in the process of raising a Series B.</p>
<p>The video, “I Use CouchDB,” stars CouchOne co-founder Chris Anderson and the company’s office manager, Claire McCabe, as a cool-looking pair whose stresses melt away when they replace their clunky SQL database with CouchDB. The video intersperses shots of the company’s product in use with scenes of Chris and Claire rolling through the streets of Oakland, Claire at one point riding on a car hood.</p>

			<content:encoded><![CDATA[<p>IAC&#8217;s Ask.com is giving up the ghost on algorithmic search and Web crawling. Rather than continuing to wilt while competing directly with Google, Ask said today it will devote its resources to Q&amp;A search. That will strike 130 engineering jobs in New Jersey and China, according to <a href="http://www.bloomberg.com/news/2010-11-09/iac-s-diller-surrenders-to-google-juggernaut-ends-ask-com-search-effort.html">Bloomberg</a>.</p>
<p><a href="http://networkeffect.allthingsd.com/files/2010/11/jeeves.jpg"><img class="alignright size-thumbnail wp-image-141" title="jeeves" src="http://networkeffect.allthingsd.com/files/2010/11/jeeves-150x150.jpg" alt="" width="150" height="150" /></a>Ask will now concentrate its efforts on a recently launched Q&amp;A search tool with the team at its Oakland, Calif., office.</p>
<p>Ask has long been the fourth-place player in search, despite some innovative spurts like its origin as a natural-language search engine using the fictional butler <a href="http://blog.ask.com/2006/02/thanks_jeeves.html">Jeeves</a>, and its early efforts to visually parse search results and media into snippets&#8211;now features of all major search engines.</p>
<p>IAC CEO Barry Diller, who has recently <a href="http://techcrunch.com/2010/09/29/diller-ask-com-has-no-value-inside-of-iac/">publicly disparaged</a> Ask, told Bloomberg today, &#8220;We’ve realized in the last few years you can’t compete head on with Google.&#8221;</p>
<p>Ask <a href="http://mediamemo.allthingsd.com/20100727/question-how-many-qa-services-does-the-web-need/">launched</a> a new Q&amp;A approach in July, following a recent trend but also playing back to its roots. Sixty percent of questions on the service are now answered, up from 30 percent, Ask.com president Doug Leeds <a href="http://searchengineland.com/ask-com-to-focus-on-qa-search-end-web-crawling-55209">told</a> SearchEngineLand today.</p>
<p>So, is Q&amp;A and social search the way to compete with Google? It could be. Despite buying Aardvark and launching some minimal <a href="http://googleblog.blogspot.com/2010/01/search-is-getting-more-social.html">social search</a> features, Google hasn&#8217;t done much in the area. There&#8217;s a lot of value in getting your network of friends to give recommendations, as many people do on Facebook and Twitter, and building communities to add knowledge to the Web rather than just crawl it, like on the small but promising Quora. These more recent innovations follow the surprising strength, in a Googlefied world, of products like Yahoo Answers and Korea&#8217;s Naver.</p>
<p>IAC hopping out of algorithmic search and crawling doesn&#8217;t change much in the market, but it does reaffirm Microsoft&#8217;s Bing as the other major player investing in search after Google. Elsewhere, I don&#8217;t even want to try to parse the <a href="http://allthingsd.com/topics/microhoo/">Yahoo-Microsoft partnership</a>. Facebook processes a ton of search queries already, despite a very basic offering, and also is working with Microsoft on search. And Twitter has seen serious growth in search&#8211;it says it gets a <a href="http://engineering.twitter.com/2010/10/twitters-new-search-architecture.html">billion queries</a> a day&#8211;but the company seems to count just about every time someone pings its service as a search.</p>

<p>Called as a witness for Oracle, Catz reiterated an earlier point made by Oracle CEO Larry Ellison, saying that had SAP licensed the materials that its TomorrowNow subsidiary ultimately pilfered, it would have cost “billions.&#8221; She also reminded SAP&#8217;s legal team that her email on SAP/TomorrowNow as a competitive threat was written without knowing about TomorrowNow&#8217;s copyright infringement.</p>
<p>Worse, <a href="http://www.zdnet.com/blog/btl/oracle-vs-sap-catz-offers-real-world-insight-that-ellison-doesnt-have/41390">she dismissed SAP&#8217;s offer of $40 million in damages as laughable</a>. &#8220;SAP paying us damages of $40 million would be a reward for their bad behavior. &#8220;It&#8217;s like taking someone’s $2,000 watch and hocking it for $20, and then offering to give us $20. It’s crazy. It completely undervalues the entire basis for our industry.&#8221;</p>
<p>A powerful jab, and one that&#8217;s making the rounds in media reports on the trial today.</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2010/11/sherlock-holmes-ellison-208x300.jpg" alt="" title="sherlock-holmes-ellison" width="208" height="300" class="alignright size-medium wp-image-52155" />Oracle is still on the hunt for former SAP chief and current HP CEO Léo Apotheker, but it hasn&#8217;t  enlisted private investigators to track him down.</p>
<p>Sources in a position to know tell me that <a href="http://www.reuters.com/article/idUSTRE6A749Z20101108">the PIs rumored to be searching for Apotheker are actually PSs</a>&#8211;process servers, agents charged with delivering subpoenas to their intended recipient. And, <a href="http://www.law.cornell.edu/rules/frcp/Rule45.htm">as federal law dictates</a>, their search extends no farther than 100 miles from the location of the trial, because if Apotheker is outside that 100-mile radius, they can&#8217;t serve him. And Oracle can&#8217;t compel him to testify. Which means it&#8217;s not really worth the company&#8217;s time or effort to hire Dog the Bounty Hunter to track him down in some Schwarzwald hideout. </p>
<p>As Oracle attorney David Boies said during a press conference after Monday&#8217;s proceedings, “Because of his role, we think it’s important for the jury to be able to see him live. But evidently, the embarrassment of avoiding trial is less than the embarrassment of testifying.  We are trying to serve him. Still.&#8221;</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2010/11/Larry-Ellison-Samurai-1-272x300.jpg" alt="" title="Larry-Ellison-Samurai-#1" width="272" height="300" class="aligncenter size-medium wp-image-51821" />If Oracle CEO Larry Ellison&#8217;s testimony today in the SAP trial lacked his usual flair for enthusiastic bloodletting, it was only because he put aside his standard samurai tactics in favor of a more subtle ninja approach. </p>
<p>On the stand in an Oakland, Calif., courtroom today, Ellison was such a picture of moderation and restraint that you almost wondered if his handlers had shot him up before his appearance&#8211;like sedating a dog for air travel.  As one SAP rep told me, Ellison &#8220;was anti-climatic given his vituperative statements of the last weeks.&#8221; </p>
<p>Which is true. But his testimony was still quite damning&#8211;to my ears anyway. For one thing, he said that Oracle could have charged SAP $4 billion to license the programs that its TomorrowNow subsidiary wrongfully downloaded. For another, he said Oracle would have had trouble paying its employees if it allowed its rivals unfettered access to the software and support libraries at issue in this case.</p>
<p>“I’m not sure we would go out of business but pretty close to going out of business,” Ellison said during questioning by attorney David Boies. “If they could get that software for nothing, we&#8217;d have a hard time paying 100,000 employees.&#8221;</p>
<p>If that was the case, then why didn&#8217;t Oracle make a bigger stink over SAP&#8217;s acquisition of TomorrowNow when it was first announced? SAP&#8217;s legal team was quick to pick up on this and hammered Ellison, claiming there&#8217;s &#8220;not a shred of documented evidence&#8221; demonstrating Oracle&#8217;s concerns. But they didn&#8217;t get much of anywhere with that because it turned out there is some. </p>
<p>&#8220;When SAP announced the TomorrowNow acquisition,&#8221; Ellison said, &#8220;I made a public statement&#8230;.I thought they might cheat around the edges in terms of our copyrights&#8230;and I publicly warned them that while they have every right to support our software, they have to respect our intellectual property&#8211;[they] can&#8217;t just redistribute it without paying for it.&#8221;</p>
<p>And, indeed, Ellison did do this during the company&#8217;s 2005 analyst day.  &#8220;SAP has every right to provide support for PeopleSoft applications as long as they don&#8217;t violate our intellectual and contractual property rights,&#8221; <a href="http://www.eweek.com/c/a/Enterprise-Applications/Oracle-Warns-SAP-to-Step-Lightly/">he said</a>. &#8220;It might make it awkward for them. That&#8217;s our intellectual property, and they should be cautious.&#8221;</p>
<p>Driving those remarks was Ellison&#8217;s fear at the time that with TomorrowNow, SAP might do Oracle real harm. &#8220;I thought this was a major program with a huge potential to do severe damage to Oracle,&#8221; Ellison said today, adding that his vision of how SAP planned to go about it wasn&#8217;t quite how things played out. &#8220;It was a brilliant idea to take our customers, but to execute it properly they had to go out and hire hundreds, if not thousands, of engineers to maintain PeopleSoft and JD Edwards and Siebel. That was going to be expensive. I certainly didn&#8217;t think they would simply take our intellectual property and then resell it to their own customers. I never thought that could happen.&#8221;</p>
<p>SAP&#8217;s attorney, Tharan Lanier, challenged Ellison on these points as well, suggesting Oracle is exaggerating when it claims that TomorrowNow&#8217;s infringement jeopardized as much as 20 to 30 percent of Oracle&#8217;s customers from its acquisition of PeopleSoft and 10 percent of those from the later acquisition of Siebel Systems. And in the end, Ellison conceded that only about 350 customers were lost as a result of TomorrowNow&#8217;s infringement. But he also managed to again suggest that potential losses were far, far greater.</p>
<p>&#8220;I think taking our intellectual property is a two-edged sword,&#8221; he said. &#8220;For [SAP] it means they have access to all our engineering output. They have regulatory updates at the same moment we have them. They have new versions of our software at the same time we have them.  They have bug fixes at the same time we have them. So they should be able to provide the same quality of support that we&#8217;re providing except that they&#8217;re doing it at a very low cost, while Oracle bears the cost of all that engineering.&#8221;</p>
<p>The other side of that sword is running an irrational risk by taking our software. That&#8217;s a risk I certainly would never, ever undertake.&#8221;</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2010/10/Plaaeeay.jpg" alt="" title="Plaaeeay" width="222" height="221" class="alignright size-full wp-image-51443" />Oracle&#8217;s long-running legal battle with SAP and its now-shuttered TomorrowNow subsidiary goes to trial in an Oakland, Calif., courtroom next week. And as uncomfortable an event as it will be for SAP, which has already <a href="http://www.tnlawsuit.com/uploads/file/SAP%20Statement%20on%20Aug%205%20PreTrial%20Filings.pdf">publicly acknowledged liability in the case</a>, it promises to be even more so for former SAP chief L&eacute;o Apotheker, who was recently <a href="http://digitaldaily.allthingsd.com/20100930/hp-names-new-ceo-leo-apotheker/">tapped to replace Mark Hurd as Hewlett-Packard’s CEO</a>.</p>
<p>Apotheker&#8217;s first day as CEO of HP, Nov. 1, is also the first day of the trial. And he&#8217;s on Oracle&#8217;s witness list. </p>
<p>But if he&#8217;s called, will he show up?</p>
<p>Oracle&#8217;s not sure he will, but it wants everyone to know that it has big plans for him in the courtroom, whether he does or not.</p>
<p>In a statement Tuesday night, Oracle CEO Larry Ellison essentially dared Apotheker to appear on the witness stand, suggesting that HP&#8217;s newly appointed Chairman, Raymond Lane&#8211;a former Oracle  president&#8211;might try to keep him from testifying.</p>
<p>&#8220;A few weeks ago I accused HP&#8217;s new CEO, Leo Apotheker, of overseeing an industrial espionage scheme centering on the repeated theft of massive amounts of Oracle&#8217;s software. A major portion of this theft occurred while Mr. Apotheker was CEO of SAP,&#8221; Ellison said in a statement. </p>
<p>&#8220;HP&#8217;s Chairman, Ray Lane, immediately came to Mr. Apotheker&#8217;s defense by writing a letter stating, &#8216;Oracle has been litigating this case for years and has never offered any evidence that Mr. Apotheker was involved.&#8217; Well, that&#8217;s what we are planning to do during the trial that starts next Monday. Unless, Mr. Lane and the rest of the HP Board of Directors decide to keep their new CEO far, far away from HP Headquarters until that trial is over. If HP keeps Leo Apotheker far from HP headquarters we cannot subpoena him to testify at that trial.&#8221;</p>
<p>Which is true&#8211;as a foreign national, Apotheker is under no legal obligation to appear at the trial if called to testify (his name has been on Oracle&#8217;s witness list since August 5, 2010&#8211;see image below). But given the recent war of words between Oracle and HP over his hiring, it would be odd for him not to, particularly if, as HP claims, he wasn&#8217;t involved in the IP theft at the center of Oracle&#8217;s suit.</p>
<p><a href="http://digitaldaily.allthingsd.com/files/2010/10/Leo_ORCL.jpg"><img src="http://digitaldaily.allthingsd.com/files/2010/10/Leo_ORCL-275x146.jpg" alt="" title="Leo_ORCL" width="275" height="146" class="aligncenter size-medium wp-image-51455" /></a></p>
<p>That said, it seems HP is already setting the stage for Apotheker to be a no-show.</p>
<p>“Oracle had ample opportunity to question Leo during his sworn deposition in October 2008,” the company said in a statement. “Given Leo’s limited knowledge of and role in the matter, Oracle’s last-minute effort to require him to appear live at trial is no more than an effort to harass him and interfere with his duties and responsibilities as HP’s CEO.”</p>

<p>The former musician has ridden all the various bumps the Internet radio station has endured since its founding in 2000&#8211;from a $9 million funding in 2004 that saved Pandora to continued struggles to stay afloat after record labels came after it over royalties.</p>
<p>Now, with a stable and growing revenue stream&#8211;based on a traditional advertising business model&#8211;turbocharged by a popular mobile app for the Apple (AAPL) iPhone and about 65 million users, Westergren talks about what&#8217;s next for the Oakland, Calif.-based company:</p>

<p>Lonely Planet, best known as a traditional travel guidebook publisher, is announcing a new U.S. head tomorrow, as it increasingly moves to reposition the company as much more of a &#8220;cross-media&#8221; platform.</p>
<p>John Boris&#8211;set to take over today as new managing director of Lonely Planet Americas, based at its Oakland, Calif., office&#8211;comes to the company from Zagat Survey, where he was the SVP of marketing and interactive.</p>
<p>Previous to that, Boris worked at 1-800 Flowers and Fresh Direct.</p>
<p>“I’m thrilled to be joining one of the world’s best-loved travel brands at such an exciting time, with Lonely Planet rapidly evolving as a cross-media travel player,&#8221; he said in a press release.</p>
<p>As the paid versus free content online debate gets louder over the next year, how well known brands like Lonely Planet&#8211;which has a strong reputation among consumers&#8211;handle the fallout will be more and more interesting to watch.</p>
<p>Indeed, in recent months, Lonely Planet has been escalating its digital content efforts, which was the initial promise when BBC Worldwide bought 75 percent of the Melbourne, Australia-based company for about $200 million in late 2007.</p>
<p>But the digitization of Lonely Planet&#8217;s business, as with many traditional media publishers like it, has been slow going, with 75 percent of its revenue still in print.</p>
<p>While that business remains profitable, the breakdown between print and digital will be changing sooner than later, since digital is where much of the growth is coming from, said CEO Matt Goldberg to me over a recent dinner in San Francisco.</p>
<p>Goldberg&#8211;who came to Lonely Planet early this year from Dow Jones, where he was SVP of digital strategy and operations, including for WSJ.com&#8211;noted that Lonely Planet&#8217;s digital businesses have doubled their revenues to $20 million this year via premium pricing and advertising.</p>
<p>Besides the obvious use of Twitter and Facebook, Goldberg flagged a number of the more promising and innovative digital initiatives now at work at Lonely Planet, especially in its key U.S. market.</p>
<p>They include:</p>
<p>* Leveraging the 700,000 registered members of Lonely Planet&#8217;s Thorn Tree community,</p>
<p>* The announcement this week of putting all or part of 600 of its travel guides on the international release of the Amazon (AMZN) Kindle e-reader.</p>
<p>* Work on collaborative trip planning for its &#8220;Trippy&#8221; gadget, as part of the Google Wave beta launched last week.</p>
<p>* A compass application for Google (GOOG) Android handsets that make use of augmented reality technology to highlight points of interest in cities. As Goldberg described it in an email, travelers will be able to &#8220;pan a city destination using the video on their handset and see Lonely Planet recommendations (points of interest from our City Guides) as virtual sticky notes above real live points of interest.&#8221;</p>
<p>* Over 500,000 downloads from around 70 premium-priced apps on the iPhone from Apple (AAPL), as well as various location-based guide apps for Nokia (NOK) and BlackBerry from Research in Motion (RIMM).</p>
<p>* Travel music collections featured on Spotify and other online music services.</p>
<p>Goldberg highlighted other interesting ideas, such as an online travel video contest and even a &#8220;hack&#8221; day in Australia recently, which will be followed by one in the U.S. in the late winter.</p>
<p>While not all of it is going to work, this kind of endless experimentation at Lonely Planet is probably the right way to keep figuring out how to deal with the seismic media shifts that show no sign of abating.</p>

			<content:encoded><![CDATA[<p>Apple (AAPL) employees will have to go that extra 12 miles for their employers after all.</p>
<p>U.S. District Judge Claudia Wilken recently denied a request from the Cupertino, Calif., company to transfer an unusual lawsuit it faces to a federal judge in San Jose, Calif.</p>
<p>Apple argued the move would make for a more convenient trek&#8211;about 88 miles round trip when leaving Apple HQ&#8211;for Apple employees involved in the case.</p>
<p>Lawyers for OdioWorks, which is suing Apple, characterized its legal foes’ request as an “attempt to undermine the assignment procedure” that paired the lawsuit with a judge in the Oakland courthouse. Last week, Judge Wilken set aside Apple’s request without comment, thus leaving the 100-mile round trip commute between Cupertino and her courtroom in Oakland in place.</p>
