<p>Twitter has been ordered by a U.S. federal judge to turn over documents related to several people involved with WikiLeaks to the Justice Department.</p>
<p>Tonight, a Twitter spokeswoman responded to a request for comment on the situation:</p>
<p>&#8220;We&#8217;re not going to comment on specific requests, but, to help users protect their rights, it&#8217;s our policy to notify users about law enforcement and governmental requests for their information, unless we are prevented by law from doing so. We outline this policy in our law enforcement guidelines.&#8221;</p>
<p>In an onstage <a href="http://mediamemo.allthingsd.com/20110107/live-twitter-ceo-dick-costolo-at-dces/">interview I did with Twitter CEO Dick Costolo</a> at a <strong>D@CES</strong> event last night in Las Vegas, he referenced the issue, but would not give any specifics.</p>
<p>While he said he could not talk about WikiLeaks specifically, he indicated that he disliked government mandates to keep things quiet and reiterated Twitter’s desire to connect people with useful information.</p>
<p>&#8220;We&#8217;re going to lash out at things that prevent us from doing that, as aggressively as we can,&#8221; said Costolo, who also used Twitter crackdowns in China as an example.</p>
<p>It might be a Herculean task to fight the federal government, which is aggressively going after WikiLeaks and its founder, Julian Assange.</p>
<p>Some Web companies, such as <a href="http://newenterprise.allthingsd.com/20101204/paypal-to-wikileaks-youre-cut-off">eBay&#8217;s PayPal unit</a>, have cut off WikiLeaks.</p>
<p>On the other hand, Twitter took legal action to unseal the court order, which allowed it to inform those involved, giving them 10 days to object. Otherwise, the San Francisco microblogging service would have had to turn over information without the knowledge of these users.</p>
<p>There will surely be more of these to other Web companies, with obvious candidates being Google and Facebook.</p>
<p>The order from the U.S. District Court for the Eastern District of Virginia is ordering Twitter to fork over subscriber names, user names, screen names, mailing addresses, residential addresses and more of several people involved with WikiLeaks.</p>

			<content:encoded><![CDATA[<p><img src="http://digitaldaily.allthingsd.com/files/2010/03/couldbeworsecouldberaining.jpg" alt="" title="couldbeworsecouldberaining" width="250" height="194" class="alignright size-full wp-image-36589" />Palm’s fourth quarter may turn out to be no better than its third&#8211;an ugly period marked by a grotesque <a href="http://digitaldaily.allthingsd.com/20100225/palm-agonistes/">30 percent revenue shortfall, poor sales and tepid interest in the company&#8217;s new line of smartphones</a>. </p>
<p>In his latest note on the company, Canaccord Adams analyst Peter Misek says Palm’s (PALM) already substantial troubles are mounting. Palm&#8217;s latest problem: Delays in the long-rumored launch of its smartphones on AT&#038;T (T). Originally expected this spring, sources now say the debut of new Pixi and Pre models has been pushed back until summer. </p>
<p>&#8220;Beyond generally lacklustre handset sales in the current quarter, which are already reflected in our previous estimates, we have recently learned that AT&#038;T has delayed the planned launch of the Pre and Pixi on its network from April to June/July,&#8221; Misek writes. </p>
<p>&#8220;Moreover, we believe that this is more than just an ordinary delay,&#8221; the analyst adds, &#8220;as AT&#038;T has cited a long list of technical issues with the Pre and Pixi. Furthermore, the carrier has decreased its initial order size and has decided to sharply reduce its marketing budget for the launch.&#8221;</p>
<p>So: A delayed launch on another major carrier, a smaller first order and a soft marketing budget. On top of these issues, Misek cites a mysterious &#8220;list of technical issues.&#8221; I’m not quite sure what he is hinting at; my sources tell me there are no problems with the devices on AT&#038;T’s network&#8211;but perhaps Misek knows something they don’t. </p>
<p>Leaving the mystery list aside, this is bad news all around for Palm, which clearly needs the additional distribution it will get through AT&#038;T sooner rather than later. Misek is slashing his February quarter unit shipment forecast to 670,000 from 720,000 and his 2011 forecast to 3.58 million units from four million.</p>
<p>Honestly, this getting difficult to watch.  </p>
<p>Palm is scheduled to report third-quarter earnings after Thursday&#8217;s closing bell.</p>

Originally offered with a ship date of April 3, official iPad cases purchased today, for example, <a href="http://www.electronista.com/articles/10/03/16/most.ipad.accessories.miss.april.3.launch/">won’t ship until mid-April</a> (if you purchased one on March 12, you’re still likely to take delivery on April 3 according to my order status checks). </p>
<p>Keyboard docks ordered today <a href="http://www.9to5mac.com/ipad-dock-keyboard-ships-april-35644634">won’t ship until late April</a> (those ordered on April 12 are scheduled to arrive on April 19). And 10W USB power adapters, which let you charge your iPad via electrical outlet, won’t ship until May&#8211;nearly a month after the arrival of the iPad itself.</p>
<p>A case of first-come, first-served, I suppose. Still, this gives third-party accessory vendors a nice little sales window free of competition from Apple (AAPL)&#8211;assuming they’re ready to take advantage of it.</p>

			<content:encoded><![CDATA[<p><img src='http://digitaldaily.allthingsd.com/files/2008/05/spam.jpg' class='centered' style="border: 1px solid #000;" alt='spam.jpg' />The hammer has fallen once again on Stanford &#8220;Spamford&#8221; Wallace. A federal judge in Los Angeles yesterday awarded MySpace <a href="http://ap.google.com/article/ALeqM5ieedXWHP7obv4SfKWxyAIwh1m5nwD90L6QC00">a $230 million judgment against Wallace</a> who, with partner Walter Rines, broadcast some 730,000 junk messages to MySpace members in October of 2006.</p>
<p>The judgment is believed to be <a href="http://news.bbc.co.uk/2/hi/technology/7399868.stm">the largest anti-spam award to date</a>. Not that it really matters, because MySpace (NWS) is unlikely to collect it. Wallace&#8211;who was by some estimates responsible for 80% of the spam on the Net back in his heyday&#8211;has rarely paid the judgments against him. Moreover, he <a href="http://spamkings.oreilly.com/archives/2005/07/wheres_sanford_1.html">has a bad habit of disappearing</a> at the first sign of legal trouble.</p>
<p>And that appears to be exactly what he&#8217;s done here. Because the $230 million award given MySpace in this case is a default judgment meted out after Wallace failed to appear in court. &#8220;It is &#8230; a defendant&#8217;s responsibility to respond to discovery, obey court orders and avoid dilatory tactics,&#8221; <a href="http://www.news.com/8301-10784_3-9930977-7.html?part=rss&amp;subj=news&amp;tag=2547-1_3-0-20">the court wrote in its order</a>. &#8220;Taking all of the above factors into account, a default is appropriate. The court finds that Wallace&#8217;s noncompliance is due to willfulness, fault or bad faith. &#8230; Wallace has had every opportunity to avoid the sanction of default. (He) has never provided any explanation for his behavior to the court.&#8221;</p>

<p>Turns out Delaney has no idea whether or not Apple placed such an order. “We have not got confirmation that an order has been placed,” <a href="http://www.informationweek.com/news/showArticle.jhtml?articleID=207000174">Gartner’s Bob Hafner told InformationWeek</a>, adding, &#8220;If Apple was to place an order, then 10 million would be a reasonable number.&#8221;</p>
