You&#8217;re going to have to wait.</p>
<p>EMI, the record label that owns the property, has put out a release that sort of denies <a href="http://www.ft.com/cms/s/0/889e63f0-1a70-11df-a2e3-00144feab49a.html">reports</a> that it had put the building on the market. The full text is at the bottom of this post, but the upshot is that:</p>
<ul>
<li>EMI rejected a $45 million offer for the studio last fall</li>
<li>EMI would like someone to invest in the property and keep it up and running, but that</li>
<li>EMI &#8220;believe[s] that Abbey Road should remain in EMI&#8217;s ownership.&#8221;</li>
</ul>
<p>The issue here is that EMI&#8217;s plans for Abbey Road may not be relevant.</p>
<p>The label&#8217;s owner, private equity shop Terra Firma, may end up <a href="http://www.businessweek.com/news/2010-02-04/emi-posts-2-4-billion-loss-as-terra-firma-weighs-raising-cash.html">losing control of the company to lender Citigroup</a> (C). If that happens, it doesn&#8217;t really matter what EMI&#8217;s current management wants to do.</p>
<p>Here&#8217;s the full statement:</p>
<blockquote class="memo"><p>EMI welcomes the reported acceleration of English Heritage&#8217;s plans to list Abbey Road and supports such a listing as an appropriate way of protecting our world famous music heritage site. In response to recent press speculation, EMI confirms that it is holding preliminary discussions for the revitalisation of Abbey Road with interested and appropriate third parties.</p>
<p>When Terra Firma acquired EMI in 2007, it made the preservation of Abbey Road a priority. Abbey Road studios had, for a number of years, been losing money and we have developed plans to revitalise the studios. These plans would involve a substantial injection of new capital.</p>
<p>Since November 2009, EMI has held discussions with a number of parties with a view to them financing these plans and maintaining this unique venue. At all times, these plans have focussed on providing access to artists and, where possible members of the public.</p>
<p>In mid-2009, we did receive an offer to buy Abbey Road for in excess of £30 million but this was rejected since we believe that Abbey Road should remain in EMI&#8217;s ownership.?</p></blockquote>

It has a new video and would like you to watch it on Vimeo, the video-sharing site being <a href="http://paidcontent.co.uk/article/419-emi-suing-vimeo-over-lip-synching/">sued by EMI, the band&#8217;s record label</a>.</p>
<p>What gives? It&#8217;s sort of simple: The band would prefer that you watch the video via Google&#8217;s (GOOG) YouTube, but EMI won&#8217;t let Web users like me embed the <a href="http://www.youtube.com/watch?v=UJKythlXAIY">YouTube version of the clip</a>.</p>
<p>The band explains why this is so <a href="http://okgo.forumsunlimited.com/index.php?showtopic=4169">here</a>, but it&#8217;s a story <a href="http://mediamemo.allthingsd.com/20090306/why-are-big-musics-videos-trapped-on-youtube-an-insider-explains/">we&#8217;ve heard before</a>&#8211;in a nutshell, it&#8217;s harder to sell ads against embedded videos.</p>
<p>That&#8217;s supposedly going to get better with Vevo, the &#8220;Hulu for music videos&#8221; joint venture that EMI is licensing its stuff to, so perhaps this kind of thing won&#8217;t be necessary in the future.</p>
<p>(That said, the band&#8217;s account is well worth reading, as it is a clear and even-handed assessment of the music industry&#8217;s attempt to wrestle with Web-era economics. Excerpt: &#8220;We’ve got this ridiculous situation where the machinery of the old system is frantically trying to contort and reshape and rewire itself to run without actually selling music. It’s like a car trying to figure out how to run without gas, or a fish trying to learn to breath air.&#8221;)</p>
<p>Meanwhile, the Vimeo situation is a bit confusing: EMI is suing the site because it encourages users to upload &#8220;lip dubs&#8221;&#8211;what you and I would call &#8220;music videos&#8221;&#8211;that use copyrighted songs without authorization. In this case, OK Go is the entity uploading the songs/videos, so I suppose that makes the legal situation more palatable (note the big copyright notice at the end). But I&#8217;m still not sure how or why the licensing/advertising issues that put the kibosh on the YouTube video don&#8217;t come into play here.</p>

Or it is in Google’s case anyway.</p>
<p>Reporting <a href="http://investor.google.com/releases/2009Q3_google_earnings.html">third-quarter results</a> after market close Thursday, Google (GOOG) topped estimates, posting net income that rose to $1.64 billion, or $5.13 a share, from $1.29 billion, or $4.06 a share in the same period last year. Net revenue for the period ended in September rose nearly one percent to $4.38 billion. Excluding items, earnings for the quarter were $5.89 a share. Consensus estimates had been calling for $5.42 a share and $4.24 billion in net revenue. The chart below shows revenue sources within Google (click to enlarge).</p>

<p>Impressive. Seems paid clicks grew 14 percent compared to the same period last year, and four percent compared to the prior period. Cost per click was down six percent year over year, but up five percent sequentially.</p>
<p>&#8220;Google had a strong quarter&#8211;we saw seven percent year-over-year revenue growth despite the tough economic conditions,&#8221; said CEO Eric Schmidt. &#8220;While there is a lot of uncertainty about the pace of economic recovery, we believe the worst of the recession is behind us and now feel confident about investing heavily in our future.&#8221;</p>
<p>Good to hear. Google’s shares, which have already risen more than 50 percent in the past six months, are on another upward tear. They rose 1.82 percent to $539.27 on the news in after-hours trading.</p>
<p><strong>Earnings call highlights via <a href="http://blogs.wsj.com/digits/2009/10/15/live-blogging-google-earnings-3/">The Wall Street Journal&#8217;s Andrew LaVallee</a>:</strong></p>

<p>4:32: Call starts. The cast is the same as last quarter: <a href="http://www.google.com/intl/en/corporate/execs.html#eric">Mr. Schmidt</a>, CEO; <a href="http://www.google.com/intl/en/corporate/execs.html#pichette">Patrick Pichette</a>, CFO; <a href="http://www.google.com/intl/en/corporate/execs.html#jonathan">Jonathan Rosenberg</a>, SVP of product management; and for the first time, <a href="http://www.google.com/intl/en/corporate/execs.html#nikesh">Nikesh Arora</a>, president of global sales operations and business development. But there&#8217;s a twist&#8211;they&#8217;ll be using Google&#8217;s moderator to vet questions with voters. They vote on &#8220;the most relevant questions,&#8221; which go to the Google execs, the operator says.</p>
<p>4:35: &#8220;While there&#8217;s obviously a lot of uncertainty about the pace of the economic recovery, we believe the worst of the recession is behind us,&#8221; Schmidt says.</p>
<p>He adds that Google now has the confidence to invest &#8220;heavily&#8221; in its future. &#8220;It&#8217;s all good news from our perspective, at least in looking at the quarter.&#8221;</p>
<p>4:37: Says &#8220;we want to really get to the perfect search engine&#8221; and that many advertisers would like to spend more with Google if the company&#8217;s product allow them to do that.</p>
<p>4:38: Schmidt says &#8220;we&#8217;re open for business in making strategic acquisitions, both large and small.&#8221;</p>
<p>4:39: It&#8217;s Pichette&#8217;s turn. &#8220;At a high level, we&#8217;re very pleased with our Q3 results,&#8221; he says. The quarter benefited from growth in AdSense for content and display initiatives.</p>
<p>4:41: U.S. revenue up 4% to $2.8 billion. U.K. revenue decline affected by foreign exchange as well as ongoing macroeconomic weakness, Pichette says.</p>
<p>4:42: Operating expenses rose from the prior quarter, mostly due to payroll, equipment and facilities-related expenses. </p>
<p>&#8220;We believe the worst of the recession is behind us,&#8221; he says.</p>
<p>4:44: Brazil was a standout in Latin America, Arora says. We&#8217;re beginning to see signs of recovery in Europe and Africa, particularly Spain. In Asia, China performed strongly as an emerging market.</p>
<p>4:46: Looking at the display-advertising business, those have also shown strong results, he says. </p>
<p>On YouTube, new advertisers and partners are helping with monetization efforts. Ninety percent of the top 50 advertisers have run YouTube campaigns with successful results&#8211;recent examples include McDonald&#8217;s and Hewlett-Packard.</p>
<p>4:47: YouTube has signed deals with all four major record labels and several independent labels. Earlier today, Google announced a partnership with Channel 4 in the U.K., which will bring full-length programming to the video-sharing site.</p>
<p>4:48: Arora adds a personal shout-out to the sales team.</p>
<p>4:50: Rosenberg calls the new AdWords front-end one of the company&#8217;s biggest investments of the year. Advertisers have new reports, can run more efficient campaigns and can get new features faster thanks to the platform, he says.</p>

<blockquote class="memo"><p><strong>7:30 p.m.</strong>&#8211;Out of the steaming heat and into the cool, air-conditioned confines of Lincoln Center&#8217;s Stanley H. Kaplan Penthouse.</p>
<p><strong>7:39 p.m.</strong>&#8211;The lights dim and Moby and Mossberg make their entrances. Moby slinks down in his chair (&#8220;Am I greasy, or is it the chair?&#8221;) just before WSJ culture editor Christopher John Farley introduces the pair.</p>
<p><strong>7:43 p.m.</strong>&#8211;Mossberg plugs his son, who&#8217;s in a band, before asking Moby&#8211;whose real name is Richard Melville Hall&#8211;if he is really related to &#8220;Moby Dick&#8221; author Herman Melville. Moby replies that that is what his parents have always told him and explains the origins of his moniker: &#8220;When I was 11 minutes old, my parents looked at me and I was this little grub of a baby and my mother said, Richard Melville Hall is a very grown up name, and my father said jokingly, let’s call him &#8216;Moby.&#8217; All these years later, I still have this name I’ve have from infancy.&#8221;</p>
<p><strong>7:46 p.m.</strong>&#8211;Mossberg asks Moby, in between jokes about being both being bald-ish, about the difference between &#8220;Play&#8221; and his new album, &#8220;Wait for Me.&#8221; Moby begins by talking about how the success of &#8220;Play&#8221; completely surprised him, because he was considered a &#8220;has been&#8221; by the time the album was originally released in the early 1990s and that Rolling Stone refused to review the album. His success with the album also confused him, because he was unsure of his next step&#8211;was he supposed to listen to the label now? To the fans? To himself?</p>
<p>&#8220;Wait for Me,&#8221; his ninth studio album, was designed as a return to simplicity, and created with old instruments&#8211;many of which were purchased on eBay&#8211;in his bedroom in Manhattan. When Mossberg asks Moby to clarity what he means by &#8220;his bedroom,&#8221; the musicians lays out out his floorplan&#8211;he lives in a two-bedroom apartment on Mott Street and with a small space (&#8220;two people starts to feel claustrophobic&#8221;) set aside for his music work.</p>
<p><strong>7:52 p.m.</strong>&#8211;Moby uses a Mossberg question as an excuse to slam Jay Leno, whom he calls the &#8220;least prepared interviewer.&#8221; He fakes a Leno voice, and mock interviews: &#8220;So Moby, you have a new record. Tell me about it.&#8221; Mossberg interjects, &#8220;So I have a low bar?&#8221; to the delight of the crowd.</p>
<p><strong>7:53 p.m.</strong>&#8211;Mossberg asks Moby how he used technology in &#8220;Wait for Me.&#8221; Moby begins by explaining that while he loves technology, he don’t fetishize it like some of his friends. &#8220;I have an 18&#8243; flat screen TV. A bigger screen doesn&#8217;t make TV any better. &#8216;Family Guy&#8217; is still funny on a little TV. If it works and doesn&#8217;t cause me undue stress, I love it.&#8217;</p>
<p><strong>7:55 p.m.</strong>&#8211;Moby launches into an explanation of what  Pro Tools and plugins are, and how thanks to this nifty recording/mixing operating system, he can take prerecorded &#8220;notes&#8221; that have been recorded abroad, say, in places like Vienna, and then recreate a 60-piece orchestra on his keyboard.</p>
<p><strong>7:59 p.m.</strong>&#8211;On to issues of intellectual property. Moby says: &#8220;I don&#8217;t mind when people pirate my music&#8211;if you want to steal my music, more power to you.&#8221; Mossberg immediately asks, &#8220;Why?&#8221; And he deadpans, &#8220;Deep-seated emotional issues.&#8221; He then goes on to explain that personally, he&#8217;s so honored that people want to listen to his music, he doesn’t want to restrict access to it. &#8220;I don’t have alimony, I don’t need insulin…I don&#8217;t have crystal meth problems.&#8221; Thus, he personally doesn&#8217;t mind, but he can only speak for himself. But to clarify, he does want you to buy his album so his friends at the label are happy.</p>
<p><strong>8:04 p.m.</strong>&#8211;Mossberg and Moby discuss the RIAA’s decision to sue customers. Moby says that it&#8217;s never been cheaper to make music, videos, and promote albums. EMI, he thinks, broke even. So why are they alienating their customers?</p>
<p><strong>8:06 p.m.</strong>&#8211;Blind item alert! Moby says that a few years ago, he was talking to a record label head, and when he asked the top honcho about their iTunes plan for their biggest star&#8217;s newest album, he was told, oh, we&#8217;re going to wait a couple months.</p>
<p>Moby then launches into philosophy mode and brings up the is/ought fallacy to illustrate his point, noting that the current music model &#8220;underpins the failure of major labels&#8211;they think, it used to be this way, so it ought to be this way.&#8221; Their ethos is, &#8220;Please go away. Make the future die.&#8221; Mossberg suggests he write a song/album with that title. Moby quips back with &#8220;Young People Suck&#8221; as a potential label-inspired tune.</p>
<p><strong>8:12 p.m.</strong>&#8211;Moby adds a qualifier to his comments, touting Mute, his own record label. &#8220;Mute is wonderful, and they care about music&#8211;it&#8217;s the big major labels who have been egregiously bad stewards of music. It&#8217;s hard to feel bad for them when they&#8217;ve brought us some of the worst music ever created.&#8221; He then gets in a dig at Lars Ulrich of Metallica, saying that if he needs a &#8220;fur-lined walking humidor,&#8221; that’s him.</p>
<p><strong>8:15 p.m.</strong>&#8211;Moby asks the audience if he can get pedantic for a moment. They cheer their assent. He then launches into a story about the early days of the Beatles, a band that got &#8220;lucky&#8221; because everything they did was in mono. &#8220;The first &#8216;Meet the Beatles&#8217; was recorded in four hours. They played the songs and it was done.&#8221; He explains how this is not possible anymore.</p>
<p><strong>8:18 p.m.</strong>&#8211;Yay! Moving on to a discussion about  Auto-Tune, which &#8220;enables anyone to fake perfect pitch.&#8221; Moby declines to name names in his anecdotes, because he has enough feuds already, but singles out Cher’s &#8220;I Believe&#8221; as the first of the supremely auto-tuned songs, and mourns how kids can&#8217;t recognize real singing anymore. Next, a discussion of playback, aka the technology that failed Ashlee Simpson when she was reduced to her now infamous hoedown on &#8220;Saturday Night Live.&#8221;</p>
<p><strong>8:23 p.m.</strong>&#8211;Memory lane for Mossberg. He recalls seeing the Supremes, and Simon &#038; Garfunkel in the &#8217;60s for $3/ticket in a gym, and how the concerts back then used to sound just like the album. But everything is much more complicated now.</p>
<p><strong>8:25 p.m.</strong>&#8211;Moby talks about how he plays to bigger crowds in Europe, and how he can enjoy the concert experience. Playing in front of a big crowd, he says, with big production values, is the musician&#8217;s equivalent of playing the big penis card.</p>
<p><strong>8:28 p.m.</strong>&#8211;Mossberg asks: When you make music, do you have to consider the fact that it&#8217;s going to be listened to on [Apple] iPods and [Microsoft] Zunes? Moby says sadly yes, and tells a story about how super-processed music works on the subway, because the noise of the L train doesn&#8217;t interfere with, say, a song by Rihanna, but the subtleties of Gershwin&#8217;s &#8220;Rhapsody in Blue&#8221; will get lost.</p>
<p><strong>8:32 p.m.</strong>&#8211;Mossberg moves on to playing a snippet of the song &#8220;Pale Horses&#8221; from &#8220;Wait for Me&#8221; because we&#8217;re running late, and Moby says he has to pee&#8211;&#8221;Syphilis is a demanding mistress.&#8221; Mossberg: &#8220;Bill Gates doesn&#8217;t say that to me…I can&#8217;t believe I&#8217;m defending Microsoft.” Moby: &#8220;I&#8217;m just saying the Zune is clumsy as hell.&#8221; [For those lacking the implied sarcasm, Moby clarifies later on that he does not, in fact, have syphilis.]</p>
<p>Moby on &#8220;Pale Horses&#8221; and many of his other songs: 80% of the work is done in a couple days, but it&#8217;s the finishing stuff that is what really takes a really long time. To get the job done, he holes himself with the music&#8211;&#8221;Hopefully, a more benign version of Ted Kaczynski during the creative process.&#8221;</p>
<p><strong>8:40 p.m.</strong>&#8211;Audience Q&#038;A time. Moby is asked about his licensing deals, and says he doesn&#8217;t license music anymore, because he&#8217;s sick of being the whipping boy for the process. Which is ironic, because everyone&#8217;s selling out now. He adds that he initially licensed the music for &#8220;Play,&#8221; because it allowed more people to hear the album.</p>
<p><strong>8:46 p.m.</strong>&#8211;Moby interrupts a question-asker to comment on how he wishes the stage were against the left window like a previous panel he was on, so everyone could get a glimpse of the view. The questioner then proceeds to take out a Chilean flag and hold it up before asking Moby if there&#8217;s relationship between his music and the cosmos. The short answer? Yes.</p>
<p><strong>8:51 p.m.</strong>&#8211;Mossberg sums up the evening and offers kudos to Moby for sharing his time and process.</p>
<p><strong>8:52 p.m.</strong>&#8211;Moby plugs a new tour date in Williamsburg, Brooklyn. And good night everybody!</p></blockquote>

		<description><![CDATA[A rare bit of good news for the embattled music label CEO: A New York court says he doesn't owe former Simon &#38; Schuster boss Richard Snyder for helping him figure out how to buy Warner Music a few years ago.]]></description>
			<content:encoded><![CDATA[<p><a href="http://mediamemo.allthingsd.com/files/2008/12/bronfman.jpg"><img class="alignright size-full wp-image-2405" title="bronfman" src="http://mediamemo.allthingsd.com/files/2008/12/bronfman.jpg" alt="" width="188" height="250" /></a> Edgar Bronfman Jr. is both a music company CEO and in a <a href="http://mediamemo.allthingsd.com/20081220/warner-music-group-disappearing-from-youtube-both-sides-take-credit/">fight against Google</a> (GOOG). So he needs good news wherever he can find it. Today a New York Court is helping out: It has ruled against former publishing executive Dick Snyder, who claimed that Bronfman owed him $100 million because he helped him hatch a plan to buy Time Warner&#8217;s (TWX) record label.</p>
<p>Snyder, who ran publishing giant Simon &amp; Schuster for a couple decades, had a an exciting and juicy story to tell: He basically claims that Bronfman hired him as consigliere as he figured out how to buy Warner Music (WMG) for $2.6 billion in 2003, but never paid him. The tale is nicely told in this <a href="http://www.portfolio.com/careers/features/2007/08/13/Snyder-Bronfman-Suit">Portfolio piece from 2007</a>, which includes plenty of character assassination and mud-slinging, if you&#8217;re in to that sort of thing.</p>
<p>Today&#8217;s news is compelling only if you&#8217;re one of the two men involved in the case. But it does look good for Bronfman: In April, the New York State Supreme Court had ruled against Snyder on four of the six claims he filed in 2007; today, an appellate court shot down the final two.</p>
<p>Here&#8217;s the statement from Bronfman&#8217;s attorney, Orin Snyder; the court&#8217;s decision is embedded below (click on button on top right to enlarge):</p>
<blockquote><p>This unanimous decision is a complete victory for Mr. Bronfman&#8211;so much so that the Court imposed court costs on Dick Snyder. We are gratified that the appellate court vindicated Mr. Bronfman and repudiated Dick Snyder&#8217;s bogus claims. Today&#8217;s decision confirmed what we have said all along&#8211;that Dick Snyder&#8217;s claims were nothing more than a work of fiction. This opportunistic lawsuit was a lame attempt to extract money from Mr. Bronfman, whose hard work, vision and creativity helped bring about the successful acquisition of Warner Music. From the outset, Mr. Bronfman refused to settle because he believed that, as a matter of principle, it was important to fight this frivolous lawsuit to the end.&#8221;</p></blockquote>

Now that the rival social network has launched what MySpace CEO Chris Wolfe likes to describe as a <a href="http://digitaldaily.allthingsd.com/20080925/myspace-music-like-napster-with-a-business-plan/">&#8220;mega-music experience,&#8221;</a> Facebook is said to be looking for a foothold in the digital music business as well. <a href="http://www.nypost.com/seven/10172008/business/friends_of_the_band_134022.htm">The New York Post reports</a> that the social network is busy poking the major record labels to gauge their interest in a Facebook music offering. Unlike MySpace Music, which is a joint venture between MySpace and the &#8220;Big Four&#8221; music labels,  Facebook&#8217;s music service would more likely take the form of an outsourcing deal with a streaming service like Rhapsody.com or Imeem.com. <img src="http://digitaldaily.allthingsd.com/files/2008/10/95px-nypost.jpg" alt="" title="95px-nypost" width="95" height="120" class="alignleft size-full wp-image-7009" /><em>If there&#8217;s a music service at all.</em> Said the Post, &#8220;Insiders familiar with the talks further cautioned that nothing is imminent, and Facebook may ultimately walk away from the plan altogether.&#8221;</p>
