Mobile ads, <a href="http://allthingsd.com/20120418/mobile-ads-are-growing-fast-still-pretty-small/">even more so</a>.</p>
<p>And if you combine the two? You get <a href="http://vungle.com/">Vungle</a>, a barely hatched start-up that just raised a $2 million seed round.</p>
<p>Vungle&#8217;s pitch is straightforward: They help app developers make video promo reels for their stuff, and turn them into &#8220;in-app&#8221; ads (you can see a sample below). There are a whole lot of ways to buy in-app advertising for other apps already &#8212; it&#8217;s a big chunk of the mobile ad business right now &#8212; but the Vungle guys argue that they make it easy. And that unlike iAd, AdMob, Millenial, etc., it&#8217;s all they do.</p>
<p>Fair enough. No way to really tell now, as the company is only in &#8220;alpha,&#8221; with a handful of paying customers that include Path, the buzzy next-gen social network, and <a href="http://pocketgems.com/">Pocket Games</a>, a game developer. A more open beta comes this summer.</p>
<p>At least as interesting as the pitch is the backstory, which has co-founders Zain Jeffer, 24, and Jack Smith, 23, leaving London on a whim to join the AngelPad start-up factory last fall, then finding themselves in a whirlwind round of financing. For instance, they pitched Crosslink&#8217;s David Silverman at his home on a weekend, and got a commitment a day later.</p>
<p>Multimillion dollar seed rounds would have been unheard of a couple years ago. Now they&#8217;re increasingly commonplace (here&#8217;s one for <a href="http://allthingsd.com/20120425/people-search-engine-ark-raises-biggest-y-combinator-seed-round-in-memory/">$4.2 million</a>), at least for a certain class of incubator-blessed start-ups. And they&#8217;re part of the reason that you&#8217;re hearing <a href="http://allthingsd.com/20120501/nope-still-no-bubble-here-says-marc-andreessen/">lots of bubble talk right now</a>.</p>
<p>For the record, the Vungle guys say they had no intention of raising so much out of the gate. But &#8220;as soon as you tell people you don&#8217;t want money, that&#8217;s when they want to give you money,&#8221; Smith says. Among those chipping in: Google Ventures, AOL Ventures, Ron Conway, Dave McClure, Charles Hudson, Maynard Webb, Scott McNealy and Tim Draper.</p>

			<content:encoded><![CDATA[<p><a href="http://allthingsd.com/20120502/after-testifying-in-oracle-google-trial-scott-mcnealy-speaks-out/mcnealy-tv/" rel="attachment wp-att-202418"><img src="http://allthingsd.com/files/2012/05/mcnealy-tv-380x285.png" alt="" title="mcnealy-tv" width="380" height="285" class="alignright size-Featured wp-image-202418" /></a>Having testified in the Oracle-Google trial with a <a href="http://allthingsd.com/20120426/former-sun-ceo-vs-former-sun-ceo-in-oracle-google-trial-over-java/">decidedly different viewpoint</a> from that of his successor, former Sun Microsystems CEO Scott McNealy took to Bloomberg TV yesterday to talk a little about Java, the licensing of its APIs, and other matters.</p>
<p>In his appearance, McNealy said that, as he remembers it, Google was asked to take out a commercial license on Java. &#8220;There is a Java specification license document available,&#8221; he said, that didn&#8217;t contain any financial requirements, but it did require compatibility.</p>
<p>McNealy had been called as a witness by Oracle, and on the stand he said that it was Sun’s practice to let other companies use Java, but only with a commercial license, and that its primary requirement was that the licensee ensure that Java remain compatible.</p>
<p>While numerous other phones from the likes of Nokia, Research In Motion and Motorola were compatible with Java applications, those on Android weren’t. Compatibility is one of the main points over which Oracle has been arguing with Google. Oracle contends that not only did Google violate its patents and copyrights, but it then went on to build its own incompatible version of Java, fracturing one of the oldest premises of Java’s existence: Write once, run anywhere.</p>
<p>McNealy is also running a <a href="http://twitpolls.com/s/RA">poll on Twitpolls</a>, asking people to vote for which side they agree with. (Google is ahead as of this morning.) </p>

<p>Meanwhile, the jury is still out, and <a href="http://allthingsd.com/20120501/jury-deliberates-oracle-google-trial-the-world-waits/">the world is still waiting</a> for a verdict. It could come today.</p>

<p>Of the two, Jonathan Schwartz, Sun&#8217;s last CEO, spent the most time on the witness stand. Called by lawyers for Google, he bolstered Google&#8217;s argument that it was free to use parts of Java as it assembled its Android mobile operating system.</p>
<p>Scott McNealy, called by Oracle, said it was Sun&#8217;s practice to let other companies use Java, but only with a commercial license, the primary requirement of which was that the licensee ensure that Java remain compatible.</p>
<p>While numerous other phones from the likes of Nokia, Research In Motion and Motorola were compatible with Java applications, those on Android weren&#8217;t. Compatibility is one of the main points over which Oracle has been arguing with Google. <p>Schwartz said he had hoped that Google would take out a commercial license, but in the end, he said, according to a report on CNet News, Sun opted &#8220;<a href="http://news.cnet.com/8301-1035_3-57420304-94/former-sun-ceo-says-googles-android-didnt-need-license-for-java-apis/">to grit our teeth</a>&#8221; and support it as part of the Java community. He said that he opted not to sue Google over the issue.</p>
<p>Oracle also presented as evidence an email from Schwartz, describing Google as having taken Java &#8220;without attribution or contribution,&#8221; and then went on: &#8220;This is why I love scroogle,&#8221; referring to a now-defunct Web-search service that served up <a href="http://en.wikipedia.org/wiki/Scroogle">Google-like search results anonymously</a>. <p>Though he has been out of the headlines for a while, former Sun Microsystems CEO Scott McNealy has been keeping busy, sitting on the boards of a couple of companies and advising others. Still, that left him with a bit of extra time &#8212; time he has been using to help get a new company off the ground.</p>
<p>McNealy&#8217;s new venture is called Wayin. It&#8217;s a mobile app designed to let users quickly post poll questions from their phone about whatever is going on, whether it is the latest episode of &#8220;Dancing With the Stars,&#8221; a major news event or the big game.</p>
<p>The idea is that someone is watching something on TV and then turns to his or her phone to post a quick question to others engaged with the same event. In a demo on Wednesday, McNealy quickly responded to several polls in under a minute. People can post queries of their own just by taking a picture &#8212; or by choosing one from their photo library and using a preset question or coming up with one of their own.</p>

<p>The app, which has quietly been live in Apple&#8217;s App Store for a bit now, officially launched this week. Wayin is free and works on iPhone, Android and the mobile Web. The company hopes to build critical mass through partnerships with sports and media companies, and has announced initial deals with the New England Patriots and Washington Redskins football teams, and with the NHL&#8217;s Los Angeles Kings.</p>
<p>Wayin plans to make money by inserting sponsored polls into a user&#8217;s stream. For advertisers, it&#8217;s a way to get instant feedback on their products and ideas. Polls could even be tied in to the commercials running during the sporting event or other live program being commented on.</p>
<p>&#8220;It’s explicit market research,&#8221; McNealy said. &#8220;There is no inference required.”</p>
<p>Wayin has about 35 employees and is based in Boulder, Colo., once a site of major operations for Sun Microsystems. The company hasn&#8217;t taken venture money, but has raised about $6.3 million from early investors.</p>

<p>Last night, BoomTown headed to San Francisco&#8217;s wedding-cake City Hall to attend &#8220;The 25 Years of .Com Gala,&#8221; which is honoring a quarter-century that I have been jacked into the matrix.</p>
<p>Actually, it&#8217;s the 25th anniversary of the .com Internet domain name.</p>
<p>VeriSign (VRSN), which administers the .com registry, sponsored the party, as well as a <a href="http://kara.allthingsd.com/20100315/boomtown-in-d-c-to-say-happy-25th-birthday-to-com-and-hello-to-broadband-plan">recent confab in Washington, D.C.</a></p>
<p>While the growth of .com was slow until the browser became popularized&#8211;numbering under 15,000 addresses in 1992&#8211;there are now close to 85 million .com domains. This innovative commercial designation is clearly the most important one, both financially and perceptually.</p>
<p>Thus, time to party at an event emceed by Web 1.0 comic favorite Dana Carvey.</p>
<p>He was funny, but perhaps the most enjoyable blast from the past was the appearance of jeans-clad former Sun Microsystems CEO Scott McNealy, who most definitely retains the title of Clown Prince of Silicon Valley as the needler-in-chief of then-dominant Microsoft (MSFT).</p>
<p>After being one of the superstars of Web 1.0, the wise-cracking McNealy has been missing in action in tech of late, as Sun&#8217;s influence waned. The company was <a href="http://digitaldaily.allthingsd.com/20100325/oracle-profits-slip">sold to Oracle</a> (ORCL) recently.</p>
<p>Ironically, given all the <a href="http://digitaldaily.allthingsd.com/20100526/facebooks-new-approach-to-privacy/">hubbub over Facebook&#8217;s privacy screw-ups</a> this week, it was McNealy who famously said in a 1999 interview: &#8220;You have zero privacy anyway. Get over it.&#8221;</p>
<p>For last night&#8217;s crowd, he rendered a very adorkable list of the many reasons he was surprised that the .com was getting feted.</p>

Last week, <a href="http://digitaldaily.allthingsd.com/20100121/sun-ceo-go-oracle-internal-memo/">we heard from Sun CEO Jonathan Schwartz</a>, who&#8211;as I reported yesterday&#8211;<a href="http://digitaldaily.allthingsd.com/20100125/sun-ceo-set-to-announce-resignation/">will soon resign</a> his position. </p>
<p>Today, it’s Sun co-founder Scott McNealy who is bidding farewell. Sources close to the company tell me that he too will leave Sun following the close of Oracle&#8217;s $7.4 billion buyout.</p>
<p>Word of McNealy&#8217;s fate comes a day before Oracle is to unveil its strategy for Oracle (ORCL) and Sun (JAVA) at an <a href="http://www.oracle.com/us/sun/index.htm">event tomorrow</a>.</p>
<p>McNealy&#8217;s farewell memo to employees, below.</p>

<p>Gang,</p>
<p>When I interviewed many of you for employment at Sun over the years, one commitment often made was that things will change above, below, and around you faster than any place you have ever been. Looks like this was one area we exceeded plan for 28 years. While it was never the primary vision to be acquired by Oracle, it was always an interesting option. And this huge event is upon us now. Let&#8217;s all embrace it with all of the enthusiasm and class and talent that we have to offer.</p>
<p>This combination has the potential to put Sun, its people, and its technology at the center of yet another industry and game changing inflection point. The opportunity is well documented and articulated by Larry and the Oracle folks. Not much I can add on this score. This is a very powerful merger. And way better than some of the alternatives we were facing.</p>
<p>So what do I say to all of you now this is happening?</p>
<p>It turns out that one simple message to the large and diverse Sun community is actually quite hard to craft. Even for a big mouth who is always ready with a clever quip. The community includes our resellers and customers, our current and former employees, their friends and families who supported our employees on their mission to change the industry, our investors, our supply and service partners, students and educators, and even our competitors with whom we often collaborated.</p>
<p>But let me try. Though nothing I could write comes close to matching the unbelievably strong and positive emotions I have for you all. See, I never was able to master dispassion. I truly loved starting, running, and living Sun. And the last four years have not been without serious withdrawal. And the EU approval rocked me more than it should have.</p>
<p>So, to be honest, this is not a note this founder wants to write. Sun in my mind should have been the great and surviving consolidator. But I love the market economy and capitalism more than I love my company.</p>
<p>And I sure &#8220;hope&#8221; America regains its love affair with capitalism. And except for the auto industry, financial industry, health care, and some other places (I digress), the invisible hand is doing its thing quite efficiently. So I am more than willing to accept this outcome.</p>
<p>And my hat is off to one of the greatest capitalists I have ever met, Larry Ellison. He will do well with the assets that Sun brings to Oracle.</p>
<p>What we did right and wrong at Sun over the years might make for interesting reading. However, I am not a book writer. I am a husband, father of four, and a builder and leader of people who want to make a difference.</p>
<p>But spare me a bit of nostalgia. Not of the mistakes we made, and lord knows I made a ton. But of the things we did right and well.</p>
<p>First and foremost, Sun innovated like crazy. We took it to the limit (see Eagles). And though we did not monetize our inventions as well as we could have, few companies have the track record in R&#038;D that we had over the last 28 years. This made working at Sun really cool. Thanks to all of you inventors and risk takers who changed how we live.</p>
<p>Sun cared about its customers. Even more than we cared about our own company at times. We looked at our customer&#8217;s mission as more important than ours. Maybe we should have asked for more revenue in return, but our employees were always ready to help first. I love this about Sun which I guess makes me a good capitalist if not a great capitalist.</p>
<p>Sun did not cheat, lie, or break the rule of law or decency. While we enjoyed breaking the rules of conventional wisdom and archaic business practice and for sure loved to win in the market, we did so with a solid reputation for integrity. Nearly three decades of competing without a notable incident of our folks going off course morally or legally. Not all executives and big companies are bad. Really. There are good companies out there. Special thanks to all of my employees for this. I never had to hide the newspaper in shame from my children.</p>
<p>Sun was a financial success. We paid billions in taxes, salaries, purchases, leases, training, and even lawyers and accountants for devastatingly cumbersome SOX and legal compliance (oops, more classic digression). Long term and smart investors made billions in SUNW. And our customers generated revenue and savings using our equipment in countless ways. Many employees started families, bought homes and put them through school while working at Sun. Our revenues over 28 years exceeded $200B. Few companies make it to the F200. We did. Nice.</p>
<p>Sun employees had way more fun than any other company. By far. From our dress code (&#8220;You must!&#8221;) to beer busts to our April Fools pranks to SunRise to our quiet enjoyment at night of a long hard well done day of work, no company enjoyed &#8220;work&#8221; more than Sun. Thanks to all of our employees past and present for making Sun such a blast.</p>
<p>I could go on for a long time reminiscing about the good and great stuff we did at Sun, but just allow me one last one. We shared. Not the greatest attribute for a capitalist. But one I could not change and was not willing to change about Sun while I was in charge. We shared in the success of Sun with our resellers. With our employees through stock options, SunShare, beer busts, and the like (for as long as Congress would allow) and through our efforts to keep as many of them on board for as long as possible during the inevitable down cycles. With our partners through the Java Community Process, through our open source collaborations, and licensing strategies. With our customers through our commitments to low barriers to exit. Sun was never just about us. It was about we. And that may be a bit of the reason we are where we are today.</p>
<p>But I have few regrets (see Sinatra&#8217;s &#8220;My Way&#8221;) and will always look back at Sun and its gang with only pride. Enormous pride. You are the best this industry ever had though few outside of Sun recognized it.</p>
<p>And what we are about will live on in Sparc, Solaris, Java, our products, and our spirit. Well past everyone&#8217;s recollections of what we did together. I will never forget though.</p>
<p>Oracle is getting a crown jewel of the technology industry. They will do great things with Sun. Do your best to support them and keep the Sun spirit alive and well in the industry. Our children will be better for it.</p>
<p>Thanks for the off the charts support to everyone who ever carried a Sun badge, used our products, or helped our company through the years.</p>
<p>And thanks to my wonderful wife, Susan, who gave this desperado (see Eagles) a chance to choose the Queen of Hearts before it was too late.</p>
<p>Someday, hopefully, you will all get to see or meet her and my other life&#8217;s works named Maverick, Dakota, Colt, and Scout. If you do, perhaps you will understand why I stepped back from the CEO role four years ago. And why I feel like the luckiest guy in the whole world.</p>

Below, the all-hands memo Sun CEO Jon Schwartz sent to employees following the announcement. Pay particular attention to the first letter of the first 7 paragraphs &#8230; </p>
<blockquote class="memo"><p>
<strong>B</strong>elieve it or not, it&#8217;s been more than nine months since Oracle first announced their intent to acquire Sun in April, 2009. And the &#8216;interim&#8217; period has been tough on everyone&#8211;on our employees, and our partners and customers. Thankfully, that interim period is coming to an end, with regulatory approval from the European Union issued today, and only a few hurdles remaining&#8211;before Oracle formally expands beyond software to become the world&#8217;s most important systems company.</p>
<p><strong>E</strong>ven though we&#8217;re not quite across the finish line, I wanted to leave you with a few final thoughts.</p>
<p><strong>A</strong>ll in all, it&#8217;s been an honor and privilege to work together. In my more than twenty years in the industry, the last thirteen at Sun, I&#8217;ve had a chance to work with and around an enormous diversity of companies, from every sector you can imagine. I can say with conviction that Sun&#8217;s people have always stood apart as the brightest, most passionate, and most inspiring. I&#8217;ve never had a bad day in my thirteen years for one very basic reason&#8211;I&#8217;ve always been surrounded by the best and brightest individuals I&#8217;ve ever come across. That&#8217;s been an honor and privilege, for which I&#8217;m enormously thankful.</p>
<p><strong>T</strong>echnology from Sun, alongside our employees and partners, have changed the world. We&#8217;ve opened markets, elections and economies. We&#8217;ve helped build the world&#8217;s most important and valuable businesses. We&#8217;ve played a key role in discovering new drugs, in bringing education and healthcare to those in need, and supplying the world with an incredible spectrum of entertainment, from smartphones to social networking. I doubt any company has had such a significant influence over the way we see or experience the world. I once told Scott McNealy he was the Henry Ford of the technology industry, making remarkable innovations accessible to anyone, and creating an immense number of jobs around the globe for those that made use of them. I can&#8217;t begin to tell you how proud I am of my association with that cause and the people behind it, and the value we created for ourselves and those that exploited our innovations.</p>
<p><strong>I</strong> also know we&#8217;ve had more than our share of very tough challenges. Amidst the toughest market and customer situations imaginable, I&#8217;m proud we&#8217;ve always acted with integrity, with a sense for what&#8217;s right, and not simply what&#8217;s expedient. Over the years, I&#8217;ve heard time and again, from those inside and outside the company, &#8220;I like and I trust Sun.&#8221; </p>
<p><strong>B</strong>uilding that good will is something to which you&#8217;ve all contributed. And you have every right to be very proud of it.</p>
<p><strong>M</strong>ake no mistake, it&#8217;s been an enormous asset.</p>

<p>And lastly &#8211; to the engineers and marketers who&#8217;ve fostered a perpetual belief that innovation creates its own opportunity &#8211; thank you. You&#8217;re right. Innovation does create its own opportunity. Like Oracle, we&#8217;re an engineering company in our heart and soul, our potential together is limitless.</p>
<p>Now many of you know that I came to Sun when a company I helped to found was acquired in 1996. I&#8217;ve also led, and been a part of many, many acquisitions at Sun, both large and small. From those experiences, I&#8217;ve learned one very clear lesson&#8211;the single most important driver of a successful acquisition are the people involved&#8211;and how committed they are to the new owner&#8217;s mission.</p>
<p>And the most effective mechanism I&#8217;ve seen for driving that commitment begins with a simple, but emotionally difficult step. </p>
<p>Upon change in control, every employee needs to emotionally resign from Sun. Go home, light a candle, and let go of the expectations and assumptions that defined Sun as a workplace. Honor and remember them, but let them go.</p>
<p>For those that ultimately won&#8217;t become a part of Oracle, this will be the first step in a new adventure. Sun has a tremendous reputation across the planet, well beyond Silicon Valley. It&#8217;s a great brand to have on your resume. We&#8217;re known as self-starters, capable of ethically managing through complexity and change, for delivering when called upon, and for inventing and building the future. With the world economy stabilizing, I&#8217;m very confident you&#8217;ll land on your feet. You&#8217;re a talented, tenacious group, and there&#8217;s always opportunity for great people.</p>
<p>For those that have roles at Oracle, may you start with a clean slate, ready to take on the myriad opportunities ahead. With the same passion and tenacity for Oracle&#8217;s success that you&#8217;ve had for Sun&#8217;s, and a renewed sense of energy around executing on a far broader mission. There is no doubt in my mind you, and Oracle, will be remarkably successful, beyond the market&#8217;s wildest expectations. But it&#8217;s important you come to work thinking, &#8220;Sun is a brand, Oracle&#8217;s my company.&#8221; Don&#8217;t look for ways to preserve or dwell in &#8220;how we used to do things.&#8221; Look for ways to help customers, grow the market, and improve Oracle&#8217;s performance. </p>
<p>Sun is a brand, Oracle is your company.</p>
<p>And to that end, with nine months of getting to know them, I&#8217;ve found Oracle to be truly remarkable, led by remarkable people. From Larry on down, they understand the enormity of the opportunity before them, and they&#8217;re more than prepared to execute on it &#8211; across the board. I&#8217;ve seen their commitment and focus, now they need yours. I&#8217;m confident you&#8217;ll give it the 10,000% effort it deserves&#8211;and we&#8217;ll all see the end result.</p>
<p>So thank you, again, for the privilege and honor of working together. The internet&#8217;s made the world a far smaller place&#8211;so I&#8217;m sure we&#8217;ll be bumping into one another. </p>

			<content:encoded><![CDATA[<p>Facebook is rolling out new privacy settings that it <a href="http://mediamemo.allthingsd.com/20090701/facebooks-new-privacy-policy-share-everything-with-everyone/">first began talking about in July</a>. The company is holding a press conference this morning to walk us media types through the change, but here&#8217;s the main thing every Facebook user ought to know: Facebook wants users to share as much about themselves&#8211;with everyone on the Internet&#8211;as they can.</p>
<p>Here&#8217;s a screenshot of the new privacy settings menu Facebook presented to me today. Note that the <em>default settings</em> for most of my data are set to &#8220;Everyone&#8221; (click image to enlarge):<br />

<p>But what does &#8220;Everyone&#8221; actually mean? It means anyone with access to the Web. But you&#8217;ll need to read the fine print below the settings to figure that one out:</p>
<p><a rel="lightbox" href="http://mediamemo.allthingsd.com/files/2009/12/facebook-everyone-setting.png"><img class="alignnone size-full wp-image-13743" title="facebook everyone setting" src="http://mediamemo.allthingsd.com/files/2009/12/facebook-everyone-setting.png" alt="facebook everyone setting" width="350" height="14" /></a></p>
<p>Important note: Facebook says these settings won&#8217;t be the default for anyone under age 18, and that kids will be prevented from sharing much of their information outside of Facebook. The company also says that users who have tweaked their privacy settings in the past will find those settings as the default when they first visit their privacy page. The majority of users, though, will end up with the &#8220;Everyone&#8221; default.</p>
<p>That said, the &#8220;share everything with everyone&#8221; strategy is a crucial part of Facebook&#8217;s effort to supplant Google (GOOG) as the Web&#8217;s key data repository. And I don&#8217;t have a problem with it, in theory: Like <a href="http://www.huffingtonpost.com/2009/12/07/google-ceo-on-privacy-if_n_383105.html">Eric Schmidt</a> (and<a href="http://www.wired.com/politics/law/news/1999/01/17538"> Scott McNealy</a> before him), I don&#8217;t think there&#8217;s much privacy on the Web to begin with. Still, even though people don&#8217;t tend to behave as if privacy is important to them on the Web, they certainly like to complain about it.</p>
<p>And for what it&#8217;s worth, I have gone ahead and deselected the &#8220;Everyone&#8221; option for my stuff. If you want to see video of my toddler toddling, you&#8217;re going to have to be one of my 466 &#8220;friends.&#8221;</p>
<p>My bet: Facebook is going to end up hearing from all sorts of folks who didn&#8217;t realize they&#8217;re sharing everything with &#8220;everyone&#8221; and are now upset about it. And I think Facebook will end up by changing its default settings sooner than later.</p>

<p>At a special meeting Thursday, a 62 percent majority of Sun’s common stock owners&#8211;not including CEO Jonathan Schwartz  and board chairman and co-founder Scott McNealy, who, oddly, did not attend&#8211;<a href="http://www.sun.com/aboutsun/pr/2009-07/sunflash.20090716.1.xml">approved the deal</a>, which calls for Oracle (ORCL) to acquire Sun (JAVA) for $9.50 per share in cash, a total of $7.4 billion.</p>
<p>The vote was quick and painless, I&#8217;m told. It began at 10:02 am PDT and closed at 10:05 am. The end of Sun’s 27-year history was decided in under five minutes.</p>
<p>Of course, the merger still faces antitrust scrutiny, but <a href="http://digitaldaily.allthingsd.com/20090629/oracles-sun-deal-approved-almost/">Oracle insists it will be completed by the end of the summer</a>. Oracle is probably right. And with ownership of Sun&#8217;s Java programming language and the Solaris operating system, Oracle will be a systems and software powerhouse capable of taking Microsoft (MSFT), Hewlett-Packard (HPQ) and IBM (IBM) to the mat.</p>

<p>Welcome back to Weekend Update, where we showcase some of the highlights from this site over the past week.</p>
<p>In the umpteenth round of the old media versus new media match, the Associated Press in its annual meeting this week played into the stereotype of the grizzled no-nonsense editor who <a href="http://mediamemo.allthingsd.com/20090406/ap-shakes-fist-at-google-tells-internet-to-get-off-its-damn-lawn/">shakes his fist at the new interweb thing (or was it intertube?) and its feisty friend Google News, who are running amok on his lawn</a>. In addition to trying to &#8220;protect news content from misappropriation,&#8221; AP board chairman and MediaNews group CEO Dean Singleton emphasized that print was the &#8220;meat,&#8221; while online was merely the &#8220;salt and pepper.&#8221; Unimpressed, BoomTown thought Singleton was <a href="http://kara.allthingsd.com/20090407/its-actually-about-selling-the-sizzle-and-not-the-steak-dean/">singling out the steak while missing the sizzle</a>.</p>
<p>In response, Google (GOOG), or He Who Was Not Named, posted a polite, if rather ambiguous, statement on its public policy blog, <a href="http://kara.allthingsd.com/20090408/boomtown-decodes-googles-associated-press-blog-so-you-dont-have-to/">which was just begging for translation</a>. Also doing some interpreting of his own, <a href="http://mediamemo.allthingsd.com/20090410/ap-exec-to-the-untrained-eye-it-looks-like-were-stupid/">AP executive Jim Kennedy spoke with MediaMemo</a> on just what all the fire and brimstone was about. In quieter newspaper-related news, <a href="http://mediamemo.allthingsd.com/20090408/wsj-promises-new-pay-sites-some-day/">The Wall Street Journal continues on its quest to spread pay content online</a>, possibly through niche content, according to WSJ.com Executive Editor Alan Murray. Also experimenting online is the <a href="http://ptech.allthingsd.com/20090408/trueslant-tests-another-model-of-web-journalism/">recently opened news Web site, True/Slant</a>, a heady combination of journalism, social networking and advertising.</p>
<p>Another news item that&#8217;s gotten people talking is the fallout from the collapsed IBM-Sun merger, aka <a href="http://kara.allthingsd.com/20090406/raise-the-yangtanic-again-sunibm-gets-new-tech-metaphor-thrown-at-it-also-not-so-currie-licious/">Sun pulls a Jerry Yang</a>. (Oh Jerry, the Internet kids because it loves&#8230; loves to kid! Pwn-age.) Following the news of the collapse, Sun (JAVA) shares dropped more than 27 percent, leading analysts and Digital Daily to predict difficult times ahead for the company, <a href="http://digitaldaily.allthingsd.com/20090406/whos-your-ma-consultant-sun-jerry-yang/">here</a> and later <a href="http://digitaldaily.allthingsd.com/20090407/investors-to-sun-weve-got-another-place-for-you-to-put-the-dot-you-put-in-dot-com/">here</a> as the stock continued its fall over the week. Besides quashing its own stock price, Sun also quashed <a href="http://digitaldaily.allthingsd.com/20090406/sun-may-the-schwartz-be-with-you/">rumors that chairman and co-founder Scott McNealy would replace CEO Jonathan Schwartz</a>.</p>
<p>Other nonthematic highlights this week:</p>
<p>BoomTown got the exclusive on the anticipated <a href="http://kara.allthingsd.com/20090410/yahoos-bartz-and-microsofts-ballmer-finally-talking-about-search-and-advertising-partnership/">talks between Yahoo&#8217;s (YHOO) Carol Bartz and Microsoft&#8217;s (MSFT) Steve Ballmer</a> in which the two CEOs discussed the possibility of a search and advertising partnership. Speaking of exclusivity, <a href="http://kara.allthingsd.com/20090409/who-will-be-twitters-bestest-search-friend-google-and-microsoft-engage-in-yet-another-pick-me-face-off/">Google and Microsoft like totally want to be Twitter&#8217;s new bff</a>, or maybe go steady if Twitter&#8217;s interested.</p>
<p>Digital Daily ruminated on <a href="http://digitaldaily.allthingsd.com/20090406/time-warner-on-aol-we-ought-to-have-that-removed/">speculations of Time Warner (TWX) doing an AOL spinoff</a>, especially after its hire of former Google exec Tim Armstrong and its attempts to amend debt agreements as per an SEC filing. Also in the rumor mill: The <a href="http://digitaldaily.allthingsd.com/20090406/hello-and-welcome-to-imoviephone/">iPhone 3.0 may support onboard video editing</a>. Less of a rumor and more of a slap in the face, to Apple (AAPL) at least: <a href="http://digitaldaily.allthingsd.com/20090408/elan-gives-apple-the-multi-finger/">Elan Microelectronics has taken off the gloves (and taken up the lawsuit)</a> because it believes that Apple&#8217;s products infringe on its touchscreen patents.</p>
<p><a href="http://mediamemo.allthingsd.com/20090410/can-universal-music-run-its-own-hulu-its-going-to-try/">MediaMemo goes over the facts about Vevo</a>, the new online music video hub that&#8217;s a partnership between Google&#8217;s YouTube and Vivendi&#8217;s Universal Music Group, with interesting ramifications for both. Meanwhile, <a href="http://mediamemo.allthingsd.com/20090407/now-available-at-itunes-price-hikes-for-music/">iTunes has put in place its new tiered-pricing system</a>, in which songs will now cost 69 cents, 99 cents, or $1.29. But in a question that shocked no one: Where are the all the lowest-tier songs? Don&#8217;t worry your pretty little heads, said Big Music, <a href="http://mediamemo.allthingsd.com/20090408/big-music-cheaper-music-coming-to-itunes-trust-us/">they&#8217;re on their way</a>.</p>
<p>In a new Mossblog, Walt Mossberg reports from the battlefield of the growing <a href="http://mossblog.allthingsd.com/20090410/the-smartphone-wars/">Smartphone Wars</a>, in which iPhones, BlackBerries and others are engaged in mortal combat. In the Mossberg Solution, <a href="http://solution.allthingsd.com/20090407/a-desktop-that-begs-to-be-organized/">Katherine Boehret reviews BumpTop</a>, an application that takes your flat, plain old X-Y plane of a desktop to the next dimension, that is, the third dimension.</p>

That seems to be the word from Sun (JAVA), which this afternoon dismissed speculation that <a href="http://www.businessweek.com/the_thread/techbeat/archives/2009/04/the_return_of_s.html">McNealy will replace CEO Jonathan Schwartz</a> in the aftermath of the deal&#8217;s collapse. &#8220;As a policy Sun does not comment on rumors or speculation,&#8221; the company said in a terse statement. &#8220;What we can say is that Sun is committed to its leadership team, growth strategy and building value for its shareholders.&#8221;</p>
<p>Whether that is a true vote of confidence remains to be seen. Certainly, Yahoo (YHOO) made similar remarks about Jerry Yang during its ill-starred negotiations with Microsoft (MSFT), and we all know how that worked out for him&#8230;</p>

<p>When Sun Microsystems (JAVA) Gadfly-in-Chief Scott McNealy made his infamous statement about online privacy in 1999, there was a horrified hubbub at the time that he had the audacity to say such a thing.</p>
<p>You know, that he actually uttered such a terrible thing as the truth.</p>
<p>What a shock then that everyone is now in yet another tizzy about Facebook changes to its Terms of Service, which pretty much state the obvious again by noting that Facebook archives info you posted, even if you quit the service.</p>
<p>As in, you probably can&#8217;t delete it.</p>
<p>No, you can&#8217;t&#8211;because you shared it, whether it be a photo, an email, a Wall post, whatever, <em>already</em>.</p>
<p>Because the fact of the matter is&#8211;since the moment the first caveman sent the first email to another Neanderthal&#8211;there has never been true online privacy for anyone who has chosen to participate in this highly <em>interactive</em> medium.</p>
<p>Here&#8217;s the key definition of interactive: &#8220;mutually or reciprocally active.&#8221;</p>
<p>That means once you send something to others, it is out there in cyberspace forever, never ever to return.</p>
<p>And that goes double on social-networking sites, where&#8211;let&#8217;s be honest&#8211;people egregiously overshare and then get all righteous when it is explained to them that sharing means, um, <em>sharing</em>.</p>
<p>As in: You cannot take it back, if you have shared with 476 of your closest &#8220;friends,&#8221; your bikini shots from Cabo.</p>
<p>Now, BoomTown has learned to live with some very unfortunate haircut choices preserved forever online and does not often agree with Facebook founder Mark Zuckerberg (I and everyone else <a href="http://kara.allthingsd.com/20071206/mark-sorry-zuckerbergs-beacon-memo-boomtown-decodes-it-so-you-don’t-have-to/">slapped him silly on the Beacon debacle until he gave in</a>, for example).</p>
<p>But he is technically right on this, even if Facebook could have done a much better job communicating the changes it made to its ToS, especially since ToS controversies are the Bermuda Triangle of the online arena.</p>
<p>This lack of clarity has always a major Facebook weakness, but it was the same for AOL&#8211;now owned by Time Warner (TWX)&#8211;back in the day when it was raising privacy red flags all the time.</p>
<p>But that does not make Facebook wrong, as <a href="http://blog.facebook.com/blog.php?post=54434097130">Zuckerberg finally said clearly in a post on Facebook</a>:</p>
<blockquote><p>People want full ownership and control of their information so they can turn off access to it at any time. At the same time, people also want to be able to bring the information others have shared with them—like email addresses, phone numbers, photos and so on—to other services and grant those services access to those people&#8217;s information. These two positions are at odds with each other. There is no system today that enables me to share my email address with you and then simultaneously lets me control who you share it with and also lets you control what services you share it with.&#8221;</p></blockquote>
<p>Zuckerberg then notes that users are just going to have to trust services like Facebook with their data, which is up to the individual to decide before posting whatever online.</p>
<p>And, if regrets come later? Well, try this quote from the great playwright Arthur Miller: &#8220;Maybe all one can do is hope to end up with the right regrets.&#8221;</p>

<p>Since BoomTown did <a href="http://kara.allthingsd.com/20071025/day-100/">an obsessive countdown</a> after Yahoo CEO Jerry Yang last year unwisely promised a 100-day, top-to-bottom look at the company, with &#8220;no sacred cows&#8221; spared (as it turned out, they <em>all</em> were), I decided that&#8211;after the month-mark had passed since Microsoft (MSFT) made its unsolicited bid for Yahoo (YHOO)&#8211;it was time for a count-up!</p>
<p>Thus, Day 32 (we&#8217;re counting from Friday, Feb. 1, when the offer was made public)!</p>
<p>And, frankly, with the added Leap Day this year to add to Yahoo&#8217;s agony, this battle is getting about as exciting as Yang&#8217;s 100-day slog&#8211;with nothing really page-turning on the horizon since Yahoo&#8217;s board kicked Microsoft&#8217;s $31-per-share offer to the curb several weeks ago.</p>
<p>Now, of course, Microsoft is returning the favor by loudly prepping a proxy fight and trotting out Silicon Valley companies like TellMe to report that a <a href="http://news.wired.com/dynamic/stories/T/TELLME_MICROSOFT?SITE=WIRE&#038;SECTION=HOME&#038;TEMPLATE=DEFAULT&#038;CTIME=2008-03-01-04-47-38">Microsoft takeover is just hunky-dory</a>.</p>
<p>&#8220;We are pretty much doing everything we were doing before&#8211;just a lot more of it,&#8221; said TellMe head Mike McCue to the Associated Press, with the cheeriness of someone with acute Stockholm syndrome and $800 million in Microsoft money.</p>
<p>And if happy, shiny, Windows-cash-gorged tech people don&#8217;t impress, according to several sources close to Microsoft, perhaps a little fear factor will work better.</p>
<p>Said these sources, there will be &#8220;three to four big-name CEOs&#8221; on its list of new board members that Microsoft must nominate in the next two weeks for its slate of directors to replace Yahoo&#8217;s current board.</p>
<p>BoomTown recently reported that the <a href="http://kara.allthingsd.com/20080222/microsoft-fishes-in-silicon-valley-for-new-yahoo-board-members/">software giant was sniffing around for prospects in Silicon Valley</a>.</p>
<p>But, sorry to say, I still cannot figure out what CEOs these are, despite a lot of effort to find out.</p>
<p>So, I started trying to figure it out myself, focusing on tech and Web execs, who are the obvious choices.</p>
<p>Nonetheless, after going over a long list of possible execs, none of the ones I considered seems likely to turn on Yahoo.</p>
<p>Intel? No, CEO Paul Otellini is on the board of Google.</p>
<p>eBay? No, that&#8217;s too big a move for the new CEO John Donahoe.</p>
<p>Sun? No, after Scott McNealy&#8217;s funny diatribes against Microsoft for so long, CEO Jonathan Schwartz simply cannot.</p>
<p>Dell? No, CEO and Founder Michael Dell has his hands full.</p>
<p>Amazon? CEO and Founder Jeff Bezos is sassy and lives up near Microsoft, but it would be a real slap at another Web icon like Yang.</p>
<p>WPP Group&#8217;s Sir Martin Sorrell? Well, to include an ad biggie would be a good move and Sorrell likes to make pointed remarks about Google, but not <em>that</em> sharp.</p>
<p>Frankly, other than non-tech companies, of which there are probably many choices who owe Microsoft in some way, I am officially out of guesses.</p>

<p>Well, of course, except for one Web 2.0 CEO, who has a big name and is in great&#8211;and I mean, great&#8211;debt to Microsoft.</p>
<p>In fact, $240 million worth of IOUs. In other words, Facebook CEO and Founder Mark Zuckerberg.</p>
<p>It would be ironic (Yahoo tried to buy Facebook a little more than a year ago), it would be poetic (only in Silicon Valley does the young eat its old) and it would be really fun to watch the fireworks (Facebook is no friend of Google&#8217;s).</p>
<p>Most of all, Zuckerberg on the board of Microsoft&#8217;s Yahoo would be Steve Ballmer&#8217;s ultimate SuperPoke at Yahoo.</p>

			<content:encoded><![CDATA[<p><img src='http://digitaldaily.allthingsd.com/files/2007/11/googlethreat.jpg' alt='googlethreat.jpg' />Much as Google would like to think otherwise, the U.S. Senate isn&#8217;t quite ready to rubber-stamp its <a href="http://digitaldaily.allthingsd.com/20070415/google-buys-doubleclick/">proposed acquisition of DoubleClick</a>. The top two members of the Senate Subcommittee on Antitrust, Competition Policy and Consumer Rights&#8211;Democrat Herb Kohl of Wisconsin and Republican Orrin Hatch of Utah&#8211;<a href="http://hatch.senate.gov/index.cfm?FuseAction=PressReleases.Detail&amp;PressRelease_id=1957"> sent a strongly worded joint letter to the Federal Trade Commission</a> urging it take a particularly hard look at the proposed acquisition.</p>
<p>&#8220;The implications of this [deal] for the Internet advertising market&#8211;and for the Internet as a whole&#8211;are profound and potentially far reaching,&#8221; <a href="http://hatch.senate.gov/index.cfm?FuseAction=DataPipes.ViewPDF&amp;Id=1957">the Senators wrote</a>. &#8220;A core part of Google&#8217;s business is placing contextual advertising&#8211;that is, text-based ads placed on third-party Web sites which are relevant to the content or to the likely reader of the Web site. Google has a dominant market position with respect to the placing of these contextual ads. DoubleClick has a leading market position in placing another form of Internet advertising&#8211;display advertising which also resides on third-party Web sites. Industry experts that we spoke to in the course of our inquiry raised serious concerns that combining these two companies&#8217; leading positions in these two forms of Internet advertising could cause significant harm to competition in the Internet advertising marketplace.&#8221;</p>
<p>The acquisition is potentially problematic for reasons of privacy as well. &#8220;DoubleClick collects an enormous quantity of information on individual Web users&#8217; preferences, and privacy advocates have expressed very serious concerns regarding the consequences of this data coming under the control of Google due to the fact that Google is the dominant Internet search engine and can also track individuals&#8217; search requests,&#8221; the senators note. &#8220;Therefore, we believe that this deal raises fundamental consumer privacy concerns worthy of serious scrutiny.&#8221;</p>
<p>The senators&#8217; arguments echo ones we&#8217;ve heard before&#8211;<a href="http://digitaldaily.allthingsd.com/20071114/doubleclick-eu/">from the European Union</a> and <a href="http://digitaldaily.allthingsd.com/20070416/google-doubleclick-antitrust/">Microsoft</a>,  and from <a href="http://www.epic.org/privacy/ftc/google/supp_060607.pdf">the Electronic Privacy Information Center, the Center for Digital Democracy and the U.S. Public Interest Research Group</a>. Though, as Danny Sullivan notes over at Search Engine Land,  <a href="http://searchengineland.com/071120-100056.php">they&#8217;re a tad bit more hysterical</a>.  Certainly, <a href="http://digitaldaily.allthingsd.com/20070518/microsoft-aquantive/">Microsoft&#8217;s $6 billion purchase of digital-ad firm aQuantive</a> suggests the barriers to entry in the Internet advertising marketplace aren&#8217;t more than knee high. And as for privacy, well, Sun chairman Scott McNealy once said: &#8220;You have no privacy, get over it.&#8221;</p>

Over the years it has amassed a staggering amount of user data&#8211;search queries, email records, social networks, purchase histories and the like.</p>
<p>And now it&#8217;s adding voice data. Or rather, more voice data than what it&#8217;s already collecting with Google 411. This morning, Google announced its plans to buy <a href="http://www.nytimes.com/2007/03/15/technology/15pogue.html?ex=1331611200&amp;en=4df47d0c8f62356d&amp;ei=5090&amp;partner=rssuserland&amp;emc=rss">GrandCentral Communications</a>, making the universal phone service its 12th purchase in six months. No terms were disclosed; though <a href="http://gigaom.com/2007/07/02/grandcentral-pulls-into-google/">GrandCentral reportedly fetched a bit north of $50 million.</a></p>
<p>&#8220;GrandCentral offers many features that complement the phone services you already use. If you have multiple phone numbers (e.g., home, work, cell), you get one phone number that you can set to ring all, some, or none of your phones, based on who&#8217;s calling,&#8221; <a href="http://googleblog.blogspot.com/2007/07/all-aboard.html">Google product manager Wesley Chan wrote in the Google Blog</a>. &#8220;This way, your phone number is tied to you, and not your location or job. The service also gives you one central voice mailbox. You can listen to your voice mails online or from any phone, forward them to anybody, add the caller to your address book, block a caller as spam, and a lot more. You can even listen in on voice mail messages from your phone while they are being recorded, or switch a call from your cellphone to your desk phone and back again. All in all, you&#8217;ll have a lot more control over your phones.&#8221;</p>
<p>And Google will have a lot more control over your voice data, which it will presumably <a href="http://radar.oreilly.com/archives/2007/04/why_google_is_o.html">harvest for future use in voice search applications,</a> something it&#8217;s already doing with Google 411. From Google’s 411 Privacy Policy: &#8220;<a href="http://labs.google.com/goog411/privacy.html">We also collect and store a copy of the voice commands you make to the service, so we can audit, evaluate and improve the voice-recognition capabilities of the service.</a>&#8220;</p>
<p>What was it Sun Microsystems Chairman Scott McNealy once said? <a href="http://www.wired.com/politics/law/news/1999/01/17538">&#8220;You have zero privacy anyway. Get over it.&#8221;</a></p>
