<p>TiVo’s (TIVO) complaint seeks both damages for past infringement and a permanent injunction&#8211;similar to the one it won against satellite provider Dish Network (DISH)&#8211;that would force AT&#038;T (T) and Verizon (VZ) to shut down their DVR services.</p>
<p>&#8220;Attempts were made to reach a commercial arrangement,&#8221; TiVo CEO Tom Rogers said during an earnings call today. &#8220;They were not reached. We believe we are being caused irreparable harm and that harm increases everyday this doesn’t cease. We have found ourselves in a similar situation with AT&#038;T and Verizon. We need to stop their continued unauthorized use of our intellectual property.&#8221;</p>
<p>And, God willing, corral them into that commercial arrangement to which Rogers refers. After all, the company lost 146,000 subscribers in its second quarter. It desperately needs to do something to win new ones and lower its churn.</p>

<p>Here&#8217;s an interview I did with <a href="http://d6.allthingsd.com/20080529/rogers/">TiVo President and CEO Tom Rogers</a> about the iconic but often-struggling pioneer and leader in the digital video recorder market.</p>
<p>The video of the interview is in four parts, all of which I will post this week.</p>
<p>In this first video, Rogers talks about why he came to TiVo (TIVO), the need to bring the company closer to the media industry and how being a DVR alone is not enough, battling the image of &#8220;content thief,&#8221; finding new ways to get users to watch commercial messages and making a business by selling networks key data about consumer television-watching behavior.</p>

<p>While Microsoft&#8217;s (MSFT) CEO Steve Ballmer and Yahoo&#8217;s (YHOO) CEO Jerry Yang hemmed and hawed about what had happened in their disastrous takeover battle that ended not with a bang, but a whimper, everyone else who appeared onstage at the sixth <a href="http://d6.allthingsd.com"><strong>D: All Things Digital</strong></a> conference last week was a bit more definitive about what should occur now:</p>

<p>Get it done.</p>
<p>From Thomson Reuters&#8217; (TRI) Tom Glocer to IAC&#8217;s (IACI) Barry Diller to TiVo&#8217;s (TIVO) Tom Rogers to Rupert Murdoch of News Corp. (NWS) (who simply said: &#8220;I&#8217;d get on with it.&#8221;), it seemed obvious to one and all that the only way either had a prayer of catching up with online search leader Google (GOOG) was to join forces.</p>
<p>It seems, according to many sources, that the pair are now in serious talks again, which&#8211;if they are smart&#8211;will come to some resolution, yes or no, within the next week. (You&#8217;ll get first wind of what&#8217;s what, as soon as much-frustrated bankers begin their leaking to major news outlets.)</p>
<p>Whatever the case, I dearly hope these discussions are not bogged down as they have been before.</p>
<p>Not in the bits and pieces niggling of some complex partial deal to buy search and spin of this and that here and there in a configuration sure to confuse everyone.</p>
<p>And not continuing with the endless roundelay of price negotiations that seems to have needlessly taken focus off the ball&#8211;which is to create a competitive alternative to the incessant brainiacs of Google (and if you want any more proof of that, see this <a href="http://www.nytimes.com/2008/06/02/technology/02google.html">New York Times piece today about the search giant&#8217;s data-crunching abilities</a>).</p>
<p>It seems $33 to $34 a share will still wrap the whole thing up and, if Microsoft was serious about its intentions to buy Yahoo when it first made its foray in February, that seems doable.</p>
<p>Because, if Ballmer is serious about his contention, which he made fervently onstage at <strong>D6</strong>, that the software giant keeps &#8220;coming and coming and coming,&#8221; it simply cannot make that attack from a piddling 9% market share in the online search business.</p>

<p>One of the most interesting takeaways I had from last week&#8217;s interview <a href="http://d6.allthingsd.com/20080527/gates_ballmer/">Walt Mossberg and I did with him and Chairman Bill Gates</a> (who seemed about as underwhelmed by a Yahoo deal as possible without slumping over asleep) was the early focus at the company on fiscal conservatism.</p>
<p>Baked into its DNA, as it turns out, is a fear of bankruptcy even.</p>
<p>While that was funny to hear about&#8211;complete with worried financial calculations on sheets of yellow paper stuffed in couches early on&#8211;it seems to continue to this day, despite Microsoft&#8217;s huge treasure chest of cash.</p>
<p>But Ballmer should slough off that tendency, as Microsoft can afford all of Yahoo and it should if it wants to make the boldest case possible that it will compete with Google.</p>
<p>As for Yahoo, both <a href="http://d6.allthingsd.com/20080528/yang_decker/">Yang and President Sue Decker</a> are to be lauded for showing up to answer Walt&#8217;s questions (and one by me via remote video about leadership, which neither actually did answer) about the company and its future.</p>
<p>Their sincerity and love of Yahoo and its products and people was clear and even touching, making it clear that companies are a true reflection of its leaders.</p>

<p>But, while making good points about the he-said-she-said nature of the past Microsoft talks, the pair still could not adequately and passionately explain what Yahoo <em>is</em> exactly, which everyone I spoke to in the halls was surprised and even disappointed by.</p>
<p>Moreover, their weariness for the next phase of tumult that will come if Yahoo remains independent was apparent in both their body language and low energy levels, especially when compared to others onstage like Murdoch, Amazon&#8217;s Jeff Bezos and, of course, the frenetic Ballmer.</p>
<p>Yang and Decker need big-time help and they need it now, help that cannot come from their own dwindling energies and that of their much-beleaguered troops.</p>
<p>Still, they also deserve credit for this very funny spoof video of advice they have been getting.</p>
<p>I especially like the turn by famed investor Warren Buffett best, with his &#8220;buy low, sell high&#8221; tip.</p>
<p>But I would fiddle with that to change it a little bit for Yahoo today: Just sell high enough.</p>

<p>Tom Rogers, a well-rounded media executive, has had his work cut out for him at TiVo (TIVO), the iconic but often-struggling pioneer and leader in the digital video-recorder market. Before coming to TiVo, Mr. Rogers was chairman and CEO of Primedia, which publishes 200 magazines, operates more than 400 Web sites and runs a wide range of television and video businesses. Previous to that, he was president of NBC Cable and executive vice president at NBC, as well as its chief strategist. While there, Mr. Rogers helped found the CNBC business cable channel and established the NBC/Microsoft cable channel and Internet joint venture, MSNBC. He also worked in politics, as senior counsel to the U.S. House of Representatives’ Telecommunications, Consumer Protection and Finance Subcommittee, and has previously worked as a Wall Street lawyer. </p>
<ul>
<li>Tom Rogers&#8217;s interview is prefaced by a video introduction clip from &#8220;The Simpsons.&#8221; In it, Keith Olbermann accuses Marge Simpson of being a content thief for using her TiVo to watch TV without commercials.</li>
<li> Kara welcomes Rogers to the stage. She recalls being at the TiVo pitch meeting &#8220;with a bunch of dumb dot-com guys,&#8221; notes that she felt it was a huge idea at the time but hasn&#8217;t proven an easy business for the company.

<li>Rogers begins by recalling his time at NBC and how his last act at the company was to make it an investor in TiVo.</li>
<li>What was TiVo when you arrived? Rogers says there was a view that it was a great device with a lot of potential. I looked at that as a student of the broadcast and cable industries, he says, and thought that we couldn&#8217;t succeed as an island apart from those industries. We had to work with them, even if TiVo was initially viewed as a means for consumers to take power back from the TV industry. We had to weave TiVo into those industries. </li>
<li>Kara insists that the major concept behind TiVo is really skipping commercials. &#8220;I can pause TV and go to the bathroom and skip the commercials when I come back.&#8221;</li>
<li>Rogers, it seems, would prefer to refer to that as &#8220;giving consumers control of their TV experience,&#8221; rather that what it really is. </li>
<li>Kara circles back: &#8220;How do you get rid of this image of TiVo as a content thief?&#8221; </li>
</ul>

<li>Rogers finally answers: &#8220;We went to the TV industry and told them that it was &#8216;game over&#8217; in terms of people watching commercials. We told them that there was one thing we know about our users: They fast-forward through ads. So what can we do?&#8221; The answer, Rogers says, is the creation of a new ad model that addresses this. We conceived of a number of solutions for this&#8211;ads that appear while users fast-forward, others that appear on the device&#8217;s save menu.</li>
<li>Kara presses Rogers again: &#8220;I don&#8217;t think I&#8217;ve <em>ever</em> watched an ad on my TiVo. &#8230; Ever.&#8221;</li>
<li>Rogers dodges a bit, noting that Kara&#8217;s just one user. He stresses that we need to get away from the Nielsen notion that whoever watches a show also watches the ads: &#8220;We&#8217;ve come up with a measurement solution that allows us to tell exactly how many people are watching ads and for how long.&#8221;</li>
<li>And what you discovered was that &#8230;. nobody watches ads? Kara asks.</li>
<li>No, they do, Rogers counters. Clearly, he thinks the Nielsen model is and always was a bunch of bollocks. He again stresses the need for accountability in advertising metrics. TiVo, he says, can offer that.</li>
<li>So what can you actually tell advertisers about their ads? asks Kara. Rogers says they can tell them what works and what doesn&#8217;t work, what shows ads performed the best in and the ones in which they performed the worst.</li>

<li>So, Kara interjects, what TiVo is really trying to do is to tell the TV industry: Hey, we&#8217;re disrupting your industry. Now, can we sell you some data?</li>
<li>Rogers notes that a great deal of the content recorded to TiVo is broadcast programming. What&#8217;s interesting, he notes, is that the highest-rated commercials of the week don&#8217;t often appear in the most-watched programs. That&#8217;s where TiVo comes in. It can determine what ads work, where they work, and when.</li>
<li>Rogers talks now about user engagement and interactive advertising. We&#8217;ve heard people touting interactive advertising for years, and it&#8217;s always failed. Why? Because people don&#8217;t want to interact with ads while they&#8217;re watching their TV programs. You can, however, engage them in advertising interactions during &#8220;pause,&#8221; he says. </li>
<li>Conversation turns to IP suits and TiVo&#8217;s recent litigation against EchoStar. Rogers rehashes the whole thing for those of you just joining us &#8230; He stresses that the injunctive relief the court has granted TiVo is <em>very</em> far-reaching. So does that mean TiVo&#8217;s going to sue more people? Kara asks. Likely, though clearly Rogers isn&#8217;t going to admit that. </li>
<li>What about your relationship with the cable industry? Rogers says TiVo has adopted a &#8220;join &#8216;em&#8221; strategy here. He would prefer to provide the industry with its software, rather than hardware. Much easier for TiVo and the cable industry to implement. Compares the consumer experience to that of adding HBO. Just call your local cable company, say &#8220;Hey, I&#8217;d like TiVo instead of the DVR I currently have.&#8221;</li>
<li>What&#8217;s the role of the TiVo box today? Does it still have one? Kara wonders. Rogers says yes. It allows us to talk directly to the consumer. He describes TiVo&#8217;s evolution into a content retrieval mechanism&#8211;movies, TV, music, YouTube, etc. What works for the consumer is a one-box solution to media. We&#8217;ve been building that solution for years.</li>
<li>Who owns that box? asks Kara. No one yet, says Rogers. But we&#8217;re close to it.</li>
<li>But selling a consumer device is hard, notes Kara. Rogers concedes, but notes that the cable industry is looking for exactly the sort of solution he&#8217;s describing. Once someone provides it, they&#8217;ll embrace it and drive it forward.</li>
<li>Kara&#8217;s a little incredulous. Rogers notes that the stage is set for just this sort of shift, noting that at this very moment, Comcast is rolling out a TiVo initiative in New England that includes a jointly branded welcome screen.</li>
<li>How do you look at the broadcast industry these days, asks Kara. The broadcast industry has it within its power to avoid some very dark days, Rogers replies. Whether it will move quickly enough to avoid them remains to be seen. Rogers says the situation is identical to the one that print faced years ago and clearly did not bother to avoid. He seems to think that the broadcast industry is a bit more on the ball than print. Not sure whether it will avoid those dark days, though.</li>
<li>Q&#038;A: Issue of cable cards? There&#8217;s no reason in the world that cable companies can&#8217;t send it to you and have you insert it, Rogers says. There&#8217;s lots of friction there. But cable companies, he says, are instituting a much better customer experience.</li>
<li>More options for viewing TV content, such as the PC? &#8220;Clearly, there are more ways to watch TV,&#8221; Rogers says. &#8220;But I have to tell you, when you see the number of flat-screens flying out of retailers, the TV set and its primary position in the home isn&#8217;t going anywhere in the future.&#8221;</li>
<li>When is TiVo going to launch in U.K.? I&#8217;m hopeful that we can soon, Rogers says.</li>
<li>What vendors will deliver to TiVo? Rogers says there isn&#8217;t a video packager that isn&#8217;t talking to TiVo. As for the major players? I don&#8217;t have a view of who&#8217;s going to dominate, Rogers adds. It&#8217;s too early. On-demand model is all that can be forecast for the time being.</li>
<p><il>What about ease of use? TiVo wireless adapters are good, Rogers responds, acknowledging there&#8217;s nevertheless a multi-set issue: You still need a second box. But we&#8217;re working on a whole-home model, he adds.</li>

<p>[This essay to attendees of the sixth <a href="http://d6.allthingsd.com"><strong>D: All Things Digital</strong></a> conference is from the program book and is written by Kara Swisher and Walt Mossberg; <strong>D6</strong> starts tomorrow night.]</p>
<p>As it turns out, creating a start-up is kind of hard.</p>
<p>And, trying to be entrepreneurial 24/7 is definitely challenging.</p>
<p>And, attempting to drastically shift your paradigm and move into new arenas with even newer rules and lots of uncertainty? Let’s just say, we are very tired these days.</p>
<p>Still, it is safe to say that we are also flatly exhilarated, riveted by our work as never before and pretty much hooked.</p>
<p>But did we mention the really tired part?</p>
<p><span id="more-5228"></span></p>
<p>In all seriousness, it has been just over a year since we and our hardy little team launched <strong>AllThingsD.com</strong>, our earnest effort to take the <strong>D</strong> conference we created six years ago and give it another life on the Web.</p>
<p>When we were designing <strong>D</strong> we had one idea in mind&#8211;to create the kind of conference we wished we could attend. It would have the best speakers, it would cover serious topics, it would treat its audience with respect and intelligence and it would offer content that was valuable and bracingly true. </p>
<p>As to pointless and insufferable panel creep and PowerPoint double-talk&#8211;we would banish them.</p>
<p>So in creating <strong>AllThingsD.com</strong>, our goal was to take the spirit of the <strong>D: All Things Digital</strong> conference itself, the amazing community and connections, the no-holds-barred style, the rich content and great writing, and add a key ingredient&#8211;a staunch commitment to accuracy, ethics, standards and a notion that online readers want quality tech news and analysis in a transparent and honest way. </p>
<p>We hope you think we are well on our way to achieving that. And we are excited by all the possibilities ahead for the site as we move into our second year of trying to take all the many virtues of mainstream media and marry them with the excitement and energy of the blogosphere.</p>
<p>To say we think a lot about change these days is an understatement.</p>
<p>And, in a way, although we tend to shy away from themes at <strong>D</strong>, the ever faster pace of change in the tech and media world has turned out to be one of the hallmarks of the speakers we have invited to share the stage with us, and their insights with you.</p>
<p>Beginning with Microsoft’s (MSFT) Bill Gates and Steve Ballmer, we could not have a better pair to talk about forcing dramatic change, even when running one of the most successful and enduring tech companies in the world. </p>
<p>From its bold and quite unsolicited offer to buy Yahoo (YHOO) this year, to its efforts to transform its core software business, to the symbolic passing of the torch as Mr. Gates moves away from his day-to-day role at the company in July, Microsoft’s leaders have sought out change aggressively.</p>
<p>So, too, have our other speakers. </p>
<p>Michael Dell is trying to reinvent Dell (DELL) again, even though it was his company that reinvented the computer business. Howard Stringer has been facing the same issues at Sony (SNE) in consumer electronics, while Time Warner’s (TWX) new CEO Jeff Bewkes has been handed a media giant he must shift even more dramatically into the digital age.</p>
<p>Amazon’s (AMZN) Jeff Bezos, one of the Internet’s true visionaries, is at it again this year, trying to make the dream of an e-book a mainstream reality.</p>
<p>And Barry Diller of IAC (IACI)? As usual, he has been right in the middle of a brawl about what direction the interactive company should take.</p>
<p>Mark Zuckerberg of Facebook has, of course, been the youthful face of change, bursting on the scene with his upstart social-networking site and upending all the apple carts in Silicon Valley as the leader of the Web 2.0 army. In this fight, he has recently been joined by former Google (GOOG) exec Sheryl Sandberg, who knows a thing or two about disruption. </p>
<p>Tom Glocer of Thomson Reuters (TRI) must take a global information powerhouse and make it even more digital, as challengers pop up everywhere. And Tom Rogers of TiVo (TIVO) is seeking to take the groundbreaking concepts the digital video-recording company pioneered and make a lasting business out of it.</p>
<p>Bobby Kotick of Activision (ATVI) has merged his offline game company, whose “Guitar Hero” is one of the mightiest brands in the sector, with one of the most powerful online multi-player games makers.</p>
<p>And Lowell McAdam of Verizon (VZ) has been trying to react to the sweeping shifts in how wireless technologies are delivered to consumers, as true change finally comes to the cellphone industry.</p>
<p>Nathan Myhrvold, former research guru at Microsoft, has always been about figuring out what’s behind the next corner, while FCC Chairman Kevin Martin has to puzzle over what role the government has to play in this fast-moving space.</p>
<p>And Melinda Gates is changing the world, which is a pretty big job.</p>
<p>And, of all the many luminaries we have on stage at <strong>D6</strong>, probably no one has had a more eventful year than Yahoo co-founder and CEO Jerry Yang. From suddenly taking over the reins at the company he launched while a student at Stanford University, to having a tough year of trying to revive Yahoo, to coping with an unsolicited takeover bid from Microsoft, Mr. Yang has had the ride of his life. He will appear with Yahoo president Sue Decker, who has become the No. 2 exec at the company, and has been charged with carrying out Mr. Yang’s vision amid much turmoil.</p>
<p>Finally, the long and storied career of News Corp.’s (NWS) Rupert Murdoch has been all about constant transformation. It is also not an understatement to say that the new owner of Dow Jones (and also <strong>AllThingsD.com</strong> and this conference too) is probably one of the most game-changing business leaders around.</p>
<p>And we hope to be equally disruptive in quizzing him and all the speakers about what it all means. Even the demos we picked will display the same forward-leaning and game-changing ideas all our speakers represent.</p>
<p>So, hold onto your seats for <strong>D6</strong>, as it’s going to be a bouncy ride.</p>
<p>And, as it turns out after our first full year as Web entrepreneurs, we would not have it any other way.</p>
<p>Except, of course, it would have been nice to get a little more sleep.</p>

<p>The annual gathering of tech and media luminaries was created and is run by my amazing partner <a href="http://walt.allthingsd.com">Walt Mossberg</a> and me (see us here at <strong>D5</strong>) and will take place May 27 to 29.</p>
<p>The conference, as we describe it on our Web site, is &#8220;unlike any other executive conference.&#8221; What we mean by that is that we try to determine the next direction of the digital revolution via unscripted and informal, but pointed, conversations about the impact of digital technology with industry leaders.</p>
<p>In other words, Walt and I needling at the major players of the digital sector, until they give up the good stuff.</p>
<p>The other digital and media leaders coming? That would be: Mark Zuckerberg and Sheryl Sandberg of Facebook; Michael Dell of Dell Computer (DELL); IAC&#8217;s (IACI) Barry Diller; Amazon&#8217;s (AMZN) Jeff Bezos; Howard Stringer of Sony (SNE); and TiVo&#8217;s (TIVO) Tom Rogers.</p>
<p>Also: Tom Glocer of Thomson Reuters (TRI); Melinda Gates of the Gates Foundation; FCC Chairman Kevin Martin; Lowell McAdam of Verizon Wireless (VZ); Activision&#8217;s (ATVI) Robert Kotick; and former Microsoft tech guru and Nathan Myhrvold of Intellectual Ventures.</p>
<p>To say our timing is impeccably planned would be undeserved&#8211;we had no idea so much news related to all these companies and their leaders would break out, from the tough economy to takeover battles to court face-offs to mergers to trying to create a whole new way of reading.</p>
<p>Also, there will be some&#8211;as yet under wraps&#8211;amazing demos onstage too.</p>
<p>While the analog conference has been sold out for many months, the action will be on the <a href="http://allthingsd.com"><strong>AllThingsD.com</strong></a> site throughout the conference with round-the-clock live blogging by <a href="http://digitaldaily.allthingsd.com">Digital Daily&#8217;s John Paczkowski</a>, as well as video highlights from stage.</p>
<p>In addition, we&#8217;ll be pointing all over the Web to important tech and media news that breaks at <strong>D6</strong>.</p>
<p>And we will also stream the entire conference in the weeks after the conference takes place, so <strong>ATD</strong>&#8216;s audience can experience the whole thing, even if they cannot all attend.</p>

<p>Walt and I are very excited for <strong>D6</strong>, even after last year, when we brought together industry legends Bill Gates and Apple&#8217;s Steve Jobs, for an historic joint interview.</p>
<p>At the time, Walt and I joked that we would not be able to top that amazing event (the video of the entire interview is below).</p>
<p>That interview was nearly unbeatable, but we also think that with the top-level interviewees we have assembled for <strong>D6</strong>, that it is <em>game on</em>.</p>

			<content:encoded><![CDATA[<p>Oh, it <em>has</em> been kind of easy to write off the digital video recording icon, hasn&#8217;t it, as cute as bouncy little TiVo guy is and as much as you&#8217;ve gotten to secretly like that &#8220;doink&#8221; noise it makes?</p>

<p>But, as it has turned out, <a href="http://digitaldaily.allthingsd.com/20071210/tivo-time-shifts-company-deathwatch/">TiVo has been on a bit of a tear lately for a has-been,</a> with a series of new partnerships and innovations that have created a stir around the long-struggling company.</p>
<p>So, BoomTown thought it was time for a video check-in with CEO Tom Rogers, which took place yesterday near TiVo&#8217;s Alviso, Calif., HQ:</p>

<p>Of course, a stir is exactly the thing the very concept of time-shifting of television caused when TiVo was created in the first Internet growth spurt in the late 1990s.</p>
<p>With its powerful premise, the company was seen as a danger to network television with its fast-forwarding ability that threatened the watching of commercials.</p>
<p>It was an image TiVo even relished, including once releasing television commercials where network executives got defenestrated.</p>
<p>But this kind of chin-leading behavior&#8211;coupled with the difficulty of being a standalone DVR company and having to sell its boxes commercially&#8211;proved a daunting challenge for TiVo, which struggled at making a dent in the consumer market, despite a name that soon became a verb.</p>
<p>But more recently, under former televison exec Rogers&#8217; leadership, TiVo has been slowly marching forward by striking a series of deals strengthening Web, photo and music-serving capabilities of its service, licensing of its software to cable giants and offering important audience behavioral data to once-hostile television networks.</p>
<p>His goal for the new TiVo? To be a content and data hub of the television-watching experience in whatever way it can.</p>
<p>Also a plus: TiVo has recently won a potentially lucrative patent lawsuit over the use of its technology.</p>
<p>As a result, its losses are down and its stock is up to yearly highs of late.</p>
<p>What&#8217;s next is anybody&#8217;s guess, but it will surely be must-see (on our own schedule, of course) TV.</p>

After <a href="http://www.engadget.com/2005/02/08/tivo-deathwatch/">years of struggle</a>, the digital video recorder pioneer<a href="http://www.nytimes.com/2007/12/10/technology/10tivo.html"> is back on its feet again</a> with some new partnerships, old partnerships that are finally coming to fruition and a new business.</p>
<p>In the past few weeks, TiVo has signed deals with online photo-sharing services Photobucket and Picasa and the music-and-video network Music Choice. It&#8217;s begun fulfilling its contracts with cable outfits Comcast and Cox. It&#8217;s entered the media-services market, partnering with NBC Universal to provide second-by-second ratings of programs and commercials, based on the TV-watching habits of subscribers to the company&#8217;s digital video recorders.</p>
<p>“We are very much a technology company,” TiVo CEO Tom Rogers told the New York Times. “At the same time, in the last year and a half, we’ve substantially moved in the direction of becoming a media company.” And that&#8217;s proven a prudent move for TiVo, where things are beginning to look up. <a href="http://finance.google.com/finance?q=NASDAQ%3ATIVO">Shares of the company</a> hit a 52-week high of $8.53 Friday. Today they were trading at around $8.35.</p>
<p>Too bad for TiVo that days of the standalone digital video recorder are reportedly numbered.  <a href="http://www.yankeegroup.com/pressReleaseDetail.do?actionType=getDetailPressRelease&amp;oldId=5">According to Yankee Group</a>, the standalone DVR product category will cease to exist by 2010, “and its dissolution will result in the end of TiVo as we know it.&#8221;</p>
