<p>But, once again the rule has been broken, this time by Spanish tennis player David Ferrer, tweeting his affection for Samsung&#8217;s Galaxy S4, and doing so from an iPhone. </p>
<p><a href="http://appleinsider.com/articles/13/04/30/samsung-celebrity-tweets-out-support-for-galaxy-s4-from-his-iphone">According to AppleInsider</a>, the tweet was quickly deleted and replaced with one not sent from an iPhone.</p>
<p>But, of course, the change came only after people noticed, <a href="https://twitter.com/jaimenovoa/status/329279163473199104/photo/1">saved a copy of the tweet</a> and began pointing out the obvious contradiction between stated opinion and the real world.</p>
<p>Ferrer is in good company with other celebs who have made similar moves, including singer Alicia Keys, who briefly continued to tweet from her iPhone after accepting a gig as creative director for BlackBerry.</p>

<p>It took five years, but the Funny Or Die comedy site finally reached five million Twitter followers. And, naturally, it&#8217;s marking the occasion with a video by its co-founder and frequent star, Will Ferrell.</p>
<p>In it, he makes fun of the site&#8217;s tweets and also fires an intern &#8212; pretty much par for the course. Along with the fandom on Twitter, Funny Or Die has two million Facebook &#8220;Likes&#8221; and 370,000 Tumblr followers.</p>

<p>Perhaps it is entirely no surprise that HBO&#8217;s Lena Dunham &#8212; whose frankly sexual cable television series &#8220;Girls&#8221; is a huge hit &#8212; has caused a wave of controversy with a new campaign video urging the reelection of President Barack Obama.</p>
<p>It&#8217;s titled &#8220;Your First Time,&#8221; and Dunham &#8212; in her typical ironically clever hipster tone &#8212; coyly talks about voting as if you were losing your virginity.</p>
<p>Says Dunham in the video: &#8220;My first time voting was amazing. It was this line in the sand &#8212; before, I was a girl, now I was a woman. I went to the polling station, I pulled back the curtain, I voted for Barack Obama.&#8221;</p>
<p>To be fair, this is <em>much</em> less racy than any five minutes of &#8220;Girls,&#8221; but you can see the problem for some.</p>
<p>Thus, since it was released via the Obama campaign, the edgy video has been decried by conservatives in no uncertain terms, such as this posting on Twitter from <a href="https://twitter.com/NolteNC/statuses/261610193899630592?tw_i=261610193899630592&#038;tw_e=details&#038;tw_p=tweetembed%20(nolte)">John Nolte, editor at large at Breitbart News</a>.</p>

<p>Oddly enough, the conservatives&#8217; most beloved President &#8212; Ronald Reagan &#8212; once made a pretty similar joke: &#8220;I know what it&#8217;s like to pull the Republican lever for the first time, because I used to be a Democrat myself, and I can tell you it only hurts for a minute and then it feels just great.&#8221;</p>
<p>Dunham, who is now tweeting from an international vacation, does not seem to care much what anyone thinks, as you can see from her <a href="https://twitter.com/lenadunham/status/261935476024414208">reaction tweet below</a>:</p>

<p>Yahoo said today in a regulatory filing that it had hired one of Google&#8217;s top sales execs, Henrique De Castro, as its COO.</p>
<p>Earlier today, I <a href="http://allthingsd.com/20121015/can-she-land-a-big-one-yahoos-mayer-about-to-hook-google-sales-exec-de-castro-for-top-ad-role/">had reported</a> that CEO Marissa Mayer had been close to nabbing the advertising exec, who has most recently been Google&#8217;s president of partners business solutions.</p>
<p>De Castro is getting a pile of money for taking the job, including a $600,000 yearly base salary and an annual bonus that could double that figure. In addition, the Silicon Valley Internet giant will give him $36 million in stock grants, including a one-time retention equity award of $18 million and $18 million in the form of performance-based stock options.</p>
<p>He is also getting $1 million in &#8220;make-whole&#8221; cash for forgoing compensation from Google and $20 million in stock to replace his shares at the search giant that will vest over four years. </p>
<p>That is a very big check, although Mayer garnered an even bigger one when she joined the company in July.</p>
<p>Yahoo&#8217;s regulatory statement on the De Castro hiring is embedded below in its entirety, so you can read about his new riches for yourself (unless Yahoo&#8217;s persnickety legal head tries to block it).</p>
<p>Said a Google spokesperson about the departure: &#8220;We&#8217;re grateful to Henrique for all of his contributions at Google and wish him all the best in his new role at Yahoo!&#8221;</p>
<p>Both Mayer and also former Yahoo CEO Scott Thompson have <a href="http://allthingsd.com/20120716/levinsohn-unlikely-to-stay-at-yahoo-as-mayer-begins-her-talent-search/">made previous overtures</a> to nab De Castro, who has held a number of high-level jobs for Google across the globe, including at DoubleClick, in display ads and with major partners.</p>
<p>While he had previously rebuffed those efforts, this time De Castro bit. </p>
<p>There were signs he might this past week, after De Castro canceled a major offsite for his employees, and several attendees who know him well said <a href="http://allthingsd.com/20121015/zero-gravity-for-all-at-google-zeitgeist-partner-conference/">he was not present at the company&#8217;s first night of its annual Zeitgeist event</a> for advertising and publishing clients. The suave De Castro is usually a more noticeable fixture at such gatherings.</p>
<p>This is Mayer&#8217;s first big hire at Yahoo, having added only lower-level or less well-known execs to her stable of talent since she was appointed. </p>
<p>She <a href="https://twitter.com/marissamayer/status/257958183476285440">touted the hire in a tweet</a>, although the news was long out the door, while also noting on Twitter it was her first full day at the office since <a href="http://allthingsd.com/20121001/october-surprise-yahoo-ceo-mayer-and-husband-have-baby-boy/">having her first baby</a> two weeks ago.</p>

<p>The hiring does create a potential issue in the sales arena, especially with current head of revenue Michael Barrett. De Castro and Barrett worked together at Google and multiple sources said the pair did not get along there.</p>
<p>It might not matter. While Barrett has publicly said he planned to stay at Yahoo under Mayer &#8212; he was <a href="http://allthingsd.com/20120618/exclusive-yahoo-hires-google-exec-barrett-as-chief-of-revenue-as-big-ad-changes-loom/">hired by interim CEO Ross Levinson this summer</a> before she arrived &#8212; many sources said he does not want to be at the company for the long term. </p>
<p>De Castro has a lot of work to do for the big payout he is getting and it will be a big challenge for him to turn around the troubled organization. </p>
<p>Along with declining growth, search market share, engagement and more, Yahoo also has had a management turnover issue of epic proportions. </p>
<p>De Castro will presumably be in charge of making it all better at Yahoo when he arrives sometime before the beginning of the year and is likely to focus on operations while Mayer zeroes in on products.</p>
<p>One area of trouble: While she has lavished attention on cultural issues and on the company&#8217;s tech troops, sources said most of the advertising and media leadership at Yahoo have had little interaction with Mayer since she arrived this summer.</p>
<p>Advertising, of course, is Yahoo&#8217;s biggest money maker.</p>
<p>The Portugal-born De Castro has a lot of experience here and is decidedly more of a charmer than Mayer.</p>
<p>More importantly, he is a very high-profile hire, as well as a colorful one. He speaks a menu of languages, dresses with a lot of style and is a worldwide traveler. I know him a little bit and find him to be smooth and confident, even if a little cagey.</p>
<p>Before Google, De Castro worked at Dell and also McKinsey.</p>
<p>All this makes him a perfect choice for Mayer, who is also a former Googler, since she has been considering purchasing a range of companies in the advertising tech space. The most likely candidate of late is <a href="http://allthingsd.com/20121011/mayer-to-unveil-new-company-goals-at-all-hands-today-but-could-talent-focus-signal-the-start-of-acquisitions/">PubMatic</a>, which has been in early talks with Yahoo about being acquired. </p>
<p>The Silicon Valley start-up would be a solid add to Yahoo&#8217;s ad platform offerings, especially if it wants to stay competitive with Google. PubMatic helps publishers effectively manage their display ad inventory, and competes with Google&#8217;s AdMeld. </p>
<p>(Ironically, Barrett ran that start-up, which he <a href="http://allthingsd.com/20110609/google-will-keep-washington-regulators-busy-with-400-million-admeld-deal/">sold to Google for $400 million</a> about a year ago.)</p>

<p>New York magazine just published what will doubtlessly be the first of many larger-scale profile pieces on new Yahoo CEO Marissa Mayer (Fortune&#8217;s at work on one, too). </p>
<p>Titled <a href="http://nymag.com/thecut/2012/10/marissa-mayer-yahoo-ceo.html">&#8220;Can Marissa Mayer Really Have It All?&#8221;</a> New York&#8217;s version is a very solid and fair effort that raises a lot of pertinent questions about the Silicon Valley Internet giant&#8217;s latest leader.</p>
<p>That, of course, includes pondering the high-profile issues around her coping with a newborn (<a href="http://allthingsd.com/20121001/october-surprise-yahoo-ceo-mayer-and-husband-have-baby-boy/"><em>really</em> new</a>) and work; her carefully crafted public glamour-geek-girl persona that is at odds with her sometimes more tetchy private one; Mayer&#8217;s mostly-up-and-then-down-at-the-end career at Google as a key exec; and the myriad challenges she faces in turning around the long-troubled Yahoo.</p>
<p>Writes Lisa Miller quite astutely: &#8220;This newest version of Marissa, the mom-geek-CEO, will surely test Mayer&#8217;s iterative powers, for she&#8217;s playing to a tougher crowd, one that won&#8217;t be placated by tweets, Manolos, and rapturous praise for pineapple malts.&#8221;</p>
<p>Indeed not, which is why sources said Mayer is likely to begin to make postpartum appearances back at Yahoo as early as this week. She delivered her first child with husband Zach Bogue, whom she dubbed &#8220;Big Baby Boy Bogue,&#8221; on Sept. 30. </p>
<p>Among the initiatives she has been working on up to and after her son&#8217;s birth, said numerous sources, is the redo of Yahoo&#8217;s powerful home page, a reorganization of top management duties, and an announcement about whether it will buy back shares or give a dividend from its recent multibillion-dollar sale of part of its lucrative stake in China&#8217;s Alibaba Group.</p>
<p>In addition, said sources, Mayer is also putting into place her new methodology of keeping track of employee performance and rewards. There is an all-hands meeting scheduled today, in fact, apparently to go over the system, which <a href="http://allthingsd.com/20120925/mayer-to-yahoos-at-not-so-radical-confab-personalization-mobile-rule-of-100-million-and-most-of-all-the-four-cs/">Mayer spoke about in her last all-hands meeting</a>.</p>
<p>The home page redo is also in the late-stage works for unveiling soon, said sources. Those who have seen it said it has a starker and simpler design ethos, and will stress user personalization, customization and more social elements. It will also have ample opportunity for third-party developers to offer a variety of services on it (maybe Mayer can save Zynga by copying a little bit from Facebook!).</p>
<p>The reorg will also be interesting. Mayer has made a number of top exec appointments, including adding a new CFO and head of HR. She will also be rejiggering other roles of existing management. </p>
<p>For example, expect tech and operations EVP <a href="http://pressroom.yahoo.net/pr/ycorp/david-dibble.aspx">David Dibble</a> &#8212; who got a <a href="http://allthingsd.com/20120614/its-time-for-an-internal-memo-dibble-takes-over-all-tech-at-yahoo/">mess of new responsibilities right before Mayer was appointed</a> &#8212; to have some of that dialed back.</p>
<p>The disposition of all $3.6 billion of Alibaba cash is perhaps the most immediate issue, especially for investors, who are largely hoping for a buyback of stock. Such a move will likely cause Yahoo shares to rise, as happened at AOL.</p>
<p>That would be nice, since Yahoo stock has stayed pretty flat since Mayer got to the company in July. (That compares, ironically, to a 31 percent rise at Google since she left.)</p>
<p>But Wall Street analysts and others have been making bullish calls on Yahoo recently, including CNBC&#8217;s screamy stock guru Jim Cramer of &#8220;Mad Money.&#8221;</p>
<p>Boosted by the growing value of its Asian assets &#8212; in China, as well as in Japan, which Yahoo is trying to sell &#8212; and also anticipating some kind of magic mojo from Mayer, price targets for Yahoo shares have been as high as $22.</p>
<p>That was from Goldman Sachs, which reinstated coverage of Yahoo with a &#8220;buy&#8221; rating recently. Analyst Heath Terry noted that &#8220;while user engagement continues to decline, the company lacks a mobile strategy and significant talent has left the company, Yahoo still has hundreds of millions of users, valuable Web properties, and the financial resources to fuel a potential turn around over time.&#8221;</p>
<p>Translated: Yahoo kinda stinks, but it still might be able to buy itself out of this mess with a $10.6 billion pile of dough from Asia.</p>
<p>All eyes will be on the actual business Yahoo operates itself in two weeks on Oct. 22, when the company <a href="http://pressroom.yahoo.net/pr/ycorp/239216.aspx?link_page_rss=239216">announces third-quarter results</a>. Sources said the quarter will come in as expected, but will still tell a story of lackluster growth in advertising, engagement and, well, every key part of its native offerings.</p>
<p>That said, Mayer is expected to be on the call &#8212; her first at Yahoo &#8212; to outline her grand vision in more detail, as a spokeswoman has noted.</p>
<p>That&#8217;s good, since shiny profiles of her can only do so much. It&#8217;ll be nice to finally hear her say something definitive in public about how she&#8217;s going to fix the company that has given the mediagenic exec even more press.</p>
<p>(And, let&#8217;s hope, without the tweets, Manolos and pineapple malts.)</p>

<p>The child is the couple&#8217;s first and it is not clear from the tweet whether he was delivered on September 30 or October 1. He is slightly early &#8212; Mayer <a href="http://postcards.blogs.fortune.cnn.com/2012/07/16/mayer-yahoo-ceo-pregnant/">had said that the child was due</a> October 7. </p>

<p>Mayer <a href="http://allthingsd.com/20120716/new-ceos-pregancy-not-an-issue-for-yahoo-board/">announced her pregnancy at the same time</a> it was unveiled that she would be taking over Yahoo in July. The former Google exec attracted some measure of discussion over her taking such a big job at the large and troubled company at such a delicate time.</p>
<p>That&#8217;s codswallop for a lot of reasons and probably moot for the highly functioning Mayer, who has said she plans to take a few weeks off. She is likely to bring her new son to work too. </p>
<p>It&#8217;s a new day, people, so get used to it.</p>
<p>And, once again, congratulations to the new family on beginning the best adventure of a lifetime.</p>

<p>All his drastic <a href="http://allthingsd.com/20120628/live-news-corp-explains-its-big-split/">corporate rejiggering</a> and continued <a href="http://allthingsd.com/20120403/news-corp-still-backing-james-murdoch/">phone-hacking controversies</a> do not seem to have stopped News Corp.&#8217;s Rupert Murdoch from continuing to tweet up a storm.</p>
<p>And by storm, I mean some pretty controversial Twitter tornadoes of late. It&#8217;s highly unusual for a sitting CEO, since many well-known people arrive on Twitter with a lot of noisy sparkle and then follow with hardly a whimper.</p>
<p>But Murdoch, who first <a href="http://allthingsd.com/20120102/rupe-on-twitter-damn-the-torpedoes-full-tweet-ahead/">appeared on the communications service in January</a>, remains very active and pot-stirring.</p>
<p>Previously, targets were <a href="http://allthingsd.com/20120114/pirates-rupert-murdoch-rails-about-obama-google-and-silicon-valley/">Google and President Barack Obama</a>, but Murdoch recently added more to his digital target practice.</p>
<p>On Saturday, July 1, particularly &#8212; he appears to go wild once every week or so, mostly on weekends &#8212; the media mogul took aim at Tom Cruise&#8217;s divorce and Scientology, as well as Republican presidential candidate Mitt Romney&#8217;s campaign performance and his favored punching bag, the New York Times, as you can see below:</p>

<p>The list of damages is long, but if you go down far enough, you&#8217;ll see that the storm also <a href="http://allthingsd.com/20120630/storm-knocks-out-amazons-power-taking-down-instagram-netflix-pinterest/">disrupted service at an Amazon data center</a> in Northern Virginia by hitting the cloud giant in a tender spot.</p>
<p>In a statement issued today, Amazon explained what happened. At a location where it operates more than 10 data centers &#8212; it didn&#8217;t say exactly how many &#8212; power was afffected at several after lightning strikes. But at only one of those data centers did redundant power not kick in the way it was supposed to.</p>
<p>The result, Amazon says, was that a &#8220;single digit&#8221; percentage of customers had their services disrupted.</p>
<p>But what an unlucky and select few. Among them were Netflix and Pinterest, both of which recovered shortly after the initial disruption.</p>
<p>Here&#8217;s Amazon&#8217;s full statement:</p>
<blockquote class="memo"><p>Severe thunderstorms caused us to lose primary and backup generator power to a portion of a single Availability Zone in our US-East Region Friday night. For perspective, in our US-East Region in Virginia, we have in excess of 10 datacenters. In the thunderstorm on Friday night, several of our datacenters had their utility power impacted, but in only one of them did the redundant power not operate correctly (which ended up impacting a single digit percentage of our Amazon EC2 instances in the US-East Region). We began restoring service to most of the impacted customers Friday night and the remainder were restored on Saturday.</p></blockquote>
<p>A less lucky member of that select few was Instagram, whose service was more severely disrupted well into Saturday.</p>
<p>Also mysterious is how Instagram, now in the process of being acquired by Facebook for $1 billion, is treating the outage. Tweets on its @instagramhelp and @instagram accounts on Twitter referring to the service disruption have been deleted. Below is a screen grab of one such tweet I saw Saturday. Who can blame Instagram for wanting to forget it ever happened? But really? We&#8217;ve asked Instagram to comment and will update this story if we hear back.</p>

<p>There is already a Tumblr created today, with all kinds of funny captions and graphics about the Affordable Care Act &#8212; which includes the requirement that most Americans have health insurance &#8212; called, <a href="http://whenscotusupheldobamacare.tumblr.com/">&#8220;When SCOTUS Upheld Obamacare.&#8221;</a></p>
<p>It entails a lot of interactive dancing and snapping of fingers, including by President Obama.</p>

<p>According to sources close to the situation, Flipboard co-founder and CEO Mike McCue has approached Twitter CEO Dick Costolo and co-founder Jack Dorsey about moving off the board of Twitter.</p>
<p>It is not clear when McCue &#8212; <a href="http://allthingsd.com/20101215/exclusive-twitter-raises-200-million-at-3-7-billion-valuation-adds-mccue-and-rosenblatt-to-board/">who became a director </a> of the San Francisco social communications company in late 2010 &#8212; will step down, but it could come soon.</p>
<p>The reason, sources said, is McCue&#8217;s growing feeling that the companies are on a product collision course, with a possible troubled or perhaps more attractive result.</p>
<p>In other words, Flipboard will either face increasing rivalry from Twitter or will end up as a possible acquisition target for it or other companies.</p>
<p>&#8220;How users consume and use Twitter is a key part of its future, and that is what Flipboard does well already,&#8221; said one person with knowledge of the situation. &#8220;There is going to be an inevitable crossroads for the two companies.&#8221;</p>
<p>Indeed, Twitter has bought several companies that help users read and <a href="http://allthingsd.com/20111208/twitter-redesigns-to-be-simpler-and-faster/">discover</a>, such as <a href="http://allthingsd.com/20120119/twitter-acquires-social-summary-tool-summify/">Summify</a>.</p>
<p>The goal has been to better make sense of the massive amount of data that the service produces daily; to that end, Twitter has <a href="http://allthingsd.com/20120501/twitter-discovery-update/ ">pushed to improve its user interface design</a> on a number of devices. </p>
<p><a href="http://allthingsd.com/20120507/exclusive-flipboard-ceo-mccue-likely-to-step-down-from-twitter-board-over-potential-future-conflicts-or-closer-cooperation/flipboard-twitter/" rel="attachment wp-att-204843"><img src="http://allthingsd.com/files/2012/05/Flipboard-Twitter-213x285.png" alt="" title="Flipboard-Twitter" width="213" height="285" class="alignleft size-medium wp-image-204843" /></a></p>
<p>And Twitter is a big part of Flipboard&#8217;s app, which is very dependent on the tweet feed and accounts for 70 percent of its links, sources said.</p>
<p>Flipboard is also more of a &#8220;mobile first&#8221; company, which is where Twitter is also headed even more aggressively.</p>
<p>Already popular on the Apple iPad, Flipboard <a href="http://allthingsd.com/20111028/news-reader-traffic-jam-yahoos-livestand-and-googles-propeller-set-to-launch-aiming-at-flipboard/">launched its iPhone app</a> late last year and it is <a href="http://allthingsd.com/20120503/flipboard-for-android-makes-a-cameo-at-samsungs-galaxy-s-iii-launch/">prepping a version</a> for Google Android soon.</p>
<p>That&#8217;s why, in addition to being a rival, it is also an obvious acquisition target for Twitter, as well as others such as Yahoo and Microsoft. </p>
<p>In fact, Google already tried to buy it last year, before Flipboard did a massive <a href="http://allthingsd.com/20110414/exclusive-flipboard-confirms-50-million-funding-at-200-million-valuation/">$50 million fundraising round that valued it at $200 million</a>. </p>
<p>Its investors include Insight Venture Partners, Comcast&#8217;s venture arm, Kleiner Perkins Caufield &#038; Byers, Index Ventures and a spate of well known angels, such as Dorsey, Facebook co-founder and Asana dude Dustin Moskovitz, Ron Conway, actor Ashton Kutcher and the investment company of former News Corp. exec Peter Chernin.</p>
<p>Co-founded by longtime entrepreneur McCue (Netscape, Tellme) and former Apple iPhone engineer Evan Doll, Flipboard <a href="http://kara.allthingsd.com/20100720/meet-flipboard-mike-mccue-talks-about-stealth-social-magazine-start-up-that-just-nabbed-10-5-million">launched to much attention in mid 2010</a>.</p>
<p>Its innovative social magazine concept is attempting to make the social networking universe more accessible, consumable and, perhaps most importantly, visually arresting via its rich app.</p>
<p>Essentially, Flipboard pulls information from media RSS feeds and sites such as Twitter and Facebook data streams and then reassembles it in an easy-to-navigate personalized format.</p>
<p><a href="http://allthingsd.com/20111208/google-currents-debuts-phew/">Google has mounted a competitor, called Currents,</a> as has Yahoo with its Livestand offering, neither of which have gotten much traction. In fact, sources said, Yahoo is likely to shut Livestand down completely.</p>
<p>There have also been a spate of other similar readers, such as Pulse and Zite. </p>
<p>Spokespersons for both Flipboard and Twitter politely declined comment.</p>

<p>Earlier today, Yahoo&#8217;s persistent thorn, activist shareholder Dan Loeb of Third Point poison-<a href="http://allthingsd.com/20120504/loeb-demands-yahoo-board-fire-ceo-by-monday-over-false-resume/">penned another letter to the board</a> of the Silicon Valley Internet company, demanding that Yahoo fire its new CEO Scott Thompson, as well as director Patti Hart, over bizarre inaccuracies related to their academic achievements.</p>
<p>&#8220;Permitting Mr. Thompson and Ms. Hart to stay with the Company after apparently violating the Code of Ethics sends a message to all Yahoo! employees that a different set of rules applies at the top,&#8221; Loeb wrote.&#8221;[Yahoo must] terminate Mr. Thompson for cause immediately given his demonstrable unsuitability to remain Chief Executive Officer and a director of Yahoo! and accept the resignation of Ms. Hart for similar reasons.&#8221;</p>
<p>And while many across the blogosphere &#8212; including some <a href="http://www.businessinsider.com/the-smartest-people-in-tech-are-ridiculing-scott-thompson-and-yahoo-2012-5?op=1 ">very clever tweets</a> &#8212; called for his head tout de suite, that&#8217;s just not going to happen.</p>
<p>At least for <em>now</em>, at this early point in a <a href="http://allthingsd.com/20120503/dan-loeb-alleges-discrepancies-on-yahoo-ceo-scott-thompsons-resume-related-to-computer-science-degree/">controversy over Yahoo filing legal documents that misrepresented Thompson&#8217;s long-ago degree</a> from Stonehill College.</p>
<p><a href="http://allthingsd.com/20120505/they-shoot-yahoo-ceos-dont-they-but-not-without-a-really-smoking-gun-and-a-much-stronger-board/220px-rubiks_cube-1/" rel="attachment wp-att-204007"><img src="http://allthingsd.com/files/2012/05/220px-Rubiks_cube-1.png" alt="" title="220px-Rubik&#039;s_cube-1" width="220" height="229" class="alignleft size-full wp-image-204007" /></a> </p>
<p>In a nutshell: Thompson does not have a computer science degree, as he had maintained he did in public bios for almost a decade, a falsehood that mysteriously seeped into documents Yahoo filed with the Securities and Exchange Commission.</p>
<p>That&#8217;s bad news for Yahoo, for sure, on many levels, but moving against Thompson at this moment is not likely to be the answer &#8212; for the short term, at least.</p>
<p>That&#8217;s due to many reasons, that I like to think of it as three hopelessly complex puzzles that need solving pronto.</p>
<p><strong>The What-Did-Yahoo-Know-and-When-Did-It-Know-It Question</strong></p>
<p>There is no question the first thing Yahoo&#8217;s board needs to do is a <a href="http://allthingsd.com/20120503/yahoos-board-will-review-resume-discrepancy-of-ceo/">thorough investigation</a> to determine how a borked bio could proliferate so widely and for so long.</p>
<p>Most importantly, Yahoo will have to reveal if Thompson actually gave them this incorrect information, as he aggressively lobbied for the then-open CEO job. </p>
<p>As I had previously reported several times, Thompson cold-emailed a Yahoo director &#8212; Intuit CEO Brad Smith, as it turns out &#8212; despite not being on the list of potential candidates. Thompson was then shuttled over to Hart, who was running the vetting process with the help of headhunting firm Heidrick &#038; Struggles, and hired within weeks.</p>
<p>Oddly, sources said Thompson never filled out the required informational papers for the job, nor did Heidrick conduct the normal background check on him. Instead, another forensic firm Yahoo hired did the work.</p>

<p>If it turns out Thompson gave any of them the bad bio info, it would be quick curtains for him. </p>
<p>But if Yahoo&#8217;s board members obtained his info on their own, the next key query would be how no one at Yahoo &#8212; especially its legal and compliance staffers, as well as outside help &#8212; managed to catch the problem during the vetting of Thompson.</p>
<p>Here are some good questions to start with: </p>
<p>Who put a faux computer science degree on Thompson&#8217;s bio in the first place, why and when did it happen? </p>
<p>Where did Yahoo get the inaccurate information? </p>
<p>Who was in charge of checking Thompson&#8217;s academic record for Yahoo? </p>
<p>And, who checked the work of the checkers? </p>
<p>The problem is made more complicated, because correct information was easily available in the SEC filings of eBay for years, since Thompson was head of its PayPal payments unit.</p>
<p>While the resume information was indeed wrong on eBay&#8217;s Web site and on numerous bios of Thompson for years, how did eBay legally get it right while Yahoo did not?</p>
<p>That calls into question the expertise of the company, its directors and those they hired to make sure execs were completely on the up and up, a task they clearly failed at.</p>
<p>If rank incompetence is the reason, which it looks like it might be, expect certain board members and other Yahoo staffers to go, along with anyone who helped in the Thompson vetting, or lack thereof.</p>
<p>Unless, of course, the gang-that-couldn&#8217;t-shoot-straight actually did shoot straight and some one at Yahoo found out about the educational discrepancy before the new CEO was announced, but declined to fix it.</p>

<p>While sinister, such a scenario is not entirely implausible, given how much pressure Yahoo was under at the time to hire a CEO quickly, due to Loeb and his looming proxy fight.</p>
<p>If any evidence were to surface that this was so, it is curtains all around, which would rain the kind of disaster down on Yahoo&#8217;s Sunnyvale HQ that would make Loeb&#8217;s attacks look like a Nerf battle. Instead, it would be &#8220;The Hunger Games&#8221; &#8212; except that no one survives.</p>
<p><strong>The Chaos-in-Sunnyvale Conundrum</strong></p>
<p>Which brings us to the profound implications of Yahoo jacking its second CEO within six months.</p>
<p>While it&#8217;s easy to yell &#8220;Fire the CEO&#8221; on a crowded Twitter, it&#8217;s simply not so easy in practice.</p>
<p>How long did it take Yahoo&#8217;s lugubrious board to figure out Carol Bartz needed to go? A &#8230; long &#8230; time. (And, she <em>had</em> a CS degree!)</p>
<p>More to the point, Thompson &#8212; and his not-so-merry band of consultants from Boston Consulting Group and, this week, McKinsey &#038; Company &#8212; has only just completed a massive <a href="http://allthingsd.com/20120404/its-official-yahoo-lays-off-2000-employees/">layoff of 2,000 employees</a> and a jarring <a href="http://allthingsd.com/20120410/its-official-yahoo-reorgs-itself-just-like-we-said-memo-time/">restructuring</a> of management.</p>
<p>He&#8217;s also in the early stages of rolling out a new and decidedly still-squishy strategic plan to  top execs (also just this week), along with working on some other key initiatives.</p>
<p><a href="http://allthingsd.com/20120505/they-shoot-yahoo-ceos-dont-they-but-not-without-a-really-smoking-gun-and-a-much-stronger-board/mr-busy-web/" rel="attachment wp-att-204024"><img src="http://allthingsd.com/files/2012/05/mr-busy-web.jpeg" alt="" title="mr-busy-web" width="330" height="301" class="alignright size-full wp-image-204024" /></a></p>
<p>That includes renegotiating its search partnership with Microsoft; noodling around on a possible deal with Google; contemplating the sale of a variety of assets; and &#8212; <em>oh, yes</em> &#8212; trying to take on social networking Godzilla Facebook over patent infringement.</p>
<p>Busy much?</p>
<p>But, most importantly, Thompson is now the umpteenth Yahoo CEO to be working on the never-ending talks with its Asian partners over selling back a piece of the company&#8217;s lucrative stake to them. </p>
<p>While Yahoo CFO Tim Morse and head lawyer Mike Callahan are the point men on the deal, the lack of CEO would be an issue in the now-proceeding again talks. </p>
<p>This is a sale that must &#8212; and I underscore <em>must</em> &#8212; get done and soon, giving Yahoo much-needed breathing room and a whole lot of cash to fork over to increasingly disgruntled shareholders.</p>
<p>So, expect Yahoo to try to milk that deal for all it&#8217;s worth in the coming week, in order to give the appearance, at least, of positive forward momentum.</p>
<p>And, like it or not, Thompson has to play a key role in it getting done. </p>
<p>Thus, the likelihood of wait-and-see over point-and-shoot on Thompson is higher than you might think.</p>
<p>That&#8217;s especially true given four members of the board are leaving within six weeks and have either or are in the process of being replaced by new members. </p>
<p>Then, Thompson will be their problem to solve.</p>
<p>Again, no small thing, since the old crew &#8212; led by feckless Chairman Roy Bostock &#8212; is not likely to want to end its appalling tenure with yet another disaster. </p>
<p>Such a move would further tarnish the legacy of its outgoing directors, although I am not sure how it could be any more sullied, given their consistent record of one bad decision after the next. </p>

<p>What do I <em>really</em> think? I think this cursed board will maintain its 100 percent score of doing the wrong thing at the right time. </p>
<p>It could be a different case with the new directors, of course, who all seem pretty sharp and not as easily impressed by a record of failure. </p>
<p>They will surely be monitoring Thompson carefully, as will employees, who have taken to internal message boards with a rage not seen in a while over the resume debacle. </p>
<p>Their morale might be one uncertainty impacting Thompson&#8217;s fate. If a lot of key employees continue to bolt Yahoo or those remaining more loudly express their disdain for the bio antics, the new directors might listen.</p>
<p><strong>The Whatever-Loeb-Says-We-Won&#8217;t-Do-Till-Later Head-Scratcher</strong></p>
<p>Which brings us back to Loeb, whose noisy campaign to grab seats on the Yahoo board has certainly hit home this week. </p>
<p>And, though Yahoo likes to ding him a lot, since he started his campaign of terribly entertaining investor terror, a lot of what he&#8217;s been calling for has happened. </p>
<p>That includes a major flushing of the board &#8212; with five longtime members, including co-founder Jerry Yang, going, going and gone.</p>
<p>In addition, Loeb brought pressure to slow down some questionable deals, from Yahoo&#8217;s PIPE dream to a tax-free spinoff in Asia in a deal only an accountant could love. </p>
<p>He&#8217;s also &#8212; though they try to deny it &#8212; got the Yahoo directors in the dangerous habit of reacting to him, rather than playing their own game. </p>
<p>While the Yahoo board has resisted any deal with Loeb (pictured here), blaming him for rejecting their kind offers of settlement, it is he who is setting the tone more than Yahoo.</p>
<p>And that tone is of alarm and trouble and chaos at Yahoo. </p>

<p>That&#8217;s not going to work to convince other Yahoo investors to back his cause &#8212; in fact, Loeb has a decidedly uphill battle to win his proxy challenge &#8212; he has still scored a direct win with the bio relevations.</p>
<p>So far, though, Loeb has not sunk Yahoo&#8217;s battleship, so it is unlikely the board will acquiesce to <a href="http://allthingsd.com/20120504/loeb-demands-yahoo-board-fire-ceo-by-monday-over-false-resume/">his latest demand of Thompson being fired by noon</a> on Monday. </p>
<p>Maybe it will eventually, or maybe it will just scold Thompson or maybe it will do nothing at all. </p>
<p>All that is an unknown &#8212; a riddle, wrapped in a mystery, inside an enigma, with a lot of managerial incompetence thrown in. And that, most of all, is the sad definition of today&#8217;s Yahoo.</p>

<p>Famed Hollywood movie director James Cameron has always been a geek, most especially an ocean geek, so it&#8217;s no surprise that he would be the one to dive seven miles down into the Mariana Trench&#8217;s Challenger Deep.</p>
<p>That would be into the Earth&#8217;s deepest place, in a tiny, vertical green tube. He&#8217;s the first person to do the treacherous dive alone &#8212; technically, it is 6.8 miles or 11 kilometers &#8212; an exploration he did with National Geographic.</p>
<p>It took about two hours to get down and a little over an hour to come back up. When he got back to the surface, Cameron was first spotted by the helicopter owned by his friend, Microsoft co-founder Paul Allen (more power-nerding!), who was also along for the adventure.</p>
<p>While down in the bottom of the sea, Cameron gathered samples and readings, but he also found time to tweet:</p>

<p>The well-known filmmaker has done two big movies related to the ocean &#8212; &#8220;Titanic&#8221; and &#8220;The Abyss,&#8221; but it is less well known that the lush landscape of &#8220;Avatar&#8221; got its color and design concepts from the sea.</p>
<p>I know all this and more about Cameron&#8217;s watery interests from an interview he did at the eighth <strong>D: All Things Digital</strong> conference in 2010. In it, he talked a lot about diving, including wanting to use submersibles to make sure the BP oil company was telling the truth about its spill back then.</p>

<p>Earlier this week, I slogged through the rain in a very dorkish GroupMe plastic poncho at SXSW in Austin to attend what I thought was one of the more interesting sessions, titled &#8220;Why Cleanweb Will Beat Cleantech.&#8221;</p>
<p>Perhaps because it was not yet another creepy location app (memo to Banjo and Highlight users, please stop attempting to get me to allow you to stalk me, cuz I <em>ain&#8217;t</em>!), it was more sparsely attended.</p>
<p>But the presentation by longtime Silicon Valley entrepreneur Sunil Paul was a good one, given his premise that current information technology tools were at the heart of creating solutions around energy conservation.</p>
<p>The founder of Brightmail &#8212; and also the first start-up partner of Zynga CEO and founder Mark Pincus at a Washington, D.C., company called Freeloader (where I first met the pair) &#8212; thinks that clean technologies like solar can be better leveraged with Cleanweb, which he defined as the &#8220;application of information technology to resource constraints.&#8221;</p>
<p>In other words, more Airbnb (fewer hotel rooms mean less carbon emissions), more Zappos (fewer stores, less driving to stores, etc.) and more teleconferencing (that&#8217;s easy to grok) is evidence that the Cleanweb could be an important contributor to saving the planet.</p>
<p>Quoting a recent tweet he saw, Paul noted that a smartphone today has as much computing power as the computers that put a man on the moon, but all we do with them is launch birds into pigs.</p>
<p>&#8220;I am saying we can do something better with the aggressive application of software technology,&#8221; he said. </p>
<p>Actually, those <a href="http://allthingsd.com/20120308/rovio-shows-off-angry-birds-space-from-space/">Angry Birds are now in space</a>, too.</p>

<p>This newfound confidence comes as a push for national regulations governing driving and cellphone use &#8212; including the suggestion of a total ban &#8212; has petered out. With Americans increasingly glued to devices and their constant flow of information, the auto makers are rolling out what they call the &#8220;connected car.&#8221; These vehicles can do everything from book a restaurant to delivering Twitter feeds &#8212; all at 65 miles an hour.</p>

<p>Persistence &#8212; even if it is the whiny, likely undeserved, lunkheaded legal version of it &#8212; certainly pays off.</p>
<p>But you have to marvel at the bizarre karma going on, given that my favorite matching pair of digital ottomans, Cameron and Tyler Winklevoss, are poised to collect up to $300 million from the shares they got in a settlement with Facebook and its CEO and co-founder Mark Zuckerberg over the founding of the social networking giant.</p>
<p>That&#8217;s right, folks, the rich do get richer, especially if they pursue their case well past the point of shame.</p>
<p>It&#8217;s not clear how many of the 1.2 million shares the Winklevii still have from the settlement they got in 2008, since they wrangled with their own lawyers over it, and the stock has also split.</p>
<p>But let&#8217;s assume the Olympic rowers kept a chunk, which will be worth a lot of gold-plated oars if Facebook reaches the upward of $80 billion valuation it is expected to in its upcoming initial public offering.</p>
<p>Facebook filed its long-expected IPO earlier this week.</p>
<p>And here&#8217;s a lovely tweet about the IPO from Cameron Winklevoss, who is looking very fetching on his Twitter page, even if it is perhaps about time to lose the rower meme image thing, given he&#8217;s on the closer side of 30 years old. </p>

<p>He sent it to his twin brother, Tyler, and also to Divya Narendra, their other partner in the ill-fated ConnectU service. </p>
<p>Without going into all the well-gone-over deets (go see the Aaron Sorkin-penned movie and believe about 26 percent of it), ConnectU was the Harvard University dating site that Zuckerberg allegedly submarined in order to start Facebook.</p>
<p>Well, presumably water under bridge &#8212; unless you are talking about the perpetually disgruntled Winklevii.</p>
<p>At the time they <a href="http://allthingsd.com/20110624/the-winklevii-didnt-actually-give-up-they-just-switched-to-another-lawsuit/">finally dropped their seven-year fraud lawsuit</a> this past summer, they then reopened to a different one then pending.</p>

<p>I went all Encyclopedia Brown yesterday after I and many others had been led astray by an account &#8212; @wendi_deng &#8212; that Twitter had verified with its famous blue check mark over the holiday weekend as that of Wendi Deng Murdoch, the wife of News Corp. head honcho Rupert Murdoch.</p>
<p>(Yes, the Murdoch who bought Dow Jones, which owns this site!)</p>
<p>As it turned out, it was not Wendi Deng Murdoch&#8217;s real account, but a fake one created by another person &#8212; unlike the one her husband recently opened, which is indeed that of the media mogul.</p>
<p>In the wake of the revelation &#8212; which got the kind of attention usually reserved for a major hurricane&#8217;s landfall &#8212; Twitter was not forthcoming about how that snafu occurred in its verification process or how that process even works now.</p>
<p>So, because I am obsessive complusive about having to make corrections after being told something is true when it is not, I got to sleuthing for the Bugs Meany of the situation.</p>
<p>As it turns out, according to sources close to the situation, it was a crime of punctuation &#8212; specifically an underscore that should not have been there.</p>

<p>Let&#8217;s back up first: Sources confirm that Wendi Deng Murdoch has indeed had a Twitter account &#8212; @wendideng &#8212; that was opened last summer. It was mostly used in connection with a movie she was a producer of, &#8220;Snow Flower and the Secret Fan.&#8221; She tweeted from the account, which had the screen name Wendi Murdoch, less than a dozen times.</p>
<p>When her husband recently decided to take up tweeting himself, <a href="http://allthingsd.com/20120102/rupe-on-twitter-damn-the-torpedoes-full-tweet-ahead/">with some amount of gusto</a>, Twitter co-founder, creator and product guru Jack Dorsey personally helped make sure Rupert Murdoch&#8217;s account was verified. </p>
<p>Even though Twitter&#8217;s public &#8220;verified&#8221; program beta &#8212; to help battle fake accounts &#8212; was phased out, the communications company still does it for high-profile people, mostly celebrities or other brand names.</p>
<p>Murdoch certainly qualified as a famous personage and Dorsey even confirmed the News Corp. head&#8217;s arrival in the Twitterverse with <a href="https://twitter.com/#!/jack/status/153270988207964160">his own tweet last Saturday</a>. </p>

<p>As a courtesy, Twitter also moved to verify Murdoch&#8217;s spouse&#8217;s account and that is when an apparent Internet copy-editing scandal was born.</p>
<p>Since the information exchange was done over a hurried holiday weekend, several sources on both sides said there was a miscommunication and the company mangled the @ address it was told by Deng&#8217;s assistant. Mistakenly, Twitter apparently thought that the correct account was the one with the underscore and not the one with no space at all.</p>
<p>Unfortunately, the underscore Wendi account was the faux one created by a British man having some fun spoofing the famous Deng, who still had the no-space one for reals.</p>
<p>It&#8217;s kind of like a digital version of one of those switched-at-birth plots, except sillier and even more entertaining.</p>
<p>Thus, carrying the distinctive blue check mark, everyone assumed Twitter had verified the right one, until it was soon pointed out by News Corp. and even the fake Deng that it had not.</p>

<p>Twitter then released a statement admitting the obvious, the fake Deng enjoyed basking in the worldwide attention and the still-verified Rupert Murdoch had lobbed some much-noticed tweets (as you can see here, in case you are not one of his more than 101,000 followers).</p>
<p>As for the real Deng? She suspended her account.</p>
<p>For now, at least. Sources said she is likely to come back to Twitter and is still a big fan of Dorsey and the service.</p>
<p>Case, <em>um</em>, closed. (I hope.)</p>

<p>In fact, News Corp. potentate Rupert Murdoch, who happens to own this Web site (and more!), just inexplicably joined Twitter.</p>
<p>And, like any newbie, he has already had to retract a tweet.</p>
<p>The controversial 140-character-or-less utterance from <a href="https://twitter.com/#!/rupertmurdoch">@rupertmurdoch</a>: &#8220;Maybe Brits have too many holidays for broke country!&#8221;</p>
<p>He quickly deleted the saucy tweet, apparently at the behest of his wife, Wendi Deng, who <a href="https://twitter.com/#!/Wendi_Deng/status/153540124158857216">publicly tweeted to him on her Twitter-verified account, as if she were in private</a> instead of chatting globally: &#8220;RUPERT!!! Delete tweet!&#8221;</p>
<p>Then, to all, <a href="https://twitter.com/#!/Wendi_Deng/status/153540419689521153">she tweeted</a>: &#8220;EVERY1 @rupertmurdoch was only having a joke pROMSIE!!!&#8221;</p>
<p>[UPDATE: My mistake: It was confirmed by Twitter that this Wendi Deng Twitter account was a fake one, even though it had been previously verified and marked so prominently by the online communications company. Whoever is writing the tweets also said they were spoofing Deng. I had relied on that verification as accurate, since I had assumed Twitter had confirmed both at the same time. Obviously, I am a dope and should not have.]</p>
<p>But Murdoch, already infected with the classic Twitter and-just-one-more-thing disease, then <a href="https://twitter.com/#!/rupertmurdoch/status/153633801740881921">noted</a>: &#8220;I&#8217;m getting killed for fooling around here and friends frightened what I may really say!&#8221;</p>
<p>Oh, joy, indeed &#8212; as I am <em>counting</em> on it.</p>
<p>Murdoch, controversies and all, has the kind of socially attuned personality tailor-made for Twitter, even though many point out that he has not been a fan of the Internet and interactive media in the past.</p>
<p>While I am no expert on that, that&#8217;s actually not been my experience in my encounters with the mogul at many of our <strong>D: All Things Digital</strong> conferences and elsewhere. In fact, he seems keen on understanding online media, even if it most certainly is not his first language, which has been print.</p>

<p>In fact, Murdoch&#8217;s tweets are listed as coming from his Apple iPad, which I have seen him carry like a precious jewel, another part of what became a truly interesting and complex relationship with Steve Jobs in the years before he died. (And it also appears as if Murdoch took his Twitter profile photo &#8212; posted here &#8212; from said iPad, judging from the angle.)</p>
<p>So let&#8217;s hope he keeps up the lively patter going forward &#8212; unlike many Twitter celebs who trail off after an initial burst of activity &#8212; as he pokes and prods the Twitterverse. A place, it should be noted, he once famously said would not make a good investment.</p>
<p>Still, so far, he seems to like the product, and will only more so, if he sticks to <a href="https://twitter.com/#!/rupertmurdoch/status/153551723779211264">yet another tweet</a>: &#8220;My resolutions, try to maintain humility and always curiosity. And of course diet!&#8221;</p>
<p>Because curious is what Twitter is all about &#8212; we can only hope the snaps of his dinners are not far behind.</p>
