U.K. chip designer ARM once again delivered the goods, Wednesday reporting solid first quarter results ahead of market expectations on the back of its processor business. It’s also quietly confident about the outlook; reiterating its annual revenue guidance.

ARM’s performance mimics that of others in the semiconductor space, including STMicroelectronics, which Tuesday reported that first-quarter earnings nearly tripled from a year earlier. Intel and Apple have also posted strong numbers over the past week on the back of strong demand.

The FTSE 100 company, which is trading at 50 times its earnings, posted a 10 percent rise in first quarter net profit to £21.5 million on the back of a 26% increase in revenue to £116 million. It secured 39 processor licenses in the quarter ended March 31 after signing 35 processor licenses in the previous quarter.

Bebo, the social network bought and sold by AOL, still has 10 million monthly unique visitors, with an average user age of 17 and lots of them in the U.K..

Tonight the Criterion Capital Partners-owned site is launching a redesign, with massive innovations like “Emotion Markers to mark a feed item as Cool, Funny, Sorry, or OMG; replacing those boring and vague ‘likes’ you might be used to on other services,” as well as overlay boxes that replace additional page views when navigating the site, and improved feeds and notifications.

What’s different about Bebo? Primarily, its customizable skins and designs, and its restricted default privacy settings, both catering to its younger user demographic. It also has a deal in the U.K. to offset mobile data charges, which as you can imagine is quite endearing.

Apple said today its App Store has hit more than 10 billion downloads worldwide, equating to roughly 62 apps for each one of its 160 million iPhone, iPod touch and iPad users.

The App Store is now roughly two-and-a-half years old and offers software for a number of categories in 90 countries, ranging from games, news, sports, health, reference and travel.

Apple took advantage of today’s milestone to highlight several new figures: In addition to revealing that it now has 160 million iOS users in the world, it said there are more than 350,000 applications in the App Store that are accessible to users in 90 countries. Of that application base, there are more than 60,000 apps available for the iPad.

“The App Store has surpassed our wildest dreams,” said Philip Schiller, Apple’s SVP of Worldwide Product Marketing in a release. “While others try to copy the App Store, it continues to offer developers and customers the most innovative experience on the planet.”

Apple said the 10 billionth app downloaded was “Paper Glider,” which was purchased by Gail Davis of Orpington, Kent, in the U.K. Davis will receive a $10,000 iTunes gift card.

As a point of reference, Apple said in September 2009 that there were 50 million iPod and iPhone users, making the 160 million number announced today fairly significant.

A sketchily sourced report out of London says that Oracle and Microsoft may be lining up to bid on the British Software firm Autonomy early in 2011. Rumors are always rumors of course, but there's a good reason to give this one some thought.

There’s a sketchily sourced report in the U.K.’s Daily Mail this morning saying that the British software concern Autonomy may be the subject of a bidding war between Oracle and Microsoft after the first of the year.

Interest from the two software giants would seem a plausible explanation for the peculiar circumstances around Autonomy’s on-again, off-again talks about making an acquisition.

In April it said it would sell convertible bonds to raise money–nearly $800 million–to fund an acquisition, though it never named a target.

Then suddenly last month the company said the deal it had been working on was being put off because of another unspecified opportunity, which promptly sent its stock reeling. Autonomy shares, which trade on London’s FTSE, are down 27 percent from their 52-week high. It could be that whatever deal the company was working on was put on the back burner following unexpected overtures from Larry Ellison and Steve Ballmer.

Autonomy specializes in what it calls Meaning Based Computing. Its software is designed to recognize the relationships between structured data–what you find in an organized database–and unstructured data–which can be anything from words in a written document, a speech or conversation, or anything else that has information that isn’t organized into rows and columns. Its customers run the gamut from businesses such as FedEx, the NYSE, Louis Vuitton and Goodyear to tech firms like Adobe and Cisco Systems.

On its face this rumor is interesting because now that the battle to roll up the data storage firms is largely resolved following Dell’s acquisition of Compellent, one of the next dealmaking battle fronts for the large IT vendors is going to be software that makes managing data in all its various forms easier, more powerful and less costly.

Autonomy certainly fits that bill, and at market valuation in the $7 billion neighborhood, both Oracle and Microsoft could get it done.

However, the cynic in me wonders if this is just a deliberate rumor intended to goose Autonomy’s flagging stock price. If that’s the case, it appears to have worked.

You might think twice about publishing a WikiLeaks e-book if you got threatening emails, too. An odd chapter to a weird story.

Add another chapter to the odd story of the WikiLeaks e-book that Amazon sold, stopped selling and is now selling again: The author tells me he asked Amazon’s U.K. site to remove the book after he received anonymous threats against him and his family.

But he says he has now reconsidered and wants the book sold, after all–even if it angers some WikiLeaks supporters.

To recap: Amazon received a storm of criticism yesterday for selling this oddly named e-book “WikiLeaks documents expose US foreign policy conspiracies. All cables with tags from 1 5000,” even though Amazon has refused to host WikiLeaks documents themselves.

Amazon’s common-sense answer to critics was that the book is commentary and analysis about the WikiLeaks data and that it intended to keep selling the title.

Later on Thursday, the book disappeared from Amazon’s shelves, and Amazon said it had been “removed by author.” But now it’s back once again.

What happened? I asked author Heinz Duthel to explain. We’ve corresponded via email, and while there’s a bit of a language gap (he’s a native German speaker), I think I understand the gist of the story: Duthel’s instinct after receiving threats was to yank the book, but now that he’s had time to think it through, he wants to sell it after all.

Below, an edited version of my correspondence with Duthel. I’m leaving his responses in their original form rather than risking making an inaccurate guess while cleaning them up:

December 9
Peter Kafka: I see now that the book is no longer available at Amazon’s store. The listing there says it has been “removed by author.” Can you please explain why you wrote the book, why you published it and why you decided to remove it?

December 10
Heinz Duthel: Yesterday I had a shocking day (at age 61) with my III. book about Wikileaks. I did remove the book after I received about 60 emails (anonymous) with insults like ‘after finish with paypal, mastercard, amazon’ we will remove you and all your books from the web’, ‘we know who are you and we will take care about you singing daughter (she is 15 and started to make some music since 2 years) and so on. Amazon.com did send me one email (Stephanie Derouin of Amazon’s Kindle Self-Publishing (DTP) Executive Customer Relations. Can you please confirm that this is your intent? You may email me at [xxx]@amazon.com. ) so I replied that I have removed the book because I don’t want that amazon.com is hacked only because of my wikileak book.

Since then one of my domains, heinzduthel.com has to be removed from my hosting company because of high cpu usage. This from 1:30 till 5:50 European Time. Now the domain is back again (amazon shop script) but I had to clean the cache for 2 hours on the domains, because it look like I had a few hundred thousand ‘visitors’.

Kafka: Your book now appears to be available on Amazon again. If that’s true, why did you decide to do so given the threats, etc.?

Duthel: I am surprised it is online again because I left this up to amazon.com in my email as you have seen. I think there is no reason why it should not be online, because I think the comments bellow the book atamazon.com are not justified at all.

…honestly this book (Wikileaks IV) is nothing else then just about Assange, Wikileaks and why, what, question marks, comments etc.

This book is in fact something for readers interested to know what is going on or what is Weakileaks and have no time to search the whole internet, sources, media, press etc.

Kafka: I am surprised to read that you’re surprised it’s now available. Did you specifically tell Amazon to remove your book? And are you okay with the fact that it’s available once again?

Duthel: Peter, to question I:

Here is the email after I have removed the book and Amazon did ask me if this has been my intent.

Dear Miss Stephanie

No it has not been my intent, I have just been informed after reading the news in Google.com that maybeamazon.com would have or get problems from all this hackers or world regulators, like Mastercard, Visa or Paypal. So this is not my attention.

I think this book like any other has the right to be online and no one can or has the right to commit extrajudicial proceedings against books or publication.

But you can see all this supporters of Wikileaks and Julian Assange black mail each and every one who is against their self proclaimed freedom of press.

After talking with my family Lawyer this evening in France he suggested to place back the book or books as it is up to Amazon to decide what is wrong or good and not some self appointed world regulators outside there…

To question II.

Yes I am OK if the book is online and available because it has been the reason why I wrote the book, but I left this up to amazon.com because I don’t want to be responsible if because of this book amazon.comget problems, hackers or what ever.

U.K. officials ruled Wednesday that Google Inc. broke the law by collecting data from wireless networks for its Street View mapping service, reflecting growing scrutiny in Europe of the U.S. Internet company’s privacy practices.

Google earlier this year said that the camera-equipped cars it uses to mark the location of wireless networks and take pictures for its Street View service had for years inadvertently collected data from publicly accessible wireless networks. Google initially said that no significant personal data was collected, but last month admitted that emails and passwords had also been copied.

On Wednesday, U.K. Information Commissioner Christopher Graham, the regulator in charge of data protection, issued a statement saying that, as a result of the “significant breach” of law, his office would audit Google’s data-protection practices in the U.K. and ask the Mountain View, Calif., company to sign an official commitment affirming that such breaches wouldn’t occur again. The U.K. regulator had earlier found that Google didn’t collect meaningful personal details.

News International Ltd., said Tuesday that around half of the 105,000 paying readers are monthly subscribers, including those to the digital sites and to the Times iPad app and Kindle edition.

Apple is selling the iPhone 4 as fast as it can make it–actually faster. With demand for the device off the charts after first-weekend sales, the company’s online storefront is now showing a ship time of three weeks for new orders. And Deutsche Bank analyst Chris Whitmore says that his survey of brick-and-mortar stores shows frequent stock-outs. “Demand is outstripping supply in multiple regions despite frequent replenishment,” he wrote in a research note issued this morning.

According to Whitmore’s survey of 100 iPhone 4 retail outlets (Apple, AT&T, Best Buy, O2, Orange and Car-Phone stores in the U.S. and U.K.), 60 percent of Apple Stores were sold out by Thursday evening, as were 100 percent of retail-partner stores. Supplies were replenished overnight, but by end-of-day Friday, quite a few stores were reporting stock-outs. And that number only grew on Saturday.

“Our checks carried out on Saturday revealed that Apple retail stores which were stocked-out on Thursday/Friday were unable to replenish stocks with ~95 percent of stores contacted experiencing stock-out situations. Further, most Apple representatives were not certain about the iPhone 4 stock replenishments and comments such as ‘We’re out of stock’, ‘Don’t know when we will have them in store’, ‘We sold out just minutes ago’, ‘No, we don’t know when we will be getting the phone’ and ‘Your best bet is the online store’ were cited frequently,” Whitmore reported.

“In addition,” according to the analyst, “retail stores which had iPhones in-stock cited long lines (2 to 3 hours) outside the stores. Comments such as ‘We have very limited numbers, we should be sold out in a couple of hours’ and ‘Please give us a call just before you leave home to make sure the iPhones are in stock’ suggested waning inventory levels.”

Whitmore figures Apple (AAPL) sold more than one million iPhone 4s over the weekend, but notes that shipments could have been dramatically higher if there was more supply.

“While the strong start is encouraging, we believe the long-term opportunity for growth of the iPhone is even more significant as near-term shipments are being gated by supply constraints,” Whitmore wrote. “We estimate Apple to sell 44 million iPhones in CY10 (8.5 million in the June quarter) and 55 million in CY11.” (See chart below; click to enlarge.)

No other details, of course–specific verbiage is that sales “topped 2 million in less than 60 days”–but we can safely assume that most of those sales were in the U.S., since the device didn’t go on sale internationally until last weekend.

If you like statistics: That’s approximately 33,000 iPads per day, 1,388 iPads per hour and 23 iPads per minute.

And if you want to hear about the iPad from the man himself: Apple CEO Steve Jobs kicks off the D8 conference on Tuesday.

Press release excerpt:

Apple Sells Two Million iPads in Less Than 60 Days

CUPERTINO, Calif., May 31 /PRNewswire-FirstCall/ — Apple® today announced that iPad(TM) sales have topped two million in less than 60 days since its launch on April 3. Apple began shipping iPad in Australia, Canada, France, Germany, Italy, Japan, Spain, Switzerland and the UK this past weekend. iPad will be available in nine more countries in July and additional countries later this year.

“Customers around the world are experiencing the magic of iPad, and seem to be loving it as much as we do,” said Steve Jobs, Apple’s CEO. “We appreciate their patience, and are working hard to build enough iPads for everyone.”

After a false start, Apple’s iPad made its international debut Friday and by most accounts, it was a strong one. Indeed, some analysts are already saying the launch went better than expected.

Noting that the nine countries in which the iPad debuted today are among Apple’s strongest international markets, RBC Capital Markets analyst Mike Abramsky said he expects the company to sell more iPads than Macs internationally–600,000 to 700,000 or more in the third quarter of fiscal 2010. Abramsky figures international Mac sales will come in at around 500,000.

Makes sense. As I noted here last week, iPad sales in the United States are believed to be outpacing those of the Mac and closing in on the iPhone 3GS.

“Industry contact feedback and previously published surveys point to strong International demand, supported by media reports of long lineups at Apple stores, and strong demand for iPads,” Abramsky wrote in a note to clients today. “iPads appear to be stocked out already at some stores and resellers, particularly in countries like Japan, Australia, and UK.”

With that in mind, Abramsky reiterates his earlier estimates for iPad sales. He believes Apple (AAPL) will sell 2.5 million iPads in Q3 and 8.1 million in calendar year 2010, adding, “Early healthy sell-through and rampant PR buzz–as it has been doing in North America–is expected to further raise demand and accelerate sell-through beyond early adopters….Over the upcoming months, we believe Apple will further ramp production to overcome initial supply shortages.” (Click on table below to enlarge.)

Apple (AAPL) will start accepting pre-orders for both the 3G and Wi-Fi models on Monday, May 10. And on May 28, Apple will begin shipping units in Australia, Canada, France, Germany, Italy, Japan, Spain, Switzerland and the U.K.

The launch will continue in July when the iPad arrives in nine additional countries: Austria, Belgium, Hong Kong, Ireland, Luxembourg, Mexico, Netherlands, New Zealand and Singapore.

Apple has already sold more than one million iPads in the U.S. since the launch of the Wi-Fi-only model on April 3 and the 3G version on April 30. Given these sales figures and Apple’s supply issues to date, it will be interesting to see how the international rollout goes.

Months after its ill-starred launch, Google’s Buzz social networking service continues to inspire outcry among privacy advocates. The latest to cry foul: An alliance of privacy commissioners from 10 countries who think Google’s “sorry we didn’t get everything right” apology for its failure to adequately protect the privacy of Buzz users is a cop-out.

In a letter to Google CEO Eric Schmidt, privacy commissioners from France, Germany, Canada, and the U.K., among other countries, slagged the search giant for failing to take adequate account of privacy considerations when rolling out new services.

“We are increasingly concerned that, too often, the privacy rights of the world’s citizens are being forgotten as Google rolls out new technological applications,” the commissioners wrote. “We were disturbed by your recent rollout of the Google Buzz social networking application, which betrayed a disappointing disregard for fundamental privacy norms and laws….”

Mincing no words, they added, “It is unacceptable to roll out a product that unilaterally renders personal information public, with the intention of repairing problems later as they arise. Privacy cannot be sidelined in the rush to introduce new technologies to online audiences around the world.”

While the first few lines of the statement largely repeat criticisms we’ve heard before, the last two really get at the crux of the entire debacle. If Google (GOOG) didn’t recognize the privacy flaws in Buzz before it released it to the public, it should have. And if it did recognize them and released the service anyway figuring it would address them later–well, that’s just plain reckless.

“Sorry we didn’t get everything right” doesn’t absolve the company from its misstep, though Google clearly seems to think it does, according to the statement it issued on the letter.

“We try very hard to be upfront about the data we collect, and how we use it, as well as to build meaningful controls into our products. Google Dashboard, the Ads Preferences Manager and our data liberation initiative are all good examples of such initiatives,” the company said.

“Of course we do not get everything 100 percent right–that is why we acted so quickly on Buzz following the user feedback we received. We have discussed all these issues publicly many times before and have nothing to add to today’s letter–instead we are focused on launching our new transparency tool which we are very excited about.”

Much has been written and said about the current economic downturn and the resulting lessons on how to run high-technology companies. Quite famously, Sequoia Capital, the premier venture capital firm in Silicon Valley, held a mandatory all-CEO meeting in fall 2008 during which it advised them to “Cut spending. Cut fat. Preserve capital.” (You can see the presentation here.)

The presentation catalyzed a movement. Start-ups everywhere adopted a lean, low-burn, low-investment model. To this day, companies seeking funding at our venture firm, Andreessen Horowitz, proudly proclaim in their pitch decks that they are raising tiny amounts of capital so they can run lean.

On the one hand, it is a fact that capital invested is negatively correlated with returns in the venture capital industry. Pumping too much money into a small start-up is unhealthy for both the company and the investor. On the other hand, Facebook has raised several hundred million dollars and is on track to produce fantastic returns for all of its investors.

So what’s a start-up to do? Much of what has been written and said about lean start-ups makes good sense. However, that advice is often incomplete, and some of the things left unsaid are the least intuitive. In this article, I will articulate some of those things left unsaid in arguing the case for the Fat Start-up.

Here is my central argument. There are only two priorities for a start-up:
Winning the market and not running out of cash. Running lean is not an end. For that matter, neither is running fat. Both are tactics that you use to win the market and not run out of cash before you do so. By making “running lean” an end, you may lose your opportunity to win the market, either because you fail to fund the R&D necessary to find product/market fit or you let a competitor out-execute you in taking the market. Sometimes running fat is the right thing to do.

What the hell do I know?

“Al Pacino couldn’t be no gangsta, DeNiro in ‘Casino’ he no gangsta
Wanna be, wanna see, wan’ get a shovel
dig Tookie up n*&%^!, cause he know gangstas”

–The Game

At this point, some of you are asking yourselves, “What the hell does Ben know? If he were really smart, then he’d know that thin is in.” It turns out that I have some experience in managing a fat start-up through the dot-com implosion of the early 2000s. This chart offers a brief summary of equity market history when I was CEO of Loudcloud and Opsware (click to enlarge):

Note that the Nasdaq index is very highly correlated to the start-up funding environment. During the two years I was CEO of Opsware, the Nasdaq fell 80 percent, far more than it has fallen during the current 2008-10 downturn. So the 2000-02 environment was at least as traumatic as this one for Silicon Valley companies–and arguably much worse.

Here is a brief summary of Loudcloud/Opsware’s fund-raising history during that time:

 September 1999: Loudcloud founded

November 1999: Loudcloud raises $21 million at a $45 million pre-money valuation (Benchmark Capital is the lead investor)

January 2000: Loudcloud borrows $45 million from Morgan Stanley (MS)

June 2000: Loudcloud raises $120M at a $700M pre-money valuation

March 2001: Loudcloud goes public on Nasdaq, raises $160 million and is valued in the public markets at approximately $480 million. Total funds raised to this point: $346 million.

August 2002: Loudcloud sells the managed services business to EDS (this was the only actual business we had at the time) for $63.5 million and becomes a software company (and changes its name to Opsware).

September 2002: Opsware trades for 35 cents per share or approximately a $28 million market cap.

September 2007: Hewlett-Packard (HPQ) acquires Opsware for $1.6 billion

During this period, Loudcloud/Opsware had over 20 direct competitors. Almost all the competitors from the Loudcloud era went bankrupt, including MFN/SiteSmith, Exodus, LogicTier, Williams Communication, Global Crossing, WorldCom/Digex and Storage Networks. Those that survived got bought with valuations of less than $100 million (e.g., Totality) or still have very low valuations (e.g., Navisite).

How did we do it?

“I had a dream I could buy my way to heaven
When I awoke, I spent that on a necklace”

–Kanye West

So how did we navigate through the great dot-com crash, crush the competition, emerge as the No. 1 company in our space and sell the company to HP for $1.6 billion? Did we “cut spending, cut now, and preserve capital?” Did we make cash preservation our No. 1 priority?

No, we didn’t. To underscore the point, here are Loudcloud’s average monthly cash burn figures for the quarters ending in:

Apr 2001: $39 million

Jul 2001: $35 million

Oct 2001: $29 million

Jan 2002: $25 million

Apr 2002: $22 million

Jul 2002: $19.4 million

As you can see, we were aggressively investing in the business throughout 2001 and 2002. While we did reduce our cash burn, we did not make cash preservation our No. 1 priority. As it was, over the course of the transition from Loudcloud to EDS, we sadly laid off 400 employees and transferred another 150 to EDS. However, we didn’t scrimp and save our way to a $1.6 billion acquisition: Instead, it’s what we chose not to cut that ultimately got us there.

Loudcloud was a Web-hosting business. Today, we’d call it a “cloud services” business, but people weren’t quite ready for the “cloud” in 2001. We supercharged our hosting business with software (called Opsware) that automated our Web-hosting operations. The other cloud services businesses of our day also had software investments. However, as the macroeconomic climate changed, they all “cut deep and cut now.” In the end, they ended up putting their software in maintenance mode and stopped building new features.

As we weighed a decision to make the same deep cuts in our own software R&D efforts (a move advocated by the intelligentsia of the day, as well as nearly every MBA we had working in the company), I faced a hard decision: Cut deep and get to cash flow break-even quickly or continue to invest heavily in software?

In the end, I decided to run fat so that we could continue to invest in the Opsware software. At the end of the day, I realized that much larger companies like IBM (IBM) could hire smart people and train them. But without a lasting technology-based advantage, it would be increasingly hard for us to defeat them and build our customer base despite early wins with Ford (F), Fox Sports, and the U.K. government (to name just three of our early customers).

Running fat meant that I laid off zero software engineers so that we could keep on investing in our technology, find our product/market fit, and build a lasting technological advantage.

Still, we had to reduce costs or we would clearly go bankrupt. With this new view of the world, I decided that rather than divesting our intellectual property, I would divest our business. Now, that may sound logical the way I’ve described it, but consider these facts:

We were generating $65 million/year from the Web-hosting business.

We were a publicly traded company with a market capitalization of close to $200 million.

All of our investors (pubic and private) believed in and invested in the Web-hosting business.

We had close to 500 employees at the time. Nearly all of them were supporting the Web-hosting business.

We had no other business. We had software, but we did not have a software product and certainly did not have a software business.

Despite all of this, we sold the Loudcloud hosting business to EDS and became Opsware the software company. It was not clear that this was a good idea at the time. In fact, the market thought it was a terrible idea: Our stock promptly lost 80 percent of its value, putting our market cap at about $28 million. It’s worth pointing out that this was about $40 million less than the cash that we had in the bank.

During the transition, we shrank our payroll from 450 employees to fewer than 100. Even with this massive reduction in expenses, it would take another three quarters to reach cash-flow break-even, a milestone we finally reached in Q2 of 2003.

One could argue–and many did–that we should have cut a lot deeper than we did given that we only had one customer. Although EDS was a very large customer (it generated $20 million/year in revenue), a brand new software company doesn’t need 100 people. We could have taken steps to reach cash-flow break-even immediately (clearly, that might have helped us get above 35 cents per share). In other words, we could have “gone lean” by cutting deep, cutting now, and preserving capital.

But rather than do what seemed obvious, I decided to keep on investing. Here’s why: In an economic boom, cash is great, but not necessarily a meaningful competitive advantage. If every company is well funded, being super-well funded doesn’t help you win. In fact, being super-well funded can actually screw you.

But in a bust (like the one we were in), having a lot of cash can be a huge competitive advantage because you can use that cash to put enormous pressure on your underfunded competitors. And that’s what we did.

We spent aggressively to match our best competitor’s product, feature for feature. And we used our public currency to acquire important adjacent functionality (network, process and storage management) that our competitors did not have and couldn’t acquire because they didn’t have the cash (or the equity).

In doing so, we were able to beat a really high-quality start-up (Bladelogic) that did not have the massive technical and cultural baggage that came from exiting the managed services business. Bladelogic was eventually sold to BMC (BMC) for $800 million. But I’m firmly convinced that had we not spent the money, Bladelogic would have emerged as the No. 1 company in the space and gotten the $1.6 billion exit instead of Opsware.

In the end, by continuing to invest aggressively in our technological advantage despite a hellacious funding environment, we were able to turn a doomed business into a winning one.

That is the very short version of how we won the market during the great tech recession of the early 2000s.

So did we learn?

“Hegel was right when he said that we learn from history that man can never learn anything from history.”

–George Bernard Shaw (1856-1950)

Every start-up is in a furious race against time. The start-up must find the product-market fit that leads to a great business and substantially take the market before running out of cash. As a result, the top two priorities are always to:

Find the product that 1,000 enterprise or 50 million consumers want to buy and grab those customers before your competitors do.

Raise enough cash and spend it intelligently so that you don’t go broke along the way.

Clearly, you can’t succeed if you don’t achieve both priority No. 1 and priority No. 2. So why is taking the market more important than not running out of cash? Because the only thing worse for an entrepreneur than start-up hell (bankruptcy) is start-up purgatory.

What is start-up purgatory, you ask? Start-up purgatory occurs when you don’t go bankrupt, but you fail to build the No. 1 product in the space. You have enough money with your conservative burn rate to last for many years. You may even be cash-flow positive. However, you have zero chance of becoming a high-growth company. You have zero chance of being anything but a very small technology business (see Navisite). From the entrepreneur’s point of view, this can be worse than start-up hell since you are stuck with the small company.

You recruited all the employees, you raised all the money and you made all the promises. You either see it through or leave–without your good reputation. No one wants to work for an entrepreneur who quits his or her own company. This is start-up purgatory, where you work just as hard, reap none of the rewards, and watch all your best people leave you. It sucks to be you.

The Bottom Line

Spending a little or spending a lot is a means, not an end. Choose the right strategy to win the market or you may end up going straight to purgatory.

As you listen to the virtues of the lean start-up–lightweight sales, light engineering, and so on–keep the following in mind:

If you are a high-tech start-up, your value is in your intellectual property. Don’t stare at your spreadsheets so long that you get confused about that.

You cannot save your way to winning the market.

The best companies can raise money even in this market. If you are one of those, you should consider raising enough to wipe out your competition.

Thin is in, but sometimes you gotta eat.

Given the time between the launch date of the Wi-Fi-only and 3G versions, will any early adopter be patient enough to wait for the latter?

Below, the press release announcing the iPad’s on-sale and shipping dates (Caution, Press release: May contain unnecessary superlatives, profound lack of objectivity).

The merger of France Telecom’s Orange and Deutsche Telekom-owned T-Mobile will create the largest mobile phone operator in the U.K. with about a 34 percent share of the market, just ahead of current market leader O2, which claims about 28 percent. It will also reduce the number of carriers in the country, which critics argue will reduce competition and raise prices.

Orange and T-Mobile disagree, of course, and claim the deal will give subscribers better coverage and improved customer service. We’ll see, I guess.

Oh, no word yet on the combined company’s name.

And there it is, Google’s European antitrust review.

The European Commission has opened an investigation into Google’s dominance of the search and search advertising markets in Europe at the behest of three complainants: French legal search engine ejustice.fr, U.K. price-comparison venture Foundem, and Ciao!, a product review and price-comparison site.

Perhaps unsurprisingly, the latter two have ties to Microsoft. Ciao is a subsidiary of Google’s Redmond rival and Foundem is a member of Microsoft-funded organization ICOMP.

In any event, the three companies have all accused Google (GOOG) of undermining their business in some way, either by unfairly demoting their rankings in its search results or by saddling them with onerous terms and conditions. And the European Commission has taken their complaints seriously enough to look into them.

The inquiry is at an “early, fact-finding stage” and may not result in further action, but it has clearly got Google worried. It was the EC, after all, that ultimately beat Microsoft (MSFT) into submission, forcing the company to alter its business practices.

In a post to Google’s Public Policy Blog entitled “Committed to Competing Fairly,” Julia Holtz, the company’s senior competition counsel, denied the charges against Google, saying the company has done nothing wrong.

“Though each case raises slightly different issues, the question they ultimately pose is whether Google is doing anything to choke off competition or hurt our users and partners,” she wrote. “This is not the case. We always try to listen carefully if someone has a real concern and we work hard to put our users’ interests first and to compete fair and square in the market.”

Microsoft will begin rolling out its “No Browser Left Behind” scheme in Europe next week, offering Windows users a choice of Web browsers, as stipulated by its antitrust settlement with the European Commission.

Microsoft will begin rolling out its “No Browser Left Behind” scheme in Europe next week, offering Windows users a choice of Web browsers, as stipulated by its antitrust settlement with the European Commission.

And so, beginning on Feb. 22, Windows users in the U.K., France and Belgium will be presented with a ballot screen offering them an opportunity to swap out Internet Explorer for one of 11 other browsers from rivals like Mozilla, Apple (AAPL), Opera and Google (GOOG).

“The browser choice screen software update will be offered as an automatic download through Windows Update for Windows XP, Windows Vista and Windows 7,” Microsoft (MSFT) Vice President and Deputy General Counsel Dave Heiner explained in a blog post announcing the move. “The software update will be installed automatically, or will prompt you to download or install it, depending on which operating system you are running and your settings for Windows Update.”

Once that’s done, users will be shown a ballot screen offering the option of installing one of the listed browsers, learning more about them or postponing the browser choice to a later time. Simple enough–assuming that automatic updates is enabled and that they actually care about browser choice.

If that’s the case, many probably dumped IE for an alternative long ago, right?

Anyway, as I said, a limited ballot screen rollout begins next week with full-scale deployment across the rest of Europe a week later, potentially reaching some 170 million PCs. It will be interesting to see how many of them end up switching to a new default browser.
