After a massive breach of its computer systems yesterday, LivingSocial has sent out emails to all of the 50 million customers impacted, a company spokesman said, and is now working with law enforcement in an investigation to help find the perpetrators.

The company declined to give more information about how the hackers might have entered the Washington, D.C., daily deals company’s system to get access to names, emails, birthdates and encrypted passwords. But it did note that it was taking extra measures to restrict access to all of its systems and consumer data and has been doing heavy monitoring of consumer accounts.

LivingSocial also underscored that credit card information of its users has not been hacked. “We store credit card data through a financial processing network, so the full number literally does not exist anywhere in our system,” the spokesman said.

Still, the hack is a huge blow for LivingSocial, which is owned in part by Amazon, impacting 50 million customers, who will now be required to reset their passwords. All of LivingSocial’s countries across the world appear to have been affected, except in Thailand, Korea, Indonesia and the Philippines, as LivingSocial units Ticketmonster and Ensogo there were on separate systems.

This is the latest big data breach in the consumer Internet space, which has seen troublesome incursions into some high-profile companies recently, including Zappos, LinkedIn and Evernote.

The attack comes at a tough time for the company, since it has been trying to turn itself around after a downturn across the daily deals landspace. LivingSocial got a large cash infusion recently from investors to help stanch its losses. Amazon owns 29 percent of the company.

LivingSocial, the daily deals site owned in part by Amazon, has suffered a massive cyber attack on its computer systems, which an email from CEO Tim O’Shaughnessy — just sent to employees and obtained by AllThingsD.com — said resulted in “unauthorized access to some customer data from our servers.”

The hack includes customer names, emails, birthdates and encrypted passwords.

The breach has impacted 50 million customers of the Washington, D.C.-based company, who will now be required to reset their passwords. All of LivingSocial’s countries across the world appear to have been affected, except in Thailand, Korea, Indonesia and the Philippines, as LivingSocial units Ticketmonster and Ensogo there were on separate systems.

One positive note in a not-so-positive situation: The email sent to employees and customers noted that neither customer credit card nor merchant financial information was accessed in the cyber attack.

When asked for comment on the email, a LivingSocial PR spokesman confirmed the attack and that 50 million customers were impacted.

The Facebook CEO adds a few more impressive names to the roster of his D.C. political advocacy group on Friday; Microsoft founder Bill Gates, current Microsoft CEO Steve Ballmer, Intuit CEO Microsoft General Counsel and EVP Brad Smith and Sean Parker of Facebook and Napster fame have all joined FWD.us, Mark Zuckerberg’s pet D.C. project aimed at changing the way Washington handles issues around immigration, education and employment issues.

“We’re thrilled that Bill Gates, Brad Smith, Steve Ballmer, and Sean Parker — longtime advocates for vital policies like comprehensive immigration reform that will grow our economy — are joining FWD.us’ efforts to organize and engage the tech community,” Joe Green, president of FWD.us, said in a statement.

“We’ve been excited by the momentum we continue to see as more members of the tech community contribute to the national debate to improve our economic future, and support the bipartisan policies that will boost economic growth and continue to grow the knowledge economy,” he said.

The group, which formally launched with a bang and an op-ed penned by Zuckerberg himself in the Washington Post earlier this month, isn’t an official Facebook joint. Rather, I’m told, it’s Zuckerberg’s own thing, focusing on legislative issues he’s especially frustrated with. In particular, the bringing in of engineering talent from outside the U.S. and how tough that can be, as well as the difficulties around convincing foreign entrepreneurs to set up shop stateside.

Gates and company aren’t the only powerful friends Zuckerberg has asked to come along for the ride. At launch, the FWD.us roster read like a veritable Who’s Who list of Silicon Valley, including figures like LinkedIn’s Reid Hoffman, Google’s Eric Schmidt, Kleiner Perkins’ John Doerr and Yahoo’s Marissa Mayer, just to name a few.

It certainly can’t hurt the group’s political clout on the Hill to have the heads of multiple Fortune 500 companies on its side — to say nothing of their wallets.

Along with supporting the Gang Of Eight legislation — which aims to improve the road to citizenship for immigrants and guest-worker programs — the group’s agenda is focused broadly on education issues, ultimately hoping to beef up the number of science and tech grads in the U.S.

Welcome to the Hill, techies.

Brunswick Group’s Michael Buckley, who has been working with Facebook on a range of corporate and other PR issues over the last several years, will be joining the social networking giant as VP of business communications.

Buckley is essentially taking the job held by well-known Washington, D.C., player Joe Lockhart, who left the company last fall.

In his new job, Facebook said that Buckley would be in charge of the company’s international, monetization, corporate, consumer and policy communications.

Buckley has been with the global strategy and communications consultancy Brunswick Group, one of Facebook’s outside agencies, for a decade, most recently as a U.S. managing partner, where he represented a number of clients at once. In tech, that has included Groupon’s Andrew Mason, as well as Mike Lynch of Autonomy, which is battling Hewlett-Packard right now.

At Facebook, he will report to Elliot Schrage, who is VP of communications and public policy, where Buckley will be one of three top execs in that organization. The others are VP of tech communications Caryn Marooney, and Marne Levine, VP of global policy.

In yet another instance of a Silicon Valley venture firm bringing in big government guns to class up the place, Khosla Ventures said that it had signed the international consulting firm run by former Secretary of State Condoleezza Rice to “bring global and domestic insight to Khosla’s portfolio companies, helping them achieve their strategic goals in industries such as technology, energy, security and healthcare.”

In other words, strategery plus!

That will presumably be provided by Rice and her partners at RiceHadleyGates, which has offices in Silicon Valley and Washington, D.C., in an undisclosed financial arrangement with Khosla. RiceHadleyGates also includes former National Security Adviser Stephen Hadley, former Secretary of Defense Robert Gates and former State Department official Anja Manuel.

In an interview yesterday, Manuel said that the goal was to help in areas that VCs might not be as familiar with, from Internet freedom laws in India to the challenges of moving into emerging markets.

“There are a lot of policy issues that entrepreneurs will be facing and we will try to be helpful as they sort through them,” she said. “We love working with innovative companies and want to make their global experience better.”

Khosla partner Samir Kaul said the firm was still figuring out how they will work together, but that Rice’s team would serve as “strategic advisers on an as needed basis.”

“What [RiceHadleyGates] does fits in very well with a lot of our themes as investors in energy and security, for example,” said Kaul. “We want to offer the companies we invest in as much help as possible and this is a real win in that regard.”

It’s certainly a high-profile move, although Khosla has done this before, signing former British Prime Minister Tony Blair on as a strategic adviser in 2010.

In addition, Andreessen Horowitz brought in former Treasury Secretary Larry Summers, as well as former D.C. Mayor Adrian Fenty, to lend its portfolio companies additional expertise.

Rice’s firm certainly has a lot of that, especially related to thorny international issues. Rice, who was once the provost at Stanford University, was also the National Security Adviser in the administration of former President George W. Bush, before moving to the State Department.

His departure comes nearly 15 months after he joined the company in July of last year, where he worked alongside Marne Levine, another Beltway insider who has served Facebook as VP of global public policy since 2010.

Lockhart is perhaps most famous for his time spent inside the White House as communications secretary for President Bill Clinton during the latter half of Clinton’s second term in office. After the administration ended, Lockhart went on to become one of the founding members of the Glover Park Group, a D.C.-based consultancy firm which has worked on campaigns for Microsoft, Verizon and Pfizer.

The decision comes in part because of Lockhart’s desire not to move to California full-time and to stay on the East Coast, where he has continued to reside throughout his employment at Facebook, a source familiar with the matter says.

Caryn Marooney, VP of technical communications, remains Facebook’s highest-ranking PR official, directly under Elliot Schrage, who is VP of communications and public policy for the company.

The departure comes at something of an awkward time for Facebook, a company largely under the scrutiny of Wall Street and public shareholders after a rough-and-tumble IPO and months of flagging stock prices.

Lockhart follows a string of other high-profile departures, including former head of platform partnerships Ethan Beard, and former director of platform marketing Katie Mitic, who both announced their exits on the same day in August. In June, Facebook CTO Bret Taylor also announced his departure.

Sources say the parting is on amicable terms, and Lockhart may still play a role as a consultant to Facebook from Washington D.C.

“The company understands Joe’s desire to remain on the East Coast, and looks forward to continuing to work with him and benefit from his counsel,” a Facebook spokeswoman told AllThingsD.

Yahoo CEO Marissa Mayer has been trying to recruit Katie Jacobs Stanton, Twitter’s head of international markets, to take a major job on the media side of the Silicon Valley Internet giant, according to multiple sources close to the situation.

While she holds that globally-focused role at the social communications service, Stanton is an obvious choice for Mayer, who actually was once her boss at Google, including when Stanton was the product management leader in the launch of Google Finance.

More importantly for Mayer, Stanton was the key driving force in creating Yahoo Finance, perhaps its most powerful content site, when she worked there from 1999 to 2002.

In other words, she knows media.

It does not seem likely Stanton will leave Twitter, but it makes a lot of sense that Mayer would try to get her.

It’s not clear what job Mayer is offering Stanton, but it is presumably a big one. One source said it could involve running Yahoo’s powerful home page, while another said it might be an even larger role.

Ross Levinsohn, the top Yahoo exec who left recently, had been overall head of media and sales for the Americas at the company. When he was named interim CEO of Yahoo earlier this year, he had elevated Mickie Rosen as SVP of media and commerce.

Rosen is still in that role now, where she has purview over all Yahoo media and commerce efforts worldwide.

But many expect Mayer to soon begin to replace Yahoo’s top exec team with choices of her own. She has already started an overhaul of its communications team, and has been recently focusing on human resources and its product leads, too.

But media is a critical unit at Yahoo, and Stanton would easily be on any short list of candidates to fill key jobs there.

At the San Francisco-based Twitter, her focus has been on raising its profile abroad, where it has been growing by leaps and bounds. That has often been in high-profile ways, such as its use in the Arab Spring protest and after Japan’s earthquake and tsunami.

Stanton came to Twitter from a stint in Washington, D.C., including at the State Department, where she did the laudable mobile donation campaign for Haiti that raised $32 million for victims of the devastating earthquake there. She was also the White House’s first director of citizen participation, and got the Obama administration tweeting via @whitehouse.

At Google, she also worked on its Open Social efforts, as well as on launching its interactive discussion tool, Google Moderator.

But Yahoo Finance is probably still her biggest hit, and one of the few properties on the site that has remain a huge success, despite the company’s many troubles.

Stanton graduated from Rhodes College, and later got a master degree from Columbia University’s School of International and Public Affairs.

I have an email into the apparently silent new PR spokeswoman at Yahoo, as well as the much more communicative spokesman at Twitter, and will update if I get a response.

We’ll see if Mayer can land Stanton, but if you want to get a good idea of the always affable and charming exec, here is a video of her in action — love her “can we go boy, girl, boy, girl” in the Q&A part at the end — at a recent event in Germany, when Twitter was opening its office in Berlin:

In related news, after picking up a midlevel Google product PR person last week to work closely with her on corporate communications, Mayer seems to have grabbed another exec from the search giant. She’s hired a policy manager named Patricia Moll Kriese to become Yahoo’s senior director for corporate projects (whatever that means!).

Earlier this week, I slogged through the rain in a very dorkish GroupMe plastic poncho at SXSW in Austin to attend what I thought was one of the more interesting sessions, titled “Why Cleanweb Will Beat Cleantech.”

Perhaps because it was not yet another creepy location app (memo to Banjo and Highlight users, please stop attempting to get me to allow you to stalk me, cuz I ain’t!), it was more sparsely attended.

But the presentation by longtime Silicon Valley entrepreneur Sunil Paul was a good one, given his premise that current information technology tools were at the heart of creating solutions around energy conservation.

The founder of Brightmail — and also the first start-up partner of Zynga CEO and founder Mark Pincus at a Washington, D.C., company called Freeloader (where I first met the pair) — thinks that clean technologies like solar can be better leveraged with Cleanweb, which he defined as the “application of information technology to resource constraints.”

In other words, more Airbnb (fewer hotel rooms mean less carbon emissions), more Zappos (fewer stores, less driving to stores, etc.) and more teleconferencing (that’s easy to grok) is evidence that the Cleanweb could be an important contributor to saving the planet.

Quoting a recent tweet he saw, Paul noted that a smartphone today has as much computing power as the computers that put a man on the moon, but all we do with them is launch birds into pigs.

“I am saying we can do something better with the aggressive application of software technology,” he said.

Actually, those Angry Birds are now in space, too.

And in 2012 — which also happens to be the 10th anniversary of the confab of tech and media titans — it’s already shaping up to be another fantastic event in terms of programming, with a lineup of onstage appearances that is sure to make some news.

There are many more very big names to come, but Walt Mossberg and I are pleased to introduce the first group of interviewees, which will give you a glimpse into the firepower we expect at D10 in late May. It is again being held in Rancho Palos Verdes, just south of Los Angeles.

The initial speakers we have confirmed so far include: New York City Mayor Michael Bloomberg; serial entrepreneur Sean Parker, who will appear with Spotify co-founder and CEO Daniel Ek; Zynga founder and CEO Mark Pincus; Federal Trade Commission Chairman Jon Leibowitz; LinkedIn Chairman and VC Reid Hoffman, who will appear with LinkedIn CEO Jeff Weiner; and Skype CEO Tony Bates.

It’s hard to imagine someone we have wanted to have onstage more than Michael Bloomberg, a man of many talents and interests. He’s known worldwide as the 108th Mayor of the City of New York. First elected in November 2001 (and again in 2005 and 2009), he is also one of the most compelling politicians in the U.S. today.

But Bloomberg is also a pioneer in terms of the business of digital news and information technology, having built a huge and groundbreaking media company and information service. Bloomberg (the company) has 310,000 subscribers to its financial news and information service, and more than 15,000 employees worldwide.

There will be a lot to talk about with him, from the upcoming presidential election to the state of our government to the future of innovation, news and technology.

Also sure to be voluble is Sean Parker, the legendary Silicon Valley entrepreneur who has been on the cutting edge of innumerable important digital trends of the recent decade. In 1999, Parker co-founded Napster, the controversial and industry-changing music service, at the age of 19.

He followed up with early contact information service Plaxo, and then shifted over to his critical involvement as founding president of Facebook in its early days as a start-up, an experience which was dramatized in the movie “The Social Network.” Parker continued to found and also invest in companies, from Causes to Spotify to his most recent, Airtime, a social video company that he is doing with his Napster co-founder Shawn Fanning.

Parker will be appearing onstage with Daniel Ek, another serial entrepreneur and technologist, who started his first company in 1997 at the age of 14. The Swedish native later co-founded online music phenom Spotify in 2006, with Martin Lorentzon.

The former CTO of Stardoll and founder of Advertigo leads a company that is changing the way music is delivered and consumed by fans, against a backdrop of intense change in the industry, succeeding even as a plethora of other services have stumbled.

Also a groundbreaker is Zynga CEO and founder Mark Pincus, yet another serial entrepreneur, whose latest effort in the online gaming arena has finally resulted in his biggest success. It recently went public, and now has a nearly $10 billion market cap.

Before founding Zynga in 2007, Pincus had already started three other companies: Push start-up Freeloader in 1995; automated tech-support company Support.com after that; and early social networking site Tribe.net in 2003.

(I met Pincus when he was at Freeloader in Washington, D.C., while writing a profile of him for the Washington Post, so I have enjoyed tracking his progress since then.)

Pincus is also an avid angel investor, with early stakes in Napster, Brightmail, Twitter and Facebook.

Reid Hoffman was another early investor in Facebook, along with many of Web 2.0’s most successful ventures. Well-known in Silicon Valley as an entrepreneur and VC, and recently dubbed the “start-up whisperer” by the New York Times (although I am not sure exactly what that means), he’s also chairman of LinkedIn, the business-networking service that also recently went public (at a $10 billion valuation, too).

He’ll appear with LinkedIn CEO Jeff Weiner, who started out life in Hollywood, but soon made his way to Silicon Valley as a top exec at Yahoo. After running its media division, Weiner spent a short time at venture firms before going operational again at LinkedIn.

What it takes to build and maintain momentum as tech companies move into more mature stages, as well as how the social networking space evolves, are among the many topics on tap for the pair.

The evolution of a start-up phenom — in this case, Internet telephony service Skype — will be among the topics covered by Tony Bates, who is now a president at Microsoft, which bought it last year.

As such, he is responsible, says the software giant in its description of his job, “for overseeing the company’s direction, strategy and overall mission to become a global communications service that will eventually reach billions of users.”

That’s a tall order for Bates, who came to Skype from a top job at Cisco. Bates has deep roots (or maybe, routing?) in the guts of the Internet, having done backbone-engineering strategy for Internet MCI. The U.K. native also holds nine patents.

Lastly, given all the activity we expect will happen between government regulatory agencies and tech companies over the next few years, we felt it was key to bring in FTC Chairman Jon Leibowitz. He has been at the FTC as a commissioner since 2004, but was given the top job by President Barack Obama in 2009.

Among his priorities, according to his bio, is “promoting competition and innovation in the technology sector through law enforcement and policy initiatives; and protecting consumers’ privacy — especially while they are using the Internet.”

Uh-oh!

Leibowitz knows from regulation, having served as the Democratic chief counsel and staff director for the U.S. Senate Antitrust Subcommittee from 1997 to 2000, where he focused on competition policy and telecommunications matters, as well as a similar stint at the Senate Subcommittee on Terrorism and Technology before that.

There will be a lot more speakers to come, of course. But, so far, we think D10 is off and running fast.

Vox Media, the Washington, D.C., online media start-up that launched a new tech site called The Verge last fall, is debuting an early version of its expected videogames offering later today.

The site, temporarily called Vox Games, will begin daily publishing today as a section on The Verge, to be followed later by a standalone site under a new brand name.

The company said that “our goal here is to create the premier destination and media outlet for video games news, reviews, video and entertainment.”

As with The Verge, the Vox Games staff is made up of well-known editorial personnel from other prominent sites. It is headed up by former Joystiq Editor in Chief Chris Grant.

Other staffers are former editors in chief of top videogames sites, including Brian Crecente (Kotaku) and Russ Pitts (Escapist).

Yet now that the attacks have subsided, it’s time to see them for what they are: Nothing more than a blunt instrument that accomplishes nothing constructive.

As of today, only one of the Web sites attacked by the hacker troupe Anonymous is still apparently affected, and that belongs to the Universal Music Group recording label. It currently displays only a message saying “The Site is under maintenance. Please expect it to be back shortly.” Others that had been attacked yesterday, including the sites of the U.S. Department of Justice, the Recording Industry Association of America and the Motion Picture Association of America all seemed to be operating normally.

Thursday’s attacks, which have been described as the biggest action yet organized by Anonymous, were launched in apparent revenge for the FBI’s arrest of several people associated with the file-sharing site Megaupload.com over suspicions of online piracy. Taking place against the backdrop of a wider, more civil protest against anti-piracy legislation currently before the U.S. Congress, the atmosphere around the attacks has been politically charged.

As Molly Wood of CNET put it, the #OpMegaUpload attacks — coming as they did on the heels of Wednesday’s peaceful anti-SOPA protest — seem like an “unsettling wave of car-burning hooligans that sweep in and incite the riot portion of the play,” spurring equally unsettling reactions from the powers that be.

Many outlets have portrayed the attacks as “hacks,” implying that someone had picked a lock in order to commit some kind of sabotage. But the tactic used — a distributed denial-of-service (DDoS) attack — is more aptly compared to a blunt instrument, requiring neither skill nor knowledge, only large numbers of willing participants who team up to swarm a site with more requests than it can accommodate and thus overwhelm its ability to function normally.

The adjective “willing” is debatable, and perhaps inaccurate. Anonymous was able to generate such impressive numbers with the operation — it claimed more than 5,000 participants — by spamming a link in chat rooms and via Twitter that, when clicked, triggered a tool used to launch the attack. People tricked into following the link are given no context or information, and so may or may not have any idea that they’re participating in the execution of a crime.

For the record, it is illegal in the U.S., the U.K., Sweden and other countries to launch and participate in a DDoS attack like the one Anonymous organized. As anyone who has observed the evolution of Anonymous (and its various affiliates using the names LulzSec and AntiSec) should know, the FBI arrested 16 people last July, many of them charged with participating in a DDoS attack against PayPal in protest of its shutting down an account used by WikiLeaks.

In 2009, a New Jersey man was sentenced to a year and a day in prison for launching a DDoS attack against the Church of Scientology. And in 2010, a 23-year-old Ohio man was sentenced to 30 months in prison for launching DDoS attacks against several prominent U.S. conservatives, including the author Ann Coulter, former New York City mayor Rudolph Giuliani and Fox News commentator Bill O’Reilly.

Records like that suggest to me that DDoS attacks never accomplish anything that the people who organize and carry them out attempt to do. At most, they inconvenience the people who visit and operate the targeted sites for a few hours, until the attention spans of the attackers shift elsewhere. They also generate headlines that are forgotten by nearly everyone except the targets, and sometimes law enforcement.

And so it will be this time. Mark your calendars, because the Megaupload revenge attacks will spur a series of arrests later this year. Some of those arrested will be people who didn’t know they were committing a crime. And that certainly won’t help Anonymous’ image. Nor will it further a single bit of what passes for the Anonymous agenda.

Poor Chris Dodd — he just got the top media lobbying job in Washington, D.C., at the very moment that the strong-arming-pols, scare-the-children, Jack Valenti era in media lobbying is now decidedly over.

It’s obviously a very confusing time for big media these days, on a lot of fronts. But any of the consummate insider moves once used by the legendarily pugnacious Valenti (pictured here onstage at our first D: All Things Digital conference in 2003) had a hard time this past week, as Internet players went very public in protesting two Congressional bills aimed at combating piracy online.

Not that Dodd didn’t try to cope.

The former Senator — who is now the chief lobbyist for the once much more powerful Motion Picture Association of America — gave a can’t-we-all-get-along interview to the New York Times on Thursday, in which he called for a meeting with techies to come to some acceptable compromise.

Wrote the Times:

“In an interview Thursday, Mr. Dodd said he would welcome a summit meeting between Internet companies and content companies, perhaps convened by the White House, that could lead to a compromise … ‘The perfect place to do it is a block away from here,’ said Mr. Dodd, who pointed from his office on I Street toward 1600 Pennsylvania Avenue.”

But on Friday, after politicians quickly moved to delay both the House’s Stop Online Piracy Act (SOPA) and the Senate’s PROTECT I.P. Act (PIPA) — after successful protests pointing out that the legislation could lead to censorship — Dodd went to the full Valenti again:

“We applaud those leaders in Washington who have chosen to stand with the millions of hard working Americans all across this nation whose livelihoods are threatened by foreign criminal websites designed to steal. As a consequence of failing to act, there will continue to be a safe haven for foreign thieves; American jobs will continue to be lost; and consumers will continue to be exposed to fraudulent and dangerous products peddled by foreign criminals.”

Foreign criminals! Foreign thieves! Is it just me, or does Dodd sounds like Cher, singing, “Gypsies, tramps and thieves”?

(Let’s be clear, that utterance could never top Valenti’s most infamous quote: “I say to you that the VCR is to the American film producer and the American public as the Boston Strangler is to the woman home alone.”)

To be fair, Dodd is hindered by strict restrictions on his lobbying Congress until next year. That said, this is not an old-timey, private Capitol Hill fight, but a modern-era, social-media-charged one.

And it’s pretty clear that the old scare tactics used by big media will no longer work as well, as consumers — as much as they like their movies — seem to love their Internet more.

Thus, what has happened is that — at least for now — the MPAA and media companies have lost and lost big, after the typically fractious Web powers decided to lock arms for once and cooperate with a creative, take-it-to-the-people approach of showing a disabled Internet.

Dramatic? Yes. Effective? Certainly. (That Facebook and Google agree on anything? Astonishing!)

Where it goes from here is unclear — the MPAA and its constituents could certainly rally and put forth their own protest. Ironically, the most effective way to do that is not via the airwaves or other former means of broadcast to the public, but on the Web.

Which is controlled by Dodd’s foes. (You see the problem here.)

The answer, in the end, might have to be the cooperation he first suggested.

As he told the Times:

“The companies, Mr. Dodd said, are ‘rethinking everything,’ not just about the bills, but about their relationship with an estranged Silicon Valley. That need for rapprochement, he said, ‘has come home in a way that no rhetoric of mine could express.’”

Much more to come, obvi.

Today it became clear that SOPA, at least in its current form, will never get that far. Word came from the White House today that the administration, while sympathetic to the cause of curbing online piracy, will support neither the SOPA bill nor its companion bill — known as PIPA — in the Senate.

Responding to a petition, the White House announced in a blog post today that Obama will not “support legislation that reduces freedom of expression, increases cybersecurity risk, or undermines the dynamic, innovative global Internet.”

Basically, what it comes down to is this: Piracy is bad, but approaches like SOPA are bad solutions that would potentially hurt the free-flowing, vibrant Internet we’ve all come to rely on for so many things. As the statement reads: “Any effort to combat online piracy must guard against the risk of online censorship of lawful activity and must not inhibit innovation by our dynamic businesses large and small.”

That aligns pretty closely with a statement that Secretary of State Hilary Clinton made in a recent speech in The Hague, in which she said that governments must fight the theft of intellectual property, “without compromising the global network, its dynamism or our principles.”

On top of that, some of the technical proposals in the bill — meant to remedy the piracy problem — go too far in tinkering, and might perhaps mess up the basic plumbing of the Internet itself. Doing so would probably create unforseen Internet security problems, the White House argues.

Any bill that does aim to clamp down on piracy should be “narrowly targeted,” and cover only “activity clearly prohibited under existing U.S. laws.” That’s also a pretty clear statement that the Administration sees SOPA, as currently written, to be vastly over-broad in its legislative intent.

Additionally, there are also reports that Eric Cantor — the Virginia Republican who everyone knows is the real power broker in the House of Representatives — says the SOPA bill won’t come to the House floor for a vote anytime soon, unless there are some significant changes to it.

Somehow, I find it encouraging that opposing SOPA — or at least calling for changes to it — was the issue on which Obama and Cantor, who can’t seem to agree on anything, found they had some room for common ground. Could this signify a badly needed thaw in bipartisan relations in Washington?

According to sources close to the situation, Dow Jones is losing its top online editor.

Kevin Delaney, managing editor of The Journal Online — or WSJ.com, as it is better known — is taking a job at the Atlantic Media Company, sources said.

The move is a blow to the Journal’s online efforts, as Delaney, who got the top job in late 2009, is a well-regarded journalist and editor.

(He is certainly an AllThingsD.com fave of those at the Dow Jones mother ship, but he still did not call me back to comment! Thanks a lot, Kevin!)

It has not yet been determined who will succeed him at WSJ.com, sources said. Delaney is not leaving immediately.

Delaney joined the media giant in 1992, was a prominent tech reporter in Silicon Valley, and was also deputy managing editor at WSJ.com.

It’s not clear what Delaney’s new position will be at the Washington, D.C.-based Atlantic Media, which is best known for its flagship Atlantic Monthly magazine and also the National Journal.

But sources said his role will be part of a new content initiative the company is undertaking.

The well-known Atlantic has recently transformed itself from a coffee-table, big-think analog offering, which still is published, to focusing more on its online content site.

That includes its sassy Atlantic Wire, which is edited by former Gawker editor Gabriel Snyder. Two stories today, for example, are titled “Where the ‘Crybaby’ Gingrich Meme Came From” and “Cain Promises ‘Unconventional’ Endorsement, Jokes Ensue.”

That’s not your intellectually snotty uncle’s Atlantic!

Complaints arose on Twitter about the high price of Uber car rides due to so-called surge prices that were put into effect across multiple cities. One user, a San Francisco-based entrepreneur named Brendan Mulligan, described in a blog post how a two-minute, half-mile Uber ride cost him $75. He also offered some tips for improving the app.

Here’s a sampling of complaints from irate Uber customers on Twitter:

A total of 97 complaints have been logged since Saturday night about surge pricing, Uber says. That does not include the 15 users the company believes may not have gotten the surge-pricing notifications through their apps when requesting cars. The company declined to say exactly how many customers requested cars via Uber on Saturday night, but founder and CEO Travis Kalanick says the total number of rides was in the five figures. Overall, he says, the evening was a success despite the complaints.

The company is reversing charges for some unhappy customers on a “case by case basis,” Kalanick says.

Uber, which launched in 2010, currently dispatches car services in seven cities, including San Francisco, New York, Washington, D.C. and Paris.

Uber doesn’t dispatch its own cars, but acts as a marketplace through which users can connect with drivers. Kalanick says the surge pricing is to ensure there are drivers available for Uber customers, since those drivers could theoretically make money elsewhere during holidays and other high-demand days.

Since Uber doesn’t dispatch taxi cabs, rates are generally higher than regular cab rides to begin with. Users get a direct-dial option for calling the driver as he or she approaches them, and the cars that arrive are usually high-end town cars. Uber rides also include a base fare of between $7 and $8 depending on the city, and the tip is automatically factored into the final price per ride.

The company has been known to put surge pricing into effect on nights when it anticipates demand to outpace the supply of car services available. The company did this on New Year’s Eve last year, and also on Halloween. When prices are about to surge, Uber sends a mass email out to its users, puts up a blog post detailing the pricing changes, and, barring technical issues, users should also get notifications through the app during times that surge pricing is in effect.

Dynamic pricing — especially when it comes to the travel industry — is not a new concept. Kalanick says Uber faces a unique challenge when it comes to changing expectations that come with decades of fixed pricing in car transportation.

“If you look at a club that charges a $20 cover on a normal night and then charges $100 on New Year’s Eve — that’s just what happens,” he told me. “But with Uber, we understand there are some people who feel the pain of that transition and we take some responsibility for making it as smooth a transition as possible.”

He said the company will still put variable pricing into effect during holidays in the future, and is currently considering whether to do the same during weekend nights.

Think about the federal government’s blocking of the $39 billion AT&T and T-Mobile merger and you might want to reread Google’s blog today, penned in reaction to the news that the Justice Department is making a second request for information about its $12.5 billion acquisition of Motorola Mobility.

“This is pretty routine,” wrote Google’s Motorola integration exec Dennis Woodside. “We’ve gotten these kind of requests before.”

Maybe Google has (and it has with other purchases) — but in actuality, only four percent of transactions got such a follow-up request from regulators.

To be fair, it is much more common in high-profile, big-money deals like this one, but it means a longer closing period and more uncertainty around the Android mobile ecosystem until it’s done.

Still, Google has good reason to be patient. Despite tough criticism and brutal lobbying, it won approval from Justice for its $700 million deal to buy flight data service ITA Software in April, after nine months of scrutiny and a number of conditions imposed.

And the search giant waited out an intense six-month Federal Trade Commission approval process last year for its $750 million acquisition of mobile advertising start-up AdMob. It had an even harder time with the FTC’s nod of its 2007 DoubleClick purchase for $3.1 billion.

One that it lost — an obvious bridge too far that I dubbed Yahoogle — was Google’s 2008 effort to meld a troubling partnership with Yahoo in search advertising.

So, we’ll see soon enough which way D.C. — which just had Google Executive Chairman Eric Schmidt up to the Senate for an antitrust hearing chit-chat — will go.

An update on our Motorola acquisition

Since we announced our plans to acquire Motorola Mobility, we’ve been excited about the positive reaction to the proposed deal — particularly from our partners who have told us that they’re enthusiastic about our defense of the Android ecosystem.

And as David Drummond said when we announced our plans in August, we’re confident that this deal will be approved. We believe very strongly this is a pro-competitive transaction that is good for Motorola Mobility, good for consumers, and good for our partners.

That said, we know that close scrutiny is part of the process and we’ve been talking to the U.S. Department of Justice over the past few weeks. Today we received what is called a “second request,” which means that the DOJ is asking for more information so that they can continue to review the deal. (This is pretty routine; we’ve gotten these kind of requests before.)

While this means we won’t be closing right away, we’re confident that the DOJ will conclude that the rapidly growing mobile ecosystem will remain highly competitive after this deal closes. We’ll be working closely and cooperatively with them as they continue their review.

Arriving at Silicon Valley’s Computer History Museum, in the heart of the tech industry, with the leader of the free world talking jobs and digital, you might expect fantastic wireless access.

You might, but not so much if you are a “local” reporter and can’t jack into the extra-secret-special wireless link the national White House press corps apparently has reserved for itself. (They also get a lovely noshing buffet, whilst we tech reporters have been instructed not to touch the pineapple and scones or else!)

Famished for coffee and carbs, we’re left with glomming onto the museum’s slowish wireless service — there are lotsa geeks here today jamming up the lines — and every now and then getting some juice from Google. The search giant blankets the Mountain View, Calif. area near its HQ with free Wi-Fi, but it fades in and out.

I am now reconsidering the antitrust investigations that the Obama administration is conducting against Google, as long as its signal is good enough to check Twitter.

So this liveblog of President Barack Obama’s LinkedIn Town Hall — which will center on jobs and is titled, “Putting America Back to Work” — could be glacial with not much news, much like what I am expecting from the event itself.

I’d certainly like to work, as long as the wireless does! (Plus, limited power outlets in the room, so it’s every reporter for herself!)

But bygones, while we await the Prez!

10:18 am: One thing that made me flee Washington, D.C., when I worked for the Washington Post, was all the rigmarole that surrounded the appearance of and access to politicians.

I get it, the security and all, and am all for it on a general safety level. But, no matter how you slice it, it hinders any kind of movement or genuine interaction, like being stuck at a really dull opera. All the world’s a stage and we are all merely waiting in traffic.

In contrast, and one of the joys of Silicon Valley, is that anyone can get up right up into the grill of the various billionaire potentates littering the landscape, engage in a debate and get a possibly real answer.

Thus, I am hoping for a lot here from LinkedIn CEO Jeff Weiner, who is going to moderate the hour-long session with the President.

By the way, while he is busy running the business-focused social networking site, Weiner is looking good in a fancy suit, almost as if he could be Secretary of the Internet. I’d vote for him.

10:28 am: Some painless but hip music is playing now, as we wait, wait, wait for Obama, who is set to begin in 30 minutes.

I wonder if the President is ever early. Wouldn’t that freak the peeps out?

(Obviously, I am bored, so I shall now go monitor Twitter to catch up on the latest in the new bad-marriage-or-not cat fight between Brad Pitt and his ex, Jennifer Aniston — as if we need him to tell us Angelina Jolie is more interesting. Frankly, Angie’s midday snack is more interesting than Jen.)

There is now what appears to be a Secret Service dude next to me, giving me a hairy eyeball. If I am jailed over my wireless protest, please give generously to my defense fund.

Free the Internet! Free the Internet!

10:35 am: Finally, the production guy is up giving out the rules. Turn off the cellphones, no making noise.

The head Secret Service guy then takes the stage. No getting out of your seat. No sudden movements. And no crossing the blue line in the front row.

“All joking aside,” he says, he will take you down. He also notes that if the President moves toward you to shake your hand, “do not move toward him.”

I love Secret Service agents — especially when played by Clint Eastwood — and wish I had one to give a few people in tech a little smackadoo on my behalf. And not only if they moved toward me!

10:47 am: This little frisson of excitement is followed by more waiting, as the final seats are filled up in the room, which is an unusually (and welcome) multi-racial and gender-balanced crowd for Silicon Valley.

Various White House aides skitter back and forth like nervous ground squirrels — I would imagine their life is one big effort to avoid any gaffe — so the Prez must be near.

I am actually looking forward to seeing him, as I never have in person and am looking forward to seeing the famous Obama charm and techie cred.

Indeed, he is probably the most fast-forward tech president there has ever been. That said, buffeted by more serious issues facing the nation, his administration has delivered on few — by which I mean none — of its promises around the digitization of the U.S.

Our high-speed broadband, for example, is still woefully slow, inordinately expensive and not easily available nationwide.

And I will not even go into the need for increased focus on math and science education or the importance of our broken visa policies.

But the topic today is jobs, which is an arena where Silicon Valley and tech shines in the U.S., even as manufacturing of it has mostly moved overseas. How tech can help improve in the creation of jobs will be issue No. 1 here.

10:55 am: Total silence with five minutes to go. I need the President around to quiet my kids.

Now, LinkedIn Chairman and VC Reid Hoffman comes in, so the event is probably about to begin.

And, indeed, Weiner emerges to cheers, to give a little speech on “changing the way we work … and connecting talent to opportunity.”

11:01 am: Then, the session starts right on time with President Obama.

He begins with a rote speech on jobs, which is nonetheless the most important issue he faces going into next year’s election.

11:14 am: Ah, wireless glitch! Back!

President Obama is inexplicably in the middle of a Medicare question, which gives him an opportunity to talk about the need for the rich to pay more taxes.

And pass his American Jobs Act, of course.

11:17 am: More on proposing legislation for retraining workers, such as the questioner’s mom.

Now to a group of email questions. The first is about when small businesses are going to get a break from onerous regulations and taxes.

President Obama says since he has been in office, he has cut taxes 16 times for those who create a business.

But he is not going to apologize for some regulations, such as those for the financial industry over the mortgage crisis.

“There are some regulations that have outlived their usefulness,” he says, but others not so much.

11:24 am: The next question is from a Chicago IT employee. Except she is not employed.

She is asking a question about keeping her skills up and what programs are needed.

“The best thing we can do for you is that the unemployment rate goes down,” said President Obama, but also adds that making it easy to go to school while waiting on a job is also important.

“Just looking at you, I can tell you are going to do great,” he tells her in an awkward effort at reassurance.

Thanks, Barack, but she needs a job!

11:28 am: A veteran is asking a question about transitioning out of the military.

Obama launches into a story of a medical technician who faced all kinds of experiences, but had to start over again with new classes when out of the military. He suggests some level of credentialing based on experience.

11:33 am: Obama gets to pick out someone from the crowd and manages to pick out a dude who is a former Googler — although he only says that he works down the street — and is out of work by choice.

He asks: “Will you please raise my taxes?

A plant? I wish!

President Obama asks the name of the start-up. “A search engine,” says the ex-Googler-in-disguise, who is Doug Edwards, an early marketing exec there who actually wrote a book on being an ex-Googler.

“That worked out well for you,” kids President Obama.

Everyone likes a rich-guy joke!

He is soon onto the idea that we’re all dang lucky and declares he does not want it to turn the debate over taxes into a rich-poor war.

Bottom line, he notes that we have to raise taxes on the very wealthy. Frankly, if we raised taxes on a bunch of folks in this room, it would help a lot.

11:42 am: A teach-training question, especially math and science teachers.

President Obama is all for it.

He is meaning well here, but all he seems to offer is a lot of bromides about the importance of education and errant related anecdotes.

Like one from IBM, where the company hires the kids in the program at the end.

President Obama wants students to see a direct connection between learning and jobs.

Then, he kind of says it again. Gosh, he can talk. How does the well-fed and wirelessly connected White House press corp take it? Lotsa donuts, I would imagine.

President Obama also wants us to turn off the electronics and video games for kids, too, thereby instantly losing the votes of my two sons!

Another laid-off guy is up at the mic. He had 22 years in IT management and is disheartened.

He wants a statement of encouragement from the CEO of America.

President Obama assures him that his track record of success gives him a leg up, but that the problem is the economy and the global meltdown, too.

It’s systemic, apparently.

“The problem is not you, the problem is the economy as a whole,” says President Obama.

That was the last question. Weiner, who has been sitting quietly (I know it was hard, Jeff, but good job), thanks the President and tells him that this is a big issue.

President does his thanks, too, for being able to speak, although not really that much was actually said.

And then a genuine moment, finally, of clarity.

“Look, we’re going through a very tough time, but we have gone through tougher times before,” he says. “But the trajectory we are going on is one that is more open, more linked …”

He talks about the need for being ready to take advantage of that opportunity.

“Things have gotten so ideologically driven, putting party above country,” he adds, that nothing is getting done. That’s why the people, the voters, have to demand leadership from their elected officials.

Or, presumably, fire them and let them try to find another job, too.

It might turn out to be the best idea yet, if these pols don’t agree on something and quick.

Ready, aim, fire — at Google at the Senate Judiciary Committee’s antitrust subcommittee hearing happening right now in Washington, D.C.

It is titled: “The Power of Google: Serving Consumers or Threatening Competition?”

Here we go:

11:04 am: As usual in D.C., the Senators on the committee get to pontificate first.

Oh, joy! (I used to live there and cover Congress stuff for the Washington Post from time to time and I am having bad déjà vu right now.)

A quick cut to Google Executive Chairman Eric Schmidt, who is appearing alone. He looks a little peaked, especially as the pols begin to describe the scary behemoth the search giant is.

And also that it is trying to force users to its other products.

Rut-roh.

11:07 am: Sen. Mike Lee, the Republican from Utah, who is a Google critic, is talking on about the search giant’s power, reading from his testimony in a dullish style.

I thought this dude was a Tea Party firebrand!

“The primary focus should be consumer welfare,” he says, blah, blah, blaaaaaaah.

11:09 am: Now, the subcommittee’s dour chairman, Sen. Herb Kohl from Wisconsin, is introing Schmidt, who is actually being introed by California Sen. Dianne Feinstein.

She is an Eric fan, obvi, praising his accomplishments at Google. But she also gives props to Jeffrey Katz, CEO of Nextag, who is testifying against Google later. Also, let her add, is the fabulous CEO of Yelp, Jeremy Stoppelman, another anti-Google speaker to come.

“I hope they tango rather than tangle,” says Feinstein inexplicably about those called to testify. Hey, white geeks can’t dance, although wrestling would also be hard for them too.

In any case, gotta love these everybody-loving pols!

11:14 am: Finally, Schmidt, who — of course — starts off invoking the last big tech giant who was here getting spanked by Congress.

Schmidt does not name Microsoft — classy, by which I mean not at all — but is referring to the software giant.

“We get it,” he says about the lessons Google has learned from Microsoft’s own antitrust troubles back in the day.

11:18 am: Schmidt is talking about Google and saying he welcomes the competition.

“Today it’s Google turn in the spotlight,” he says, still not uttering the word “Microsoft,” much as Microsoft execs have often not been able to say Google. “One company’s past [should] not be another company’s future.”

Now, the senators can have at him. Kohl is up first.

11:20 am: The first question is if Google is favoring its own products, via search.

Schmidt harkens back to what he calls early Google lore that it is just trying hard to get consumers stuff quicker.

The need for speed!

“Is really trusting Google to do the right thing sufficient?,” asks Kohl, who quotes former President Ronald Reagan’s famous line: “Trust but verify.”

That gives Schmidt the chance to talk about how quickly Google could lose out to competitors and then is onto how hard it is to do what Google does.

It takes extra-smart smartypants. Trust us, he says, as we are smartier!

11:24 am: Kohl comes back with a damning quote from Google’s famous Marissa Mayer, who apparently has said that the company favors its own products and why not?

Schmidt says he was not there when she allegedly said this, but that its own testing and intuition tells Google if consumers want a Google map or whatever tout de suite!

Kohl repeats the Mayer quote again: “We do all the work for the search page, so we put [a Google Maps link] in first.”

“I will let Marissa speak for herself,” says Schmidt, now too deep in the weeds of her verbal faux pas. Get out, Eric!

11:28 am: Sen. Lee is up, not taking any of this speedy, we-know-best business.

And he has a chart! I love a good chart. It shows Google info always ranks first in listings versus other sites it competes with.

Lee wants to know why, according to his chart, that Google seems to come up first.

“Either way, you’ve cooked it,” claims Lee.

“Senator, I can assure you we have not cooked anything,” counters Schmidt.

(Note: Google does have an excellent cafeteria in Silicon Valley, complete with organic arugula and Kombucha for all.)

11:33 am: Hoo boy! But Lee’s time has expired, so Schmidt gets a break in the form of New York’s Sen. Charles Schumer.

I like the way he says “ee-no-vation” for innovation.

He does an expected plug for New York, of course. Somehow it is No. 1 in tech. Not so much, but brag on, Chuck!

11:38 am: Schumer is still talking about New York and its fab entrepreneurs.

Apparently, he has done a lot of jawboning with start-up dudes (likely over Kombucha) and they think Google is a positive force.

“Google is actually pretty good, we don’t see them as rapacious,” Schumer says the New York nerds tell him.

Is “rapacious” the criteria here?

Schumer is running out of time and has yet to ask a question and now is trying to get Schmidt to test Google’s broadband project in the Hudson Valley.

Now that’s rapacious!

Is there going to be an actual question here?

Yes: Oh please tell us, genius boy, what could Google do better?

11:42 am: Now, Sen. John Cornyn from Texas is on and asking about the prescription controversy Google was embroiled in recently.

Oops, I missed a bit when someone called me about the CEO mess at Hewlett-Packard I reported on earlier.

Onto Senator Amy Klobuchar from Minnesota. She is cleverly using an article about the Vikings football team to ask about how Google’s super-secret-sauce algorithm works and how it ranks results.

“Do you think companies should have a lot more certainty in how they are ranked?,” she asks.

11:51 am: Schmidt is not really answering, except to say Google is not perfect.

“We don’t know how to do it with more certainty,” he says, which is odd for a company that is perhaps the most irksomely certain group of geeks ever assembled on the planet.

Klobuchar moves to copyright issues. “There’s a real problem here,” agrees Schmidt.

Yes, and some media companies think Google is the problem and has not done enough to fix the problem.

“It’s difficult,” says Schmidt. Well, isn’t Google smartier?

“We’re under great pressure to resolve this,” he says.

11:55 am: Klobuchar is still worried about the small businesses, but she wants Google to come to Duluth.

Good lord, it’s a shakedown in plain sight. Maybe Google isn’t the scary one here! These pols seem pretty frightening.

Now Iowa Sen. Charles Grassley is saying he will attend some Google event in his state.

Of course!

Grassley makes a wishy-wishy statement, and we get to hear from Iowans on both sides.

Some are apparently concerned that Google is a troublemaker and some aren’t.

Iowans, like a lot of folks, are torn.

“We are happy to be judged,” says Schmidt.

12:00 pm: Now it is time for Sen. Al Franken from Minnesota.

“First let me say, I love Google,” he says.

Otay. I wonder if Franken knows that Google is a giant scary computer.

But, as a citizen of San Francisco, I say he should love whoever he wants!

Franken is also concerned about his love’s behavior and is taken aback by one of Schmidt’s previous answers.

It’s that irksome Marissa Mayer quote again.

When asked if the algo was unbiased, Schmidt apparently was not as sure as shootin’!

Now, it is onto Yelp and the fiery quotes from Stoppelman about how Google nefariously blocks the review site’s content.

Eric “generally” disagrees with Jeremy.

At one point Google tried to buy Yelp, so this is a fraught situation.

Does Franken know about the previous Google-Yelp hookup?

Drama!

Schmidt says it is Yelp’s fault for asking to be removed from the algo. Actually, Yelp only asked Google to stop jacking its fare.

12:11 pm: Oh noz, another pol? This time Sen. Richard Blumenthal from Connecticut.

He is super-smiley, while calling Google a “behemoth.” I like that word a lot and use it for the company often, although I always like to use a qualifier like “thuggish” or “freaky.”

Back to the blabby Blumenthal, who cannot seem to get out a question.

Wait! He asks if Google can suggest some fixes to “avoid government regulation.”

I. Kid. You. Not.

12:21 pm: Kohl is back and giving Google a little more slap-a-doo.

I like the whole Kohl thang of looking over his glasses down at Schmidt.

He asks: Should we trust Google? Should we?

In my opinion: If your mother says she loves you, you should check it.

So, no!

Schmidt assures him: “We make mistakes.”

Lee is then back, asking if Google gives preference to its own products in search?

Exactly the point and a question that is still not answered properly.

12:24 pm: Lee remains troubled by Schmidt’s testimony.

He uses terms like “leverage its natural dominance” and “significant market share to disadvantage” competitors.

Sounds like, um, Microsoft. And then it is back to that niggling Marissa Mayer quote. (Memo to the voluble exec, who apparently never met a microphone she didn’t want to talk into: You might want to take a day off today at the Googleplex.)

Google-luvin’ Franken is back and he is asking about mobile search.

Where Google is dominant again! (Jellllllo, Al, we in Silicon Valley know that one already!)

He asks if all Android devices come pre-loaded with Google products. Schmidt thinks two-thirds come with it, but handset makers can choose.

12:31 pm: Back to all-smiles Blumenthal, who says he has come to no conclusion.

But lo! He is not as silly as he seems and goes into an interesting racetrack analogy about how Google owns the track and now has horses and now those horses are winning.

Hmmmm…

Schmidt disagrees, natch!

He thinks the Internet is the platform and Google is the GPS.

12:37 pm: Finally, the second panel of critics. Sadly, I must go to an appointment in Silicon Valley to visit one of its rapacious companies.

12:47 pm: The panel’s back in session. The first critic to take a shot at Google, Thomas Barnett, a lawyer for Expedia.

12:51 pm: Riffing on Schmidt’s earlier “We know, we get it” comment, Barnett argues the opposite.

“Google doesn’t get it,” he says, adding that the company’s ever-expanding market power is troubling.

12:54 pm: Google is a monopoly, Barnett continues, and it has a duty not to abuse that position. He concludes by saying antitrust enforcement can and should play a role in maintaining competition in the markets in which it does business.

12:57 pm: Moving on now to Nextag CEO Katz, who has some tough words for the search giant. “Today Google doesn’t play fair,” he says.

He argues that Google rigs its results to drive consumers to Google Product Search when they search for information to inform their purchases.

1:00 pm: Next: Stoppelman of Yelp, who wonders if it’s even possible to create a company like Yelp today because of Google’s massive market power.

1:04 pm: Google’s outside lawyer, Susan Creighton, takes the mic next. Having trouble with the video stream from the Senate, but as best I can tell she talked broadly about the competitive landscape and reiterated Schmidt’s “competition is just a click away” narrative.

1:08 pm: She concludes by saying government oversight of Google’s search results rankings would put the company at a disadvantage and turn its search service into something akin to a “regulated utility.”

1:09 pm: Interesting. Creighton says she doesn’t believe Google has monopoly power.

1:10 pm: “Each of you right now can test whether or not you like Google’s search results and if you don’t like them it’s free and instantaneous to try someone else.”

1:22 pm: Apologies, the Senate video feed has gone from bad to worse.

1:23 pm: Franken asks Yelp’s Stoppelman and Nextag’s Katz if they could start their companies today given Google’s market power.

Both say that’s unlikely.

1:26 pm: Terse exchange between Franken and Creighton about whether Google paid Apple to be the default search engine on its iOS devices. Lots of back and forth, but Creighton finally concedes that there’s some sort of financial deal between the two companies.

1:39 pm: Sen. Lee asks what Google might do to “level the playing field.” Stoppelman suggests separating search from its other properties. Pipe dream.

1:40 pm: Well, it looks like it may be getting near the end of the session, which is a good thing because we get it to by now.

And that is: Nothing significant is going to get said here.

While New York City was largely spared — though Staten Island and Queens were whacked fairly hard — surrounding states, especially Connecticut and New Jersey, got a good thumping. As many as 700,000 people in Connecticut and 600,000 in New Jersey are without power in the wake of Irene, and many will go without for as long as a week.

Power outages in others states, in no particular order: Vermont is reporting another 50,000 residents without power, and at one point or another, every single road in that state, except for Interstates 89 and 91, were closed due to flooding.

Another 700,000 are without power in Massachusetts; 160,000 are without power in New Hampshire; power is out for 171,000 in Maine; and power is out for 284,000 in Rhode Island.

Power outages were still being addressed this morning in Maryland, Virginia and North Carolina; another 20,000 or so are without power in the District of Columbia. Delaware has 39,000 without power, and a tornado touched down there; Pennsylvania, including the Philadelphia area, has about 400,000 without power. The total number of homes and businesses without power up and down the East Coast was in the neighborhood of six million.

An estimate of the cost of damage to insurers, conducted by Kinetic Analysis, a firm that predicts storm damage, is about $3 billion, down from an earlier estimate of $14 billion. The death toll so far is 25.

Flooding is by far the biggest threat. The city of Troy, New York, is threatened by a swelling Hudson River and a fragile dam holding it back.

Overall, communications infrastructure held up pretty well — except in those places where it didn’t. In a conference call on Sunday, the Federal Communications Commission said that 130,000 wireline subscribers lost phone service, while nearly 1,400 cellular telephone sites were out of service. Another 1,093 cell sites were running on backup power, and 500,000 cable TV subscribers lost service. The agency warned the tally could get worse, as power outages remain and battery backup systems fail.

All the stock exchanges in New York will open normally, though lots of traders who typically come into the city on Metro North may have trouble getting to work.

Did I say New York was largely spared? By the storm, mainly, but not by slightly panicked officials. The Metro Transit Authority is scrambling to get the subway system back up and running normally. Having for the first time shut the entire system down, it was limping back to life as of 6 am Eastern time. While the Long Island Railroad is running a nearly normal schedule, Metro North is not expected to operate at all.

New York area airports are re-opening as of 7 am Eastern time. Traffic at Logan International Airport in Boston is still snarled, as is Amtrak’s Acela service. Flights into and out of Baltimore and Washington, D.C., were slowly getting under way.

Another casualty: Local public radio station WNYC suffered damage to its AM transmitter because of flooding in New Jersey, and directed listeners to its Web stream, though its FM transmitter was fine.

For all the trouble Irene caused humankind, a more fragile creature emerged unscathed from the storm’s path. USA Today has an interesting story about a rare whimbrel, a type of shorebird, nicknamed Chinquapin by wildlife scientists in Georgia, who tagged it with a radio tracking device and spotted its signal on the Caribbean island of Eleuthera. The bird had flown through the most dangerous northeast section of Irene when it was still a Category 3 hurricane. Whimbrels typically spend their summers in Canada and then fly south to Brazil to breed. That’s one tough bird.

Yes, New York and much of the Eastern seaboard is preparing for a direct hit from Hurricane Irene, which is being described locally as as a “once-in-a-lifetime” type of hurricane that hits all the populated coastal areas rather than skirting them.

Mayor Mike Bloomberg just announced mandatory evacuations for areas of the city that are most likely to be flooded, which affects more than a quarter-million people. Subway trains, buses, as well as the Long Island Railroad and Metro North rail service are all scheduled to shut down tomorrow at noon.

Many New Yorkers, myself among them, are either getting out of the city or hunkering down. Last night I stocked up on new flashlights and a few of those huge packages of batteries that tend to last for years. As much faith as we have in Con Edison and other regional power companies who keeps the lights on, they’re warning of possible outages.

Phones, wireless, and Internet infrastructure are likely to take a hit too up and down the East Coast. I checked in with several companies to see what they’re saying about their ability to keep services turned on so that people in affected areas can stay informed and communicate with loved ones.

If the power goes out, and if you haven’t done away completely with your old-school telephone line, now would be the time to make sure you have an old-school corded phone around the house. If your home loses power, the phone lines will keep running. The phone networks’ central offices and switching stations have backup power to keep the dial tone on. However, if you have a cordless phone you’re out of luck. Best to spring for an old-style corded phone if you don’t have one lying around.

If you’re wireless-only, you have a pretty good chance of being able to make calls. I checked in with Verizon Wireless, AT&T and T-Mobile today. As with the central offices on the wireline network, wireless towers have backup power too. All carriers said their teams were fanning out across the region topping off the fuel tanks of backup generators and readying mobile cell sites that can be deployed quickly where needed.

I remember my BlackBerry kept running during the Northeast Blackout of 2003. I was able to contact friends outside the blackout zone to get news stories about what was going on. That is, until my BlackBerry’s battery ran out. Have extra batteries and even an extra phone charged up and ready, and make sure your phone stays dry. All the carriers are advising that you save your power for emergency calls and use text messaging to minimize network congestion. Remember that it was network congestion that ground the wireless networks to a halt after the earthquake on Tuesday. (It felt so strange to type that. Suddenly I feel like I’m a character in a Left Behind novel.)

So what about the Internet? Customers of Verizon FIOS know that even if the power goes out, their modems have an eight-hour backup to keep the bits flowing and the dial-tone on for phone service, but not the Internet. Time Warner Cable, which serves about 6 million people from the Carolinas to New England, has deployed Business Recovery Unit trailers up and down the coast to quickly restore service to affected areas.

All that is great news for connections at home. What about critical services for businesses? As we saw in April when it crashed for a few days, Amazon Web Services is pretty critical for several companies. The company has data centers in Northern Virginia that are close enough to Irene’s path to make customers nervous. Geekwire noticed a message on a support forum advising customers to make sure they’re running applications in more than one data center. “We are monitoring Hurricane Irene and making all possible preparations, e.g. generator fuel, food/water, flashlights, radios, extra staff,” the message said.

And what about Monday morning? In New York, the big question is whether the markets will open on time. After 9/11, the New York Stock Exchange closed from the time of the attacks (Sept. 11, 2001, was a Tuesday) through the end of the week. Trading reopened the following Monday, Sept. 17. If the market did fail to open Monday, it would be the first time such a closure was forced on the exchange by external forces since then. The last time a hurricane shut down financial markets was in September of 1985, during Hurricane Gloria.

Reuters is reporting that staffers at the big board were laying in a supply of fuel for backup power generators located above the trading floor, as well as a supply of food. A final decision about whether or not to open as usual will be made Saturday or Sunday as circumstances warrant.

The hurricane’s name, of course, can’t help but conjure up thoughts of “Goodnight, Irene,” the early 20th century folk standard that seems to close every third or fourth installment of Garrison Keillor’s “Prairie Home Companion” radio show, the lyrics of which have been running through my head all day. The folks at The Awl have collected 23 different versions of the song performed by artists as varied as Willie Nelson, Eric Clapton and The Meat Puppets. Acting as Facebook often does to Google, a new site started by former Engadget editor Josh Topolsky just hired away yet another passel of tech journalists from the giant gadget news and reviews organization.

Editorial movement is not uncommon on tech news sites, but this level of it from one site to another is somewhat, um, aggressive.

Engadget, which is owned by AOL, is one of the largest tech-focused sites on the Web. Topolsky left his editor-in-chief job there in March.

By April, he had grabbed eight prominent Engadget staffers who had left the huge tech site amid editorial tensions, in order to start a new competing gadget property for the well-funded sports content start-up SB Nation.

Now, sources said, Topolsky has added Thomas Ricker, an Engadget senior editor, who had run its European coverage; Sean Hollister, a senior associate editor, who ran its West coast team; and Joseph Flatley, an associate editor.

Also hired: Thomas Houston, editor-in-chief of Switched, an AOL tech site that was recently subsumed into its Huffington Post Media unit; and Dieter Bohn, who was editor-in-chief for the Smartphone Experts network of sites, including Crackberry and others.

And other possible new hires soon from Engadget: Another European editor, Vlad Savov, and writer Jacob Schulman.

The Topolsky-helmed site is still unnamed but is now operating as This Is My Next. It already has 16 writers, compared to Engadget’s two dozen, and is set to debut in the fall with a new name.

It will be the first content expansion at the Washington, D.C., SB Nation, which completed a $10.5 million Series C round, led by Khosla Ventures, in the fall.

Before that, SB Nation had already raised about $13 million in total venture funding from Accel Partners, Allen & Company and Comcast Interactive Capital, as well as from angel investors such as Ted Leonsis and others in Silicon Valley.

Another AOL link: SB Nation was founded by former AOLer, CEO Jim Bankoff, who had bought Engadget for AOL many years ago.

Engadget Editorial Director Josh Frulinger said that the impact of the talent drain on Engadget — mostly from This Is My Next raids — has been small, since the site has also been aggressively hiring.

“We’re past the people leaving and into celebrating what we’ve accomplished in six short months, and we welcome any new competition,” he said. “Dana Wollman, Brian Heater, Myriam Joire, Zach Honig, Joe Pollicino, Richard Lawler, Michael Gorman, Sean Buckley, Joseph Volpe, Brad Molen, Terrence O’Brien, Amar Toor and Sharif Skar — all brought on in the past six months — are your Engadget stars of tomorrow.”

To prove it, AOL said unique visitors for Engadget in June were up 1.1 percent from May and will be up again for July. In recent reports, the site had 14 million unique monthly visitors.

Earlier this week, he hired away eight staffers from AOL’s Engadget in order to create a competing tech news and gadget reviews site.

And now, according to sources close to the situation, the former AOL content head is close to hiring another former top AOL media exec, Marty Moe (pictured here), to manage it and also more niche sites the blog network is contemplating launching.

Sources said the hiring of Moe is not yet complete, but is close to being struck.

Tyler Bleszinski, SB Nation’s founder and sports editorial director, will continue to manage the start-up’s sports blog network, while Moe will focus on the company’s tech vertical and any other future categories.

Moe left AOL less than a year ago, after nine years working at the New York-based portal, including with Bankoff.

Both had been involved in the purchase of Weblogs Inc., which included the flagship Engadget site.

Now, it seems they will be trying to remake the concept of a content network, although in a more entrepreneurial and innovative setting.

The new tech site–which is still unnamed and will be helmed editorially by outgoing Engadget Editor in Chief Josh Topolsky–will debut some time in the fall. It is the first content expansion at the Washington, D.C., SB Nation, which has heretofore been exclusively focused on sports.

Topolsky will be joined by former Engadget managing editor Nilay Patel and also former staffers Paul Miller, Joanna Stern, Ross Miller, Chris Ziegler, Justin Glow and Dan Chilton.

All of the above had left Engadget in a series of departures of late, all due to increasing unhappiness with AOL’s management and content strategy.

Many new upstart content sites such as SB Nation have begun to try to eat away at the big portal’s content strategy–pushed by its CEO Tim Armstrong–with perhaps more nimble efforts of their own.

And those smaller companies are also well funded.

It had already raised about $13 million in total funding from Accel Partners, Allen & Company and Comcast Interactive Capital, as well as from angel investors such as Ted Leonsis and others in Silicon Valley.

UPDATE: In related news, sources said that AOL has zeroed in on Tim Stevens, Engadget’s automotive editor to replace the outgoing Topolsky. The New York-based company had already named Darren Murph as its new managing editor.

Now Stevens will be competing with Topolsky, as well as managing editor Nilay Patel, who will also lead the Engadget tech-exodus (techxodus?). The others include former Engadget staffers Paul Miller, Joanna Stern, Ross Miller, Chris Ziegler, Justin Glow and Dan Chilton.

Stern and Ziegler are still on Engadget’s editors site as current employees.

As you may have already heard (or read), there’s some activity going on in the world of Joshua Topolsky. Earlier this evening, David Carr published a piece in the New York Times about a new project that I’m embarking on…and I want to just say a few things about it.

Firstly: yes, this is happening. I’ve decided to join the team at SB Nation to build something brand new in the tech space. Now I know it might seem odd to some that I would be partnering with a sports publisher to build a technology news site, but that’s only half the story. This isn’t just about sports, or tech, or lone silos. What we will build together at SB Nation is a new media company–buoyed by the absolutely incredible work SB Nation has already done in publishing–and part of that new media company will be the as-yet-unnamed gadget and technology site that I’ll be working over the next few months to create. When we launch (hopefully in the fall), I will be editor-in-chief of a property that I hope will inform, entertain, and engage fans of technology in whole new ways.

I should say that I wouldn’t want to build something like this alone, and thankfully, I won’t have to. I’ll be joined by some very good friends at this new venture–people like Nilay Patel, for instance.

Of course, the natural question I’m sure a lot of people have is: why SB Nation? The easy answer is that the people at SB Nation share my vision of what publishing looks like in the year 2011. They think that the technology used to create and distribute news on the web (and mobile) is as important as the people who are responsible for the content itself. And that’s not just pillow talk–SB Nation is actively evolving its tools and processes to meet the growing and changing needs of its vast editorial teams and their audience communities. They’re building for the web as it is now. From the perspective of a journalist who also happens to be a huge nerd, that’s a match made in heaven. SBN isn’t just another media company pushing news out–it’s a testbed and lab for some of the newest and most interesting publishing tools I’ve ever seen. In short, I was blown away when I saw what kind of technology they’re using to get news on their front page and engage audiences, and even more blown away when I started talking to them about what could come next.

But beyond the technology (and possibly more important than the technology), there’s another factor here that’s driving my decision. It’s that SB Nation believes in real, independent journalism and the potential for new media to serve as an answer and antidote to big publishing houses and SEO spam–a point we couldn’t be more aligned on. This is a group of people that not only think independent media works, but are reaping the rewards of new publishing done right. As the fastest growing online sports publisher, they’re seen as a source for credible and honest journalism, which is why industry stalwarts like Rob Neyer have recently joined their ranks (ranks which include hundreds of talented sports experts). This isn’t tabloid page grabbing or content farming–it’s news and insight by and for a passionate and informed group of people. And that’s exactly where I want to be.
