Apple Loses Bid to Ban Samsung Galaxy Nexus
Apple’s request for a ban on U.S. sales of the Samsung Galaxy Nexus smartphone has been denied again, this time for good.
The U.S. Circuit Court of Appeals in Washington, D.C., on Thursday said it would stand by an October decision rejecting Cupertino’s demands for a ban on the Nexus ahead of a March 2014 intellectual property infringement trial.
The appeals court’s decision is a clear win for Samsung, which can now keep its products on store shelves in the crucial U.S. market while it slugs it out with Apple in the pair’s smartphone-IP Hundred Years War.
News of the decision follows Judge Lucy Koh’s finding this week that Samsung did not willfully infringe Apple patents, and her denial of Samsung’s motion for a new trial in the $1 billion verdict issued against it last August.
